for the City Council to seek advice from the city attorney (551.071) as to the
posted subject matter of this City Council meeting.
The City Council may confer privately with its attorney to seek legal advice on
any matter listed on the agenda or on any matter in which the duty of the attorney
to the governmental body under the Texas Disciplinary Rules of Professional
Conduct of the State Bar of Texas clearly conflicts with Chapter 551, Texas
Government Code.

Summary:
The City hired Kimley -Horn & Associates to review the current and future traffic
conditions along Iron Horse Boulevard through the Transit Oriented Development (TOD)
District and provide recommendations for number and width of lanes, presence and
style of on- street parking, etc. Representatives from Kimley -Horn & Associates will be
presenting their findings and recommendations during this Work Session. Staff will be
seeking input from the Council on codifying the recommendations into the TOD Zoning
Code.
General Description:
The Iron Horse Cross Section Analysis is attached for review. After combining three
separate developments' traffic impact analyses (TEXRail Iron Horse Station, Iron Horse
Village and Iron Horse Commons) and factoring traffic growth rate assumptions, Kimley-
Horn calculated anticipated traffic counts for the year 2025. From there, future roadway
and intersection capacities and peak hour levels of service were estimated. The
analysis concluded that 4 travel lanes, a center turn lane, and the presence of on- street
parking will appropriately accommodate travel along Iron Horse Boulevard through the
Transit Oriented Development District.
Kimley -Horn will present on the process and methodology of the report as well as their
recommendations. Each section of Iron Horse will be presented with cross section
recommendations and a plan view. A large roll plot will be printed out for the Council to
review the corridor in one comprehensive view.
Revisions to Street Cross Sections in the TOD Code
After analyzing the future traffic growth, anticipated vehicle movements, and adjacent
uses along the corridor, it became clear that the TOD Code would need to be adjusted
in three key areas.
Change the TOD Boulevard Cross Section. The "TOD Boulevard" as currently
written in the TOD Code calls for no on- street parking. Under current
development proposals, however, on- street parking would help buffer live /work,

mixed -use and residential townhomes from vehicles traveling Iron Horse
Boulevard and provide convenient parking for residents and visitors.
2. Add Center Turn Lane to Commercial Avenue Cross Section. Iron Horse
Boulevard currently has a continuous center turn lane south of Browning Drive.
When the TOD Code was crafted, the center turn lane was removed from the
future cross section. Because of the anticipated left turning movements at
Browning Drive, the TEXRail Station and the various developments along the
corridor, it is now evident that the center turn lane must be maintained.
3. Add Angled Parking to Commercial Avenue Cross Section. City Council has
expressed a desire to adhere to the mixed use criteria of the TOD Core as much
as possible. If this is to occur, adequate and convenient parking for commercial
uses must be provided to attract retail, restaurant, office and other commercial
users. To that end, the report recommends the use of angled parking along
much of the corridor. This would require some additional right -of -way and paving
from the various property owners along the corridor as they develop.
Staff will be seeking input from City Council on Kim ley- Horn's report and the three
proposed changes to the TOD Code.

Subject: Iron Horse Boulevard Cross Section Evaluation

The purpose of this evaluation is to analyze future conditions and provide preliminary cross
section recommendations for Iron Horse Boulevard from IH -820 to Rufe Snow Drive in the
City of North Richland Hills, Texas.
The following sections document the data collection and methodology used in evaluating Iron
Horse Boulevard.
Existing and 2025 Backgiround'Tiraffic Volurne
Existing (2015) turning movement volumes were obtained for the AM and PM peak hours from
the recently completed TEX Rail Iron Horse Station traffic impact study at the following
locations:
• Iron Horse Boulevard and IH -820 Frontage Roads
• Iron Horse Boulevard and Boulder Drive
• Iron Horse Boulevard and Browning Drive
• Iron Horse Boulevard and Eagle Crest Drive
• Iron Horse Boulevard and Rufe Snow Drive
Using tube count data collected in April 2016, the 2015 turning movement volumes were
increased 20% to reflect additional traffic added as a result of the recently operational
managed lanes along IH -820.

To obtain the year 2025 background traffic growth, the adjusted 2015 traffic volumes were
grown at a rate of 2.2% for ten years. The growth rate used was obtained from the TEX Rail
Iron Horse Station traffic impact study.

The year 2025 total traffic volumes were calculated by adding site traffic from three proposed
developments along Iron Horse Blvd to the 2025 background traffic volumes. These
developments are known as Iron Horse Commons, The Fountains at Iron Horse, and the TEX
Rail Iron Horse Station. Site - generated traffic data for the Iron Horse Commons and TEX Rail
Iron Horse Station were obtained traffic impact studies performed for those sites.
To estimate the trips generated by the Fountains at Iron Horse development, average trip
generation rates from the 9th edition of the ITE Trip Generation Manual were used. Table 1
shows the trip generation rates for the proposed land uses.
Table 2 summarizes the total number of trips that are expected to be generated at build -out
of the proposed development during the AM and PM peak periods and on a daily basis. The
number of trips generated represents the number of vehicles entering and exiting the
proposed development to and from the adjacent street system.
The distribution and assignment of site traffic to the study area roadway network were based
on existing traffic patterns, the locations of the proposed driveway access to /from the site, and
TEX Rail Iron Horse Station trip distribution. The following percentages of trip distribution are
assumed on the surrounding roadway network:
• 60% - Iron Horse Boulevard, south of the study area
• 40% - Iron Horse Boulevard, north of the study area
These site generated traffic volumes were added to the 2025 background traffic volumes
along with site traffic from Iron Horse Commons and the TEX Rail Iron Horse station site traffic
to obtain the 2025 Total Traffic Volumes. These volumes are presented in Exhibit 1
(attached).

Intersection Capacity Analysis
The evaluation of traffic operations in the study area was comprised of peak hour level of
service analyses for each of the peak hours using the Synchro 9TM software. The purpose of
this analysis was to determine if any deficiencies exist or are anticipated within the network
short term so that recommendations for improvements can be made.
Capacity defines the volume of traffic that can be accommodated by a roadway at a specified
"level of service." Capacity is affected by various geometric factors including roadway type
(e.g. divided or undivided), number of lanes, lane widths, and grades. Level of service (LOS),
which is a measure of the degree of congestion, ranges from LOS A (free flowing) to LOS F
(a congested, forced flow condition). A description of each operational state for both
signalized and unsignalized intersections is presented in Table 3.
The results of the 2025 conditions traffic analyses are presented in Table 4. Note, based on
recommendations provided in the TEX Rail Iron Horse Station and Iron Horse Commons traffic
impact studies, both intersections were assumed to be signalized in 2025 conditions.
Based on the results of the intersection capacity analysis, both intersections within the study
area are projected to operate at level of service D or better during the AM and PM peak hours
in 2025 conditions.

Proposed Gross Sections
Based on the results of the intersection and thoroughfare capacity analyses, cross section
recommendations were prepared for each segment of Iron Horse Boulevard. These
recommendations are presented in the sheets attached to this memorandum. For adherence
to the City of North Richland Hills Transit - Oriented Development (TOD) code, angled or
parallel on- street parking is recommended on all segments which are not adjacent to existing
surface parking lots. It is generally recommended that angled parking be considering adjacent
to high density, mixed -use development, while parallel parking is recommended adjacent to
residential development.
Effects of On- Street Parking
It is generally accepted that the presence of on- street parking has many different impacts on
a roadway, including the portion of right -of -way not used for vehicular travel. On- street parking
is widely recommend as a method of enhancing a street because it provides a barrier between
vehicular and pedestrian traffic, acts as a traffic calming measure, and can help to boost the
economic activity of the surrounding area.
The impact of on- street parking on traffic flow can vary widely depending on the type of parking
that is provided and the expected hourly turnover. Studies have estimated that on- street
parking can decrease roadway capacity by up to 17% in areas with high- turnover and parking
configurations requiring reverse maneuvers. This reduction in capacity can also be as little as
2% in areas with low turnover and parking configurations that result in fewer reverse
maneuvers. Based on the results of the thoroughfare capacity analysis, all segments of Iron
Horse Boulevard are projected to have adequate capacity to withstand minor reductions due
to the presence of on- street parking.
Back -in Angled Parking
In areas where angled parking is recommended, back -in angled parking may be considered
as an alternative to traditional angled parking. The advantages of back -in angled parking
include greater visibility of the road when pulling out of parking spaces and safer unloading of
passengers and cargo.

asked to consider a resolution supporting the Fort Worth Transportation Authority's TEX
Rail project. The city has been notified by The T that action is required by the City
Council to permit The T to acquire property for the Smithfield station. The city has been
made aware that timing is of the essence to ensure construction of the station is
completed within the projected timeframe. City Council is being asked to consider and
approve Resolution 2016 -017. The resolution approves the Fort Worth Transportation
Authority's acquisition through eminent domain, if necessary, of approximately 5.831
acres of land situated in the John H. Barlough survey, abstract number 130, City of
North Richland Hills, Tarrant County, Texas; said tract being all of Lot 2 -r, Block H,
Smithfield Addition, an addition to the City of North Richland Hills, according to the plat

The NRH Animal Adoption & Rescue Center and the Texas Coalition for Animal
Protection will host a Low Cost Pet Vaccination Clinic from 10:00 a.m. to noon on
Saturday, April 30, 2016 at the center located at 7301 Iron Horse Boulevard. The clinic

Tarrant County is hosting a Senior Expo for residents 50 years of age and better on

Kudos Korner — Ken Boyer of the Police Department — A citizen witnessed Officer Boyer
helping a man in a motorized wheelchair near a busy intersection and posted his
appreciation online. "I share this to show that police officers have great hearts and are
kind," the citizen said. Officer Boyer's actions are a reflection of the compassion and
dedication city employees have for our community. By the way, Officer Boyer was
recently named Police Officer of the Year for 2015 by the NRH Police Department.

Summary:
The Town of Bartonville is requesting to enter into an interlocal purchasing agreement
for the purchase of goods and services from vendors selected through the competitive
bidding process.
General Description:
The Town of Bartonville is requesting to enter into an interlocal purchasing agreement
for the purchase of goods and services from vendors selected through the competitive
bidding process. Bartonville is interested in purchasing from a current City of North
Richland Hills contract for Slurry Sealing (RFB 15 -020, Intermountain Slurry Seal).
Council has authorized several of these interlocal agreements in the past, and they
have been mutually beneficial to North Richland Hills and the other agencies.
Participation reduces the overall expense of soliciting bids, and purchasing in larger
quantities often lowers the cost of the goods and /or services. Each agency will place
their orders and pay the vendors directly.
The City of North Richland Hills or the Town of Bartonville may change or cancel the
agreement with a 30 -day written notice. North Richland Hills currently participates in
interlocal agreements with several local governments throughout the DFW Metroplex
and various parts of Texas. In April 2016 the City Council approved a similar agreement
with the Town of Double Oak. Also on the May 9t" agenda is another interlocal
agreement with the Town of Hickory Creek. NRH has approved over 30 other interlocal
agreements for items like firefighting clothes /bunker gear and irrigation supplies.
Recommendation:

This Agreement made and entered into by and between the City of North Richland Hills,
hereinafter referred to as "NRH ", and the Town of Bartonville, hereinafter referred to as
"Bartonville ".
Pursuant to the authority granted by the Texas Interlocal Cooperation Act {Article 4413

governmental bodies, the parties hereto, in consideration of the premises and mutual promises
contained herein, agree as follows:
NRH and Bartonville desire to enter into an Agreement for the purchase of goods and
services from vendors selected through the competitive bidding process. Specifications for said
items should be determined in cooperation with the final approval of the entity processing the
bid.
The responsibility of each entity shall be as follows:
NORTH RICHLAND HILLS
NRH shall be allowed to purchase goods and services from vendors who have been
selected by Bartonville through the competitive bidding process. NRH will place orders
directly with and pay directly to the selected vendor for goods and services purchased
through a contract.
2. All purchases will be within the specifications that have been agreed to. NRH shall be
responsible for the Vendors compliance with all conditions of delivery, price and quality
of the purchased goods or services.
3. NRH shall give a 30 -day written notification to all participating agencies of any change
or cancellation of participation.
4. The Purchasing Agent, shall be designated as the official representative to act for NRH
all matters relating to this cooperative purchasing agreement.
TOWN OF BARTONVILLE
Bartonville shall be allowed to purchase goods and services from vendors who have
been selected by NRH through the competitive bidding process of NRH. Bartonville will
place orders directly with and pay directly to the selected vendor for goods and services
purchased through a contract.

General Description:
The Town of Hickory Creek is requesting to enter into an interlocal purchasing
agreement for the purchase of goods and services from vendors selected through the
competitive bidding process. Hickory Creek is interested in purchasing from a current
City of North Richland Hills contract for Slurry Sealing (RFB 15 -020, Intermountain
Slurry Seal).
Council has authorized several of these interlocal agreements in the past, and they
have been mutually beneficial to North Richland Hills and the other agencies.
Participation reduces the overall expense of soliciting bids, and purchasing in larger
quantities often lowers the cost of the goods and /or services. Each agency will place
their orders and pay the vendors directly.
The City of North Richland Hills or the Town of Hickory Creek may change or cancel the
agreement with a 30 -day written notice. North Richland Hills currently participates in
interlocal agreements with several local governments throughout the DFW Metroplex
and various parts of Texas. In August 2015 the City Council approved a similar
agreement with the City of Mesquite. Another similar agreement was approved with the
Town of Double Oak in April 2016. NRH has approved over 30 other interlocal
agreements for items like firefighting clothes /bunker gear and irrigation supplies.
Recommendation:

Summary:
Since 1993, Tarrant County has provided Tax Assessment and Collection services for
the City of North Richland Hills. Staff requests that the City Council authorize the City
Manager to execute a contract with Tarrant County in order to continue the provision of
these services for Tax Year 2016.
General Description:
The Tarrant County Tax Assessor /Collector has submitted its annual agreement for
property tax collection services. The county has collected property taxes for the City of
North Richland Hills since October 1993. During this time, staff has been pleased with
the county's performance, customer service and the cost savings realized by the city. A
copy of the agreement is attached for Council consideration.
This agreement is essentially the same as the previous agreement. The proposed rate
for Tax Year 2016 is $0.95 per account; a decline of $0.15. The county maintained a
rate of $0.50 per account from 1993 until 2008 when the rate increased to $0.65. In
2012, the county raised the per account rate to $0.90 and again in 2013 to $1.10 per
parcel. Tarrant County had held the $1.10 per account rate since 2013.
Although the Tax Year 2016 rate declined, there is an anticipated increase in the
number of accounts. The estimated number of accounts based on the preliminary tax
roll received in April 2016 is 58,684. This is an increase of 1,735 accounts compared to
the July 2015 Certified Tax Roll. Based on these accounts, the total estimated cost for
this service is approximately $55,750.
Staff believes the service provided by the Tax Assessor /Collector remains a good value.
It would not be possible for the City of North Richland Hills to conduct the same service
for the amount charged by Tarrant County.

coming year for in- county accounts to $.95 the lowest collection fee of any urban county in Texas. The fee for out -
of- county accounts will remain $2.60 per account. The rates will be applied to the Tax Year 2015 ending number of
accounts.
State law requires that I charge taxing entities my actual costs for tax collection.
Enclosed are three original renewal contracts for the assessment and collection of your ad valorem taxes by my
office for the tax year 2016. After the contracts have been signed, please return ALL copies to the attention of
Sheila Moore, Entity Liaison. I will mail a fully executed contract to you after the Commissioner's Court has made
formal approval of the contract. This will be at the end of September, so the contract will be returned in October. If
you require more than one original, please make a copy of the contract and mail all four back to my office. In order
to have your contract in place prior to the upcoming tax season, I would ask that you have the properly executed
contract returned to me no later than July 31, 2016.
In addition to your 2016 contract, I am enclosing an attorney confirmation form. Please fill out the requested
information, sign and return to my office along with the collection contracts.
You will be invoiced for your collection commission by January 31, 2017 with payment due no later than
February 28, 2017.
The time for rate calculations is rapidly approaching and many of you are already in budget preparations. Please
remember the importance of getting the rate and exemption information to us prior to the September 16`x' rate
submission deadline. My office will provide more information on this requirement in the near future.

§ Agreement For the Collection of Taxes
COUNTY OF TARRANT S
Agreement made this day of , 2016, by and between the Tarrant County Tax
Assessor /Collector, hereinafter referred to as ASSESSOR/COLLECTOR, and Tarrant County, hereinafter referred to
as the COUNTY, both of whom are addressed at 100 E. Weatherford Street, Fort Worth, Texas 76196 -0301, and the
City of North Richland Hills hereinafter referred to as City, whose address is PO Box 820609, North Richland Hills, TX
76182.
PURPOSE OFAGREEMENT
The purpose of this Agreement is to state the terms and conditions under which the ASSESSOR/COLLECTOR will
provide assessment and collection services of Ad Valorem taxes levied by the City.
NOW THEREFORE, in consideration of the mutual promises herein contained, the parties hereto agree as follows

SERVICES TO BE PERFORMED
The ASSESSOR/COLLECTOR agrees to bill and collect the taxes due and owing on taxable property upon which the
City has imposed said taxes. The ASSESSOR/COLLECTOR shall perform the said services in the same manner and
fashion as Tarrant County collects its own taxes due and owing on taxable property. The services performed are as
follows: receiving the Certified Appraisal Roll fi•om the appropriate Appraisal District and monthly changes thereto;
providing mortgage companies, property owners and tax representatives, tax roll and payment data; providing all
necessary assessments of taxes and Truth in Taxation calculations as required; the transmittal of tax statements via the
U.S. Mail or electronic transfer of data; and payment processing. All City disbursements, made by check or by
electronic transfer (ACH), for collected tax accounts will be made to the City on the day the COUNTY Depository Bank
indicates the mandatory assigned "float" period has elapsed and the funds are posted to the collected balance. If any daily
collection total is less than one hundred dollars ($100.00), the disbursement may be withheld until the cumulative total of
taxes collected for the City equals at least one hundred dollars ($100.00), or at the close of the month.

III.
COMPENSATION
In consideration of the services to be performed by the ASSESSOR/COLLECTOR, compensation for the services
rendered is a rate of ninety-five cents ($0.95) per account located within Tarrant County, and two- dollars and sixty cents
($2.60) per account located outside Tarrant County. The number of accounts billed will be based on the July 25 billing
roll certified to the ASSESSOR/COLLECTOR, net of subsequent account additions and deletions made by the Appraisal
District. The ASSESSOR/COLLECTOR will invoice for these accounts by January 31, 2017 with payment to be
received from the City by February 28, 2017.
The scope of services identified in this contract does not include the administration of a rollback election. In the event of

a successful rollback election, these costs incurred by the Tarrant County Tax Office will be separately identified, billed,
and paid by the entity,
IV.
A UDITS
The ASSESSOR/COLLECTOR will provide to the City auditor necessary explanations of all reports and access to
ASSESSOR/COLLECTOR in -house tax system computer terminals to assist the City auditor in verifying audit samples
of the financial data previously provided by the ASSESSOR/COLLECTOR during the past audit period. Additional
support for entity verification or entity auditor verification is not a part of this contract. Each request for support will be
reviewed individually. Costs for providing audit support will be determined by the ASSESSOR/COLLECTOR and will
be charged to and must be paid by the City.
V
TAX RATE REQUIREMENT
The City will provide the ASSESSOR/COLLECTOR, in writing, the City's newly adopted tax rate and
exemption schedule to be applied for assessing purposes by Friday, September 16, 2016. Under authority of
Section 31.01 (h) of the Property Tax Code, any additional cost of printing and mailing tax statements because of late
reporting of the tax rate or the exemption schedule will be charged to and must be paid by the City.
The tax rate and the exemption schedule for each of the last five (5) years in which an ad valorem tax was levied, or all
prior years where there remains delinquent tax, must be furnished in writing to the ASSESSOR/COLLECTOR at the
time of the initial contract.
vi.
COMPLIANCE WITHAPPLICABLE
STATUTES, ORDINANCES, AND REGULATIONS
In performing the services required under this Agreement, the ASSESSOR/COLLECTOR shall comply with all
applicable federal and state statutes, final Court orders and Comptroller regulations. If such compliance is impossible for
reasons beyond its control, the ASSESSOR/COLLECTOR shall immediately notify the City of that fact and the reasons
therefore.
VII.
DEPOSIT OF FUNDS
All funds collected by the ASSESSOR/COLLECTOR in the performance of the services stated herein for the City shall
be promptly transferred to the account of the City at the City's depository bank. All payments to entities will be made
electronically by the automated clearing house (ACH). The ASSESSOR/COLLECTOR has no liability for the funds
after initiation of the ACH transfer of the City's funds from the COUNTY Depository to the City's designated
depository.
vIIL
INVESTMENT OF FUNDS
The City hereby agrees that the COUNTY, acting through the COUNTY Auditor, may invest collected ad valorem tax
funds of the City during the period between collection and payment. The COUNTY agrees that it will invest such funds
in compliance with the Public Funds Investment Act. The COUNTY further agrees that it will pay to the City all interest
or other earnings attributable to taxes owed to the City. All parties agree that this Agreement will not be construed to
lengthen the time period during which the COUNTY or the ASSESSOR/COLLECTOR may hold such funds before
payment to the City.
IX.
REFUNDS
Refunds will be made by the ASSESSOR/COLLECTOR except as set forth herein. The ASSESSOR/COLLECTOR
will advise the City of changes in the tax roll which were mandated by the appropriate Appraisal District.
The ASSESSOR/COLLECTOR will not make refunds on prior year paid accounts unless the prior year paid accounts

for the past five (5) years are provided to the ASSESSOR/COLLECTOR.
All refunds of overpayments or erroneous payments due, but not requested, and as described in Section 31.11 of the
Texas Property Tax Code, will after three years from the date of payment, be proportionately disbursed to those entities
contracting with the ASSESSOR/COLLECTOR. The contract must have been in force, actual assessment and collection
functions begun and the tax account was at the time of the over or erroneous payment within the City's jurisdiction. The
proportional share is based upon the City's percent of the tax account's total levy assessed at the time of receipt of the
over or erroneous payment.
In the event any lawsuit regarding the collection of taxes provided for in this agreement to which the City is a party, is
settled or a final judgment rendered, and which final judgment is not appealed, and the terms of such settlement
agreement or final judgment require that a refund be issued by the City to the taxpayer, such refund shall be made by
ASSESSOR/COLLECTOR by debiting funds collected by ASSESSOR/COLLECTOR on behalf of the City and
remitting such refund to the taxpayer in conformity with the terms of the settlement agreement or final judgment.
X.
DELINQUENT COLLECTIONS
The ASSESSOR/COLLECTOR will assess and collect the collection fee pursuant to Sections, 33.07, 33.08, 33.11 and
33.48 of the Property Tax Code, when allowed. The ASSESSOR/COLLECTOR will collect attorney fees that are
specified by the City through written agreement with a delinquent collection Attorney. The ASSESSOR/COLLECTOR
will disburse the amount directly to the City for compensation to a Firm under contract to the City.
If the delinquent collection Attorney contracted by the City requires attendance of ASSESSOR/COLLECTOR personnel
at a court other than the District Courts in downtown Fort Worth, and the COUNTY is not a party, the employee's
expenses and proportionate salary will be the responsibility of the City and will be added to the collection expenses and
charged to the City.
The ASSESSOR/COLLECTOR will not be responsible for the collection of prior year delinquent accounts unless all
delinquent accounts information is provided to the ASSESSOR/COLLECTOR.
Xl.
TERM OFAGREEMENT
This Agreement shall become effective as of the date hereinabove set out, and shall continue in effect during the 2016
tax year, unless sooner terminated by providing sixty (60) day written notice, as outlined in paragraph XII.
XIL
NOTICES
Any notices to be given hereunder by either party to the other may be effected, in writing, either by personal delivery or
by mail, registered or certified, postage prepaid with return receipt requested. Mailed notices shall be addressed to the
address of the parties as they appear in the introductory paragraph of this Agreement, but each party may change this
address by written notice in accordance with this paragraph.

XIII.
MISCELLANEOUS PROVISIONS
This instrument hereto contains the entire Agreement between the parties relating to the rights herein granted and
obligations herein assumed. Any oral representations or modifications concerning this instrument shall be of no force or
effect,
This Agreement shall be construed under and in accordance with the laws of the State of Texas, and all obligations of the
parties created hereunder are performable in Tarrant County, Texas.
This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective legal
representatives and successors.
In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal,
or unenforceable in any respect, such invalidity, illegality, or enforceability shall not affect any other provision hereof
and this Agreement shall be construed as if such invalid, illegal, or unenforceable provisions had never been contained.
This Agreement and the attachments hereto constitutes the sole and only agreement of the parties hereto and supersedes
any prior understandings or written or oral agreements between the parties respecting the within subject matter.

Summary:
The 2015 -16 budget included the replacement of three motorcycles for the North
Richland Hills (NRH) Police Department. It is being recommended to purchase these
motorcycles from American Eagle Harley- Davidson.
General Description:
In the 2015 -16 adopted budget, Council allocated funding for the replacement of three
Harley- Davidson police motorcycles assigned to the traffic division of the NRH Police
Department. The quote included the cost for three new Harley- Davidson motorcycles,
extended warranty policy, and labor to remove equipment from the old motorcycles and
install the equipment on the new motorcycles.
Notice of the City's intent to bid was advertised in local newspapers, as required by
State statute, and posted on the City's Website. Four vendors were contacted and
requested to participate in this bid process. Only two of those vendors submitted bids
by the extended due date. After reviewing the bids received, staff recommends
awarding bid number 16 -021 to American Eagle Harley- Davidson for the amount not to
exceed $72,856.02.

Harley- Davidson motorcycles are the preferred motorcycle for law enforcement. The
new police motorcycles will be used by the Police Department for traffic enforcement
and response to traffic accidents.
The Police Department has eight (6 front - line /2 reserve) Harley- Davidson motorcycles assigned
to the traffic division. Currently, the Fleet Services department does not perform service
or repairs to the NRH police motorcycles due to the lack of training. Therefore, all
scheduled and unscheduled repairs involving the NRH motorcycle fleet are outsourced

Summary:
The 2015 -16 budget included the replacement of vehicles for the Police Department,
Neighborhood Services, Finance, and Parks. It is being recommended to purchase
these vehicles from Sam Pack's Five Star Ford.
General Description:
In the 2015 -16 budget, funding was approved for the replacement of several vehicles.
The table below identifies ten new replacement vehicles for Council's consideration.
Two of the older vehicles are being replaced with hybrids (Hybrid Sedan and C -Max
Hybrid):

All of the vehicles being recommended for replacement have reached the end of their
respective life cycles (6 to 15 years) as outlined within the Vehicle Equipment
Replacement Plan. Due to current age and usage, continued repair and upkeep on
these vehicles is no longer cost - effective.
The City of North Richland Hills is a member of several inter -local groups and utilizes
existing contracts with vendors through the Local Government Purchasing
Cooperatives. The Local Government Code states that purchases made through a
cooperative purchasing agreement satisfy any State law that would require the City to
solicit competitive bids.
Sam Pack's Five Star Ford has submitted quotes using State of Texas contract #071 -
072-AT 2014 totaling $304,994.90 for nine of the vehicles and HGAC contract #VE11-

15 for one vehicle totaling $24,765.75. The HGAC contract offered a deeper discount
than the State of Texas contract on the C -Max Hybrid. The City has conducted
previous business with Sam Pack's Five Star Ford with good results.
The city currently does not have any hybrid vehicles. The two vehicles being
recommended as hybrids are generally low mileage and low speed vehicles. One is for
Neighborhood Services and one is for Finance (the mail vehicle). The hybrid vehicles
cost on average about $4,300 more than a standard gasoline vehicle. However, the
hybrid vehicles do get approximately twice the miles per gallon in fuel economy. In a
typical situation the savings in fuel will offset the additional money paid up front just
before its time to replace it.
Recommendation:
Approve purchase of Police Department vehicles, hybrid vehicles, and medium -duty
truck from Sam Pack's Five Star Ford in the amount of $329,760.65.

a request from Spry Surveyors for a Zoning Change from R-1 -S Special
Single Family to R -1 Single Family on 0.463 acres located in the 7200
block of Bursey Road.
Presenter: Clayton Husband, Principal Planner
Summary:
On behalf of property owner Bob Griggs, Spry Surveyors is requesting approval of a
zoning change from R -1 -S Special Single Family Residential to R -1 Single Family
Residential on a 0.46 -acre portion of property in the 7200 block of Bursey Road.
General Description:
The proposed 20,151 square foot area for the zoning change is accessible to Bursey
Road and is currently part of a larger 4 -acre lot accessed off of Londonderry Drive to the
south. The purpose of the zoning change request is to separate this area from the
larger lot and develop it with a new single family residence facing Bursey Road.
Because the proposed lot area is less than the minimum 1 -acre required for the R-1 -S
District, the zoning change is required. The R -1 District is a common district along this
stretch of Bursey Road.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation provides for traditional low- density
single - family detached dwelling units.
CURRENT ZONING: The property is currently zoned R -1 -S Special Single Family
Residential and is part of a larger 4 -acre property.
PROPOSED ZONING: The proposed zoning is R -1 Single - Family Residential. The R -1
district is intended to provide areas for very low density development of single - family
detached dwelling units that are constructed at an approximate density of 2.9 units per
acre. If approved, the minimum dwelling unit size would be 2,300 square feet.

PROPERTY LOCATED IN THE 7200 BLOCK OF BURSEY ROAD FROM
R- 1- S(SPECIAL SINGLE FAMILY RESIDENTIAL) TO R- 1(SINGLE
FAMILY RESIDENTIAL) ZONING; PROVIDING THAT THIS ORDINANCE

WHEREAS, the City of North Richland Hills, Texas is a home -rule municipality located
in Tarrant County, Texas acting under its charter adopted by the
electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS, the Zoning Ordinance of the City of North Richland Hills regulates and
restricts the location and use of buildings, structures, and land for trade,
industry, residence, and other purposes, and provides for the
establishment of zoning districts of such number, shape, and area as may
be best suited to carry out these regulations; and
WHEREAS, the owner of the property containing approximately 0.463 acres of land
more fully described on Exhibit "A" and shown on Exhibit "B" attached
hereto, located in the 7200 Block of Bursey Road (the "Property ") has
filed an application to rezone the Property from its present classification of
R -1 -S (special single family residential) to R- 1(single family residential);
and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on April 21, 2016, and the City Council of the
City of North Richland Hills, Texas, held a public hearing on May 9, 2016
with respect to the zoning change described herein; and
WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland
Hills, and all other laws dealing with notice, publication, and procedural
requirements for rezoning the Property; and

WHEREAS, upon review of the application, and after such public hearing, the City
Council finds that granting the request herein furthers the purpose of
zoning as set forth in the Zoning Ordinance of the City of North Richland
Hills and that the zoning change should be granted, subject to the
conditions imposed herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF
NORTH RICHLAND HILLS, TEXAS:
Section 1: That the Zoning Ordinance of the City of North Richland Hills is hereby
amended by rezoning from R -1 -S (special single family residential) to R-
1(single family residential) a 0.463 acre tract out of Lot 2R2, Block 1,
Double K. Ranch Addition, North Richland Hills, Tarrant County, Texas,
commonly referred to as located in the 7200 block of Bursey Road as
described on Exhibit "A" and shown on Exhibit "B," attached hereto and
incorporated for all purposes.
Section 2: That the official zoning map of the City of North Richland Hills is amended
and the Planning Manager is directed to revise the official zoning map to
reflect the approved R -1 (residential) zoning, as set forth above.
Section 3: The use of the property described above shall be subject to all applicable
regulations contained in the Building and Land Use Regulations and all
other applicable and pertinent ordinances of the City of North Richland
Hills.
Section 4: The zoning district as herein established has been made in accordance
with a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such code, in which
event the conflicting provisions of such ordinances and such code are
hereby repealed.
Section 6: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance
are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining sections, paragraphs, sentences,
clauses, and phrases of this Ordinance, since the same would have been

enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase.
Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final
conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation,
both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be
prosecuted until final disposition by the courts.
Section 9: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 10: This ordinance shall be in full force and effect immediately after passage
AND IT IS SO ORDAINED.

Mark Wood, 6617 Precinct Line Road, North Richland Hills, 76182 stated he was here
on behalf of property owners Dr. Bob and Susan Griggs. Mr. Wood provided details of
both the Zoning Change and Final Plat cases including information about the variance
requested for the sewage facility requirements.
Vice Chairman Schopper asked if there were any questions for Mr. Wood.
Commissioner Mike Benton asked if the applicants had run any percolation tests related
to the proposed septic tank.
Mr. Wood responded no, they have not. He stated that the owner understands that
approval of a variance for septic would be made subject to meeting Tarrant County
guidelines, otherwise the sewer line would have to be extended.
Planning Manager Comstock summarized the staff report for both requests and
discussed the variance request to Section 110 -365 of the North Richland Hills

Chairman Randall Shiflet asked if the recommendation for denial was because of the

Summary:
On behalf of property owner Bob Griggs, Spry Surveyors is requesting approval of a
replat for Lots 2R1 & 2R2, Block 1, Double K Ranch Addition in the 7200 block of
Bursey Road and Londonderry Drive. A variance to Section 110 -365 is also being
requested to support the use of a septic system.
General Description:
The 4.138 -acre property is currently developed with a 10,925 square foot single family
home addressed at 7229 Londonderry Drive. The property, however, extends two
blocks north and has 88.3 feet of frontage along Bursey Road. The property owner
wishes to subdivide his property to create a new developable lot along Bursey Road.
The new proposed Lot 2R2 would be 0.46 -acre in size, whereby reducing the larger Lot
2R1 to 3.68 acres. A zoning change request to R -1 is being considered concurrently for
the new Lot 2R2 to address the new lot size.
VARIANCE REQUESTED: The applicant has requested a variance to Section 110 -365
of the Subdivision Ordinance regarding sewage facility requirements for the purpose of
allowing a septic sanitary system on Lot 2R2 of this plat. The section states:
The developer shall furnish, install, construct, or extend, at his own
expense, sewage collection facilities necessary for the proper
development of the subdivision. The sewage system shall provide
individual service to every lot in the subdivision. All sewer mains
constructed within the proposed subdivision shall be extended to the
perimeter of the proposed subdivision to allow for future extension of the
sewer system into adjacent properties regardless of whether or not such
extensions are required for service within the subdivision. The sewage
system shall be designed and constructed in accordance with the
specifications contained in the design manual. Where considered
necessary by the public works director, the facilities shall be sized in
excess of that dictated by the design manual, to provide for the future
growth and expansion of the city systems. All sanitary sewer installations

shall be in conformance with the city's wastewater system capital
improvements plan.
Furthermore, Section 1 -03(E) of the Public Works Design Manual provides criteria for
alternate sewage systems (i.e. septic systems). Where public sanitary sewer systems
are not within 300 feet of the plat, alternate sewer systems may be approved if the
existing city sanitary sewer is not and cannot feasibly, in the opinion of the Public Works
Department, be made available to the area of the development. The property has two
feasible options for connecting to the City's public sewer system. A public sewer line
terminates 247 feet east along Bursey Road. Another line is available in Wexford Court
approximately 237 feet from the subject property.
Because of the proximity to existing sewer facilities and the size of the lot (less than '/2-
acre), the Public Works Department cannot approve the use of a septic sanitary system
on the proposed Lot 2R2. It must be approved by City Council through the subdivision
variance request process.
COMPREHENSIVE PLAN: The Comprehensive Plan classifies this area as "Low
Density Residential." This designation provides areas for the development of traditional,
low- density single - family detached dwelling units.
THOROUGHFARE PLAN: The development has frontage on Bursey Road, classified
as a C4U Major Collector roadway with 68 feet of right -of -way and a design speed of
30 -40 MPH. No additional right -of -way is required of this property for Bursey Road.
CURRENT ZONING: R -1 -S Special Single Family. A zoning change request is being
considered concurrently, which would change the proposed Lot 2R2 (20,151 square
feet) along Bursey Road to R -1 Single Family. The proposed replat is consistent with
the R -1 and R-1 -S zoning districts for their respective lots as proposed.

2.66 acres at 8500 Clay Hibbins Road for the purpose of expanding the previously -
approved Fresh Meadows residential development from 35 lots to 46 lots. This
proposed zoning change request has an associated Preliminary Plat case being
considered on the same agenda.
General Description:
The 2.66 -acre property under consideration is currently unoccupied, but has a metal
accessory building of approximately 5,400 square feet. The property has frontage on
Clay Hibbins Road and is across from residential lots one acre and greater located
within the City of Keller. Tree cover primarily exists along the common property line
along Clay Hibbins Road.
City Council approved the R -2 zoning for the Fresh Meadows residential subdivision in
November 2015. The plan called for 35 lots on 11 acres. This additional 2.6 acres
would add 11 more residential home sites to the development for an overall project of
46 lots on 13.54 acres, or 3.4 dwelling units per acre.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation provides for traditional low- density
single - family detached dwelling units.
CURRENT ZONING: The property is currently zoned AG Agricultural.
PROPOSED ZONING: The proposed zoning is R -2 Single - Family Residential. The R -2
zoning district is intended to provide areas for low- density development of single - family
residences that are constructed at an approximate density of 4.0 units per acre, a
minimum lot size of 9,000 square feet, and a minimum home size of 2,000 square feet.

AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS, TEXAS
AMENDING THE ZONING ORDINANCE OF THE CITY OF NORTH
RICHLAND HILLS, AND THE ZONING MAP OF THE CITY OF NORTH
RICHLAND HILLS, TEXAS BY REZONING A 2.66 ACRE TRACT OF
PROPERTY LOCATED AT 8500 CLAY HIBBINS ROAD FROM
AG(AGRICULTURE) TO R- 2(SINGLE FAMILY RESIDENTIAL) ZONING;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF
ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, the City of North Richland Hills, Texas is a home -rule municipality located
in Tarrant County, Texas acting under its charter adopted by the
electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Local Government Code; and
WHEREAS, the Zoning Ordinance of the City of North Richland Hills regulates and
restricts the location and use of buildings, structures, and land for trade,
industry, residence, and other purposes, and provides for the
establishment of zoning districts of such number, shape, and area as may
be best suited to carry out these regulations; and
WHEREAS, the owner of the property containing approximately 2.66 acres of land
shown on Exhibit "A" attached hereto, located at 8500 Clay Hibbins Road
(the "Property ") has filed an application to rezone the Property from its
present classification of AG (agriculture) to R -2 (single family residential);
and
WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills,
Texas held a public hearing on April 21, 2016, and the City Council of the
City of North Richland Hills, Texas, held a public hearing on May 9, 2016
with respect to the zoning change described herein; and
WHEREAS, the City has complied with all requirements of Chapter 211 of the Local
Government Code, the Zoning Ordinance of the City of North Richland
Hills, and all other laws dealing with notice, publication, and procedural
requirements for rezoning the Property; and
WHEREAS, upon review of the application, and after such public hearing, the City
Council finds that granting the request herein furthers the purpose of
zoning as set forth in the Zoning Ordinance of the City of North Richland
Ordinance No. 3407

Hills and that the zoning change should be granted, subject to the
conditions imposed herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYOF
NORTH RICHLAND HILLS, TEXAS:
Section 1: That the Zoning Ordinance of the City of North Richland Hills is hereby
amended by rezoning from AG (agriculture) to R- 2(single family
residential) a 2.66 acre tract known as Lot 2, Block 1, Barrett - Andrews
Addition, North Richland Hills, Tarrant County, Texas, commonly referred
to as 8500 Clay Hibbins Road, as shown on Exhibit "A," attached hereto
and incorporated for all purposes.
Section 2: That the official zoning map of the City of North Richland Hills is amended
and the Planning Manager is directed to revise the official zoning map to
reflect the approved R -2 (residential) zoning, as set forth above.
Section 3: The use of the property described above shall be subject to all applicable
regulations contained in the Building and Land Use Regulations and all
other applicable and pertinent ordinances of the City of North Richland
Hills.
Section 4: The zoning district as herein established has been made in accordance
with a comprehensive plan for the purpose of promoting the health, safety,
morals and general welfare of the community.
Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except when the provisions of this Ordinance are in direct
conflict with the provisions of such ordinances and such code, in which
event the conflicting provisions of such ordinances and such code are
hereby repealed.
Section 6: It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses, and phrases of this Ordinance
are severable, and if any section, paragraph, sentence, clause, or phrase
of this Ordinance shall be declared unconstitutional by the valid judgment
or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining sections, paragraphs, sentences,
clauses, and phrases of this Ordinance, since the same would have been
enacted by the City Council without the incorporation in this Ordinance of
any such unconstitutional section, paragraph, sentence, clause or phrase.
Section 7: Any person, firm or corporation violating any provision of the Zoning
Ordinance and the zoning map of the City of North Richland Hills as
amended hereby shall be deemed guilty of a misdemeanor and upon final

conviction thereof fined in an amount not to exceed Two Thousand Dollars
($2,000.00). Each day any such violation shall be allowed to continue shall
constitute a separate violation and punishable hereunder.
Section 8: All rights and remedies of the City of North Richland Hills are expressly
saved as to any and all violations of the provisions of any ordinances
governing zoning that have accrued at the time of the effective date of this
Ordinance; and, as to such accrued violations and all pending litigation,
both civil and criminal, whether pending in court or not, under such
ordinances, same shall not be affected by this Ordinance but may be
prosecuted until final disposition by the courts.
Section 9: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clause of this ordinance
two times.
Section 10: This ordinance shall be in full force and effect immediately after passage
AND IT IS SO ORDAINED.

Osama Nashed with ANA Consultants, 5000 Thompson Terrace, Colleyville, stated that
his company requested a zoning change and plat for this area last year. The City
Council at that time requested that the whole area be secured for development instead
of taking a piecemeal approach. Mr. Nashed stated that adding this property will provide
three exits instead of two and this property will be a good addition to the subdivision.
Vice Chairman Schopper opened the Public Hearing for ZC 2016 -05 at 7:49 p.m.
Seeing no one wishing to speak, Vice Chairman Schopper closed the Public Hearing for

Summary:
On behalf of the owner, Davis /Mockingbird NRH Ltd., PSI Atlantic Richland Hills LLC is
requesting approval of a replat of Lot 1R, Block 2, Red Gate Addition. The property is
located on the east side of Davis Boulevard and north of Mockingbird Lane. The plat is
complete and meets the requirements of the zoning ordinance and subdivision
regulations.
General Description:
The final plat for Red Gate Addition was approved in 1987. Over time, several land
swaps occurred between this property and the La Casita Manufactured Home
Community property (Holiday East Mobile Home Park Addition) to adjust the common
property line due to several home sites in the park being built over the common property
line. The applicant submitted a replat in order to establish the current property boundary
for the development of the site as a self- storage facility.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Retail." This designation is intended to permit a variety of retail trade, personal
and business services establishments, and offices.
THOROUGHFARE PLAN: The property has frontage on Davis Boulevard and
Mockingbird Lane. Davis Boulevard is classified as a Principal Arterial (P6D) at this
location, which is ultimately a six -lane divided roadway with a right -of -way of 120 feet.
Mockingbird Lane is classified as a Residential street (R2U), which is a two -lane
undivided roadway with an ultimate right -of -way of 50 feet. Right -of -way dedication is
not required for this property.
CURRENT ZONING: The property is currently zoned NR -PD Non - Residential Planned
Development for the development of a self- storage facility of 606 or fewer units. The
NR -PD was approved by City Council on April 11, 2016, and it includes development
standards for the self- storage facility and establishes C -2 Commercial as the base
zoning district. The C -2 district is intended to provide for development of retail and
general business uses primarily to serve the community and region. Uses include a

Summary:
JPC Realty, LTD is requesting approval of a replat for Lots 23R & 24R, Block 1, W.E.
Odell Addition for the purpose of platting two office lots on 1.10 acres at the northwest
corner of Davis Boulevard and Odell Street.
General Description:
The proposed replat combines two existing platted lots and portions of two platted lots
into two new lots and reorients them toward Davis Blvd instead of Odell Street. The
purpose of the plat is for the development of two 4,000- square -foot office buildings on
separately platted lots.
As required by the 0-1 Office zoning district and residential adjacency standards, 25-
foot building lines are provided on both street frontages and 35 -foot building lines are
provided adjacent to residential properties. Sight visibility easements are provided at all
driveway and street intersections to keep any visual obstructions out of these

PUBLIC HEARING: The replat meets the State's requirement under Section 212.015
of the Local Government Code, for a public hearing since it has been zoned for single -
family residential uses within the past 5 years. As such, property owners included in the
W.E. Odell Addition within 200 feet of the proposed replat have been given notice of the
public hearing. Advertisement of the public hearing has also been made in the Fort
Worth Star Telegram.
While a public hearing is required, Section 212.005 of the Local Government Code still
applies. This statute states that municipalities must approve a plat that satisfies all
applicable regulations. In this particular case, no variances are being requested and the
plat meets all applicable development regulations.
PLANNING & ZONING COMMISSION: The Planning & Zoning Commission is
scheduled to hold a public hearing and consider this item at their May 5, 2016 meeting.
Staff will provide the Commission's recommendation to City Council at their May 9
meeting.

Summary:
On behalf of Lonnie and Deborah Gillilan, Robert Richards is requesting approval of an
Amended Plat to combine existing Lots 6 & 7, Block 1, Woodbert Addition into one Lot
6R. This 0.924 -acre lot is located on the north side of Woods Lane and west of Davis
Boulevard. The proposed amended plat meets the requirements of the zoning
ordinance and subdivision regulations.
General Description:
The original plat for Woodbert Addition was platted in 1946 to the Town of Smithfield.
The amended plat will combine two existing lots into a single lot for constructing a new
house on the property.
COMPREHENSIVE PLAN: The Comprehensive Plan classifies this area as "Low
Density Residential." This designation provides areas for the development of traditional,
low- density single - family detached dwelling units.
THOROUGHFARE PLAN: The development has frontage on Woods Lane, classified
as an R2U local street. Woods Lane is a two -lane undivided street with a 50 -foot wide
right -of -way. Additional right -of -way is not required from this property. Woods Lane is a
dead -end street on the west end, and future development in this area will need to
provide a connection with Sayers Lane to the south. Curbs and gutters exist on both
sides of the street. Sidewalks do not exist on Sayers Lane.
CURRENT ZONING: R -3 Single - Family Residential. This final plat is consistent with the
R -3 zoning standards.

Section 54- 102(b) for speed limits on specific streets.

Summary:
Council is being asked to approve Ordinance No. 3411 to amend speed limits on three
specific streets; State Highway 121 East and Westbound Frontage Road, Interstate
Highway 820 North and South Frontage Road, and Mid - Cities Boulevard.
General Description:
Recently the Texas Department of Transportation (TxDOT) Traffic Operations Section
conducted engineering and traffic investigations along two portions of highway frontage
roads within the City of North Richland Hills city limits. As a result of the investigations,
TxDOT recommends increasing the speed limit to 45 MPH from the existing speed
limits of 35 and 40 MPH. Attached are maps showing the limits of the recommended
speed limit changes. Basically the entire westbound frontage road will be increased to
45 MPH and the eastbound frontage will be increased to 45 MPH beginning at Holiday
Lane and continuing east to the city limit boundary. The section of the eastbound
frontage road from Rufe Snow Drive to Holiday Lane will remain as it is currently posted
today, 35 MPH.
Additionally, the City of North Richland Hills Traffic Division performed traffic studies
along Mid - Cities Boulevard between Rufe Snow Drive and Davis Boulevard and the
results indicated the existing speed limit should be increased from 35 MPH to 40 MPH.
As you may be aware the speed limit on Mid - Cities is already 40 MPH between Davis
Boulevard and Precinct Line Road, so increasing the speed limit on the section between
Rufe Snow Drive and Davis Boulevard will provide a consistent speed limit on the Mid -
Cities Boulevard corridor throughout the city.
The proposed changes to the ordinance are described below and identified on the
attached map.

AN ORDINANCE AMENDING SECTION 54.102(8) OF THE NORTH
RICHLAND HILLS CODE OF ORDINANCES; ALTERING THE PRIMA
FACIA SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE
PROVISIONS OF THE TRANSPORTATION CODE, CHAPTER 545,
SECTION 545.356, UPON CERTAIN STREETS AND HIGHWAYS, OR
PARTS THEROF, WITHIN THE CORPORATE LIMITS OF THE CITY OF
NORTH RICHLAND HILLS AS SET OUT IN THIS ORDINANCE;
ESTABLISHING A PENALTY FOR VIOLATION; PROVIDING FOR
PUBLICATION AND AN EFFECTIVE DATE.
WHEREAS, The Texas Transportation Code, Chapter 545, Paragraph 545.356m
provides that whenever the governing body of the City shall determine
upon the basis of an engineering and traffic investigation that any prima
facie speed therein set forth is greater or less than is reasonable or safe
under the conditions found to exist at any intersection or other place or
upon any part of a street or highway, with the city taking into consideration
the width and condition of the pavement and other circumstances on such
portion of said street or highway, as well as the usual traffic thereon, said
governing body may determine and declare a reasonable and safe prima
facie limit thereat or thereon, said governing body may determine and
declare a reasonable and safe prima facie speed limit thereat or thereon
by the passage of an ordinance, which shall be effective when appropriate
signs giving notice thereof are erected at such intersection or other place
or part of the street or highway.
WHEREAS, The Texas Department of Transportation (TxDOT) and The City of North
Richland Hills has performed such engineering and traffic investigation for
IH 820 FR, SH121 FR, and Mid - Cities Boulevard and has recommended
that posted speed limits be changed as herein established;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS THAT:
SECTION 1. THAT Section 54.102 (b) of the North Richland Hills Code of Ordinances
be amended to read as follows:

Subject: Consider Resolution No. 2016 -018, Approving reimbursement for
Meadow Lakes Drive extension not to exceed 1,000,000.

Summary:
The City needs to acquire rights of way and install streets for the Meadow Lakes Dr.
extension project. Approving a reimbursement resolution for these items allows the
bidding and awarding of contracts before receipt of the bond proceeds.
General Description:
To reimburse expenditures with the proceeds of future debt, a resolution must be
approved authorizing such. The Council approved similar resolutions in September
2015 and January 2016.
Certificates of obligation are anticipated to fund the extension of Meadow Lakes Dr.
from Rufe Snow eastward, identified as project PW1602. The section of Rufe Snow
south of Loop 820 between Meadow Lakes Drive and Loop 820 is experiencing severe
traffic congestion. In an effort to improve this congestion Meadow Lakes Drive will be
extended across Rufe Snow Drive and tie into Larue. This will eliminate the off -set
intersection at Larue and Meadow Lakes Drive. The estimated cost for these
improvements will be $1,000,000.
The reimbursement resolution itself does not authorize the issuance of bonds; it only
stipulates that any expenses made before the bond sale may be reimbursed with bond
proceeds. Any interim funding required will be appropriated from existing reserves and
will be repaid upon receipt of the bond proceeds. A separate agenda item regarding
"Notice of Intent" to issue certificates of obligation will be presented to Council at a later
date.

RESOLUTION NO. 2016 -018
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, DECLARING EXPECTATION TO REIMBURSE EXPENDITURES
WITH PROCEEDS OF FUTURE DEBT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of North Richland Hills, Texas (the "Issuer ") intends to issue
debt for the acquisition of real property and the installation of streets and sidewalks as
listed on Exhibit "A" (collectively, the "Project ");
WHERAS, the City further intends to make certain capital expenditures with
respect to the Project and currently desires and expects to reimburse the capital
expenditures with proceeds of such debt;
WHEREAS, under Treas. Reg. § 1.150 -2 (the "Regulation "), to fund such
reimbursement with proceeds of tax - exempt obligations, the City must declare its
expectation to make such reimbursement; and
WHEREAS, the City desires to preserve its ability to reimburse the capital
expenditures with proceeds of tax - exempt obligations; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, THAT
RFCTION 1
All of the above premises are hereby found to be true and correct legislative and
factual findings of the City of North Richland Hills, and they are hereby approved and
incorporated into the body of this Resolution as if copied in their entirety.
SECTION 2
The City reasonably expects to reimburse capital expenditures with respect to
the Project with proceeds of debt hereafter to be incurred by the City, and this resolution
shall constitute a declaration of official intent under the Regulation. The maximum
principal amount of obligations expected to be issued for the Project is $1,000,000.
SECTION 3
This Resolution shall take effect from and after the date of its passage.

Project Description
The area along Rufe Snow, south of LP 820 is severely congested that include 7 different ingress /egress points within a 700 foot
span. The project proposes the conversion of current the Rufe Snow Meadow lakes 3 way signalized intersection into a 4 way
signalized intersection that would be a separate but complimentary project to ST0102 - Rufe Snow Drive Street & Utility
Improvements, which calls for a raised median along Rufe Snow. This project would extend Meadow lakes east of Rufe Snow,
connecting to the commercial area along LP 820. The project would also eliminate 3 of the 7 ingress /egress points within the 700
foot span.
Project Justification
In January of 2012, City Council requested staff to proceed with a long term plan to reduce congestion, improve safety and enhance
mobility in this particular area. According to internal traffic counts, there are over 30,000 cars per day along Rufe Snow between
Karen Drive and LP 820, with automobiles stacking well south of Marilyn Lane during peak periods. As the LP 820 corridor
redevelops, traffic volume and improved access to and from commercial on the south side of LP 820 will be
necessary.

and alternate judges of the Municipal Court of Record.
General Description:
The City Council has adopted regulations governing its Municipal Court of Record in
Chapter 58, City of North Richland Hills Code of Ordinances. Chapter 30 of the Texas
Government Code relating to municipal courts of record provides that the judge of the
municipal court of record shall be appointed by the City Council by ordinance.
Ordinance No. 3412, appoints a judge and alternate judge for the term of two years.
Recommendation:
To approve Ordinance No. 3412.

AN ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS, TEXAS
APPOINTING THE JUDGE AND ALTERNATE JUDGES OF THE
MUNICIPAL COURT OF RECORD IN THE CITY OF NORTH RICHLAND
HILLS AND PROVIDING A SALARY; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of North Richland Hills is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Local Government Code; and
WHEREAS, the City Council has adopted regulations governing its Municipal Court of
Record in Chapter 58, Code of Ordinances, City or North Richland Hills,
Texas, as amended; and
WHEREAS, Chapter 30 of the Texas Government Code relating to municipal courts of
record provides that the judge of the municipal court of record shall be
appointed by the City Council by ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS:
SECTION 1: THAT in accordance with the Code of Ordinances of the City of North
Richland Hills, Texas, as amended, Stewart Bass is hereby appointed as
the judge of the Municipal Court of Record in the City of North Richland
Hills, Texas, for a term of two years.
SECTION 2: The Judge of the Municipal Court of record shall be paid a salary of
$74,793.00 per year which shall not be reduced during his term of office.
He shall also be allowed to participate in the City's employee group health
plan in the same manner as employees, although he shall not be deemed
an employee and shall not have any retirement or health benefits when his
term of office has expired.
SECTION 3: Glynnis McGinty and Lorraine Irby are appointed to serve as Municipal
Judge when the Judge of the Municipal Court of Record is temporarily
absent for any reason. Such judges shall be compensated by the Judge
of the Municipal Court of Record at the rate previously established by the
City for such service by alternate judges.
SECTION 4: This ordinance shall be cumulative of all provisions of ordinances and of
the Code of Ordinances of the City of North Richland Hills, Texas, as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in which
event the conflicting provisions of such ordinances and such Code are
hereby repealed.

SECTIONS: It is hereby declared to be the intention of the City Council that the
phrases, clauses, sentences, paragraphs, and sections of this ordinance
are severable, and if any phrase, clause sentence, paragraph or section of
this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, paragraphs
and sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 6: This ordinance shall be in full force and effect from and after its passage
and publication as required by law, and it is so ordained.
