Presenter: Clayton Comstock, Senior Planner CASE SUMMARY: On behalf of Nancy Lou Knight, Robert Flynn is requesting approval of a zoning change from "AG" Agricultural and "R-1" Single Family to "R-2" Single Family on 4.53 acres at the northeast corner of Chapman Road and Meadow Road. The applicant has indicated intent to develop a 14-lot single family residential cul-de-sac subdivision on the property and would follow up with a preliminary plat after zoning approval. EXISTING SITE CONDITIONS: According to the Tarrant Appraisal District, the existing 1,140 square foot home on the lot was built in 1948. PLATTING STATUS: The property is currently unplatted and described as Tract 4 of the John McCommas Survey, Abstract No. 1040. A plat would need to be approved and filed prior to building permits being issued. PRELIMINARY PLAT ATTACHED: Although it is not the subject of the case, the current version of the applicant's proposed Preliminary Plat is attached for reference. This case is still under staff review and is estimated to reach the Planning & Zoning Commission at their April 17 meeting. Preliminary Plats are not considered by City Council. EXISTING ZONING: The first one acre off of Meadow Road is zoned "R-1" Single Family Residential while the remaining 3.5 acres is zoned "AG" Agricultural. SURROUNDING ZONING / LAND USE: North: R-1-S Special Single Family/ Low Density Residential South: R-2 Single Family/ Low Density Residential East: R-2 Single Family/ Low Density Residential West: R-1-S Special Single Family/ Low Density Residential COMPREHENSIVE PLAN / STAFF REVIEW: The Comprehensive Plan depicts "Low Density Residential" for this area. The Low Density Residential Land Use provides for traditional, low- density, single-family detached dwelling units. Staff believes this change to "R-2" zoning would be consistent with the "Low Density Residential" category; however, staff is also concerned with the encroachment of smaller lot sizes into one of the more rural estate areas of North Richland Hills. The area defined by Meadow Road, Little Ranch Road, North Forty Road, and Meadow Creek Road is nearly all "R- 1-S" zoning and larger lots of at least one acre. Staff has concerns over the ongoing encroachment of R2 lots in this rural R-1-S estate area and plans to have a joint P&Z and City Council work session in the next month to clarify and develop a conceptual plan for preservation of the larger lots or a conceptual plan to transition from the existing larger lots to smaller lots. For this reason, staff is requesting this zoning case to be postponed until an interim plan can be made with appropriate public input. The applicant is aware that the future lot sizes for this predominantly rural area have not been established by the city but wishes to proceed to the Planning & Zoning Commission. Staff has requested the applicant to consider a postponement but he wanted to continue the process. I live at 6724 Meadow Road, which is the second house to the north from the intersection of Cliapinan and Meadow, on the east side of the street. My neighbor, Nancy Long, has been approached by a man who introduced himself as the developer of the 4.7 acre tract at the northeast comer of the intersection, who told tier- L fie has already acquired the property for development. 2. The tract will be subdivided into 14 home sites. 3. 'Traffic from the homes,will feed onto Meadow Road, 4. Meadow Road will be widened to ft)ur lanes to accommodate the increased traffic. 5. He wants to meet with the Longs privately, (he specifically said without neighbors), but he did not leave a card or contact information. Not very long ago, another developer proposed a similarly dense project for that same lot and was denied. This developer seems to feel that lie is assured of' approval, which apparently is on the agenda for this Thursday. Please allow me: to express my strong opposition to the development, in part for the following reasons: I. My neighbors and I were compelled to plat our properties fear R-I-S. 2. My neighbors to the south added ontta their homy at great expense in order to care for their parents who suffer from Alzheimer's disease. 3. My neighbors to the north just completed the platting'Ire-zoning process in order to add on to then-recently purchased house. My family was told at the time we built our home that the City had abandoned an old master plan that called for re-routing of Meadow into a cookie-cutter major or thoroughfare because the City wanted to perpetuate the low density and "country" atmosphere of the neighborhood. 5. Allowing 14 honles, packed onto 4.7 acres of land inlinediately next to illy neighbors to the south is in stark contrast to the City's demands that were imposed upon my fainfly and my neighbors. 6. The traffic froin 14 homes will purportedly cnipty onto Meadow Road within a short distance from the intersection with Chapman Road. 7. Meadow Road is a commonly used route south that allows neighborhoods to the north to avoid Smithfield Road, 8. '"he fire station at Hightower and Douglas uses Meadow f6r access to the south, 9. The City installed traffic: signals not long ago in recognition of the need to manage existing traffic safely, and it is working well in my opinion. ('rhank you fir the planning that went into that improvement.) 10. The additional traffic during rush hour will be unmanageable, light or no light, increasing traffic oil other neighborhood streets and increasing safcty concerns for families throughout (lic, neighborhood. 11. Even though the developer spoke of' additional lanes a,,,,, a fact, even if' the City added lanes, the traffic turning; left to go south would be unmanageable during peak times because of'sole egress being onto Meadow near the intersection.. If those cars go north you will have a ripple effect of traffic congestion throughout neighboring streets. 12. The density of the development will change the character of the neighborhood, initially reducing and ultimately eliminating the atmosphere for which we purchased our properties and acco unn odated the City's recent demands when building and improving our hornes. 13, [Ionic values will be negatively impacted immediately and will only recover only if and when another developer decides to derriolish our homes and build all additional high-density pro.iCCI(S) On Our lots, It is bad public policy to use the City's power to grant a developer high-density platting and zoning that will exchange 14 well-built homes and cookie-cutter streets for the cornillUnity'S character, flood as critical intersection, and compel expensive road improvements that are not desired by the neighborhood, "file proposed development contradicts the City's long-term plans as we have always understood it and defies the platting and zoning imposed oil neighboring, properties. The rush to approve this project is inconsistent, obJectionable and highly concerning. The City may have unspoken long-term plans to convert our neighborhood to high- density housing, That plan needs to be public record so that families do not corni-nit themselves to build and improve their homes based on City-influenced inisconceptions. Presenter: Clayton Comstock, Senior Planner CASE SUMMARY: Dyoungco Construction Services and Design, LLC is requesting approval of a zoning change from "AG" Agricultural to "R-1" Single Family and "R-1-S" Special Single Family on 2.59 acres at 7100 Bursey Road. The applicant has indicated intent to develop three new residences: two on the "R-1" zoning area (0.74 acre) and one on the "R-1-S" zoning area (1.85 acres). A Final Plat is accompanying this zoning change request to allow for the subdivision into three lots. According to the Tarrant Appraisal District, the existing 1,620 square foot home on the lot was built in 1961. The applicant has indicated intent to demolish the home and build a newer home closer to Bursey Road. They would possibly keep the existing secondary dwelling unit or "granny flat" on the property and may also pursue a large accessory building SUP in the future. A 35' gas pipeline easement also exists on the property along Bursey Road. This means that the lots essentially have a 35-foot building setback line rather than the 25-foot required by zoning. PLATTING STATUS: The property is currently unplatted and described as Tract 1A4 of the Thomas Spronce Survey, Abstract No. 1399. A Final Plat accompanies the zoning change request under Case Number FP 2014-06 and proposes to create Lots 3-5, Block 1, Pearson Subdivision. The Pearson Subdivision exists immediately to the west and was originally filed in 1981. EXISTING ZONING: "AG" Agricultural SURROUNDING ZONING / LAND USE: North: City of Keller/ R-2 Single Family equivalent South: R-3 Single Family/ Low Density Residential East: R-3 Single Family/ Low Density Residential West: R-2 Single Family/ Low Density Residential COMPREHENSIVE PLAN / STAFF REVIEW: The Comprehensive Plan depicts "Low Density Residential" for this area. The Low Density Residential Land Use provides for traditional, low- density, single-family detached dwelling units. Staff believes the change to "R-1" zoning would be consistent with the "Low Density Residential" category. The applicant's primary purpose for requesting "R-1-S" zoning on the remainder is for a future accessory building greater than 500 square feet, but the "R-1-S" zoning also provides rights for the keeping of livestock on the property. This zoning entitlement would be for a relatively small area (1.85 acres) that is surrounded by properties that do not carry the same entitlement (R-3 and R-2 zoning). While this site may not be ideal for horses no alternative exists for the applicant at this time to achieve the desired result of a large accessory building, staff is planning a work session with the Planning & Zoning Commission and City Council to discuss whether large accessory buildings and the keeping of livestock should be split, whereby accessory building opportunities in other zoning districts are increased. Presenter: Clayton Comstock, Senior Planner CASE SUMMARY: Dyoungco Construction Services and Design, LLC is requesting approval of a Final Plat for three single-family residential lots on 2.59 acres at 7100 Bursey Road. Two lots are proposed at 16,200 square feet each and the third lot is proposed at 80,567 square feet, or 1.85 acres. The applicant is requesting "R-1" and "R-1-S" zoning and all three lots meet the proposed zoning district development criteria. SEE REPORT FOR CASE ZC 2014-07 FOR MORE INFORMATION. THOROUGHFARE PLAN: The lots will have direct frontage on Bursey Road, a "C4U" 4-lane undivided collector with 68-feet of right-of-way and a design speed of 30-40 MPH. The full amount of right-of-way exists for this fully improved street and existing sidewalks, therefore none is required by this plat. ROUGH PROPORTIONALITY DETERMINATION: The developer will be responsible for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to support the development in accordance with the City's design criteria. In this case, the only infrastructure required appears to be the provision of a 6" water tap to provide water service to Lots 4 & 5. The above determination of proportionality is made pursuant to Section 212.904, Texas Local Government Code by the undersigned professional engineer in the employ of the City of North Richland Hills, licensed by the State of Texas.
