Adjournment Item 9 has been added as an Emergency Action Item for Consideration by the Committee because it impacts the welfare of the Citizens of North Richland Hills CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JANUARY 14, 1999 PS 98-65 Request of Kenton Holcomb for a Final Plat of Lots 1 & 2, Block 1, Town Center Addition. (Located at the Northwest Corner of Cardinal Lane and Simmons Drive) Mr. Holcomb represents Blue Line Ice in this platting request that contains approximately 6.1 acres of land. This property is currently zoned I1-Light Industrial; however, the City Council has considered a zoning change application for this property from I1-Industrial to TCD Town Center District. At the time of agenda preparation council has not considered this request. The hearing will take place on Monday, January 11, 1999. Mike Curtis, PE, Capital Improvements Coordinator has reviewed this project and will be available at the P&Z meeting to answer any questions. The issues associated with this final plat are as follows: 1. Offsite Easements: There may be a need for offsite easement agreements in conjunction with the development of this site. The applicant has been advised and has agreed to these requirements. 2. Shared Parking Agreement: The executed Shared Parking Agreements were a requirement of the approval of the preliminary plat. A draft copy of this agreement has been submitted for the P&Z’s review prior to execution. The shared parking agreement proposed is between the owners of Lots 1 & 2, Block 1, Town Center Addition and does not include BISD. A copy is attached for your consideration. 3. Street Improvements: Street improvements will be required for Cardinal Lane and Simmons Drive. The applicant has been advised of this requirement and has indicated that obligation for construction and design is the responsibility of Arcadia Realty. The applicant has been advised that the City of NRH requires that half of each of these streets be constructed. The street section proposed for Cardinal Lane in the Town Center indicates 27 feet of pavement. Half of this is required to be built, which is 13.5 feet. The Public Works Department has requested an additional 6.5 feet of pavement to create a 20-foot pavement section. When the property opposite develops the street shall be permanently constructed in accordance with the Town Center Standards. Simmons Drive was partially constructed with the development of Birdville High School. The applicant has been advised that they are required to construct the remainder of this street according to City of NRH standards. The applicant has agreed to this requirement. 4. ROW Vacation: The northeast corner of the property at Cardinal Lane and Simmons Drive has a small portion of ROW that the applicant is proposing the City vacate during this process. The City is agreeable to vacating this small portion of property. The applicant has been advised that a metes and bounds description and exhibit will need to be prepared and forwarded to the Public Works Department for review. An ordinance will be prepared vacating this ROW and will be placed on the City Council Agenda on January 25, 1999. The applicant has agreed to supply all necessary documentation regarding this ROW. All other engineering issues have been addressed and agreed to. This plat is in conformance with the Comprehensive Land Use Plan for the City of NRH. RECOMMENDATION: To approve PS 98-65 subject to an executed Shared Parking Agreement between Lots 1 & 2, Block 1, Town Center Addition and engineer’s comments. _____________________ Christopher Baker Planner PUBLIC ACTION SCHEDULE P & Z Commission: 1/14/99 City Council: 1/25/99 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JANUARY 14, 1999 PZ 98-59 Public Hearing to Consider Amending the Zoning Ordinance to Establish Regulations for Site Plan Approval of all Commercial Projects that are Located within 200 Feet of Residentially Zoned Property or Property that is Indicated to be Residential on the Approved Comprehensive Land Use Plan Ordinance No. 2362 At the December 17, 1998 meeting a discussion item was on the agenda regarding the establishment of regulations to require site plan approval for all commercial projects within 200’ of residentially zoned property. At that meeting, the Commission directed staff to proceed with the creation of site plan approval regulations. The attached ordinance modifies the Zoning Ordinance to require site plan approval for all new commercial projects in all commercial zoning districts. This includes O1-Office, LR-Local Retail, C1- Commercial, C2-Commercial, OC-Outdoor Commercial, I1-Light Industrial and I2-Medium Industrial. The site plan approval requirements will be triggered when a new commercial facility or renovation that exceeds more than 75% of the assessed value of the property takes place within 200’ of existing residentially zoned property and future residential property as indicated by the Comprehensive Land Use Plan for the City of NRH or increases the square footage of the building by 30% or more. The site plan submittal requirements as indicated in the attached ordinance are exactly the same as those for a SUP or a PD. Notice has been given in accordance with state law and no comments have been received. RECOMMENDATION: To approve PZ 98-57 and Ordinance No. 2362. _____________________ PUBLIC ACTION SCHEDULE Christopher Baker P & Z Commission: 1/14/99 Planner City Council: 1/25/99 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JANUARY 14, 1999 PZ 97-60 Public Hearing to Consider Amending the Zoning Ordinance to Revise the Screening Wall regulations Between Commercial and Residential Property. Ordinance No. 2363 At the December 17, 1998 P&Z meeting, there was as a discussion item, consideration of establishing new regulations for masonry screening walls between commercial and residential uses. On December 17, 1998 the Commission expressed concern regarding establishing new regulations regarding masonry screening walls. However, the City Manager’s office has given direction to staff to proceed with the ordinance revisions in order to provide additional protection for existing and proposed residential neighborhoods. The attached ordinance is an effort to close a potential loophole in our existing regulations. The existing regulations indicate that a screening wall is required when commercial and residential zoning districts abut. However, it does not speak to if a wall is required when a public street bisects the uses. At this point it becomes an interpretation for staff. The proposed ordinance states that public streets between commercial and residential properties either existing or future, as indicated on the Comprehensive Land Use Plan, do not act as a buffer. A wall is required. Notice has been given in accordance with state law. No comments have been received. RECOMMENDATION: To approve PZ 98-60 and Ordinance No. 2363. _______________________________ Christopher Baker Planner PUBLIC ACTION SCHEDULE: Planning & Zoning Commission: 1/14/99 City Council: 1/25/99 CITY OF NORTH RICHLAND HILLS, TEXAS PLANNING AND ZONING COMMISSION COVER SHEET JANUARY 14, 1999 PS 98-55 Request of Marvin Smith for a Final Plat of Lots 1 – 3, Block 2, Douglas Estates, Phase II. (Located in the 7500 Block of Douglas Lane) Marvin Smith is the owner and developer of this 2.45-acre tract of land. Mr. Smith is proposing to create 3 lots in order to construct new homes at this location. The property is currently zoned R1- Residential. The issues associated with this plat are as follows: 1. Drainage: The City is in the process of improving Douglas Lane. Drainage improvements are included in the project. The applicant has been advised that an engineered grading plan will be required for Lots 1 & 3 during the building permit process. The applicant has agreed to this request. 2. Water: The City is constructing a water main in Douglas Lane that will provide service to these lots. 3. Sewer: A sewer main will also be constructed during the Douglas Lane improvements. Stub outs will be provided to each lot as part of a ROW agreement. The applicant has been advised that finished floor elevations are required in order to verify that there is proper sewer flow for these properties. The applicant has provided the requested information. 4. Sidewalks: Sidewalks will be constructed as part of the Douglas Lane improvements. This plat is in conformance with the Comprehensive Land Use Plan for the City of NRH. RECOMMENDATION: To approve PS 98-55 subject to engineers comments. ____________________________ Christopher Baker Planner PUBLIC ACTION SCHEDULE: P&Z: 1/14/99 CC: 1/25/99 CITY OF NORTH RICHLAND HILLS PLANNING AND ZONING COMMISSION COVER SHEET JANUARY 14, 1999 PZ 98-55 Public Hearing to Consider the Request of Marshall Merritt for a Special Use Permit to allow a Car Wash and Gasoline Sales at a Proposed Convenience Store on Lot 5, Block 1, Walker Branch Addition. (Located on the Northwest Corner of Grapevine Highway & Harwood Road) Ordinance No. 2361 At the December 17, 1998 meeting, the Commission tabled the request of Mr. Merritt for a Special Use Permit at the applicant’s request in order to provide additional time for site plan manipulation. Since that meeting, several new issues regarding the site plan have been raised. Additional time is needed to further resolve the new issues raised. Staff anticipates that issues with this site plan shall be resolved to a point where the Commission may consider and take action at the January 28, 1999 meeting. RECOMMENDATION: To table PZ 98-55 and Ordinance No. 2361 to the January 28, 1999 meeting. ____________________________ Christopher Baker Planner CITY OF NORTH RICHLAND HILLS PLANNING AND ZONING COMMISSION COVER SHEET JANUARY 14, 1999 PS 98-60 Request of Rick Simmons for a Preliminary Plat of Lot 1, Block 1, Villa’s on Bear Creek Addition. (Located in the 8000 Block of Davis Boulevard) Rick Simmons is the owner of this15.5-acre tract of land. This property is currently zoned as a PD for Independent Senior Living. The issues associated with this plat are as follows: 1. Flood Plain: Portions of the northern boundary of this property are located in the FEMA 100-Year Flood Plain. The applicant has been advised that this portion of the property is to be designated as a drainage easement and shall have it’s own metes and bounds description. The applicant has agreed to this request. 2. Drainage Analysis: A drainage study will be required in conjunction with the final plat. 3. Fire Hydrant: The applicant has been advised of the fire hydrant radii coverage requirement. The applicant has agreed that the property shall have appropriate fire coverage in accordance with the regulations. 4. Offsite Easement: Offsite easements may be required in conjunction with the development of this property. The applicant has been advised that all Offsite Easement Agreements shall be forwarded to the Public Works Department for review and approval. 5. Little Bear Creek Corridor: All of the Park Department concerns regarding this project were addressed at the time of site plan approval for the PD. 6. ROW Dedication: The preliminary plat does not show conclusively the required ROW dedication for Davis Boulevard. The applicant has been advised that information is required to determine if any additional ROW is needed at this location. The applicant has agreed to this request. 7. Driveway Spacing: The site plan approved in conjunction with the PD request indicated two curb cuts along Davis Boulevard. The plat/plans indicate these curb cuts in conformance with the approved site plan. 8. Sidewalks: The applicant has been advised that sidewalks are a requirement and has agreed to this request. 9. Streetlights: The applicant has been advised that streetlights are required and has agreed to this request. All other engineering comments have been agreed to. This plat is in conformance with the Comprehensive Land Use Plan for the City of NRH.
