Adjournment CITY OF NORTH RICHLAND HILLS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PS 98-11 Request of Tom Mihaloupoulos for a Final Plat of Lot 1, Block 1, Garvon Addition. (Located at 8100 Bedford-Euless Road) Garvon, Inc. is redeveloping the old J.C. Penney Warehouse property at 8100 Bedford-Euless Road, which is approximately 1.4 acres into a Charter Furniture Retail Store. The property has never been platted. Since the renovation of the building exceeds 50% of the total value of the structure, the Subdivision Regulations require platting at this time. The zoning at this location is C-2 Commercial which allows the retail furniture store by right. Directly to the north of this location is the Richland Oaks residential development. The P&Z heard this preliminary plat at the March 12, 1998 meeting and approved the request. The issues associated with this final plat are as follows: 1. Sidewalks: The P&Z waived the sidewalk requirements during the preliminary platting process because there are no sidewalks on the south side of Bedford-Euless Road. 2. Street Lighting: The developer has been advised that streetlights are a requirement at this location. 3. Street Improvements: The applicant has been advised and has agreed to construct new curb and gutter along the frontage of the proposed lot. The developer has agreed to all other engineering comments. This plat is in conformance with the Comprehensive Land Use Plan for the City of NRH. _____________________ Christopher D. Baker Planner PUBLIC ACTION SCHEDULE P & Z Commission: 5/14/98 City Council: 6/08/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PZ 98-16 Public Hearing to Consider the Request of Jim Makens for a Zoning Change from AG Agricultural to C-1 Commercial on a Portion of Tract 11B, T. Peck Survey, A-1210. (Located in the 8700 Block of Davis Boulevard) Tabled 4/23/98 The P&Z originally heard this case on April 23, 1998, however, because the applicant was not in attendance at the meeting, the Commission tabled the request. Mr. Makens is the agent representing Orval Hall Excavating Company, the owner of the property. This property is located on the north side of the new intersection of Precinct Line Road and Davis Boulevard and is directly adjacent to the city limit lines with Colleyville and Keller, located east and north respectfully. Mr. Makens has a preliminary plat on this property which is currently being reviewed by Public Works and the Planning Department. The property contains approximately 3.74 acres of land. Mr. Makens is requesting the property be rezoned from AG Agricultural to C-2 Commercial, to allow a retail convenience store with gasoline sales. There was discussion at the previous meeting at the request of the North Davis Boulevard Overlay Citizens Committee regarding zoning this property to C-1 Commercial in lieu of C-2 Commercial. At this location C-1 would allow a convenience store with gasoline sales without a Special Use Permit because the property is more than 200’ away from residential property. All property owners within 200’ of this request have been notified. To date, no adverse comments have been received. This rezoning request is in accordance with the Comprehensive Land Use Plan for the City of NRH. _____________________ Christopher D. Baker Planner PUBLIC ACTION SCHEDULE P & Z Commission: 5/14/98 City Council: 6/08/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PS 98-18 Request of John Barfield for a Preliminary Plat of Forest Glenn East Addition. (Located on North Tarrant Parkway) Mr. John Barfield is the owner and developer of this 115-acre development which will be known as Forest Glenn East. The preliminary plat contains 228 single family residential lots and four commercial lots. This development is generally located west of Davis Boulevard and south of North Tarrant Parkway. The issues associated with this preliminary plat are as follows: 1. Zoning: The property contains various zoning classifications and these include R2 (sf residential), C1 (commercial), O1 (office) and R4D (duplex). The applicant has submitted a rezoning application to rezone the property to be consistent with the proposed development. The rezoning request is a separate item for consideration and will considered at a later meeting date. 2. Flood Plain: A large portion of this plat is located within the 100-Year Flood Plain. The developer has been advised that a CLOMR and LOMR will need to be submitted to both the Public Works Department and FEMA prior to final approval of this subdivision. 3. Little Bear Creek: Large portions of this plat are impacting the Little Bear Creek Corridor Ordinance which limits encroachment into the 100 year flood plain and regulates the manner in which lots abut the flood plain boundary. The plat has been reviewed by the staff Little Bear Creek Corridor Review Committed and a copy of their comments is attached. 4. GPS Coordinates: The developer has been advised that this plat will need to be tied to the City’s GPS monuments. 5. R-O-W Dedication: The developer has been advised that additional right-of-way may be required on the portion of the plat that fronts North Tarrant Parkway and Davis Boulevard. 6. Sidewalks: The developer has been advised that sidewalks are required adjacent to all public streets. 7. Screening Walls: The Developer has been advised that a masonry -screening wall will be required adjacent to North Tarrant Parkway and Davis Boulevard. Additionally, the developer is proposing commercial zoning adjacent to residential zoning. A masonry-screening wall in accordance with the Zoning Regulations will be required at these locations. All other engineering comments have been met. This plat is in conformance with the currently adopted Comprehensive Land Use Plan for the City of NRH. PUBLIC ACTION SCHEDULE: ___________________________ Planning & Zoning Commission: 5/14/98 Barry LeBaron, AICP; Director of City Council: N/A Planning and Inspections CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PZ 98-22 Public Hearing to Consider Amending the Site Plan Regulations and to Establish a Plan Review Fee. The recently approved amendment to the masonry requirements now requires all non-residential buildings to be at least 75% masonry construction. This ordinance provides relief from the requirements by allowing the applicant the ability to submit a site plan for review and approval by both the P&Z and the City Council. Additionally, the R-7 Multi-family regulations requires site plan approval for any proposed project that entails a zoning change or a proposed project utilizing existing land zoned R-7 Multi-family. The current “Site Plan” requirements contained in the zoning regulations are quite limited and open to interpretation. Therefore, the proposed site plan review requirements incorporate procedural steps for reviewing a site plan. There currently is no fee to cover the costs associated with staff time reviewing site plans. Staff believes that because of the amount of staff time required to perform an adequate review, a site plan review fee is necessary. Staff has researched fees that other towns and cities charge developers for site plan reviews. These fees range from a base fee of $300 to a structured fee schedule based on acreage of the proposed project. The City of NRH has proposed a fee of $225. This fee will be assessed on those projects that require a site plan review only. The fee will not be charged to projects where a site plan is required as part of a zoning change, i.e., a PD or SUP, which already have application fees. The proposed ordinance also more clearly defines what is required to be shown as part of the site plan, i.e., curb cuts, landscaping, exterior lighting, etc. The ordinance further outlines review procedures and criteria, as well as explaining waiver requests, the approval process, and establishes a one year time limit for site plan approvals. Staff feels this ordinance more effectively communicates to potential applicants what is required and expected of site plan submittals. This will allow shorter review times and create a greater understanding among applicants, staff, P&Z and City Council. ____________________________ Barry LeBaron, AICP, Director Planning & Inspections PUBLIC ACTION SCHEDULE: Planning & Zoning Commission: 5/14/98 City Council: 6/08/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PZ 98-21 Public Hearing to Consider the Request of Mark Harwell for a Zoning Change from R- 2 Residential to R-1-S Residential on Tract 12A3, of the T.K. Martin Survey, A-1055. (Located at 8620 Martin Drive) Mr. Harwell is the owner of this approximately 2 acre tract of land located at 8620 Martin Drive, which is currently zoned as R2, Residential. Mr. Harwell would like to be able to keep horses on his property. The current zoning classification does not allow horses to be kept. Mr. Harwell has consequently applied for the R-1-S, Special Residential district that allows for horses. All property owners within 200 feet of this request have been notified. To date, staff has not received any adverse comments. This rezoning request is in conformance with the currently adopted Comprehensive Land Use Plan for the City of NRH. ___________________________ Christopher D. Baker Planner PUBLIC ACTION SCHEDULE: Planning & Zoning Commission: 5/14/98 City Council: 6/8/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PZ 98-23 Public Hearing to Consider Amending the Table of Permitted Uses to Allow an Indoor Sports Arena. The City has recently received an inquiry regarding professional wrestling and in what zoning district it is permitted. The current Table of Permitted Uses does not allow for a venue for professional wresting. Before an applicant can receive a Certificate of Occupancy (CO) for a specific location it must be determined in what zoning district the use is allowed. The Planning Department feels that the classification of this new and unlisted use should not be so strict that it allows only for professional wrestling. The department feels that a larger, broader use category should be created in which professional wresting, or other exhibition sports could fit. We propose the new use as an Indoor Sports Arena. Staff has researched how other towns and cities currently regulate indoor sports arenas. Many towns allow indoor sports arenas by right in their more intense commercial zone and in the industrial zones. Staff believes that this new use should be allowed in the C-2 Commercial district, not by right, but by CS Conditional Special Use Permit only. This would give the P&Z and the City Council authority over and approval of Indoor Sports Arenas that locate within 200’ of residentially zoned property. Staff believes that the potential negative impacts of indoor sports arenas, i.e., traffic generation, necessitate and require the scrutinitization and mitigation of impacts. Attached please find a copy of the letter provided by Mr. Ken Taylor. It further illustrates and explains the proposed use, which would be allowed in the indoor sports arena land use category. ___________________________ Barry LeBaron, AICP, Director Planning & Inspections PUBLIC ACTION SCHEDULE: Planning & Zoning Commission: 5/14/98 City Council: 6/08/98 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET MAY 14, 1998 PS 98-22 Request of Larry Tadlock for a Preliminary Plat to be known as Lots 1&2, Block 1, Tadlock Addition (Located in the 7700 Block of Mid-Cities Blvd.) Mr. Larry Tadlock is the owner and developer of this 1.65 acre parcel of land located in the 7700 block of Mid-Cities Blvd., just west of Smithfield Road. The property is currently zoned C1, Commercial. The property to the north of the proposed plat that is zoned both R2, Residential and Ag, Agricultural. This issues associated with this preliminary plat are as follows: 1. Driveway: The applicant has been advised of the 500 foot separation requirements for drive approaches on Mid-Cities Blvd. The applicant has been instructed to provide this information with the Final Plat, 2. Drainage: The Public Works Department is requiring a Drainage Study to be submitted in conjunction with the Final Plat. 3. Water Line: A Water line extension will need to be constructed to the eastern portion of Lot 1. 4. Fire Lane: The applicant has been advised that a fire lane will need to be constructed from the proposed water line extension along Lot 1 so that adequate fire protection is ensured. 5. GPS Coordinates: The applicant has been advised that GPS coordinate are required. 6. Sidewalks: The applicant has been advised that sidewalks are a required adjacent to all public streets. 7. Street Lights: The applicant has been advised that streets lights are required at this location and that coordination is required with both the Public Works Department and TU Electric. __________________________ PUBLIC ACTION SCHEDULE: Christopher D.
