SEPTEMBER 1, 2016
The Substandard Building Board of the City of North Richland Hills, Texas met on the
1 st day of September 2016 at 2:00 p.m. in the Council Workroom.

Chairman Crowson called the meeting to order at 2:00 p.m.
2. APPROVAL OF MINUTES OF THE JUNE 16, 2016 SUBSTANDARD
BUILDING BOARD MEETING.
MR. ROBERT MCCARY MOVED TO APPROVE THE MINUTES OF THE JUNE 16, 2016
SUBSTANDARD BUILDING BOARD MEETING. MR. THOMAS MOREAU SECONDED THE MOTION.

3. SSB2016 -61 PUBLIC HEARING AND CONSIDERATION WHETHER THE
STRUCTURE ON THE PROPERTY LOCATED AT 8250 BEDFORD EULESS
ROAD KNOWN AS BLOCK 1, LOT 1A, BENNIGANS ADDITION, NORTH
RICHLAND HILLS, TARRANT COUNTY, TEXAS IS SUBSTANDARD WITHIN
THE MEANING OF THE CITY'S ORDINANCES AND ORDER REPAIR OR
DEMOLITION.
APPROVED
Chairman Crowson called on Code Enforcement Officer Kevin Goodpaster to present
the item.
Mr. Goodpaster provided the Board with an overview of action taken to date for the
structure located at 8250 Bedford Euless Road.
• A Minimum Standards Notice was issued on February 10, 2015;
• Interior and exterior inspection was conducted on February 26, 2015;
• Title Search completed in March 2015
• A notice and order was mailed by certified mail on April 9, 2015;
• Notice of public hearing was signed on May 11, 2015;
• Notice of public hearing was filed in the Tarrant County Deed Records on May
14,2015-1
o That case was subsequently tabled for 90 days to allow the owner time to
complete the repairs;
• Notice of public hearing was mailed certified on August 5, 2015;
• Notice of public hearing was filed in the Tarrant County Deed Records on August
7,2015-1
• The SBB assessed a $91,000 civil penalty for failure to repair the structure timely
on August 27, 2015;
• Notice and Order was mailed certified on July 12, 2016;
• Notice of public hearing was mailed certified on August 18, 2016;
• Notice of public hearing was posted on the front door of the structure on August
15, 2016;
• Notice of public hearing was listed in the Legal Notices section of the Fort Worth
Star - Telegram on August 19, 2016.
• Notice of public hearing was filed in the Tarrant County Deed Records on August
18, 2016;
Mr. Goodpaster reported that he found the following outstanding violations upon
inspection of the structure. Photos from the initial inspection in 2015 and current photos
were presented

• Sec. 98 -462 (h) Faulty weather protection. Buildings or portions thereof shall be
considered substandard when they have faulty weather protection which shall
include, but not be limited to, the following:
o (2) Deteriorated or ineffective waterproofing of exterior walls, roof,
foundations or floors, including broken windows or doors. Photos showed
ineffective waterproofing of exterior walls and broken windows.
o (3) Defective or lack of weather protection for exterior wall coverings,
including lack of paint, or weathering due to lack of paint or other approved
protective covering. Photo showed missing trim at front entry, damaged
wood trim at window.
o (4) Broken, rotted, missing, split or buckled exterior walls or wall coverings
or roof coverings. Photos showed evidence of a roof leak due to faulty
weather protection.
• Sec. 98 -462 (e) Hazardous electrical wiring. Electrical wiring which was installed
in violation of code requirements in effect at the time of installation or electrical
wiring not installed in accordance with generally accepted construction practices
in areas where no codes were in effect or which has not been maintained in good
condition or which is not being used in a safe manner shall be considered
substandard. Photos showed damaged electrical lines as well as exposed wiring.
• Sec. 98 -462 (g) Hazardous mechanical equipment. Mechanical equipment which
was installed in violation of code requirements in effect at the time of installation
or mechanical equipment not installed in accordance with generally accepted
construction practices in areas where no codes were in effect or which has not
been maintained in good and safe condition shall be considered substandard.
Photos showed damaged water heaters and electrical panel.
• Sec. 98 -462 (i) Fire Hazard. Any building or portion thereof, device, apparatus,
equipment, combustible waste or vegetation which, in the opinion of the chief of
the fire department or the fire marshal, is in such a condition as to cause a fire or
explosion or provide a ready fuel to augment the spread and intensity of fire or
explosion arising from any cause shall be considered a substandard building.
Photo showed storage of materials and missing firewalls or sheetrock/fire
suppression.
• Sec. 98 -463 (b) Commencement of proceedings. Whenever the building official or
director of neighborhood services has inspected or caused to be inspected ay
building, and has found and determined that such building is:
o (2) Regardless of its structural condition, unoccupied by its owners,
lessees, or other uninvited persons as a place of harborage, or could be
entered or used by children; or
o (3) Boarded up, fenced, or otherwise secured in any manner if:
• A. The building constitutes a danger to the public even though
secured from entry; or
• B. The means used to secure the building are inadequate to prevent
unauthorized entry or use of the building in the manner described
by subsection (b)(2) directly above, the building official or director of

neighborhood services shall commence proceedings to cause the
repair, rehabilitation, vacation, removal or demolition of the building.
o Photo showed the building shell with ladders, missing windows and walls
sections and cement forms.
Mr. Goodpaster advised the Board that staff recommends the structures be:
o found substandard, and
o order all required permits be obtained witihin 15 days of the board order,
and
o the building repaired or demolished within 30 days of the board order; and
o allow lienholder to be granted 30 days to repair or demolish the structures
if property owner fails to bring property into compliance; and
o authorize the city to demolish the structures.
Mr. Crowson asked Mr. Goodpaster to clarify the dates listed in the presentation. In
response to Chairman Crowson's question, Mr. Goodpaster informed the Board that
permits had been obtained recently to the hearing and that the repairs were slow - going.
Mr. Crowson asked if the permits were obtained following the August 2015 hearing.
Building Official Dave Pendley spoke and testified that the permits had not been
approved recently to the hearing. Mr. Pendley referred to a few exchanges of data and
information delaying the permit. Mr. Pendley referenced the tower description on the
plans; he discussed the Landscape Review Board requirements and a number of delays
and meetings with the contractor.
Mr. Parks asked a question about the civil penalty which was answered by Director
Stefanie Martinez.
Mr. McCary asked if the owner had given a date of completion. Mr. Pendley responded
that the contractor had stated at previous meetings that he had other projects that were
to begin at the beginning of the new year. It was presumed that the project would be
complete by the end of this year.
Chairman Crowson opened the public hearing and asked for anyone wishing to speak
on the item to come forward. No one appeared on behalf of the owner and the public
hearing was closed. The Board members had open discussion.
MR. THOMAS MOREAU MOVED TO ENTER THE FOLLOWING ORDER FOR SSB2016 -61
DETERMINING THAT PROPERTY LOCATED AT 8250 BEDFORD EULESS ROAD KNOWN AS BLOCK
1, LOT 1A, BENNIGANS ADDITION, NORTH RICHLAND HILLS, TARRANT COUNTY, TEXAS, IS A
COMMERCIAL STRUCTURE HEREBY FOUND TO BE A SUBSTANDARD BUILDING BY REASON OF
CONDITIONS SET FORTH IN THE NOTICES OF THIS HEARING AND SUCH NOTICES ARE HEREBY
INCORPORATED IN THIS ORDER AND IT SHALL BE REPAIRED WITHIN THIRTY (30) DAYS; AND

FURTHER ORDER THE OWNER TO OBTAIN PERMITS WITHIN FIFTEEN (15) DAYS; ALL REQUIRED
REPAIRS MUST BE COMPLETED WITHIN THIRTY (30) DAYS; IF PROPERTY OWNER(S) FAILS TO
REPAIR OR DEMOLISH THE STRUCTURES THE LIENHOLDER HAS THE SAME TIME AS PROVIDED TO
THE PROPERTY OWNER. SHOULD BOTH THE OWNER AND LIENHOLDER FAIL TO BRING THE
PROPERTY INTO COMPLIANCE THE CITY BE AUTHORIZED TO DEMOLISH THE STRUCTURES. A
LIEN WILL BE PLACED ON THE PROPERTY FOR ALL COSTS INCURRED IF THE CITY DEMOLISHES
THE STRUCTURE. MR. THOMAS OSEN SECONDED THE MOTION.
MOTION TO APPROVE CARRIED 6 -0.
