OPDINANCE NO, 845 / AN ORDINJ\¡\ CE REGULATING 'illE RATFB AND GIARGES OF ALL PERSONS FIRMS, CDHPORATICNS OR ASSOCIATIC1\fS OF PERSONS ENGAGED IN 'lliE BUSINESS OF FURNISHING, DISTRIBUTING, OR DELI\lERING NATURAL GAS ro HESIDENTIAL AND Cn.1MEHCIAL CUSroMERS IN THE CITY OF NORTH RIŒLAND HIUB , TEXAS: PROVIDING A PENAL'IY ŒAUSE: AND PROVIDING AN EFFECTIVE DATE, WHEREAS, on April 23, 1980, Lone Star Gas Company made application for for a rate increase in gross annual Residential and Comnercial gas sales revenues of $4,945,934 fran its Fort Worth, Distribution System consurœrs; and, WHEREAS, public hcarings have been held on the application of Inne Star Gas Company; and, \~IEREAS, the hearings on said rate increase application have now been included and closed and the City Council has duly considered all rratters presented to it; NOW 'TIIEREFDRE, BE IT OPDAINED BY TIIE CI'IY CDUNCIL OF THE CI'IY OF -BORTH RICHI..AND HIllS TEXAS : SECT I CN 1. TI1at the City Council of the City of North Richland Hills Texas, in the exercise of its sound legislative discretion finds that the rates set out below and fixed by this Ordinance are determined to be fair, just and reasonable. The above rates are applicable to each residential and corrmercial consumcrs per meter per rrDnth or for any part of a rrDnth for which gas is used at the saræ location. 2, Bills are due and payable whcn rendcred and if not paid within 15 days of the date shown on the bill as the "present ræter reading" date or the "for service through" date, subjects the eust()tJ"ßr to imœdiate termination of gas service unless they have made other payrænt arrangerœnts with the Company. Restoration of service is subject to the Cbmpany's reasonable regulations and charges as authorized in paragraph B (5) below to include a $20.00 ReCDnnect Charge. 3, The anDunt of each rrDnthly bill computed at the above rates shall be subject to the following adjustrœnts: (a) Gas Cost Adjustrænt Each rrDnthly bill at the above rate shall be adjusted for gas cost as follows: (i) The city gate rate incre~se or decrease applicable to current hi 11 ing nnnth residential and comrercial sales shall be estimated to thc nearcst $0.0001 per ~1cf based upon: (a) A vohlJJX::> factor of 1.0142 ck>tCJmined for the distribution system as the ratio of Mcf pur- chased divided by the Mcf sold for the 12 D"Dnth period eneled ,Tune 30, 1979. , . . . 'I I 'j Page 3 - Ordinance No. (b) The city gate rate estimated to be applicable to volurœs purcha.sed during the current calendar month, expressed to the nearest $0.0001 per Mcf (shown below as "Re"). (c) The base city gate rate of $2.0279 per 1~f. (ii) Correction of the estimated adjustment deterrrrrned by (3) (a) (i) above shall be j ncluded as part of the adjustment for the second following billing ITDnth. TI1e correcting factor (shown below as "C") shall be expressed to the nearest $0.0001 per Mcf based upon: (a) The corrected adjustm:mt aITDunt based upon the actual city gate rate, less (b) 'I11e estimated adjustment aITDunt billed under (3) (a) (i) above, divided by (c) Distribution system residential and commercial sales Mcf recorded on the Company's books during the prior year for the rrDnth that the correction is included as part of the adjustment. (iii) The adjustrænt determined by (3) (a) -"(i) and (3) (a) (ii) above shall be multiplied by a tax factor of 1.06146 to include street and alley rental and state occupation tax due to increasing O:xnpany revenues under this gas cost adjustrœnt provision. The Cornpany shall have the right to collect such reasonable charges as are necessary to conduct its business and to carry out its reasonable rules and regulations in effect, as set forth in Attachment "A" hereto which is incorporated herein. 6. The Company shall be allowed to continue to collect the 5~ and lOý surcharges authorized by the Railroad Corrmission of Texas, Final Order in GUD-1604 until such tiræ as the respective anDunts authorized to be collected have been collected. The Company shall irrrœdiately notify the City when the aJJDunts authorized to be collected have been collected. SEcn CN 3. --~-_.- TI1at any person, firm or corporation who refuses to comply with the tenI1S and provisions of this ordinance shall be deeræd guilty of a misdcarœaJ10r and, upon conviction, may be fined not to exceed 'IWo Hundred I:bllars ($200), and each day's violation shall constitute a separate offense. SECTION 4. That this ordinance shall take effect on and after the date of its passage and publication as required by law. Main Line Extemion Rate (ResIdential) The charge fo~ extending mains beyond the free limit established by Lone Star Gas, or -any free limit established by City franchise is $4.50 per foot except for large commercial and industria] consumers which are handled on an actual cost per foot basis. 5. Retuíned Check Charges A returned check handling charge of $5.00 is métde for each check returned to the Cornpany for reasons of non-sufficient funds, account closed, payrnent withheld, invalid sigí1ature or im?roper prcparatjon. - r .
