ORDINANCE NO. 754
AN ORDINANCE LIMITING WEIGHT OF VEHICLES TRANSPORTING REAQY
MIXED CONCRETE OVER ALL BUT CERTAIN PUBLIC STREETS IN NORTH
RICHLAND HILLS, TEXAS, TO VEHICLES WITH A TANDEt1 AXLE LOAD
OF 36,000 POUNDS OR LESS, A SINGLE AXLE LOAD OF 12,000 POUNDS
OR LESS, PROHIBITING GROSS LOADS EXCEEDING 48,000 POUNDS;
PROVIDING A PENALTY, AND AUTHORIZING PUBLICATION.
WHEREAS, Art. 6701d-12, Sec. 2, as amended by the 65th Legislature
in 1977 allows cities to limit the weight of ready-mixed concrete trucks using
public highways maintained by the city upon a finding that such public high~/ays
are insufficient to carry the maximum gross vehicle axle loads authorized by
Sec. 1 of Art. 6701d; and, .
, WHEREAS, there is not a single street located within and maint?ined
by the City of North Richland Hills which is \capable of carrÿingsuch' wéights?
which fact is hereby determined by the City Council of the City of North
Richland Hills;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS:
Sec. 1. Ready-mixed concrete trucks with tandem axle loads
exceeding 36,000 pounds, with single axle loads
exceeding 12,000 pounds, or with a gross load exceeding
48,000 pounds are hereby prohìbited from all public
streets in the corporate limits of the City of
North Richland Hills, Texas, with the following
exceptions: Airport Freeway, Loop 820, Texas 121
(Grapevine Highway), Davis Boulevard (FM 1938)
and any other public highway maintained by the
State of Texas.
Sec. 2. Any person, firm, or corporation violating any
provisions of this ordinance as read together
with the Comprehensive Zoning Ordinance and
the accompanying map thereto shall be guilty
of a misdemeanor, and upon conviction thereof
shall be fined in a sum not to exceed bro hundred
($200.00); each and every 10adviblatibn $hiill
çonstitute a separate offense and is punishable
as such.,
Sec. 3. The City Secretary is hereby authorized and
directed to cause publication of the descriptive
caption and penalty clauses hereof as an alternative
method of publication provided by law.
