REGULAR MEETING
The City Council of the City of North Richland Hills, Texas met as the Landscape Review
Board on the 27th day of June 2016 immediately following the 7:00 p.m. City Council meeting.

Chair Trevino called the meeting to order June 27, 2016 at 7:59 p.m.

2.2 LRB 2016 -02, PUBLIC HEARING AND CONSIDERATION OF A REQUEST
FROM ATHLOS ACADEMIES FOR A VARIANCE TO CHAPTER 114 -
VEGETATION OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES
AT 4131 RUFE SNOW DRIVE.

Chair Trevino opened the public hearing and called on Principal Planner Clayton Husband to
introduce the item.
Principal Planner Clayton Husband informed Council the applicant Athlos Academies is
requesting a variance from the landscaping and buffering standards on 12.847 acres located
at the northwest corner of Rufe Snow Drive and Glenview Drive.
Applicant representative Adam Zaragoza with Athlos Academies, 918 S. 9th Street, Bose
Idaho came forward. Mr. Zaragoza stated that he has read the staff report and was agreeable
to the recommendations made. He was available to answer any questions.
Mr. Husband presented staff's report. The standard buffer requirements for the west and north
property lines are a 15 -foot buffer yard and one large tree per 30 linear feet. The applicant has
met the 15 -foot buffer requirement on both the west and north property line but is seeking a
waiver of the 22 required trees on the west property line due to a gas pipeline and easement
and requesting substitution of 44 ornamental trees for the 22 large trees on the north property
line due to overhead utility lines.
Development Review Committee recommended the following:
1. Compliance with current standards in the north buffer yard. The standards for buffer yards
require that one large tree be planted for each 30 linear feet of buffer yard area, with 40% of
the trees being an evergreen species. While the standards allow for the substitution of two
small trees for one large tree in the setback adjacent to a street, it does not apply to the buffer
yard. Given the height of the utility lines, careful maintenance of either large or small trees will
be a continual process.
2. Plant 16 additional large trees on site to mitigate the number of trees lost in the west buffer
yard. The restrictions on landscaping within the gas pipeline easement causes a reduction of
22 trees planted on the site. Staff has identified landscape areas on the property where 16
large trees could be added, which would result in a net loss of only six trees on the site.

Chair Trevino called for anyone wishing to speak for or against the request to come forward.
There being no one wishing to speak, Chair Trevino closed the public hearing and called for
the motion.
COUNCIL MEMBER WELCH MOVED TO APPROVE LRB 2016 -02, SUBJECT TO THE
DEVELOPMENT REVIEW COMMITTEE'S RECOMMENDATIONS. COUNCIL MEMBER
RODRIGUEZ SECONDED THE MOTION.
MOTION TO APPROVE CARRIED 5 -0.
3. ADJOURNMENT
Chair Trevino adjourned the meeting at 8:05 p.m.
