B. 2 Consideration of Minutes from the November 21, 2013 Planning & Zoning Commission Meeting APPROVED Bill Schopper motioned to approve the minutes of the November 21, 2013 meeting. The motion was seconded by Steven Cooper and passed Unanimously (5-0). C.1 SUP 2013-06 Public Hearing and Consideration of a request from Ralph Schwab for a Special Use Permit for an Accessory Structure larger than 500 square feet on 2.23 acres located at 8713 Stewart Drive. Ralph Schwab, 8713 Stewart Drive, NRH, came forward requesting for an Accessory Structure to house his motor home. The construction has been built without a permit but with the instruction of the City Staff, plans are to do the landscape, brick work and painting required and permits will be obtained. Clayton Comstock said this request for the Special Use Permit for an Accessory Structure larger than 500 square feet which has already built but the applicant intends on complying with the Staff recommendations to complete a 4 foot tall waynes coat and landscaping to the western facade to screen from adjacent residential properties. Staff recommends approval of this request. Steven Cooper asked Mr. Schwab if it was just an oversight on his part to construct the building without permits? Mr. Schwab said there was an existing shop already on the property and was only going to put an awning up, but decided to just construct the building then realized a permit should have been obtained. Chairman Shiflet asked the applicant about his roofing business and equipment stored on property. If recommended for approval to the City Council, it would not allow him to run a roofing business from his home. Mr. Schwab stated he owns other property and the trailers are for trimming trees on the existing properties in order to not keep a dumpster onsite. There are no intentions on running a business from the home address. Chairman Shiflet opened the Public Hearing and asked if anyone wished to speak on the matter. Seeing none, a motion was entertained. Steven Cooper asked Staff if anyone had received any comments or concerns from adjacent property owners. Clayton Comstock said not anyone that he aware of. APPROVED Don Bowen motioned to approve SUP 2013-06 subject to the agreement with the City to apply the four foot masonry and carport columns. The motion was seconded by Mark Haynes. The motion passed (5-0). C.2 RP 2013-13 Consideration of a request from Claymoore Engineering for a Replat for Lots 2R1 and 2R2, Block 1, Davis-North Tarrant Parkway Addition on 15.394 acres located at 8450 Davis Boulevard. CONTINUED FROM THE NOVEMBER 21, 2013 MEETING Clay Kristy, Claymore Engineering, 2328 Lotus Avenue, Fort Worth, came forward with a request to create two separate lots, one for client to retain and the other for another company to purchase. There was previous development planned for this property, but at this time there is no knowledge of the intended development. Clayton Comstock said this request for Replat at the stated address is to combine different parcels into just two parcels for future development. All access, utility and drainage easements seen are based on a previous development approval and it is intended this will be Replatted again in the next year or two to accommodate future development. Staff recommends approval. APPROVED Mark Haynes motioned to approve RP 2013-13. The motion was seconded by Steven Cooper. The motion passed (5-0). C.3. PP 2013-07 Consideration of a request from J & J NRH 100 FLP for a Preliminary Plat of Thornbridge East Phase V; 43 single family residential lots and 4 open space lots on 15.407 acres located near the southwest corner of Belshire Drive and Precinct Line Road Jason Weaver, Project Engineer with Goodwin and Marshall, 2405 Mustang Drive, Grapevine, TX came forward with a request for 15 acre parcel for 43 lots to build single family homes with a future detention facility. Clayton Comstock said this is the natural continuation of two existing streets, Bentley and Glendara to create Phase V of Thornbridge East. One of the open space lots for the detention pond will require a Special Use Permit and one that connects at Grace Meadows to the south giving an opportunity to create pedestrian connection between the two. In addition, there are other open space lots with landscape buffers at Precinct Line Road. APPROVED Steven Cooper motioned to approve PP 2013-07. The motion was seconded by Bill Schopper. The motion passed (5-0). C.4 FP 2013- 10 Consideration of a request from Montage Development for a Final Plat of Steward Estates, 15 residential lots and 2 open space lots on 5.508 acres located at 6721 Crane Road Derek Murway with Montage Development, 170 Players Circle, Southlake, TX came forward with a request for Final Plat of Steward Estates. Chairman Shiflet asked the applicant about the drainage concerns. Derek Murway answered stating when he bought the sight, there were as-builts showing storm drainage on the property. The engineer discovered there are no inlets to the storm drain. During the development phase, all intentions were to drain onto Crane Road into the storm drainage. The underground pipe does not tie into the storm drains. There will be a modified drainage plan with an expensive retaining wall endeavor to keep drainage from going onto any neighboring property. Chairman Shiflet stated that Jerry Court and Paula Court could be affected; it will be drastically reduced but concentrated. Are we improving or compounding for the house on Paula Court? Derek Murway stated we are drastically improving the issues and the homeowners do not want a drainage flume to take up a portion of their lot. The drainage flow from 13 to 5 will be a 60% decreased water volume. Tim Welch, Welch Engineering, 1308 Norwood Drive, Suite 200, Bedford, TX came forward stating the subdivision regulations for the City of NRH state we need to provide some kind of either drainage easement or an impact to the post-development condition. It does not say anything about the opportunity of where you can reduce the overall flows, we have met the intention of not increasing the run-off, but we have reduced the run-off. If there was an existing system in Crane Road that was available, a lot of this water would have been transposed over to that collection point. We also looked at a storm drainage system to the west to run there, but unfortunately, the older neighborhood has sidewalks and irrigation systems and violations to setbacks and other issues that make it cost-prohibitive. One of the solutions for this difficult site is to redirect the water into Jerry Court and also build a retaining wall which will help the neighbors to the south and overall making a positive impact on seven residential lots who have drainage problems. It will reduce over 60 % of the flow and will overall help many residential lots. Steven Cooper asked if in the future Crane Road would open up drainage would it be a simple modification to run the water down not feasible. Tim Welch said no, because now it is going east to west, you would have to tear up existing concrete and raise two feet then run back over. In the future, when Public Works makes the modifications on Main Street, bring the box culvert up and run into Jerry Court and enclosed into a drainage system. Don Bowen asked if drainage on both streets goes to Main Street and are we decreasing or increasing the Main Street flow. Tim Welch answered the flows presented are the same ones in the City of NRH 1985 Master Plan with the same calculations in the 2001 Study of Crane Road. It is just redirecting and going to Main Street. The future Capital Improvements will help take care of these issues. There was not adequate funding to make the connections in 2001 and no additional funding was given for the improvements on Crane Road. Clayton Comstock summarized stating the above mentioned request is for a Final Plat for 15 residential lots and 2 open spaces. There are no necessary easements required because a connection is there for the flume. The variance request is for lot grading as is relates to the Public Works Design Manual. Greg VanNieuwenhuize came forward stating the lots west of Jerry Court and north of Paula Court are getting about 13 cubic feet per second of water during the 100 year rain event. The engineers stated that amount of water is drastically reduced, but because the subdivision is draining from an easement onto property without an easement, Public Works criteria requires that drainage be contained within a drainage easement and an acceptable drainage structure, such as a flume, or the downstream owner's acceptable of the water they are getting. After speaking to both of the property owners at Lot 13 and 14, they want to speak about the concerns they have. Property owns at lot 13 are not in town at the time and want to wait until next week to decide. Public Works Department cannot support the variance until such time we know both property owners are in favor of the variance. Mark Haynes asked if on average if the flow has been at 13, how the flows compares between the properties affected. Greg VanNieuwenhuize said the 100 year rain event is fairly significant and is rarely seen. The 2007 rain events did not even hit 100, so that tells you how substantial a 100 year rain event is. No strict comparison can be really made. Steven Cooper asked for clarification of the proposal. There was general discussion about the variance and proposal. Clayton Comstock said regarding the Plat itself, the lot dimensions meet the Zoning Ordinance and Staff recommends approval of the Plat, the hang-up is on the variance request and Staff recommends waiting until the property owner has his questions addressed before recommending approval of the variance. The Planning and Zoning Commission can either recommend approval or denial of the variance to City Council, when City Council reviews the variance, they have 4 criteria they have to approve or deny the variance on. They are stated as such: 1. The conditions upon which the request for a variance is based are unique to the property and are not applicable generally to other properties; 2. A tract has peculiar physical surroundings, severe topographical conditions, or unique environmental qualities worthy of protection; 3. Where a hardship to the owner would result rather than a mere inconvenience; or 4. The variance will not have an adverse effect Chairman Shiflet asked the Commission if there was a consensus to allow a 3 minute presentation to citizens wishing to speak. Alex and Kelly Dixon, 6516 Paula Court, NRH came forward with their drainage concerns. He stated he is quite happy with the recommendations made and is in agreement with the development. Derek Murway asked if it would be acceptable to approve the request contingent upon meeting with the other property owner prior to City Council which will allow moving forward and not losing a month for development. APPROVED Bill Schopper motioned to approve the Plat for FP 2013-10 and recommend approval of the variance subject to Lot 13 being in agreement. The motion was seconded by Don Bowen. The motion passed (6-0). Don Bowen asked for clarification from Greg VanNieuwenhuize about the Public Works recommendation. He said if Mr. Day is of the same sentiment from Lot 14, we would recommend approval of the variance. Or if Mr. Day wants some sort of drainage easement and the developer is willing to construct it, he would no longer need the variance. D.O. Presenter: Clayton Comstock, Senior Planner ORDINANCE SUMMARY: Staff is proposing to establish a Freeway Corridor Overlay District that will implement a number of recommendations of the 2001 City Image Study and the 2005 Loop 820 Corridor Plan. The Overlay would limit the types of commercial uses, increase screening standards from commercial to residential, and create an urban landscape design for the corridor. ZONING TEXT REVISION: The attached ordinance does the following: • Increases masonry wall requirement between commercial and residential from 6' to 8' masonry, to also include a requirement for a limestone element (i.e. column or all or part of wall); • Defines the uses permitted in the corridor. Here, the ordinance mostly impacts industrial and heavy commercial uses The following uses are permitted today that the Overlay would prohibit: • Pest Control Service Store • Lawn Maintenance Service Shop • Janitorial Supply & Service Company • Wedding Chapel • Day Care Center/ Kindergarten • Light Auto Uses in C-2 District The Overlay removes the option to request a Special Use Permit for the following uses: • Mini-Warehouse (Self Storage) • Feed & Seed Store • Moving/Storage Company • Laundry, Self-Service • Farmers Market • Drive-Through Buildings less than 1,400 sq. ft. • Tire & Battery Sales • Automobile Lubrication Center • Automobile Inspection Station • Auto Upholstery Shop • Auto Alarm/Stereo/Window Tinting • Cemetery/Mausoleum • Alcoholic, Narcotic, Psychiatric Rehabilitation Center • Nursing Home / Orphanage • Bingo Hall • Commercial Stable • Used Car Sales • Car Wash • Auto Repair/ Paint & Body Shop • Commercial Carpet Cleaning • Assembling Operations • Truck & Heavy Machinery Sales/Service/Rental • Greenhouse or Plant Nursery (wholesale) • RV/Camper/Boat Sales ACCOMPANYING LANDSCAPE ORDINANCE REVISION: This zoning ordinance text revision is half of the Freeway Corridor Overlay regulations. An accompanying Landscape Ordinance text revision is also being proposed that will: • Increase evergreen tree requirement adjacent to residential from 40% to 100%; • Reduces the public street landscape setback from 15 feet to 10 feet; • Specifies that trees in the public street landscape setback shall be spaced 50- foot on-center; • Limits ornamental tree substitutions for large trees to driveways only; • Creates a palette of corridor trees to include: Shumard Oak, Chinquapin Oak, Bur Oak, Live Oak, Texas Red Oak, Caddo Maple and Cedar Elm; • Limits Live Oaks to a maximum of 50% along public streets; • Establishes limestone hardscape requirements as one of two options: o Option 1: 18" — 30" Leuders Limestone wall with a minimum of 30 square feet of stone facade per 50 linear feet of freeway frontage; a solid cast stone cap of 6" applied to the top. • Option 2: 36" tall by 30" wide bollards with 6" solid cast stone cap; placed 50' on-center, off-set from canopy trees; shrubs between Because Chapter 114 (Landscape Ordinance) is separate from zoning, it does not require Planning & Zoning Commission approval; however planning staff will present the content of that ordinance and welcomes any recommendation from the Commission that we can include in the ordinance or pass along the City Council. Feet PUBLIC INPUT: By creating an overlay district, this ordinance effectively "changes" the zoning of all properties impacted. As such, public hearing notifications were sent to all properties within the proposed Freeway Corridor Overlay as well as those properties within 200 feet of the overlay. The public hearing notifications also included two additional dates for informational open houses with staff. The open houses were held on December 17 (afternoon) & 18 (morning) and were attended by a total of approximately 35 individuals. Most attendants were residents within 200 feet that voiced approval of the overlay. REMOVAL OF MID-CITIES OVERLAY ZONE: The Freeway Corridor Overlay District is taking the place of the Mid-Cities Overlay Zone within the Zoning Ordinance. The Mid-Cities Overlay Zone was created in 1997 following the widening and land use study of the corridor. Over the years the legitimacy of the Overlay Zone has diminished its necessity, and both the Planning & Zoning Commission and City Council have directed staff to remove it during previous work sessions. CONSOLIDATION OF PERMITTED LAND USE TABLE: The Ordinance revises the Permitted Land Use Table in three ways: 1. Creates a new "Freeway Corridor Overlay District" column that defines what uses are not permitted in the corridor; 2. Consolidates office uses into just a few categories; 3. Consolidates the Town Center Permitted Uses Table with the overall Permitted Uses Table The table had to be significantly revised to include the overlay district; so staff saw it as an opportune time to make other formatting and consolidation revisions. BAIL BONDS: The Ordinance also revises the definition of "Alternative Financial Establishment" to include bail bonds businesses, whereby requiring an SUP in industrial zoning districts. Staff is concerned that, with the consolidated jail services of Haltom City, Richland Hills, Watauga and NRH in the new City Hall and police/jail facility at the old North Hills Mall site, bail bonds businesses would be attracted to the commercial areas surrounding City Point. It has not been an issue at our current facility because there is no commercial immediately adjacent. STAFF RECOMMENDATION: Approval of TR 2013-07. WHEREAS, it is the goal of the City Council to provide quality community development and revitalization, safety and security, a positive city image, a sense of community and local and regional leadership; and WHEREAS, the 2001 City Image Study and the 2005 Loop 820 Corridor Plan recommended specific commercial property standards for properties along Interstate Loop 820 and State Highway 183; and WHEREAS, the North Tarrant Express construction project provides an opportunity to implement those two plans and define the character of North Richland Hills through this Freeway Corridor; and WHEREAS, the City Council has received the recommendations of the Planning and Zoning Commission concerning the matters herein dealt with, which recommendations were made after the holding of a public hearing before said Commission on such matters; and WHEREAS, notice has been published of the time and place of a public hearing held before the City Council concerning the changes herein made, which public hearing has been duly held; and, WHEREAS, the City Council has determined that the amendment to the Comprehensive Zoning Ordinance herein made is in the best interest of the health, safety and general welfare of the citizens of the City of North Richland Hills; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS: SECTION 1. The Freeway Corridor Overlay District includes the entirety of all properties which adjoin or are located within 200 feet of the ultimate Right- of-Way for Northeast Loop 820 (IH-820) and Airport Freeway (SH 121/SH 183), and are not planned for single-family residential, parks/open space, stormwater drainage easement use or Transit Oriented Development (TOD) as shown on the City's Comprehensive Land Use Plan." SECTION 2. That Chapter 118, Article IV, Division 14 of the Code of Ordinances of the City of North Richland Hills, Texas, (Mid-Cities Overlay Zone)is hereby removed and replaced with the following: "DIVISION 14. FREEWAY CORRIDOR OVERLAY DISTRICT Sec. 118-551. Purpose and applicability. (a) Purpose. It is the purpose of this Article to provide standards for the Freeway Corridor Overlay District in order to mitigate the negative effects of the Interstate Loop 820 and State Highway 121/183 such as noise, aesthetics, glare of lights, and to protect public and private investment. It is also the intent of this section to implement the recommendations of the 2001 City Image Study and the 2005 Loop 820 Corridor Plan. (b) Applicability. The standards and regulations set forth in this subdivision are superimposed and shall supersede the standards and regulations of any underlying zoning district which are in conflict and shall apply in the following circumstances: (1) When an existing building is proposed for remodeling, alteration, addition, or expansion, in which the value of the proposed construction exceeds 50 percent of the current appraised value of the existing structures, excluding the value of the land; (2) When an existing building is proposed for an addition that will increase the square footage of the existing building by 30 percent or greater; (3) Upon all new construction; or (4) As a requirement of the approval of a special use permit or planned development. Sec. 118-552. Permitted uses. Uses permitted within this Freeway Corridor Overlay District shall be those that are permitted in the base district provided in Article V, Division 3, Sec. 118-631 of this chapter, Table of Permitted Uses unless otherwise noted by that table. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. Savings. The proposed Cambridge development includes 192 single family residential lots in three phases ("Estates," "Place" and "Villages") under"R-2" and "R-3" development standards. COMPREHENSIVE LAND USE PLAN REVIEW: The 51 acres under consideration is currently vacant undeveloped land that has been cut up with several gas pipelines and two valve station sites. Until now, the property has been assumed to be reserved for commercial use. The current zoning is 1-2" Industrial and the Comprehensive Land Use Plan designates the area as "Commercial" and "Neighborhood Services." The history of this assumption goes back to the original vision of "Industrial Park Boulevard" (before being changed to "Iron Horse Boulevard") and Rufe Snow Drive being an industrial hub for the region. The properties are even described within the "NRH Industrial Park Addition." Although zoned and marketed for commercial and industrial use, the property has not been an attractive location given the surrounding residential uses, the difficult lot dimensions, and the distance from the more-attractive Rufe Snow corridor. More successful industrial centers have developed elsewhere in the region as well, diminishing the demand for this industrial space. The rezoning to residential uses would support local retail and service-based businesses and be more complementary to adjacent residential. The Development Review Committee supports the change from commercial to residential use. ADJACENCY TO PRESTIGE AMERITECH: The Cambridge development would surround the 17.6-acre Prestige Ameritech facility. They and Sandlin Homes have been in contact regarding potential conflicts between uses. At this time, Prestige Ameritech opposes the zoning change, as they see it as likely limiting their business growth and requiring them to eventually vacate the location. Their opposition represents 19.26% of the total area within the 200' buffer for zoning notification,just shy of the 20% required to force a super-majority vote on City Council. The only development regulation for Cambridge that addresses the adjacency issue with industrial is an 8-foot board-on-board cedar fence (right) for all lots backing to Prestige Ameritech. Additional items that should be considered include additional evergreen tree screening, applying sound attenuation standards to the buildings' construction adjacent to Prestige Ameritech, and possibly even requiring the fence to be masonry. ADJACENCY TO RAIL & TRAIL: Forty (40) lots will back directly to the future TEXRail commuter rail line and the Olga regional Cottonbelt Trail. The influx of residential would continue to feed the Rufe Snow commercial corridor and the nearby Liberty Park and trail system. Staff would be more comfortable, however, if the R-PD had a stronger R-2 base. The "Place" is currently proposed to have an R-3 base district with 15 lots designated for 1,800 square foot minimum dwelling unit size. Given the history of Council's approvals, R-2 is the preferred standard and a 2,000 square foot home is the expected minimum. The opposition by Prestige Ameritech is concerning. Staff understands that their opposition is based on the fact that approval of this case would disallow future growth of their facility and possibly create complaints of their facility. Their facility has proven in the past to handle a much larger capacity. Their zoning would continue to allow them to operate and the City's current residential adjacency development regulations would not apply unless their facility expands by 30 percent or more. At that time, additional items would need to address by Prestige Ameritech along the west property line which would include a masonry screening wall, 15' landscape buffer with 1 tree per 30 feet (40% evergreen), and the possible screening of truck loading areas from the residential. If approved, zoning case ZC 2014-03 would change this property's zoning classification from 1-2" Industrial to "C-2" Commercial, whereby making the existing auto rental business non-conforming. Auto Rental is a permitted use in the 1-2" Medium Industrial zone but requires an SUP in the "C-2" Commercial zone. Should the existing Enterprise Rent-A-Car tenant ever vacate the property, this Special Use Permit would allow the auto rental use to continue. The site also has an accessory automated car wash for use by Enterprise Rent-A-Car only.
