HomeMy WebLinkAboutOrdinance 0865 ~ . # '~, ORDINANCE NO. 865 An ordinance providing for the disposition of stolen recovered property, abandoned property, and found property, other than motor vehicles, in the possession of the Police Department; providing a Saving Clause, pro- viding a Penal Clause, directing publication; and naming an effective date. I Be it ordained by the City Council of the City of North Richland Hills, Texas: Disposition of Stolen Recovered, Abandoned, and Found Property. SECTION 1. All stolen property, abandoned, and found property of every kind, except motor vehicles, which shall remain unclaimed with the Police Department for a period of thirty (30) days and which is not being held as evidence in a pending criminal case,without being claimed or re- claimed by the owners, whether known or not, may be sold at public auction, appropriated to the City's use, or destroyed, as required by law. ARTICLE 1. SECTION 2. The Chief of Police shall give to the City Secretary a list of all property subject to sale hereunder and shall thereafter deliver such property to the City Secretary before the date of sale and take a receipt from such City Secretary showing in detail all property so delivered. SECTION 3. Thirty days notice of the time and place of sale of all property to be offered for sale and a descriptive list of the property to be offered for sale shall be posted at the door of the Tarrant County Northeast Sub-Court House and at any regular entrance to the North Richland Hills City Hall and a copy thereof sent by registered mail to the last known address of the owner, if the name of such owner is known to the City Secretary. Thereafter, such property shall be offered for sale at public auction to the highest bidder. Such property may be sold as individual items, or assembled in lots, at the discretion of the City Secretary. Provided however, that the head of any department of the City of North Richland Hills may request, in writing, that any items offered or to be offered for sale be assigned to his or her department. The City Secretary may, at his or her discretion, assign such item or items to such department or sell such items at public auction. '·c SECTION 4. The public auction provided for in the preceding section shall be conducted at the place and hour designated in the notice, all sales shall be for cash. SECTION 5. The City Secretary shall conduct such public auction and shall keep an accurate statement of each article sold and the price bid and paid there for, and shall make a complete report in writing to the Finance Director of the time, place, and manner of conducting such sale. All funds received on account of such auction shall be delivered to the Finance Director who shall give his or her receipt therefor. SECTION 6. The Finance Director shall place all funds received by him or her under and by virtue of this Chapter to the credit of the General Fund, to be thereafter disbursed as the City Council shall order. SECTION 7. Any person violating any of the provisions of this Chapter shall be deemed guilty of a misdemeanor. In addition to the penalties otherwise provided, any officer or employee of the City violating any provision of this Chapter shall forfeit his office or employment. SECTION 8. If any section, sub-section, sentence, clause, or phrase of this ordinance is held for any reason to be invalid, such decision shall not affect the validity of the re- maining portion of this Code. SECTION 9. Any person violating any of the provlslons of this ordi- nance shall be deemed guilty of a misdemeanor and shall be punished by a fine not to exceed two hundred ($200.00). SECTION 10. The City Secretary is hereby directed to publish the caption, penalty clause and effective date of this ordi- nance for five (5) days in the newspaper of genreal circulation in the City of North Richland Hills. SECTION 11. This ordinance shall be in full force and effect from and after the date of its passage and publication as required by law and it is so ordained.
