HomeMy WebLinkAboutOrdinance 0818 ORDINANCE NO. 818 WHEREAS Article 1011g. of Vernons Annotated Civil Statutes requires the affirmative vote of four of the five me~bers of the Zoning Board of Adjustment in order to grant a variance; AND WHEREAS said Article 1011g. makes provision for the appointment of alternate members of the Zoning Board of Adjustment by charter re- vision or ordinance amendment; NOW BE IT ORDAINED by the City Council of the City of North Richland Hills that Article XXVII, Section I, first sentence of Ordinance No. 179 (Zoning Ordinance) is hereby amended to read as follows: "There is hereby created a Board of Adjustment consisting of five (5) members, and two (2) alternate members, each to be appointed by a majority of the City Council for a term of two (2) years, or until their successor has been appointed, and removable for cause by the appointing authority. The Board meets once each month. Unfortunately, the members sometimes become ill, take vacations, or need to be absent for business or other reasons. The cases dealt with by the Zoning Board of Adjustments often involve contracts with time limited contingency clauses or contracts for construction with bid expiration dates. The delay of even thirty days can cause severe financial hardship to the individuals involved. The Texas Code allows the appointment of up to four alternate members to this board who can replace members who must be absent. The proposed revision would make provision for two such members.
