EXECUTIVE SESSION
The City Council may enter into closed Executive Session as authorized by
Chapter 551, Texas Government Code. Executive Session may be held at the
end of the Regular Session or at any time during the meeting that a need arises
for the City Council to seek advice from the city attorney (551.071) as to the
posted subject matter of this City Council meeting.
The City Council may confer privately with its attorney to seek legal advice on
any matter listed on the agenda or on any matter in which the duty of the attorney
to the governmental body under the Texas Disciplinary Rules of Professional
Conduct of the State Bar of Texas clearly conflicts with Chapter 551, Texas
Government Code.
1. Section 551.072: Deliberate the purchase, exchange, lease or value of real
property - (1) 7301 NE Loop 820 and (2) Southeast corner of Rufe Snow and NE
Loop 820.
2. Section 551.087: Deliberate the offer of financial or other incentives to a business
prospect with which the city is conducting economic development negotiations -

Subject: Discuss Adoption of 2014 National Electrical Code with Pool Safety
Amendments

Summary:
The City of North Richland Hills has been in the process of updating its electrical code
for several months and will be giving a presentation to the city council concerning the
significant changes found in the 2014 National Electrical Code (NEC). Of particular
interest will be several local amendments supporting swimming pool safety by requiring
door alarms, as well as a safety inspection during construction.
It is staff's intent to bring an ordinance adopting the 2014 NEC at the April 25, 2016
council meeting.
General Description:
The 2014 edition of the National Electrical Code® (NEC®) as published by the National
Fire Protection Association, officially became the electrical code of Texas on September
1, 2014 through the Texas Electrical Safety and Licensing Act passed by the Texas
legislature. Since that time, the 2014 NEC has been enforced by the North Richland
Hills Building Inspection Department.
Although the state has mandated the usage of the 2014 NEC, staff will be bringing forth
a housekeeping ordinance in an effort to keep the city's published Code of Ordinances
current. In addition to the adoption of the NEC text, the ordinance will include a small
number of local and regional amendments recommended by both the council-appointed
Technical Code Review Committee and the North Texas Council of Governments'
Regional Codes Coordinating Committee (RCCC). The purpose of the amendments is
two-fold: To promote uniformity among municipalities in the DFW area; and to address
specific trade practices associated with our region of the country.
It is important to note that although the state has mandated the 2014 NEC, chapter
1305.201 of the Electrical Safety and Licensing Act affords municipalities the authority
to make amendments to the code where it is assured that equivalent objectives can be
achieved by establishing and maintaining effective safety.

Pool Safety Amendments
In addition to the standard electrical details, staff will be proposing a number of local
amendments to the Swimming Pool and Spa sections of the code that promote
swimming pool safety. These amendments compliment the efforts of Water Safety 365,
a North Richland Hills citizens committee, who has partnered with staff in an effort to
prevent accidental drownings. These amendments include:
1. Requiring permanently mounted door alarms on all exterior doors leading to a
private swimming pool/hot tub area.
2. Requiring a pre-plaster/safety inspection during the construction of a swimming
pool prior to it being filled with water.
Water Safety 365 has commissioned the production of a water safety video that will be
presented to council at a later date. It is staff's intent to create a policy requiring pool
owners to declare they have viewed this video prior to accepting a permit application.
A short PowerPoint program will be presented to council for their input and
recommendations.

Mayor Pro Tern Turnage made the following announcements.
City departments will be open for business at our new City Hall tomorrow, March 29,
2016 and the Police Department is expected to open in the new building on April 7, U)
2016. City Council meetings and Planning & Zoning Commission meetings will continue
to take place here at the old City Hall until after our grand opening celebration on May
13. Join us on a path to better health at the 6th annual Mayor's 5K Walk on Saturday,
April 2. The walk will start at 9:00 a.m. in the parking lot at the NRH Centre. There is no
fee to participate, but pre-registration is encouraged. Visit the city's website or call the
NRH Centre for more information.

Our monthly community bicycle rides resume on Tuesday, April 5, 2016. The rides
begin and end at Cross Timbers Park at 5:45 p.m. Everyone is welcome, whether you co

Kudos Korner — Joe Pack of the Parks and Recreation Department — A citizen emailed
thanks and appreciation for the manner in which Joe responded to his questions and
concerns about a trail issue. The email stated: "Mr. Pack was very proactive in his
research and response and it was a pleasure talking to him today. He is indeed an
Ambassador for our city and his enthusiasm for North Richland Hills being the best city
in the county is catching!"

Summary:
In the 2015-16 adopted budget, $62,400 was allocated for replacing equipment for the
Iron Horse Golf Course and $132,800 for replacing equipment for the Parks and Public
Works Departments. This item is to authorize the purchase of turf equipment in the
amount of$131,663.73.
General Description:
In the 2015-16 adopted budget, Council approved funding in the amount of $62,400 to
replace a tractor at the Iron Horse Golf Course and $132,800 for replacement
equipment for the Parks and Public Works Departments. Most of the equipment
averages a 12 to 14 year replacement cycle.
The City of North Richland Hills is a member of several inter-local groups and utilized
existing contracts with John Deere Dealerships and Professional Turf Products through
the Local Government Purchasing Cooperative (BuyBoard contract 447-14) to request
quotes on the equipment needed. The John Deere contract requires the purchase
order for their equipment to be made out to John Deere via the local dealership of
Austin Turf& Tractor.

Summary:
Consider authorizing the City Manager to execute a contract with Matrix Demolition LLC
for abatement and demolition of the facility located at 6720 NE Loop 820 in the amount
of $466,450.00.
General Description:
The facility located at 6720 NE Loop 820 previously provided municipal services and
served as the location for several City departments. The opportunity presents itself for
redevelopment into private commercial uses, and thus the facility needs to be
demolished and prepared for new construction.
During the environmental review, the facility was identified as having asbestos
containing materials, which must be abated. Alpha Testing, Inc. was hired to perform
the initial study identifying those materials and will also provide the professional
services necessary to ensure the abatement is performed according to federal, state,

The City is currently the fiduciary agent for a grant to fund the North Texas Anti-Gang
Center (TAG Center). The North Richland Hills Police Department, in cooperation with
law enforcement agencies across the area, supports the TAG Center in its mission to
reduce violent crime and related activities that are perpetrated by gangs. State grant
funding is available through the Governor's Office to continue this project and the funds
must again be disbursed to a governmental entity. The Governor's Office has contacted
the City of North Richland Hills to continue as the fiduciary for grant.
General Description:
The investigative units participating in the TAG Center are the Texas DPS Investigative
Unit, the U.S. Homeland Security Investigators Gang Squad, the ATF's Violent Crime
Squad and Intelligence Unit, and the FBI's Gang Unit, as well as local municipal and
county agencies. The units will have access to the High Intensity Drug Trafficking
Area's regional support center located in North Texas.
State funding for this project must be disbursed to a governmental entity. As such, the
Governor's Office contacted the City of North Richland Hills to again serve as the
fiduciary for this grant to continue the TAG Center Project. The grant application
requests $900,000.00 to continue the program through August 2017. As grantee, the
City will coordinate and manage the grant, to include payment and reimbursement of
expenditures generated by the North Texas Anti-Gang Center and its contracted on-site
project manager and staff. For fiduciary services the City will receive a 5%
administrative fee for time and resources dedicated to the grant, which will equal
$45,000.00 at the current amount in the grant application.
Authorization from Council to apply for the original grant from the Office of the Governor
was received on October 13, 2014. This grant is a continuation of the program to cover
the TAG Center's annual operations budget for fiscal year 17/18.

Summary:
The Criminal Justice Division of the Texas Governor's Office has notified the Police
Department that grant funds have been allocated to assist in funding body-worn camera
acquisition programs for law enforcement agencies under the 2016 CJD Criminal
Justice Programs Competitive Grant # 30938-01. If awarded, the Police Department
will use the funds to purchase body-worn cameras for officers as well as the requisite
video storage and accessories permitted under the grant guidelines.
General Description:
The use of body-worn cameras among law enforcement agencies is becoming
increasingly accepted as a means for supervisors and city administrators to safeguard
their officers and citizens. However, the purchase of a body-worn camera system to
equip a large number of agency officers can be cost prohibitive. The Governor's Office
Criminal Justice Division announced the availability of funds specifically for the
purchase of body-worn cameras by municipal and state law enforcement agencies. The
CJD required a preliminary submission by each applicant indicating their agency need
prior to allowing agencies to make a formal application. The North Richland Hills Police
Department was one of the agencies selected to receive grant funds through this
announcement based on our grant submission and approved to submit the formal
application. The CJD identified and mandated the funds be used to equip 74 front line
North Richland Hills Police Officers with body cameras and for the purchase of any
requisite video data storage solution as well as any needed equipment to maintain the
functionality of the body cameras.
The total of the grant award is $94,771.25. This includes $75,817.00 from state funds
and a 25% required match amount of $18,954.25 from city funds. This grant request is
through the Texas Governor's Office and is passed through the Criminal Justice
Division who selected agencies on a competitive basis who would receive grant fund
awards from this announcement.

Council is being asked to Approve Resolution No. 2016-016, which authorizes the
payment for the Engineering and Construction of the Big Fossil Relief Sewer which is
required by the Big Fossil Agreement between the Cities of North Richland Hills,
Richland Hills, Haltom City and Fort Worth.
General Description:
The cities of North Richland Hills, Richland Hills, Haltom City and Fort Worth executed
an agreement to design and construct the Big Fossil Creek Relief Sewer in 2010. The
agreement indicated that the cost of the project would be divided up between the 4
cities based on the percentage of flow each city contributed to the new sewer main. The
city of North Richland Hills' percentage of flow was indicated in the agreement as 6.4%.
The same percentage was applied to the total project cost and North Richland Hills'
funding responsibility was approximately $1.2 million. The total cost for Big Fossil Sewer
Main was estimated to be approximately $18.4 million.
The agreement also indicated that Fort Worth would administer the project and invoice
the other three cities for their respective share for each partial payment paid to the
contractor by Fort Worth. However, before Fort Worth can award the design or
construction contract the other three cities will need to adopt a resolution authorizing
payment to the city of Fort Worth of its respective share of the cost to be incurred.
Exhibit A identifies the proposed Big Fossil Relief Sewer Main (identified as the gray line
in the legend) as well as the existing lines that will be replaced by the new Big Fossil
main. The existing lines to be replaced are shown by color in the legend for the different
cities that are using the lines. Fort Worth also elected to design and build the total
project in three phases. Phase 1 for design and construction is represented by the
segment of line that begins at Point A and ends at Point B. Phase 3 is the section that
begins at Point B and ends at Point D. This agenda item is for the design and
construction of Phases 1 and 3. Phase 2 will begin at Point D and end at Point F at the

The property was previously developed with a single family home in need of significant
repair. Shortly after the existing owner took possession of the property in January 2013,
the home was demolished. Before building permits can be issued for a new home, the
already-platted lot must also be properly zoned for single-family residential use.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation provides for traditional low-density

Section 4: The zoning district as herein established has been made in accordance
with a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as E
amended, except when the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such code, in which
event the conflicting provisions of such ordinances and such code are
hereby repealed.
Section 6: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance
are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining sections, paragraphs, sentences,
clauses, and phrases of this Ordinance, since the same would have been
enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase.

Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation,
both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be
prosecuted until final disposition by the courts.
Section 9: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance

Lane.

Summary:
On behalf of the property owner, Davis/Mockingbird NRH Ltd, PSI Atlantic Richland
Hills, LLC is requesting a zoning change from C-2 Commercial to NR-PD Nonresidential
Planned Development. The applicant proposes to construct a self-storage facility on
4.55 acres located at the northeast corner of Davis Boulevard and Mockingbird Lane.
General Description:
A complete site plan package is attached. Planned improvements to the site include
three single-story buildings with a total of 606 rentable self-storage units, a single-story
office building, and associated parking and loading areas. Twenty-one (21) parking
spaces are also provided for recreational vehicle (RV) parking and storage. The total
building area on the site is 89,525 square feet. While the property has frontage on Davis
Boulevard, the driveway access to the site is limited to Mockingbird Lane.
Land Use
The property is zoned C-2 Commercial, and self-storage facilities are permitted only
through approval of a special use permit or a planned development district. This method
provides for a site-specific review of a development proposal to determine whether it is
appropriate for the neighborhood area or location.
In 2007, a City Council discussion concluded that the market coverage for self-storage
facilities was saturated in North Richland Hills. The direction from that discussion was
that future development requests for this use would be reviewed on a case-by-case
basis to assess community expectations and market conditions prior to considering new
facilities in the city.
The Development Review Committee recommends denial of the zoning request based
on the extensive review of the project design, current market conditions, and the criteria
noted below. The Planning & Zoning Commission echoed many of the same concerns
and also voted to recommend denial of the case.

a. Adequate market coverage of self-storage facilities exists in the immediate
area. Uncle Bob's Self Storage (900 units) is located one-quarter mile
south of the site on Davis Boulevard. U-Haul Moving & Storage (674
units), Public Storage (486 units), and Cube Smart (432 units) are located
within one mile of the site. If the radius is expanded to two miles, the total
number of self-storage units increases to 6,500. On average, one unit per
ten NRH residents, or one unit per four NRH households, is available
within this two-mile area. The City of North Richland Hills also provides a
disproportionate geographic share of self-storage units in the Northeast
Tarrant County region.
b. Prior direction from the City Council and Planning and Zoning Commission
has been provided regarding limiting additional self-storage facilities.
c. In a statistically significant survey of NRH residents conducted in 2015,
only 1% of those surveyed said that they would like to see more
storage/mini-warehouse businesses. This was the lowest ranking category
of any business. In the same survey conducted in 2013, only 5.7 percent
of residents surveyed responded "yes" to whether they would like to see
more storage and mini-warehousing businesses; 94.3 percent responded
no.
d. With its proximity to the Town Center zoning district and manufactured
housing, this 4.55-acre tract may be suitable for an infill residential
planned development with single-family patio homes and/or townhouses.
To the City's knowledge, this development option has never been
explored by current or prior owners of this property. Past discussions
have only considered retail/commercial, which staff agrees may not be a
viable use in the near future given the existing vacancies in the immediate
area.
e. This particular property is undeveloped vacant land. Similar to the City's
policy on auto-related uses, the self-storage/mini-warehouse use would be
more appropriate in a redevelopment scenario or as an expansion to an
existing facility with the intent of increasing development standards on
existing properties.
f. Self-storage facilities do not generate any residual benefit other than
property taxes. This area of Davis Boulevard is in need of either daytime
population through office uses or new residential development to help
revive and sustain the existing retail establishments in the area and
encourage economic growth.

g. The facility as proposed is an older concept of self-storage. Other more
urban multi-story facilities offer a better aesthetic in architectural design by
appearing as retrofitted industrial-era warehouses or office buildings, and
include drive-through rather than drive-up services and limited outside
storage.
There would be some minor benefits to a self-storage facility use specific to this
location.
The Mockingbird Lane, Irish Drive and Davis Boulevard confluence of streets and lack
of a signalized intersection on Davis does create traffic delays and access issues on
occasion. This has been one primary reason for the property not developing with retail
in the past. According to the ITE Trip Generation Manual, a 606-unit self-storage facility
may generate approximately 150 vehicle trips on a weekday or Saturday compared to
approximately 260 vehicle trips per day for a single family residential development of
about 27 units.
Because of the security requirements and limited hours of operation, self-storage
facilities may also be considered to be "quiet neighbors" to existing single family
residential neighborhoods.
Planned Development Regulations
If the Planning & Zoning Commission and City Council find that the proposed land use
is appropriate for this location, modifications to specific development standards for the
site would also need to be considered. These modifications are described in more
detail below. All other development standards have been satisfied.
Building Materials
The proposed design for the three buildings containing the storage units does not meet
the exterior building material standards for non-residential construction. The exterior
wall materials include the use of brick, stone, stucco, and metal in amounts that do not
align with the minimum and maximum percentages allowed for each material. Brick and
stone materials (Masonry Group A) must comprise at least 70% of a building facade,
while the use of stucco (Masonry Group B) is limited to a maximum of 30% of the
facade. Metal, which is considered an accent material, is limited to 15% of the facade.
The following describes the details of the exterior wall materials for each building. The
buildings correspond to the key map below.

percent of the parking lot area be landscaped. The landscaping is typically contained
within a parking lot island that includes one large tree, with all parking spaces being
within 100 feet of the large tree.
The design of the proposed self-storage facility includes parking and loading areas in
the interior of the sites to provide access to the buildings and individual units.
Landscaped islands are not proposed within the interior of the site, so the standards for
parking lot landscaping and parking space distance from trees are not satisfied. All the

site landscaping is placed at the perimeter of the property in the street yards facing
Davis Boulevard and Mockingbird Lane and in the buffer yards adjacent to the Fountain
Ridge subdivision and La Casita manufactured home community. The applicant is
requesting approval of the plan as presented.
Stormwater Detention
The applicant is proposing an underground stormwater detention facility. Because of
the conditions of the property and the surrounding developments and the size of the
downstream stormwater system, on-site detention will likely be required no matter the
proposed use. Because the zoning ordinance requires a Special Use Permit for
detention facilities, though, it is included in the NR-PD regulations as a permitted use.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Retail." This designation is intended to permit a variety of retail trade, personal
and business services establishments, and offices.
CURRENT ZONING: The property is currently zoned C-2 Commercial. This district is
intended to provide for the development of retail and general business uses primarily to
serve the community and region. Uses include a wide variety of business activities and
may involve limited outside storage, service, or display. The C-2 district should be
located away from low and medium density residential development and should be used
as a buffer between retail and industrial uses. The district is also appropriate along
business corridors as indicated on the comprehensive plan.
PROPOSED ZONING: The applicant is requesting a zoning change to Planned
Development in order to develop the site as a self-storage facility.

more fully described in Exhibit "A" attached hereto, located at 7800
Mockingbird Lane (the "Property") has filed an application to rezone the
Property from its present classification of C-2 (Commercial) to NR-PD
(Non-Residential Planned Development) to allow for a self-storage facility
on the Property; and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on March 17, 2016, and the City Council of
the City of North Richland Hills, Texas, held a public hearing on April 11
2016 with respect to the zoning change described herein; and
WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF
NORTH RICHLAND HILLS, TEXAS:
Section 1: THAT the Zoning Ordinance of the City of North Richland Hills is hereby
amended by rezoning the Property and approving a non-residential
planned development in accordance with modified standards as provided
herein on a 4.55 acre tract of land within the W. W. Wallace Survey,
Abstract No. 1606, Tarrant County, Texas, commonly referred to as 7800

Mockingbird Lane and more specifically described by metes and bounds 0
on Exhibit "A," attached hereto and incorporated for all purposes.

Section 2: The City Council finds that the information submitted by the applicant
pursuant to the requirements of the Zoning Ordinance is sufficient to cm
approve the non-residential planned development in accordance with the
requirements of Exhibit "B", the Nonresidential Planned Development (NR-
PD) District Land Use and Development Regulations, attached hereto and
incorporated for all purposes, and the Exhibit "C", the Site Plan, attached
hereto and incorporated for all purposes, which are each respectively
approved.
Section 3: That the official zoning map of the City of North Richland Hills is amended
and the Planning Manager is directed to revise the official zoning map to
reflect the approved Non-Residential Planned Development, as set forth
above.
Section 4: The use of the Property described above shall be subject to the
restrictions, terms and conditions set forth in the PD District Land Use and
Development Regulations and the Site Plan attached as Exhibits "B" and
"C. Unless otherwise provided in Exhibits "B" and "C, the Property shall
be governed by all applicable regulations contained in the Building and
Land Use Regulations and all other applicable and pertinent ordinances of
the City of North Richland Hills.

Section 5: The zoning district as herein established has been made in accordance
with a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 6: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such code, in which
event the conflicting provisions of such ordinances and such code are
hereby repealed.
Section 7: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance
are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining sections, paragraphs, sentences,

clauses, and phrases of this Ordinance, since the same would have been 0
enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase. eo
Section 8: Any person, firm or corporation violating any provision of the Zoning cm
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 9: All rights and remedies of the City of North Richland Hills are expressly E
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation,
both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be
prosecuted until final disposition by the courts.
Section 10: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 11: This ordinance shall be in full force and effect immediately after passage.

Nonresidential Planned Development (NR-PD) District
Land Use and Development Regulations
Lot 1A1, Block 2, Red Gate Addition
North Richland Hills,Texas
This Nonresidential Planned Development (NR-PD) District shall adhere to all the conditions of the North
Richland Hills Code of Ordinances, as amended, and adopt a base district of C-2 Commercial. The
following regulations shall be specific to this NR-PD District. Where these regulations conflict with or
overlap another ordinance, easement, covenant, or deed restriction, the more stringent restriction shall
prevail.
I.ZONING 0
A. Permitted Special Land Uses. Uses in this PD shall be limited to the following: co
1. Self-storage facility of 606 units or less.
2. Detention Pond. A detention pond may be installed on the site. The pond must be
constructed as an underground facility, subject to approval by the City Engineer. The
standards of Section 118-729 of the Zoning Chapter of the Code of Ordinances do not apply Ua
if the pond is constructed as an underground facility.
B. Development Regulations. Development of this property must comply with the following standards
and the Site Plan attached as Exhibit C.

1. Development Standards. Development of the property must comply with the development
standards of the C-2 Commercial zoning district.
2. Building Design and Materials. The building design must comply with the building elevations to
attached as Exhibit C and the following standards for exterior building materials.
a. Building A: Metal is prohibited as a material on the west, north, and south E
elevations of the building. The east elevation may include R-panel metal cladding as
a permitted material.
b. Building B: On the north elevation of the building, the wall areas and the columns
between overhead doors must be faced with brick, stone, or stucco. The east, west,
and south elevations of the building may include R-panel metal cladding as a
permitted material.
c. Building C: Metal is prohibited as a material on the south, east, and west elevations
of the building. The north elevation may include R-panel metal cladding as a
permitted material.
d. Neon or LED trim lighting shall be prohibited on any portion of any building.

3. Landscaping. All landscaping and buffering standards must comply with the Landscape Plan
attached as Exhibit C and Chapter 114 of the North Richland Hills Code of Ordinances,
except as modified below:
a. At least eighteen percent (18%) of the lot area must be maintained as a landscaped
area.
b. Landscaping is not required in the parking lot internal to the site.
4. Signs. All signage on the site and buildings must comply with Chapter 106 of the North
Richland Hills Code of Ordinances.
a. Neon or LED trim lighting shall be prohibited on any portion of any sign.
5. Administrative Approval of Site Plans. Site plans that comply with all development-related
ordinances and this Ordinance may be administratively approved by the Development
Review Committee. Substantial deviations or amendments from the development standards
or Site Plan, as determined by the City Manager or his/her designee, require a revision to
the approved Planned Development in the same manner as the original. N

Richland Hills, TX LLC, 4060 Robin Wood Cove, Memphis, TN came forward to
present. They are seeking approval of the application as filed. He stated it is most likely 0
the highest and best use for the property. They have complied with all buffers, green
space, and zoning requirements. It is extensively landscaped, with over 20% more than
is required. He stated the supply of self-storage being adequate is not correct and this
market shows as being underserved and undersupplied, with the biggest draw for
climate-controlled space. North Richland Hills has fewer self-storage units than other
cities. While the Commission would like to see other things on this site, there are
inherent limitations with the property. TXDOT will not allow a curb cut on Davis
Boulevard. The traffic patterns will not create problems for the neighbors to the north
and east. He stated the operations promote business and economic progress. The site

will include a screening wall and landscape screening, and building "B" is a completely
interior building sitting 5 feet below the others.
Mike Benton asked about why comparisons were made to the Dallas market and not the
Fort Worth market. He mentioned differences in masonry standard calculations.

Mr. Williams responded that drivers passing by would see landscaping and not the non-
masonry internal structures. They come up with 70%, but staff measures 60%.
Chairman Shiflet asked about fencing and gates blocking the southeast corner to
secure their property.

Mr. Williams responded that there is a screening wall on the north and east side that is
satisfactory. There is a wall along the east side, a gate, then a wall that connects to the
corner of the building, which fills in any gaps.
Chairman Shiflet asked about the masonry percentages and why the discrepancies E

explained that they would address masonry with another course of brick, if needed.

subdivision and self-storage facilities as negligible differences.
Mr. Williams quoted 50 trips per day for a self-storage use. Self-storage is a demand-
driven item. He stated the design is not an older concept as had been mentioned.

Dustin Wyatt, 8204 Ulster Drive, North Richland Hills, came forward in opposition to the

application. He stated the traffic impact is not necessarily the number of vehicles but
type of vehicles. This use would bring large vehicles. Turning movements would be very
difficult onto Mockingbird Lane turning left or right.
Loretta Lawson, 7800 Mockingbird Lane, North Richland Hills, came forward in
opposition to the application. She expressed concern with how the rezoning would
affect Las Casita Mobile Home Community. They are a zero crime community and feel
this use would change the area. The address is the same for both properties and that
would need to be corrected. The safety of children would need to be maintained.
Chairman Shiflet closed the public hearing at 8:52 p.m.

request from Chad and Amy Brown for a Secondary Living Unit on
1.962 acres located at 7005 Smithfield Road.
Presenter: Clayton Husband, Principal Planner
Summary:
Chad and Amy Brown are requesting a Special Use Permit (SUP) to authorize
modifications to standards for a proposed secondary living unit on their property. The
applicants are proposing to convert an existing accessory building into a secondary
living unit. Their 1.962-acre property is located at 7005 Smithfield Road, south of
Hightower Drive.
General Description:
The secondary living unit is proposed in an existing building that was formerly built as a
racquetball court. The proposed improvements include a 1,195-square foot secondary
living unit on the first floor, and a recreation room and bathroom on the second floor.
There are separate entrances into the building proposed for the living unit and the
recreation room.
Renovations to the building were started before a building permit was issued. Building
inspection staff visited the site several times to discuss permit requirements with the
owner's contractor and to examine the construction that had taken place. Based on the
proposed renovations for the secondary living unit, it was determined that the size and
scope of work required approval of a special use permit.
Section 118-718(c) of the Zoning Ordinance includes a standard that the combined
square footage of all permanent accessory buildings is limited to five percent of the lot
area. In addition to the secondary dwelling unit, there is a detached garage on the
property. The square footage of the two buildings is equivalent to 3.17% of the lot area,
and the property complies with this standard.
The property is zoned R-1-S Special Single Family. A secondary dwelling unit is
permitted by right in this zoning district, subject to the following standards. Included with
each standard is a description of the applicant's proposal. A complete set of floor plans
and building elevations is also attached.

Modifications to or deviations from these standards may be approved through approval
of a special use permit. Due to the secondary living unit's proposed size of 1,195 square
feet and the lack of a breezeway connection to the primary residence, the
improvements can only be authorized through approval of a special use permit.
1. Use. A secondary living unit may only be used by domestic persons and their
family or a relative of the occupants of the main house. This unit cannot be
rented or leased or have a separate utility meter. The owner has stated the living
unit is for a family member, as described in the attached letter.
2. Connection to primary residence. Secondary living units must be constructed no
more than 25 feet from the main house and be connected by a breezeway that is
a minimum of six feet wide and attached to the roofline. The existing building
being renovated for the living unit is approximately 44 feet from the main house
and not connected by a breezeway. The owner is seeking a deviation from this
standard.
3. Architecture. A secondary living unit must have the same architectural style as
the primary structure and meet all standards that apply to the primary structure
except for minimum living area, the requirement for a garage/carport, and the off-
street parking requirements. The building architecture and materials of the
building are consistent with the main house.
4. Maximum total floor area. A secondary living unit is limited to 650 square feet of
living area. The proposed living unit is 1,195 square feet in area. The floor plan
indicates the unit includes a living area, kitchen and bath facilities, a bedroom,
two closets, and a storm shelter. The owner is seeking a modification to this
standard to allow the proposed floor area. For reference, the primary residence
is approximately 6,595 square feet (Source: Tarrant Appraisal District).
As previously stated, there are separate entrances into the building for the secondary
living unit and the recreation room. The living unit has direct access from the front porch
of the building, but access to the recreation room is from a stairway through a separate
entrance on the porch. The DRC is concerned that the building could have the
appearance of a two-family structure since the two floors function as separate and
independent areas and the second floor contains bathroom facilities. To alleviate this
concern, the DRC recommends that the floorplan be redesigned so there is a direct
connection to the second floor from the living unit through a hallway and that the
building has a single entrance.
SUP CONDITIONS. The zoning ordinance provides that special use permits may
establish reasonable conditions of approval on the operation and location of the use to
reduce its effect on adjacent or surrounding properties. Some of the characteristics
described by the applicant are included in these conditions. The following are the
proposed conditions of approval for this SUP application.

COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation is intended to provide areas for the
development of traditional, low-density single-family detached dwelling units.
CURRENT ZONING: The property is currently zoned R-1-S Special Single Family. This
district is intended to provide areas for very low density development of single-family
detached dwelling units that are constructed at an approximate density of one unit per
acre in a quasi-rural setting. The R-1-S district is specifically planned to allow for the
keeping of livestock in a residential environment.
PROPOSED ZONING: The applicant is requesting a Special Use Permit to authorize
modifications to the standards for a secondary living unit.

accessory building which are all on one electric meter, one water bill and one sewer

The Secondary living unit is being remodeled for Chad's mother:
Sherry Brown,age 72. She currently resides in Colleyville. She has had a few
accidents lately involving falling and she has become concerned about living alone
as well we should be. This living space will not be rented to her or anyone else. It
will be given for her use as a permanent home until she passes. It is a private
solution for our family rather than an assisted living facility. We understand the
Special Use Permit is designed for this reason and the secondary living space will

AMENDING THE ZONING ORDINANCE OF THE CITY OF NORTH
RICHLAND HILLS BY APPROVING A SPECIAL USE PERMIT TO
AUTHORIZE CONSTRUCTION OF A SECONDARY LIVING UNIT IN
ACCORDANCE WITH MODIFIED STANDARDS TO BE LOCATED AT
7005 SMITHFIELD ROAD; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY FOR VIOLATIONS
HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR

WHEREAS, the City of North Richland Hills, Texas is a home-rule municipality located
in Tarrant County, Texas acting under its charter adopted by the
electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and

issuance of a Special Use Permit for the construction of a secondary living
unit that deviates from the standards outlined in the Zoning Ordinance;

WHEREAS, the owner of the property located at 7005 Smithfield Road has filed an
application for a Special Use Permit to allow certain deviations from the
required standards for a secondary living unit on said property; and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on March 17, 2016, and the City Council of
the City of North Richland Hills, Texas, held a public hearing on April 11
2016 with respect to the Special Use Permit described herein; and
WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland
Hills, and all other laws dealing with notice, publication, and procedural
requirements for the approval of a Special Use Permit on the property;

WHEREAS, upon review of the application, and after such public hearing, the City
Council finds that granting the request herein furthers the purpose of
zoning as set forth in the Zoning Ordinance of the City of North Richland

conditions imposed herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS:
Section 1: THAT the Zoning Ordinance of the City of North Richland Hills is hereby
amended by approving a special use permit to authorize a secondary
living unit to be constructed in accordance with modified standards as
provided herein on a 1.962 acre tract of land within the William Cox
Survey, Abstract No. 321 , North Richland Hills, Tarrant County, Texas,
commonly referred to as 7005 Smithfield Road and more specifically
described by metes and bounds on Exhibit "A," attached hereto and
incorporated for all purposes.

Section 2: The City Council finds that the information submitted by the applicant
pursuant to the requirements of the Zoning Ordinance is sufficient to co
approve the Special Use Permit in accordance with the requirements co a.
hereof, subject to the following conditions:
1. Permitted use. One secondary living unit is permitted in the building for
use by domestic persons and their family or a relative of the occupants
of the primary living unit. The unit must not be rented or leased.

Section 4: The use of the property described above shall be subject to all applicable
regulations contained in the Building and Land Use Regulations and all
other applicable and pertinent ordinances of the City of North Richland
Hills.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such code, in which
event the conflicting provisions of such ordinances and such code are
hereby repealed.
Section 6: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance

are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment co
or decree of any court of competent jurisdiction, such unconstitutionality co a.
shall not affect any of the remaining sections, paragraphs, sentences,
clauses, and phrases of this Ordinance, since the same would have been
enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase.
Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation,
both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be
prosecuted until final disposition by the courts.
Section 9: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 10: This ordinance shall be in full force and effect immediately after passage.

Principal Planner Clayton Husband presented SUP 2016-01.
Applicant, Suzanne Canalizo, with Sugarbaker Remodeling and Design, 7005 Smithfield
Road, North Richland Hills, came forward to present. They are remodeling the cabana
to a mother-in-law suite. She explained the main house flooded with sewage in the past
and the owner has had to make many improvements since the property was purchased.
The accessory building is not appealing to a renter. This is the highest taxed property in
the North Richland Hills.

Clayton Husband came forward to summarize the application. The site includes a
lengthy driveway, main house, detached garage, and former cabana building. The
renovation work on the building commenced prior to issuance of permits. The living unit
space is proposed at 1,195 square feet, with the maximum size allowed at 650 square ,
feet. This is one of the reasons for the SUP application. The second item is the
connection between the primary house and the secondary living unit. The distance
exceeds the allowable 25 feet. Since the appearance of this unit could be similar to a
duplex, the Development Review Committee recommends removing the separate
second story entrance as part of this renovation work and providing only a single cm
entrance to the secondary dwelling.
Don Bowen asked if the door is removed, would that increase the square footage
limitation.

Clayton Husband advised that standard applies to the living area on the first floor and U)
the second floor recreation room would not count against the square footage.
Chairman Shiflet asked how complaints would be addressed if there were reports of the
second floor being used as a living area and not recreational uses. E

Steven Cooper asked about cooking facilities.
Clayton Husband responded that there is no prohibition of cooking facilities.

modifications being adopted. When the property was built, the structure was limited to

Clayton Husband stated staff could address Ms. Smith's concerns directly.
Chairman Shiflet reiterated that this project is not new building construction, only a

Teresa Neeman, 7033 Briardale Street, North Richland Hills, came forward in
opposition to the application. She stated she has experienced some flooding issues in
her back yard. She said the building cannot be a rental property, but could it become a ,
day care unit or an office?
Joann A. Gilbert, 7825 Noneman Drive, North Richland Hills, completed a card in favor
of the application, but she wished not to speak.

Bill Gilbert, Jr, 7820 Noneman Drive, North Richland Hills, came forward in support of
the application. He stated this is the third family that has lived in this house in the last 10
years. They have struggled with the problems at the house. About 6 weeks ago, they
mentioned changing the racquetball court to a mother-in-law suite. He stated he does
not know what impact this will have on the 2-acre property. He does not wish to see a
duplex built there for renters. If there are no possibilities that these things can occur, U)
then he has no problem with the request.
Clayton Husband clarified that the letter received by property owners was a standard
notification letter to residents within 200 feet of this site. This application is not a zoning E
change request. The SUP is for authorizing the larger square foot of the secondary
living unit and the absence of the attachment to the home.
Steven Cooper asked what action residents could take should there be indication that
this property is used as a rental unit.
Clayton Husband stated that code enforcement officers could be involved. Alternatively,
the building inspections department could be notified to investigate a zoning violation.

to the application. She stated she is an insurance agent and has concerns about
drainage. The property drains onto the downstream neighbors and she would like to
know what the city is going to do about this.

would become a fire egress issue, but she would entertain what the Commission
advises.

Don Bowen clarified that there are concerns from neighbors about flooding. However,
this SUP application does not adjust the footprint of the building, only the internal
renovation of an existing structure.
Chairman Shiflet asked if the patio is changing the grade of the property. cm
Suzanne Canalizo explained that the patio would be raised in slightly elevation.
Steven Cooper asked the staff engineer to address this.

Summary:
JPC Realty, LTD is requesting approval of a zoning change from R-3 Single Family
Residential to 0-1 Office on 1.10 vacant acres at the northwest corner of Odell Street
and Davis Boulevard for the purpose of developing two 4,000 square foot professional
garden office buildings.
General Description:
According to the Tarrant Appraisal District, the properties at 8121, 8125 and 8129 Odell
Street have remained vacant under single ownership since the mid-1990s. The
property has remained for sale through the redevelopment of Odell Street with newer
homes. The applicant is contending that the proximity and orientation along Davis
Boulevard has limited the property's viability for residential use and is instead
requesting a zoning change to allow two single-story pitched roof professional office
buildings of 4,000 square feet each.
The initial Site Plan packet is attached for

The Texas Department of Transportation (TxDOT) has issued conceptual approval of
the driveway location on Davis Boulevard under the design currently proposed. The
driveway would be a right-in/right-out driveway with raised median to discourage left-
turning maneuvers. Staff has also commented that the driveway on Odell Street should
be the minimum of 25-foot in width.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation provides for traditional low-density
single-family detached dwelling units.
If the zoning is approved, the Comprehensive Land Use Plan would be amended as
well. The appropriate Land Use designation would be the "Office" designation, which is
intended to permit professional and organizational offices with accessory and related
uses.
TRAFFIC IMPACT: The property is situated at the northwest corner of Davis Boulevard
and Odell Street. Odell Street is classified on the Master Thoroughfare Plan as an R2U
2-lane residential street 31-feet in width that was reconstructed in 2011 . Because of the
connection between Smithfield and Davis, speedhumps that were previously in place
prior to 2011 were reinstalled with the reconstruction project.
A Traffic Impact Analysis (TIA) was not required at the time of application submittal
because the expected trips generated from the site do not meet the City's threshold for
a full traffic study. Following the Planning & Zoning Commission's recommendation for
denial based on traffic concerns, the applicant has hired a traffic engineer to prepare a
Traffic Impact Analysis. The findings will be presented by the applicant at the City
Council meeting.
CURRENT ZONING: The property is currently zoned R-3 Single Family Residential.
PROPOSED ZONING: The proposed zoning is 0-1 Office. The 0-1 office district is
intended to permit the professional and organizational office needs of the community.
While the 0-1 district does allow for some limited retail and service uses, professional,
medical and banking office uses are heavily favored and are anticipated to occupy the

CITIZEN INPUT: To date, staff has received two letters of opposition to the proposed
rezoning. Those letters are attached for your review. Furthermore, five additional area

wife and I are vehemently opposed to this change for several reasons.
There have been numerous studies concerning the inordinate amount of traffic on Odell Street between
Davis Blvd. and Smithfield Road. This section of Odell is a major cut-through and the vast majority of traffic is
of those who do not live on Odell. Every morning during school, eastbound traffic on Odell is backed up 10-15
cars deep. These are parents who have dropped their children off at Smithfield Elementary. This change from
R-3 Single Family to 0-1 Office zoning can only result in major additional vehicle traffic on our street.
Davis Blvd. at Odell, is a 50mph DOT zoned road. However,many drivers are exceeding this limit.
Additional traffic entering and exiting this heavily traveled six lane highway is tantamount to begging for a
major accident to occur at Odell/Davis. On the plot plan it showed egress to both Davis and Odell which will
only make matters more unacceptable.
I have personally witnessed that the property owner has been trying to unload this corner for over 10
years. The new owner, whether he purchased "subject to zoning change" or not, should not burden us with
additional traffic and congestion.
Allowing this zoning change will only exacerbate an already difficult situation. This property should
remain zoned R-3 Single Family. With all of the construction going on in Northeast Tarrant County,there is a
builder out there who would love to have over one acre to build on. We finally got rid of the eyesore salvage
yard on the southeast corner and now a commercial enterprise on the northwest corner just unacceptable.

other applicable and pertinent ordinances of the City of North Richland
Hills.
Section 4: The zoning district as herein established has been made in accordance
with a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as E
amended, except when the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such code, in which
event the conflicting provisions of such ordinances and such code are
hereby repealed.
Section 6: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance
are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining sections, paragraphs, sentences,
clauses, and phrases of this Ordinance, since the same would have been
enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase.

Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final

($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation,
both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be

The purpose of this memorandum is to document the results of a traffic impact analysis(TIA)for the Co a.
proposed medical office development, to be located on Davis Boulevard at Odell Street in North
Richland Hills,Texas(See Figure 1).The proposed development site plan is shown in Figure 2.This 2
analysis was conducted to determine the possible impacts of the proposed development change on
traffic operations along Davis Blvd. and Odell St., adjacent to this development. The analysis also
examined the proposed development access driveways to determine the need for right turn lanes on
Davis. Blvd. at the access driveway serving the proposed subject development, in response to the
request from the City of North Richland Hills staff and TxDOT,which has jurisdiction over access to
Davis Blvd. (FM 1938). 2
ANALYSIS APPROACH

The approach applied to the analysis was as follows:

➢ Conducted traffic counts to establish existing traffic volumes at the development access street 0
intersections with Davis Blvd and Odell St. The analysis was conducted for the morning and
afternoon peak traffic periods. PM peak period turning movement traffic counts were obtained on
Thursday, March 24, 2016, at the intersection of Davis Blvd and Odell St. AM peak period traffic
counts were made on Friday,April 1, 2016, at this same intersection. It should be noted that the
AM peak hour chosen for the analysis contained the highest 1 hour volumes for the west
approach of the Odell St. intersection with Davis Blvd. Also, a 24 hour traffic volume count of
29,421, made in early 2015, on Davis Blvd, south of Odell St,was obtained from the TxDOT,for
reference. The 2016 traffic volume counts are provided in Appendix A and summarized in
Figure 3 and Figure 4.
➢ Estimated the vehicle trips in and out of proposed development. Using the 9th Edition of the
Institute of Transportation Engineers (ITE) Trip Generation Manual, it was determined that, for
the weekday trip generation rates per 1000 square feet of gross leasable area for the AM and
PM peak hours, the proposed 7,946 square foot Medical Office development will generate a
total of 19 vehicle trips in the AM peak hour and 30 vehicle trips in the PM peak hour. The
AM and PM peak hour trips generated by the medical-dental offices land use proposed for the
development are presented below in Table 1 and the ITE Trip Generation Manual formulas and
graphs used to determine the trip generation rate are contained in Appendix B.

development. The directions of approach and departure for traffic coming to and leaving the
development were derived from viewing the existing housing development density on a Google
Map and considering the distribution shown in the traffic counts conducted at the intersection of

Trips generated by the development were then assigned to the appropriate approaches of the
intersections to be analyzed. These volumes are shown in Figure 5 and Figure 6. It should be
noted that vehicle trips to the proposed development from the south and east will need to access
the site by way of the Odell St. Driveway 2, since TxDOT is requiring that the Davis Blvd.
Driveway 1 will be restricted to right-in and right-out only. Similarly, motorists leaving the site to
the north will be expected to depart via Driveway 2 and return to the north by way of the
intersection of Odell St. and Davis Blvd.

➢ Combined the AM and PM peak hour existing non-site traffic volumes and that which will be
generated by the development at the intersections of Davis Blvd with Odell St. and Driveways 1
and 2. These volumes are shown in Figure 7 and Figure 8.
➢ Entered the above traffic information as input data into the Trafficware's "SimTraffic" traffic
analysis software package, both for the existing conditions and for conditions that included the Ln

traffic added by the proposed development. SimTraffic is designed to model b o t h signalized Ln
and unsignalized intersections. SimTraffic is especially useful for analyzing complex
cm
situations that are not easily modeled macroscopically including: 0
• Closely spaced intersections with blocking problems
• Closely spaced intersections with lane change problems
• The affects of signals on nearby unsignalized intersections and driveways
• The operation of intersections under heavy congestion.
➢ The traffic lane configurations and intersection traffic control were also determined and are
displayed in Figure 9. The results were then tabulated and conclusions developed to determine
the impact of the added traffic.
➢ Observed the operation of traffic entering and exiting Odell Street, noting the queuing of vehicles
at the intersection and the average and maximum delay time waiting to turn into and out of this
side street.
➢ Based on TxDOT requirements, analyzed and determined the need for a separate right turn
deceleration site access lane on Davis Blvd. at Driveway 1.

Intersection Caacit - The analysis of impacts is measured in terms of traffic operating
level of service (LOS). According to the Highgay Highway Capacity Manual, capacity is defined as the Ln
cm
maximum number of vehicles that can be expected to travel on a given section of roadway or a Ln
specific lane during a given period under prevailing traffic conditions. The operational conditions of
cm
roadways are measured in terms of "Level of Service" (LOS). Level of Service refers to the 0
operational conditions within a traffic stream and their perception by motorists in terms of delay,
freedom to maneuver, traffic interruptions, comfort, convenience and safety. There are six levels of
service(LOS)or capacity conditions for each roadway facility and they are designated from"A"to"F",
with "A" representing an optimal, free-flow condition, and "F"representing a congested, forced flow
condition. These Delay/LOS relationships are shown in Table 2 for intersections with stop sign
control. A summary of the analysis results for the existing traffic conditions is shown in Table 3. The
capacity analysis worksheets for the unsignalized intersections are contained in Appendix C.

As can be seen from the results in Table 3, the existing traffic operations in 2016, for the entire
intersection analyzed, are at a LOS A at the intersection of Davis Blvd. and Odell St, and all
approaches, except for the EB and WB approaches of Odell St.,which are operating at LOS C and D
for the AM peak hour and the EB approach of the intersection, which is operating at LOS B for the cm
PM peak traffic hour. These conditions exist without any site generated traffic. Ln

For the analysis of the impacts of adding the development site traffic to the existing traffic at the 0
Davis Blvd. and Driveway 1 intersection and the intersection of Davis Blvd. and Odell St., the same
Synchro analyses were conducted. A summary of the 2016 base + site analysis results for the AM co
and PM peak hours are shown in Table 4.

As can be seen from the results in Table 4, the LOSs for the combined existing and development
traffic were A, the same as for the non-site traffic conditions. The individual approaches would all
operate at LOS A, except for the WB approach of Odell St., which would operate at LOS D for the
AM peak hour, and the EB and WB approaches, which would operate at C and E for the PM peak
traffic hour.
Effects of Added Site Traffic —Another measure of impact is the operation of traffic entering the
adjacent residential neighborhood. Based on the type of land use being proposed,there will only be
the addition of 19 vehicles in the AM peak hour traffic period and 30 vehicles in the PM peak hour
traffic period. The driveway on Odell St. will be expected to serve only 12 vehicle in the AM peak
Hour and 17 in the PM peak hour. Most of these vehicles will be expected to come from and go to
Davis Blvd. as the primary route to and from the site,with only 4 vehicles in the AM peak hour and 6
in the PM peak hour expected to come from or go to the west on west approach of Odell St.
Even if some small amount of this traffic accesses the site by way of the west approach of Odell
Street, observations made on Tuesday and Wednesday,April 5th and 6th during the AM and PM peak

traffic hours, indicated that traffic entering and exiting this approach of Odell Street generally
averages from 1 to 2 vehicles stopped more than 20 seconds and only once experienced a backup of
4 vehicles where the last vehicle in the queue had to wait I minute and 45 seconds at the intersection
before turning onto Davis Blvd. The queuing information obtained from these observations in
contained in Appendix A.
It is also quite likely that some of the development traffic will already be in the traffic on Davis Blvd.on
their way to and from work, school, or some other destination. It is often assumed that 10% of the
non-site traffic will be"pass-by"traffic that will become site traffic of the proposed development and
reduce the amount of added site traffic.
Right Turn Lane Requirements - The Texas Department of Transportation (TxDOT) Access
Management Manual contain criteria for right turn lanes on roadways that can be applied to this
cm
proposed development site. Chapter 2,Access Management Standards, in the Access Management Ln
Manual, presents thresholds for these auxiliary lanes. The relevant sections of these documents
cm
referenced in the following discussions are provided in Appendix D. 0
For right turn lanes, Table 2-3, on page 2-14 of the Access Management Manual, shows that a
co
deceleration right-turn lane to an intersecting street or driveway is required if the speed on the main
roadway is greater than 45 mph and the right turn volume is greater than 50 vehicles per hour. Since
there are only 15 and 8 vehicles projected to turn right into Driveway 1 during the AM and PM peak
hours from Davis Blvd., with a posted speed limit of 50 mph; a right turn lane is not warranted for
Driveway 1.
Intersection Spacing — The site plan in Figure 2 has been reviewed by TxDOT and the driveway
access, including the distances to the adjacent cross streets of Odell Street and Cross Drive, found
to be acceptable, as long as traffic access is restricted to right in and right-out only. The TxDOT
approval letter is contained in Appendix E.

Conclusions

Based upon the Analysis Findings described above, the following conclusions can be drawn. tm
Intersection Levels of Service — The overall intersection Levels of Service (LOSs) for existing
conditions, and with development traffic added, were found to be at acceptable levels at all
intersections analyzed, with the adjacent street intersection of Davis Blvd and Odell St and the
access Driveway 1 intersection with Davis Blvd at LOS A.
On an approach basis, the only approach that had an LOS below C,with site traffic added, was the
westbound approach of Odell Street at Davis Blvd,with a D and E LOS during the AM and PM peak
hour, respectively. The D level of Service in the AM peak hour exist without site traffic and the E
LOS in the PM peak hour seems to be an computer-generated anomaly,since the results without site
traffic is an A LOS and the added site volumes for this approach are very low. These conditions
would lead to the conclusion that the proposed development traffic will not materially impact the traffic
conditions in the area and, therefore, does not warrant any capacity improvements at this
intersection.
Right Turn Lane Requirements—Since right turns off of Davis Blvd. into Driveway 1 will be 5 and 3
vehicles during the AM and PM peak hours, respectively,which is below the threshold volume of 50;
the development access driveway right turning volumes do not meet the TxDOT warrant for a
separate right turn lane.

Driveway Spacing—TXDOT staff has reviewed the proposed distances between the site access
driveway and adjacent cross-street intersections and offered their approval as acceptable spacing.
Sight Distances-The gently rolling terrain and straight roadway alignment in both directions from
the proposed Driveway 1 and Davis Blvd, and the proposed Driveway 2 and Odell St. will allow for
good sight distance and traffic operating safety conditions, as well.

At each Council meeting a member of the governing body announces upcoming events
in the City and recognizes an employee that exemplifies the City's core values.
General Description:
Announcements -
The 2015 Sounds of Spring Concert Series kicks off this Friday April 15th, at 7 p.m. at
the NRH Centre Plaza. Admission is free. Seating is on the law, so don't forget to bring
a blanket or lawn chair. A variety of gourmet food trucks will be on site for each concert
and there will be free games and activities for children. For more details, please go
online or call the NRH Centre.
On Saturday, April 16th North Richland Hills residents can get rid of unwanted bulky
items during the annual Spring Community Cleanup. Items can be dropped off between
9 a.m. and noon at the Tarrant County College-Northeast Campus in parking lot E.1 by
the tennis courts. NRH residents can also bring up to five average size file boxes of
paper to be securely shredded onsite and then recycled. Proof of residency must be

Meet New York Times bestselling author Lisa Lillien at the North Richland Hills Public
