RRO AN ORDINANCE PROVIDING FOR THE MARKING OF OFF-STREET PARKING FOR HANDI- ÇAPPED PERSONS; PROVIDING FOR THE USE OF SUCH SPACES BY AUTOMOBILES WITH SPECIAL LICENSE PLATES, TAGS OR DEVISES ISSUED BY THE STATE OF TEXAS FOR DISABLED VETERANS AND DISABLED PERSONS; PROHIBITING THE PARKING OF ANY OTHER VEHICLES IN SUCH SPACES; PROVIDING FOR THE TOWING OF ALL SUCH VEHICLES NOT HAVING SPECIAL LICENSES; PROVIDING A PENALTY AND ESTABLISH- ING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of North Richland Hills, Texas has been requested by merchants providing handicapped parking and by handicapped persons generally to make ordinance provisions for the limit- ing of certain parking spaces to the handicapped. WHEREAS, the State of Texas has provided for special licenses and tags for disabled persons and disabled veterans by ART. 6675-5e and 6675-5e.1., Texas Revised Civil Statutes; now therefore, Be it ordained by the City Council of the City of North Richland Hills, Texas: SECTION 1. Marking Handicapped Spaces: Upon the request of the owner or operator of any off-street parking facility, the Police Department of the City is authorized to designate stalls or spaces in an off-street parking facility for the exclusive use of vehicles which display distinguishing license plate, specially designed symbols, tags, or other devices, issued pursuant to ART. 6675-5e and 6675-5e.1., Texas Revised Civil Statutes, to disabled veterans and disabled persons. Such markings shall be required for handicapped park- ing spaces under the provisions of the Zoning Ordinance of the City. SECTION 2. Parking Restricted; Towing of Unauthorized Vehicles From Handicapped Spaces. It is unlawful for the operator of any vehicle not displaying a distin- guished license plate issued to disabled persons pursuant to ART. 6675 a- 5e.1., Texas Revised Civil Statutes, or to disabled veterans pursuant to ART. 6675a - 5e, Texas Revised Civil Statutes, to stop, stand, park, or leave standing such vehicle in any parking space properly designated for the exclusive use of physically handicapped persons pursuant to the fore- going section. Such shall constitute a Class "c" Misdemeanor. Any vehicles not displaying the proper license plates, tags, or devices, may be towed from a handicapped parking space designated by the fore- going section at the expense of the owner of such vehicle, and may be impounded until all towing and storage charges are paid. - SECTION 3. Penalty Any person, firm, or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a Class "c" Misdemeanor and upon final conviction thereof fined in an amount not to exceed two hundred dollars ($200.00).
