Adjournment CITY OF NORTH RICHLAND HILLS PLANNING AND ZONING COMMISSION COVER SHEET September 24, 1998 PZ 98-23 Public Hearing to Consider Establishing Regulations Regarding Commercial Amusement, Indoor. On May 14, 1998 staff brought forth a discussion item regarding the establishment of regulations for indoor sporting arenas. At that time staff recommended that indoor sporting arenas be permitted in the C2-Commercial District, but only with a CS-Conditional Special Use Permit. This would mean that the special use permit requirement would only be triggered if the locaiton was within 200’ of residentially zoned property. As a result of that meeting the Commission directed staff to review information on how other cities currently deal with indoor sporting situations. Staff contacted several area cities, the results are summarized below: Carrollton: The City of Carrollton considers sports assembly, convention center, sports arena, and other arena type land uses as public assembly in their intensity. Each of the aforementioned uses are regulated in the City of Carrollton’s Zoning Ordinance as follows: • Sports Assembly: A Special Use Permit in the light commercial, heavy commercial and commercial warehouse districts. • Convention Center: Special Use Permit in all districts. • Sports Arena: Special Use Permit in light commercial, heavy commercial and commercial warehouse. Keller: The City of Keller permits commercial amusement indoor uses by right in the retail, town center, and PD zoning categories. They do not require a Special Use Permit for this use; it is allowed by right in these three districts. Plano: The City of Plano does not specifically address commercial amusement indoor type uses. The use would be considered as a civic center and is therefore permitted by right in all of the commercial and industrial districts. The intensity of these types of uses can vary. Therefore, it is recommended that indoor sporting events be allowed by Special Use Permit in the C1-Commercial and the C2-Commercial zoning district. It is also recommended that these uses be permitted by right in the industrial districts. The attached ordinance reflects the above suggestions. On April 27, 1998 the City Council declared a moratorium of accessory buildings that are greater than 12 feet in height. The moratorium will expire October 28, 1998. The City Council also directed staff to research how other cities regulate accessory buildings. Staff, in light of the Council direction and research efforts, has drafted a set of regulations for your consideration. They are summarized by the 4 categories below: Temporary: Permanent: ∫ May be located on contiguous vacant land ∫ Located on same lot home ∫ Not permitted in the front yard ∫ Not permitted in front yard ∫ 3 foot side building line setback ∫ 6 foot side building line setback ∫ 12 foot Max. height ∫ 15 foot Max. height ∫ 200 sq. ft. max. ∫ 500 sq. ft. Max. ∫ No masonry requirement ∫ Conform to masonry requirement Carports: Detached Garages: ∫ Must be on the same lot as house. ∫ Must be on same lot as house ∫ Shall not extend past front building line. ∫ Shall not extend beyond front b/l ∫ Side yard setback shall be six feet. ∫ If platted after 1990 only side, rear or ∫ Maximum height is ten feet. Front entry will be allowed ∫ Maximum height 15’ ∫ Maximum 500 square feet. ∫ Maximum of 360 square feet. ∫ Concrete or asphalt drive ∫ No masonry requirement. More detailed information is provided in the draft ordinance attached. Attached is a copy of the Rules & Procedures for your information. Please notice that this item is an agenda item.
