Adjournment CITY OF NORTH RICHLAND HILLS PLANNING AND ZONING COMMISSION COVER SHEET JULY 23, 1998 PZ 98-30 Public Hearing to Consider the Request of James Nader for a Special Use Permit for a Self-Service Laundry Facility on Lot 7, Block 1, North Park Estates Addition. (Located in the 6400 Block of Rufe Snow Drive) James Nader is the applicant proposing to construct a coin operated laundry in the 6400 block of Rufe Snow Drive. This site is currently zoned C2-Commercial. The Zoning Ordinance indicates that a self -service laundry facility that is located within 200’ of residential property requires a Special Use Permit. Mr. Nader submitted a site plan, which was reviewed by staff and identified the following major issues: 1. Masonry Screening Wall: The commercial property abuts residential property and requires a masonry-screening wall along the common property line. The applicant has agreed to provide and has shown on the site plan the required screening wall. 2. Landscaping: On Monday, July 13, 1998 the City Council agreed to adopt landscaping enhancements and directed staff to achieve these standards when possible. This case is a Special Use Permit and requires site plan approval; therefore, the opportunity exists to achieve these landscaping enhancements as follows: Landscaping Analysis Requirement Provided Status Lot Area 29,329 s.f. 15% Landscape Req 4,399 s.f. 9,429 s.f. Signage: The applicant is proposing to construct a 23’ pole sign with a square footage of 64 square feet. This meets the new guidelines established by the City Council on July 13, 1998 that indicate a maximum of 25’ in height and a 100 square foot area. 4. Hours of Operation: That applicant has indicated that this facility will be open from 8AM til 11PM 7 days a week. 5. Fire Lane: There is an existing fire lane that follows the north property line. The site plan has been reviewed by the Fire Department, who has agreed that the removal of the fire lane can occur if adequate fire lanes are provided through the proposed parking areas of the development. 6. Sidewalks: The applicant has been advised that sidewalks are required next to all public streets. The applicant has agreed to and indicates sidewalks on the site plan. 7. Dumpster: The site plan seems to indicate the location of the dumpster, however, it is not clearly labeled or indicated as such. The applicant has been advised that if a dumpster is visible from the public right-of-way, it shall be screened. 8. Exterior Lighting: The applicant is proposing to construct pole lights around the building. Height of the pole lights are not indicated on the site plan. There is residential development directly behind this property that may be affected by exterior lighting. 9. Staff Comment Letter: The staff review letter dated July 13, 1998 indicates further issues that have been addressed by the applicant on the site plan. The applicant agreed to all comments made by staff in the July 13, 1998 letter. All property owners within 200’ of this request have been notified. To date, staff has received no adverse comments. This request is in conformance with the Comprehensive Land Use Plan for the City of NRH. RECOMMENDATION: To approve the SUP request with the landscaping enhancements as initiated by the City Council on July 13, 1998. PUBLIC ACTION SCHEDULE _________________________________ Christopher D. Baker P & Z Commission: 7/23/98 Planner City Council: 8/24/98 CITY OF NORTH RICHLAND HILLS PLANNING AND ZONING COMMISSION COVER SHEET JULY 23, 1998 PZ 98-31 Public Hearing to Consider the Request of Tommy Kline for a Zoning Change from R6T-Townhomes to PD-Planned Development for Single Family Dwellings on Blocks 31, 32 and 33, Holiday North Addition. (Located in the 5500 Block of Holiday Lane) Postponed 7/9/98 Tommy Kline previously appeared before the Commission on July 9, 1998 in order to request a zoning change from R6T-Townhomes to PD-Planned Development for single family residences. At that time, there was significant discussion between the Commissioners, the applicant, and the citizens attending the meeting regarding various issues. The Commission voted to postpone Mr. Kline’s request until the next regularly scheduled meeting (July 25, 1998). Staff contacted Mr. Kline early in the week of July 15, 1998, in order to get direction from the developer regarding his intentions with this case. Mr. Kline has indicated, according to the attached letter, that he would like this case postponed until the August 13, 1998 P&Z meeting. If the Commission votes to postpone this request until August 13, 1998, staff will re-notify property owners in accordance with state law. RECOMMENDATION: To postpone PZ 98-31 until August 13, 1998. ___________________________ PUBLIC ACTION SCHEDULE: Christopher Baker Planning & Zoning Commission: N/A Planner City Council: N/A CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JULY 23, 1998 PZ 98-33 Public Hearing to Consider the Request of Ralph Schwab for a Zoning Change from AG-Agricultural to R1S-Residential on Tracts 8F and 8N1, T. K. Martin Survey, A- 1055. (Located at 8713 Stewart Street) Ralph Schwab is the owner of Tracts 8F and 8N1, of the T. K Martin Survey, containing approximately 2.2-acres of land that is currently zoned AG-Agricultural. The property to the east is zoned R2-Residential, the property to the north, south and west is all zoned AG-Agricultural. Mr. Schwab is in the process of platting this property in order to construct a home. Mr. Schwab would like to rezone this property to R1S-Special Residential in order to preserve the ability to have horses on site. All property owners within 200’ of this request have been notified. To date, staff has received adverse comments via telephone. This rezoning request is in conformance with the Comprehensive Land Use Plan for the City of NRH. B. Edens Survey, A-499. (Located at 8750 Hightower Drive) Fred Ballinger represents Lisa McManus in this rezoning request containing approximately 4 acres of land. The property is currently zoned AG-Agricultural. The property to the east is zoned R2- Residential, to the south is AG-Agricultural, to the west is R2-Residential and to the north is zoned AG-Agricultural. Ms. McManus is in the process of platting this property in order to construct a new home. Ms. McManus would like to rezone this property to R1S-Special Residential in order to preserve the ability to have horses on site. All property owners within 200’ of this request have been notified. To date, staff has received no adverse comments. This rezoning request is in conformance with the Comprehensive Land Use Plan for the City of NRH. Baker Planning & Zoning Commission: 7/23/98 Planner City Council: 8/24/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JULY 23, 1998 PZ 98-35 Request of Jim Brown for a Reduction of the Masonry Building Requirements on Lot 14, Block 3, J. L. Autrey Addition. (Located at 4019 Rufe Snow Drive) Mr. Brown is the owner of Brown Service Company that has an exiting building at 4015 Rufe Snow Drive. Mr. Brown on December 8, 1997 received a Special Use Permit on 4019 Rufe Snow Drive in order to construct and operate a contractors shop and garage. The City Council recently approved an ordinance that requires 75% masonry construction for all new commercial buildings. This ordinance also allows the reduction of the masonry building requirement by site plan approval. Mr. Brown is seeking to reduce the masonry percentage on his proposed building. Originally, Mr. Brown was going to construct the building with an 80% masonry coverage on each elevation. However, he would now like to provide masonry only on the front of the office and 25’ down each side, as indicated on the submitted site plan and elevations. RECOMMENDATION: To deny PZ 98-35. __________________________ PUBLIC ACTION SCHEDULE: Barry LeBaron, AICP Planning & Zoning Commission: 7/23/98 Director of Planning & Inspections City Council: 8/24/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JULY 23, 1998 PS 98-12 Request of Ken Jaffe for a Final Plat of Lot 1, Block 1, East West Partners Addition. (Located in the 8600 Block of Davis Boulevard) Mr. Jaffe is the owner and developer of this 1.05-acre tract of land that is currently zoned C1- Commercial. The following are issues associated with this final plat: 1. Driveway Spacing: During the preliminary plat review and approval process, it was indicated that drive approaches were to be located on the joint property line of Lots 1 & 2. The driveway configuration for Lot 1, Block 1 has been revised and is no longer located on the joint property line with Lot 2 on Precinct Line Road. Public Works is not opposed to this arrangement, provided it is understood that only one additional drive approach will be permitted for Lot 2 on Precinct Line Road. All additional approaches will be required to meet Public Works Design Manual standards and must be permitted by Texas Department of Highways and Transportation. 2. Sanitary Sewer: This development will be extensively using offsite easement agreements in order to extend sewer. At the present time, the offsite sewer easements have yet to be confirmed. All easement agreements shall be forwarded to the Public Works department for review; approval and filing before any construction or permits will be approved. 3. Sidewalks: The applicant has been advised that sidewalks are required adjacent to all public streets. 4. Street Lighting: The applicant has been advised that streetlights are a requirement and shall be coordinated by the Public Works Department with the cost being paid directly to TU Electric. 5. Plat Resubmittal: The applicant revised a previous draft of the plat as per the July 8, 1998 Public Works comment letter and resubmitted the plat on July 13, 1998 without any written exceptions or comments. Staff has not had the opportunity to review the revised plat to ensure that the appropriate corrections and/or changes were made in conjunction with the July 8, 1998 Public Works comment letter. Staff did not want to postpone Mr. Jaffe’s plat because review had not taken place. It is anticipated that all corrections and/or changes that were made are in compliance with the Public Works comment letter. At the meeting, if any additional corrections are required, staff will provide the Commission with the appropriate information. All other engineering comments have been agreed to. This platting request is in conformance with the Comprehensive Land Use Plan for the City of NRH. RECOMMENDATION: To approve PS 98-12. ____________________________ PUBLIC ACTION SCHEDULE: Christopher D. Baker Planning & Zoning Commission: 7/23/98 Planner City Council: 8/10/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JULY 23, 1998 PS 98-28 Request of Fred Ballinger for a Final Plat of Lot 1, Block 17, Stony Brooke Addition. (Located at 8750 Hightower Drive) Fred Ballinger is representing Lisa McManus in this final platting request. Mr. Ballinger previously appeared before the Commission on April 23, 1998 and received approval of the preliminary plat. The following is the approval motion made by the Planning & Zoning Commission at the April 23, 1998 meeting: ” …the alignment of Hightower Drive as a C-4-U be centered on Marti Lane to the east, with a 68’ right-of-way, a recommendation that a covenant be allowed for street and drainage improvements on Hightower Drive and Eden Road and also for the water and sewer improvements on Hightower Drive, waive the masonry screening wall along Hightower but require sidewalks and allow adequate emergency vehicle access to the house without requiring curb and gutter.” The issues associated with this final plat are as follows: 1. STREET IMPROVEMENTS: A covenant for street improvements on Hightower Drive and Eden Road as required by the motion of the P&Z shall be executed. 2. WATER LINE EXTENSION: An eight-inch water main located in the existing Hightower Drive needs to be extended to tie into the water line in Eden Road. A covenant shall be executed in accordance with the motion of the preliminary plat. 3. EMERGENCY ACCESS: The P&Z required the applicant to provide emergency access to the structure without curb and gutter. Plans for this access have yet to be received by the Public Works Department. 4. DRAINAGE: At the preliminary platting stage, the P&Z waived drainage improvements on Hightower Drive if a covenant was signed. The P&Z did not waive the requirement for a drainage study to be performed in conjunction with the development of this lot. Public Works feels that a grading plan should be prepared for the lot. Public Works has performed an on-site investigation, which has revealed that there will be no runoff from the existing pavement of Hightower Drive. As a result, Public Works is not opposed to postponing the installation of drainage improvements, including any major swales. However, if it is determined that a swale is necessary it shall be designed according to City criteria. The applicant is requesting a waiver of any additional drainage studies, analysis or improvements, necessary for the Hightower Drive extension and Eden Road and the construction plans associated with such improvements. 5. SANITARY SEWER: The P&Z during the preliminary plat review approved the waiver of the sanitary sewer main extension in Hightower Drive if a covenant was signed. A waiver of the sewer extension on Eden Road was not included in the motion by P&Z. The sewer main needs to be extended to the north property line adjacent to Eden Road. This will allow for adequate service to this property and provide for future extension. The applicant is requesting a waiver of sanitary sewer extensions and the construction plans associated with the improvements. 6. SCREENING WALL: The P&Z during the preliminary plat review waived the screening wall requirements adjacent to the C-4-U thoroughfare because it is a one-lot subdivision. 7. SIDEWALKS: The Subdivision Regulations require that sidewalks be constructed adjacent to all public streets. The Public Works Department has indicated that sidewalks for Hightower Drive will be included in the covenant. The P&Z required sidewalks adjacent to Eden Road, plans for this sidewalk should be included with the construction plans for the house. The applicant is requesting the P&Z Commissioners to direct the Public Works department to calculate the construction costs for sidewalks along Eden Road so that an escrow amount may be established and paid by the owner. 8. STREETLIGHTS: Streetlights are a requirement of the design manual. The placement, coordination and installation of streetlights are coordinated by the Public Works Department with the costs paid directly to TU Electric. The location of proposed streetlights should be included on construction and topographical drawings to determine placement needs. The Public Works department has indicated the location of future streetlights along Hightower Drive shall be included with the plans for the extension of Hightower Drive. Streetlights for Eden Road have not been shown but should be installed at this time. . The applicant is requesting a waiver of any street lighting necessary for Hightower Drive extension and Eden Road and construction plans associated with such improvements. 9. INSPECTION FEES AND UTILITY & DRAINAGE PLANS: The Public Works Department requires that 4% for water and sewer and 3% of street and drainage be paid prior to construction to cover inspections of the property. The applicant is requesting a waiver for all other improvements, no additional inspection fees, and all requests by the Public Works Department relating to drainage and utility plans. RECOMMENDATION: This plat is in conformance with the Comprehensive Land Use Plan for the City of NRH. It is recommended that the Planning & Zoning Commission either approve the waiver requests of the applicant or deny the plat because it does not meet the requirements established in the Subdivision Regulations. Because this plat does not meet the requirements established by the City of NRH, state law permits denial of this platting request.
