APPROVED Park Planner Michael Wilson presented item. The existing playground equipment at Norich Park was installed in 1994 and is scheduled to be replaced. The city received competitive sealed proposals on February 20, 2018. The project is included in the capital projects budget and is funded by the park impact fee reserves. PUBLIC HEARINGS April 09, 2018 City Council Meeting Minutes Page 4 of 7 C.1 ZC 2017-11, ORDINANCE NO. 3509, PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM BENCHMARK AMERICAN HOMES, LLC, FOR A ZONING CHANGE FROM LR LOCAL RETAIL TO RI-PD RESIDENTIAL INFILL PLANNED DEVELOPMENT AT 6351, 6413, 6415, AND 6429 GLENVIEW DRIVE, BEING 3.535 ACRES DESCRIBED AS LOTS B AND B1, DIAMOND LOCH ADDITION, AND TRACT 2132, R.P. BARTON SURVEY, ABSTRACT 175. PUBLIC HEARING POSTPONED TO APRIL 9, 2018. APPROVED Mayor Trevino announced that this request was postponed by Council at their March 26, 2018 meeting. The public hearing and action was postponed to the April 9, 2018 City Council meeting. Mayor Trevino opened the public hearing and called on Planning Manager Clayton Comstock to introduce the item. Mr. Comstock informed Council the applicant is requesting a zoning change for 3.535 acres located on the north side of Glenview Drive across from Linda Spurlock Park. The area is designated on the Comprehensive Land Use Plan as low density residential and the current zoning is local retail. Mr. Comstock presented site photos of the property. Applicant representative Osama Nashed, 5000 Thompson Terrace, Colleyville, presented request. As recommended by Council, the applicant meet with adjacent neighbors on April 3, 2018 to discuss their concerns with the proposed development. The development will have 1.5 story homes on Lots 1-11, with no second story windows on the back; residential units will be a minimum of 2,000 square feet; and an 8-foot fence will be constructed with the development adjacent to Diamond Loch residents. If request is approved, the developer will clear the underbrush located between the development and adjacent neighbors. The backyard will be a minimum of 20 foot and any tree that is identified as suitable and within 10 foot of the fence will remain. Mr. Comstock presented staffs report. The request is for 17 single family lots with a minimum of 2,000 square feet for residential units. Mr. Comstock reviewed the landscape plan, site details, planned development standards, and preliminary plat. As a result of the meeting with the applicant and neighbors, the following planned development standards have changed: - 1.5 story permitted on Lots 1-11. A half story is defined as a floor area that is partially or wholly built into the framing of the roof or where the upper level is less than 60% of the lower.; - No windows facing north on second story of Lots 1-11; and - North property line: 8-foot pre-stained cedar board-on-board fence with finished side facing north. Mr. Joe Wade, 6420 Diamond Loch North, spoke in opposition of the request. Mr. Mark Chandler, 6400 Diamond Loch North, spoke on behalf of ten or more individuals. He reviewed discussions with applicants of Benchmark American Homes. Mr. Chandler thanked Benchmark for meeting with them and they are in support of the development based on their discussions. Mr. Steve Owen, 6404 Diamond Loch, spoke in support of the request. There being no one else wishing to speak, Mayor Trevino closed the public hearing. H. INFORMATION AND REPORTS - COUNCIL MEMBER RODRIGUEZ H.1 ANNOUNCEMENTS Council member Rodriguez made the following announcements. The 2018 Sounds of Spring Concert Series kicks off this Friday at 7:00 p.m. on the plaza April 09, 2018 City Council Meeting Minutes Page 6 of 7 in front of City Hall. Admission is free. Seating is on the lawn, so don't forget to bring a blanket or lawn chair. A variety of gourmet food trucks will be on site for each concert and there will be free games and activities for children. For more details, please visit our website or call the Parks Department. The annual Spring Community Cleanup will take place this Saturday, April 14, 2018. Residents can drop off bulky items like brush, old furniture and tires. Paper shredding will also be available. Items can be dropped off from 9:00 a.m. to noon at the parking lot of Tarrant County College Northeast, by the tennis courts. Proof of residency must be presented. Kudos Korner - Our Volunteers in Police Service - The VIPS recently surpassed 100,000 hours volunteered to the City of North Richland Hills. Presenter: Mark Mills, Finance Director Summary: The Town of Pantego is requesting to enter into a cooperative purchasing agreement for the purchase of goods and services from vendors selected through the competitive bidding process. General Descri to ion: The Town of Pantego is requesting to enter into a cooperative purchasing agreement for the purchase of goods and services from vendors selected through the competitive bidding process. The Town of Pantego is interested in purchasing from a current City of North Richland Hills contract for Slurry Sealing (RFB 15-020, Intermountain Slurry Seal). Council has authorized several of these cooperative agreements in the past and they have been mutually beneficial to North Richland Hills and the other agencies. Participation reduces the overall expense of soliciting bids and purchasing in larger quantities often lowers the cost of the goods and/or services. Each agency will place its own orders and pay the vendors directly. The City of North Richland Hills or the Town of Pantego may change or cancel the agreement with a 30-day written notice. North Richland Hills currently participates in cooperative agreements with several local governments throughout the DFW Metroplex and various parts of Texas. Recommendation: Authorize the City Manager to execute a cooperative purchasing agreement with the Town of Pantego for slurry sealing. COOPERATIVE PURCHASING AGREEMENT BETWEEN CITY OF NORTH RICHLAND HILLS AND TOWN OF PANTEGO This Agreement made and entered into by and between the City of North Richland Hills, hereinafter referred to as "NRH", and the Town of Pantego, hereinafter referred to as "Pantego". Pursuant to the authority granted by Chapter 271 of the Texas Local Government Code providing for the cooperation between local governmental bodies, the parties hereto, in consideration of the premises and mutual promises contained herein, agree as follows: NRH and Pantego desire to enter into an Agreement for the purchase of goods and services from vendors selected through the competitive bidding process. Specifications for said items should be determined in cooperation with the final approval of the entity processing the bid. The responsibility of each entity shall be as follows: L NORTH RICHLAND HILLS 1 . NRH shall be allowed to purchase goods and services from vendors who have been selected by Pantego through the competitive bidding process. NRH will place orders directly with and pay directly to the selected vendor for goods and services purchased through a contract. 2. All purchases will be within the specifications and under the terms and conditions that have been agreed to by the parties. NRH shall be responsible for the Vendors compliance with all conditions of delivery, price and quality of the purchased goods or services. 3. NRH shall give a 30-day written notification to all participating agencies of any change or cancellation of participation. 4. The Purchasing Agent, shall be designated as the official representative to act for NRH in all matters relating to this cooperative purchasing agreement. IL TOWN OF PANTEGO 1 . Pantego shall be allowed to purchase goods and services from vendors who have been selected by NRH through the competitive bidding process of NRH. Pantego will place orders directly with and pay directly to the selected vendor for goods and services purchased through a contract. 2. All purchases will be within the specifications and under the terms and conditions that have been agreed to by the parties. Pantego shall be responsible for the Vendors compliance with all conditions of delivery, price and quality of the purchased goods or services. 1 Pantego shall give a 30-day written notification to a participating agency of any change or cancellation of participation. 4. City Manager, shall be designated as the official representative to act for Pantego in all matters relating to this cooperative purchasing agreement. This Agreement shall take effect upon execution by the signatories and shall be in effect from date of execution until terminated by either party with thirty (30) written notice. IN WITNESS WHEREOF, the parties hereto have caused this agreement to be executed by their authorized officers. GENERAL DESCRIPTION: Staff estimated that the total cost of fuel for the FY 2017/2018 would be $474,457. This fuel includes gasoline, diesel fuel and propane. The amount of$474,457 was included in the 2017/2018 budget and approved by Council. The city and Tarrant County currently have an agreement in place to allow for the purchase of gasoline, diesel fuel and propane with Martin Eagle Oil Company using the Tarrant County contract. Staff has reviewed prices that Tarrant County has for fuel and believes that the Tarrant County contract provides the best pricing for our needs. All state competitive bidding requirements will be met by purchasing fuel through this contract. RECOMMENDATION: Authorize the purchase of fuel for city vehicles and equipment in an amount not to exceed $474,457 using the Tarrant County contract with Martin Eagle Oil Company. One-hundred thirteen (113) vendors were contacted and requested to participate in this bid process. All documents pertaining to this bid were posted on the Tarrant County website and were downloaded by interested bidders. A pre-bid conference held on January 30, 2018 was attended by four (4) vendors as well as representatives from Transportation Services, Precinct 1 Maintenance, and Purchasing. Five (5) bids and three (3) no bids were received. Bids were evaluated by Transportation Services, three (3) Maintenance Precincts, and Purchasing representatives. Award recommendations are to the low bids, meeting specifications. The bid received from Mansfield Oil Company was deemed non-responsive for failure to sign Addendum 1 as required. The term of the contract is twelve (12) months, effective April 7, 2018, with three (3) options for renewal periods of twelve (12)months each. Therefore, it is the joint recommendation of Transportation Services, three (3) Maintenance Precincts, and Purchasing that Bid No. 2018-057, Annual Contract for Fuel, be awarded to the vendors listed above at the per unit price. PRESENTER: Clayton Comstock, Planning Manager SUMMARY: On behalf of Oakmark Custom Homes, Teague, Nall, and Perkins, Inc., is requesting a zoning change from R-1-S Special Single-Family to R-2 Single-Family Residential on 2.199 acres located at 8120 Sayers Lane. GENERAL DESCRIPTION: The applicant is requesting a zoning change to R-2 Single Family Residential with the intent to develop the property as single-family residential. The property is located west of Davis Boulevard on the south side of Sayers Lane at the end of the street. The site is currently vacant. The proposed zoning change is consistent with the recommendations and policies of the Comprehensive Plan. PUBLIC INPUT: Following posting of the public hearing signs on the subject property, the Planning & Zoning Department received a petition in opposition to the request. The Texas Local Government Code states in part that if a written petition of opposition is signed by the owners of at least 20% of the area of the lots or land included in the 200- foot notification area surrounding the property, the affirmative vote of at least three-fourths of all members of the governing body is required to approve the request. The analysis of the petition indicates that the owners of 62.6% of the land area signed the petition in opposition to the request. COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Low Density Residential." WHEREAS, the City of North Richland Hills, Texas is a home-rule municipality located in Tarrant County, Texas acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the Zoning Ordinance of the City of North Richland Hills regulates and restricts the location and use of buildings, structures, and land for trade, industry, residence, and other purposes, and provides for the establishment of zoning districts of such number, shape, and area as may be best suited to carry out these regulations; and WHEREAS, the City Council has previously passed an ordinance adopting a Comprehensive Land Use Plan Map as the primary document on which to base all zoning, platting, and other land use decisions; and WHEREAS, the Comprehensive Land Use Plan Map provides guidance for future development in conformance with the adopted Comprehensive Land Use Plan; and WHEREAS, the owner of the property containing approximately 2.199 acres of land located at 8120 Sayers Lane (the 'Property") has filed an application to rezone the Property from its present classification of R-1-S (Special Single- Family) to R-2 (Single-Family Residential); and WHEREAS, the Planning and Zoning Commission of the City of North Richland Hills, Texas held a public hearing on April 5, 2018, and the City Council of the City of North Richland Hills, Texas, held a public hearing on April 23, 2018, with respect to the zoning change described herein; and Ordinance No. 3512 ZC 2018-02 Page 1 of 4 WHEREAS, the City has complied with all requirements of Chapter 211 of the Local Government Code, the Zoning Ordinance of the City of North Richland Hills, and all other laws dealing with notice, publication, and procedural requirements for rezoning the Property; and WHEREAS, upon review of the application, and after such public hearing, the City Council finds that granting the request herein furthers the purpose of zoning as set forth in the Zoning Ordinance of the City of North Richland Hills and that the zoning change should be granted, subject to the conditions imposed herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: Section 1: That the Zoning Ordinance of the City of North Richland Hills is hereby amended by rezoning from R-1-S (Special Single-Family) to R-2 (Single Family Residential) 2.199 acres of property described as Lot 8, Block 3, Woodbert Addition, commonly referred to as 8120 Sayers Lane, as described on Exhibit 'A," attached hereto and incorporated for all purposes. Section 2: That the official zoning map of the City of North Richland Hills is amended and the Planning Manager is directed to revise the official zoning map to reflect the approved R-2 (Single Family Residential) zoning, as set forth above. Section 3: The use of the property described above shall be subject to all applicable regulations contained in the Building and Land Use Regulations and all other applicable and pertinent ordinances of the City of North Richland Hills. Section 4: The zoning district as herein established has been made in accordance with a comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of North Richland Hills, Texas, as amended, except when the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such code, in which event the conflicting provisions of such ordinances and such code are hereby repealed. Section 6: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any section, paragraph, sentence, clause, or phrase of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall Ordinance No. 3512 ZC 2018-02 Page 2 of 4 not affect any of the remaining sections, paragraphs, sentences, clauses, and phrases of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional section, paragraph, sentence, clause or phrase. Section 7: Any person, firm or corporation violating any provision of the Zoning Ordinance and the zoning map of the City of North Richland Hills as amended hereby shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. Section 8: All rights and remedies of the City of North Richland Hills are expressly saved as to any and all violations of the provisions of any ordinances governing zoning that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. Section 9: The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption and penalty clause of this ordinance two times. Section 10: This ordinance shall be in full force and effect immediately following publication as required by Section 9 hereof. AND IT IS SO ORDAINED. PRESENTER: Clayton Comstock, Planning Manager SUMMARY: On behalf of HW Ventures, LLC, Hamilton Duffy is requesting a zoning change from C-1 Commercial to R-2 Single-Family Residential on 2.952 acres located on the south side of Sayers Lane just west of Davis Boulevard. GENERAL DESCRIPTION: The applicant is requesting a zoning change to R-2 Single Family Residential with the intent to develop the property into six single-family residential lots. The property has 480 feet of frontage on Sayers Lane and is approximately 267 feet deep. A replat of the property will be considered at a future meeting. The site is currently vacant. COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Retail." This designation is intended to permit a variety of retail trade, personal and business services establishments, and offices. The Strategic Plan Committee reviewed the area around the Sayers Lane and Davis Boulevard intersection during its discussions on the future land use plan. While the future land use plan recommendations have not yet been ratified by the Committee or adopted by City Council, it is anticipated that this area would be recommended for low density residential development. Final recommendations are planned for presentation and adoption by October 2018. CURRENT ZONING: The property is currently zoned C-1 Commercial. This district is intended to provide for development of retail service and office uses principally serving community and regional needs. The district should be located on the periphery of residential neighborhoods and be confined to intersections of major arterial streets. Section 2: That the official zoning map of the City of North Richland Hills is amended and the Planning Manager is directed to revise the official zoning map to reflect the approved R-2 (Single Family Residential) zoning, as set forth above. Section 3: The use of the property described above shall be subject to all applicable regulations contained in the Building and Land Use Regulations and all other applicable and pertinent ordinances of the City of North Richland Hills. Section 4: The zoning district as herein established has been made in accordance with a comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the community. Section 5: This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of North Richland Hills, Texas, as amended, except when the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such code, in which event the conflicting provisions of such ordinances and such code are hereby repealed. Section 7: Any person, firm or corporation violating any provision of the Zoning Ordinance and the zoning map of the City of North Richland Hills as amended hereby shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. Section 8: All rights and remedies of the City of North Richland Hills are expressly saved as to any and all violations of the provisions of any ordinances governing zoning that have accrued at the time of the effective date of this Ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this Ordinance but may be prosecuted until final disposition by the courts. GENERAL DESCRIPTION: The applicant is requesting a zoning change to NR-PD Nonresidential Planned Development with the intent to divide the property into two lots for office development. The property has 268 feet of frontage on Davis Boulevard and is approximately 112 feet deep. A replat of the property will be considered at a future meeting. The site is currently vacant. This site is adjacent to property also under consideration for rezoning to R-2 Single-Family Residential on the April 23, 2018, agenda (see ZC 2018-05). A conceptual plan for the property is attached. The purpose of the conceptual plan is to identify modifications to specific site development standards for the site. These items are described in more detail below. A site plan for the property must be approved by the Development Review Committee before the issuance of a building permit. Building lines Due to the limited depth of the property, the applicant proposes to modify the front and rear building lines as shown in the table below. The required building line is based on the current zoning of C-1 Commercial. Masonry screening wall Construction of a masonry screening would be required along the west property line since the adjacent lot would be used for single-family residential development. The wall would typically be constructed at the time the commercial property develops. However, the applicant proposes to construct the screening wall before the house is built on the residential lot. The planned development would include a standard that the screening wall be constructed by a certain date to be determined. Driveways The property has an existing drive approach on Davis Boulevard near the south property line. The planned development would include a standard to remove the driveway as part of the site development. Driveway access to the site would be restricted to Sayers Lane. COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Retail." This designation is intended to permit a variety of retail trade, personal and business services establishments, and offices. The Strategic Plan Committee reviewed the area around the Sayers Lane and Davis Boulevard intersection during its discussions on the future land use plan. While the future land use plan recommendations have not yet been ratified by the Committee or adopted by City Council, it is anticipated that this area would be recommended for office development on the Davis Boulevard frontage. Final recommendations are planned for presentation and adoption by October 2018. CURRENT ZONING: The property is currently zoned C-1 Commercial. This district is intended to provide for development of retail service and office uses principally serving community and regional needs. The district should be located on the periphery of residential neighborhoods and be confined to intersections of major arterial streets. It is also appropriate for major retail corridors. PROPOSED ZONING: The proposed zoning is NR-PD Nonresidential Planned Development following the 0-1 Office district land uses and development standards. The following regulations shall be specific to this NR-PD District. Where these regulations conflict with or overlap another ordinance, easement,covenant or deed restriction, the more stringent restriction shall prevail. A. Permitted Land Uses. The buffer yard adjacent to single-family residential property must be at least ten (10) feet wide. The buffer yard must be landscaped in accordance with the standards contained in Section 114-72 of the landscaping and buffering regulations. S. A six-foot tall masonry screening wall must be constructed on the west property line adjacent to the single-family residential property. The wall must be constructed as a traditional masonry wall or a pre-cast product such as Verti-crete. This 2.88-acre subdivision is located on the east side of Wessex Street, north of Liberty Way. The proposed final plat is consistent with the preliminary plat and meets the requirements of the zoning ordinance and subdivision regulations. GENERAL DESCRIPTION: The final plat for Cambridge Estates Phase 2 includes 12 single-family residential lots and one open space lot. The residential lots range in size from 6,400 to 13,450 square feet, with an average lot size of 8,321 square feet. The open space lot, located at the northeast corner of Wessex Street and Liberty Way, is 25,596 square feet (0.588 acres) in size.
