Pubic Hearing and Consideration of a Request by Robert Flynn for a Zoning
Change from AG Agricultural and R-1 Single Family Residential to R-2 Single
Family Residential on 4.53 acres on property described as Tract 4 of the John
McCommas Survey, Abstract No. 1040; being located at 7509 Chapman Road.
Robert Flynn, 7005 Whippoorwill Court, Colleyville came forward to present the
proposed rezoning from AG Agricultural and R-1 Single Family residential to R-2 Single
Family Residential at 7509 Chapman Road.
Clayton Comstock came forward and stated that the future thoroughfare shows for four
lane roadway on Chapman Road through the proposed area. Zoning today at 7509
Chapman road is AG Agricultural. Mr. Comstock explained staff's position for
postponement of the hearing, and that staff is reviewing data. In response to
commissioner Steven Cooper, Mr Comstock explained that this request is not within the
Smithfield TOD District, but is within '/2 mile of the future TEXRail Station.
Chairman Shiflet opened the public hearing.
Ben Johnson, 1712 Oak Knoll Drive, Colleyville came forward representing American
Life Homes. He is in favor of this property being developed, as it is prime "transition"
area.
Melanie Hunt, 1233 Stegall, Keller came forward in favor of this property being
developed. As a realtor, she feels that the area's upcoming transit plans and the "villa"
type lot sizes are suitable for the target home buyer demographic.
James Bellamy, 6912 Little Ranch Rd. North Richland Hills came forward in opposition.
He feels that the development will create a loss of the rural character. The addition of
28 new drivers will cause more traffic problems. Additional homes will cause drainage
problems as water flows towards the creek.
John Cope, 6724 Meadow Road, North Richland Hills came forward in opposition as the
density of this project would be impactful to the area. He feels that the development will
create a loss of the rural character. Streets are not yet four-lane to accommodate
additional traffic.
Mack Garvin, 6908 Little Ranch Road, North Richland Hills came forward in opposition.
Placing two homes on this property would be what he would consider as "transitional"
development, not fourteen homes.
Nancy Long, 6704 Meadow Road, North Richland Hills came forward in opposition.
Nancy is in the process of preparing a petition against the rezoning proposal. As a
resident, she was told that this part of the city would remain country.
Darren Whitten, 6728 Meadow Road, North Richland Hills came forward in opposition.
The appeal of his property is the rural character. R-2 zoning does not appear to be
transitional. Similar zoning proposals in the past have been dis-allowed, so what would
have changed to make this proposal different?
William Bell, 6733 Meadow Road, North Richland Hills came forward in opposition. As
a long term property owner, he loves his neighbors, just doesn't want them to be too
close. Please consider the long term home owners.
William Kathleen, 6733 Meadow Road, North Richland Hills wishes to record opposition,
but not to speak.
Carmella Miller, 7500 Chapman Road, North Richland Hills came forward in opposition.
She lives at the end of Meadow Road. If this proposal goes through, her property value
will decrease. With additional traffic, she will never get out of her driveway.
Guy Shaver, 7405 North Forty Road, North Richland Hills came forward in opposition.
He believes that traffic will be a problem. He believes drainage will be a problem.
Neighbor, John Cope was asked to build a drainage pond at the bottom of his property,
for just one residence. A proposal for 1 acre lots could still preserve the integrity of this
rural area.
Angel Whitten, 6728 Meadow Road came forward in opposition. She would have
purchased this property two years ago, but it was priced for a developer, not a single
home owner. We want to maintain the rural character.
Yvette Pabon, 6812 Meadow Road, North Richland Hills wishes to record opposition,
but not to speak.
Ivanna Martinez, 6812 Meadow Road, North Richland Hills wishes to record opposition,
but not to speak.
Randall Shiflet closed the public hearing. Applicant Robert Flynn was requested to
present responses to concerns raised at the Public Hearing.
Robert Flynn, 7005 Whippoorwill Court, Colleyville came forward to present responses.
If he were to put in a permit to put in only five lots along Chapman Road, the city would
most likely not approve five driveways. This proposal is a perfect fit single family home
demographic.
DENIED
Mike Benton motioned to deny ZC 2013-20. The motion was seconded by Mark
Haynes and Steven Cooper. The motion to deny passed unanimously (7-0).

ZC 2014-07
Public Hearing and Consideration of a request from Dyoungco Construction
Services and Design, LLC for a Zoning Change from AG Agricultural to R1 Single
Family Residential (0.74 acres) and R-1-S Special Single Family Residential
(1.85acres) on 2.5934 acres located at 7100 Bursey Rd.
Dwayne Young came forward to items C.2 and C.3. His request is to change the zoning
of 7100 Bursey Road from AG Agricultural into two different types of zoning. Two lots
would be zoned R-1 and one lot would be zoned R-1-S to allow the option of a future
SUP request for a large accessory building. His intent is to convert this address into
three parts. Two would be smaller R-1 home lots, using the revenue from sale of these
homes to build his residence and accessory building on that same land.
Clayton Comstock came forward and stated that agenda items C.2 and C.3 address the
zoning and subdivision of a single property at 7100 Bursey Road into three properties.
APPROVED
Steven Cooper motioned to approve ZC 2014-07. The motion was seconded by
Don Bowen. The motion passed unanimously (7-0).

Don Bowman motioned to approve FP 2014-06. The motion was seconded by
Mike Benton. The motion passed unanimously (7-0).

for a Replat for Briar Pointe Villas on 1.998 acres located at 8326 Amundson
Drive. THE APPLICAT HAS REQUESTED TO CONTINUE THIS CASE TO THE

ZC 2014-06 Public Hearing and Consideration of a request from Janet McCready
for a Zoning Change from R-1 Single Family Residential to R-2 Single Family
Residential on 1.983 acres located at 8708 Stewart Dr.

CASE SUMMARY: Janet McCready is requesting approval of a zoning change from
"R-1" Single Family to "R-2" Single Family for a 1.98-acre parcel at the southeast corner
of Stewart Drive and Simmons Road. The applicant is simultaneously requesting to
subdivide the 2-acres into 5 lots (Case FP 2014-05), whereby two lots would front
Simmons Road and three lots would front Stewart Drive.
EXISTING SITE CONDITIONS: The 1958 1,180 square foot residence of the Stewart
family had a significant fire recently and the home has been demolished.
PLATTING STATUS: The property is currently unplatted and described as Tract 8L of
the Tandy K Martin Survey, Abstract No. 1055.
EXISTING ZONING: "R-1" Single Family Residential. The "R-1" zoning category
requires 13,000 square foot lot size, which two of the five proposed lots do not meet.
"R-2" requires 9,000 square foot minimum lot size. The minimum home size in "R-1" is
2,300 square feet compared to the 2,000 minimum required by the proposed "R-2"
zoning.
COMPREHENSIVE PLAN: The Comprehensive Plan depicts "Low Density Residential'
for this area. This change in zoning would be consistent with that category and the
surrounding uses.
SURROUNDING ZONING / LAND USE:
North: R-1 and R-1-S Single Family Residential / Low Density Residential
South: R-2 Single Family Residential / Low Density Residential
East: R-1 Single Family Residential / Low Density Residential
West: R-2 Single Family Residential / Low Density Residential
THOROUGHFARE PLAN: The property has frontage on Simmons Road and Stewart
Drive , both of which are classified as "R2U" 2-lane undivided residential streets with 50-
feet of right-of-way. Right-of-way for both streets is being dedicated to accommodate
pavement and utilities within that 50 feet.

CASE SUMMARY: Janet McCready is requesting approval of a Final Plat for an
addition to Creekside Estates, subdividing a single two-acre parcel into 5 lots at the
southeast corner of Simmons Road and Stewart Drive.

STAFF REVIEW: The Development Review Committee has reviewed the plat and has
determined that it complies with both the Zoning and Subdivision Ordinances, assuming
the proposed "R-2” zoning is approved.
ROUGH PROPORTIONALITY DETERMINATION: The developer will be responsible
for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to
support the development in accordance with the City's design criteria. The required
infrastructure includes the construction of a sanitary sewer main along the Stewart Drive
frontage as well as a section of concrete flume to accommodate drainage. The
Subdivision will also have an impact on the existing public Right-Of-Way ("ROW'). As
such, the developer will be responsible for the dedication of additional ROW on
Simmons, Stewart, and the following:

RP 2014-02 Consideration of a request from JCP Realty, Ltd. for a Replat for Lots
2R1 and 2R2, Block 1, Smithfield Corners Addition on 0.947 acres currently
described as Lot 2R, Block 1, Smithfield Corners Addition and located at 6340
Davis Blvd.

CASE SUMMARY: JCP Realty, Ltd. is requesting approval of a replat to subdivide one
0.95-acre vacant lot into two for the purpose of developing two single-story professional
office buildings. The property is located near the southeast corner of Mid-Cities Blvd
and Davis Blvd between the existing Liberty Bank and Walgreens. The Site Plan for the
property (attached for reference) has been reviewed by the Development Review
Committee and is near final approval.
PLATTING STATUS: The property is currently platted as Lot 2R, Block 1, Smithfield
Corners.
EXISTING ZONING: "C-1" Commercial. The proposed plat conforms to the "C-1"
Commercial development standards.
THOROUGHFARE PLAN: The lot has frontage and shared access to Davis Boulevard
(FM 1938), a "P6D" 6-lane divided principal arterial. The intersection of Davis
Boulevard and Mid-Cities Boulevard is scheduled to be widened and improved by
TxDOT and the City of North Richland Hills. That intersection improvement will require
additional right-of-way along this property's frontage. The applicant has worked with
staff to show that area as "Right-of-Way Reservation" for future dedication and has
established the building setback, access easements, and landscape buffers based on
that future right-of-way line.
ROUGH PROPORTIONALITY DETERMINATION: The public improvements
necessary for the subdivision (identified as RP 2014-02) to develop in accordance with
the City's minimum standards include additional drainage facilities, water infrastructure,
sanitary sewer infrastructure and concrete sidewalks along Davis Boulevard (FM 1938).
The construction of these improvements is the responsibility of the applicant/developer.
The developer is proposing to install the necessary drainage facilities, water
infrastructure and sanitary sewer infrastructure. However, because upcoming
improvements to the intersection of Davis Boulevard and Mid-Cities Boulevard will
impact any sidewalks constructed within the Right-of-Way of this subdivision, the
applicant/developer will be responsible for the economic equivalent of such sidewalks
along Davis Boulevard. The value of this infrastructure is indicated in the table below:
