HomeMy WebLinkAboutResolution 2018-002 RESOLUTION NO. 2018-002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, AUTHORIZING THE DONATION OF 4.837 ACRES OF LAND LOCATED ALONG THE EAST SIDE OF THE COTTON BELT RAILROAD, WEST OF IRON HORSE BLVD, AND NORTH OF IH-820 TO THE FORT WORTH TRANSPORTATION AUTHORITY TO BE USED FOR THE PUBLIC PURPOSE OF THE TEXRAIL PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL ASSOCIATED DOUMENTS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, The Fort Worth Transportation Authority (the "FWTA") has received a multi-million dollar federal grant from the United States Department of Transportation to construct a twenty-seven mile commuter rail line to run between Fort Worth and the Dallas/Fort Worth International Airport, commonly referred to as the "TEXRaiI Project"; and WHEREAS, As a part of the TEXRaiI Project, the commuter line will make stops at Iron Horse Station and Smithfield Station, both of which will be located within the boundary of the city of North Richland Hills; and WHEREAS, Pursuant to an Interlocal Agreement between the City of North Richland Hills (the "City") and the FWTA, the City is required to provide monetary support with the contribution of certain land located within the City necessary for parking at the Iron Horse Station (the "Property"); and WHEREAS, FWTA, a regional transportation authority, is a public body corporate and politic organized and existing under Chapter 452, Texas Transportation Code; and WHEREAS, The City and the FWTA each desire for the Property to be donated to the FWTA and apply the appraised value of the Property towards the City's local match for the grant and allow the donation to satisfy the City's requirements to provide land necessary for the parking at Iron Horse Station; NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: SECTION 1. That the City Council hereby authorizes the donation of 4.837 acres of city- owned land located along the east side of the Cotton Belt Railroad, west of Iron Horse Blvd., and north of IH-820, to the Fort Worth Transportation Authority to meet the City of North Richland Hill's required contribution of property for the TEXRaiI Project. Resolution No. 2018-002 Page 1 of 2 SECTION 2.That the City Manager is hereby authorized to execute the Revised Terms of Purchase and all associated documents necessary to effect the donation. SECTION 3. That this authorization is contingent upon the Property's continuous use for a public purpose. Should the property no longer be used for a public purpose, ownership of the Property shall revert back to the City. SECTION 4. That this Resolution shall take effect and be in full force and effect from and after the date of its adoption, and it is so resolved; and all resolutions of the City Council of the City in conflict herewith are hereby amended or repealed to the extent of such conflict.
