what the City could possibly lose. Councilman
Scoma stated that when the Council originally
discussed this, detailed information on the
impact it would have on the entire City was
to be provided. Councilman Scoma stated he
hoped Tecnol understood it would affect the
whole City. Councilman Scoma stated this was
a major decision and he hoped that whatever
action the City took, Tecnol would not take
offense. Mayor Pro Tern Davis stated that
tax abatement was available. Mayor Pro Tern
Davis stated he felt the City needed to look
into it further. Councilman Sibbet stated that
by not acting it might take away the City's
entrepreneurial marketing spirit. Councilman
Sibbet supported this tax exemption proposal.
Mr. Kelly explained the context of the contract.
The City would realize a $11,115 savings.
Rex McEntire assured the Council the contract
was correct and Municipal Software (Mr. Johnson's
former employer) had agreed to its terms.
Councilman Scoma stated he felt the contract
left a great deal of exposure to the City.
Councilman Scoma stated he felt the contract
did not cover all the legal aspects.

Mayor Pro Tern Davis stated the consultant
needed to show proof of insurance. Mayor Pro
Tern Davis questioned item number 5 on the City
being able to sell any system that was developed.
Mr. Kelly stated when the system was developed
it could not be sold by the City because it
became public domain.

suggested the following changes to the Ordinance:
(1) Article II, Section 2.01, (J) add "containing an
artificial body of water, introduced in accordance
with Uniform Plumbing Code"; (2) Article IV,
Section 4.03 add "HEALTH AND SAFETY PROVISIONS
FOR PUBLIC AND SEMI-PUBLIC POOLS"; (3) Article V,
Section 5.01 add "the pool shall be closed and the
City Manager or Deputy City Manager shall be
notified". Councilman Sibbet asked about

stated they had a chemical to use on
abandoned contaminated pools. Councilman
Scoma stated he felt this ordinance needed
to be incorporated in the Building Code
or Code Enforcement Policy. Ms. Burney stated
she planned on placing an article in the news-
letter on care of private pools.
ACTION TAKEN
Mr. Horvath stated the Staff was recommending Greg
the low bidder. Mayor Pro Tern Davis stated he felt
the City should go with a company the City felt
comfortable with.
Mayor Brown asked if the work on the golf course
was complete. Mr. Sanford stated it was being
worked, but not yet completed. Councilman Scoma
questioned the cost difference in the gabion
work at the golf course and Big Fossil Creek.
Mr. Dickens explained that there was a big
difference in the two projects.
The cleaning contract bid was explained
to the Council and that the low bidder for
the articles of clothing most frequently
cleaned was Dove Cleaners. The Council
decision was to stay with Richland Cleaners.

minutes of the March 12, 1990 meeting.
Motion carried 6-0; Councilman Metts abstaining due to absence from the
meeting.

PRESENTATION OF PROCLAMATION - CLEAN CITY WEEK
Mayor Brown advised that the proclamation declared March 26-31, 1990 as
IIClean City Week" in North Richland Hills. The Mayor, Council, Board and
Commission members would compete in seeing who could gather the most trash.
It was suggested that area representatives be invited.

Councilwoman Spurlock removed Item No. 13 and Councilman Scoma removed
Items No. 10, 12, 16, 17 and 19 from the Consent Agenda.

Councilman Scoma moved, seconded by Mayor Pro Tern Davis to approve
Ordinance No. 1657 with the changes that were made in Pre-Council.

GN 90-46 APPROVE GRANTING EASEMENT FROM CITY
TO SOUTHWESTERN BELL TELEPHONE

Councilwoman Spurlock asked if the City could require that a fence be
installed.
Mr. Dickens stated he would prefer not to have a fence because it was
adjacent to a flood plain.
Councilwoman Spurlock stated the easement said they had a right to fence
it.
Mr. Dickens stated that could be taken out of the document.
Councilwoman Spurlock suggested that landscaping be required in place of
the fence.
Councilman Garvin moved, seconded by Councilman Scoma, to approve GN 90-46
subject to landscaping as illustrated in the rendering.
Motion carried 7-0.

GN 90-47 CONSIDERATION OF EXEMPTION OF FREEPORT PROPERTY
TAXES - FREEPORT EXEMPTION (AMENDMENT 5) -
ORDINANCE NO. 1663
TABLED
Councilman Garvin moved, seconded by Councilman Sibbet, to approve
Ordinance No. 1663.
Councilman Scoma stated he looked at this from the standpoint of the
impact it would have on the entire City. Councilman Scoma stated he
thought it would be a major mistake to approve the exemption at this time.
Councilwoman Spurlock stated she thought it would be a disadvantage to
approve the exemption at this time.
Councilman Sibbet stated he felt it would be a positive step for the city
to approve the exemption at this time.
Councilman Garvin withdrew his motion.
Councilman Scoma moved, seconded by Mayor Pro Tern Davis, to table
Ordinance No. 1663 until September 1990.
Motion carried 6-1; Mayor Pro Tern Davis, Councilwoman Spurlock, Councilmen
Garvin, Welch, Metts and Scoma voting for and Councilman Sibbet voting
against.

DENIED
Councilman Scoma moved, seconded by Councilman Welch, to award the annual
uniform cleaning contract to Richland Cleaners, with the expiration date
of September 30, 1990.
Motion carried 7-0.

PU 90-14 AWARD OF BID FOR EMISSION ANALYZER
TO ALLEN TEST PRODUCTS
APPROVED
After considerable discussion, Councilman Welch moved, seconded by Mayor
Pro Tern Davis, to approve PU 90-14.

to Bil-Mik, Inc. in the amount of $49,017.00 and amend the Shauna Drive
budget to be $49,100.

CITIZENS PRESENTATION
Mr. Nelson Stoppiello, 7400 Jade Circle, appeared before the Council.
Mr. Stoppiello expressed concern about the dirt that was being taken out
of Calloway Branch and being placed on an adjacent lot.
Mr. Dickens advised that he would check into the situation.
Councilwoman Spurlock advised that the Library was having the poetry
contest awards March 31, 1990.
Councilman Scoma announced that the clean-up program for the City would be
March 31, 1990, beginning at 11:00 a.m.
Mr. Sanford advised that the golf course would open April 2, 1990.
