HomeMy WebLinkAboutZBA 1997-01-16 Minutes MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS January 16, 1997 - 7:30 p.m. 1. CALL TO ORDER The meeting was called to order by Chairman Duer at 7:30 p.m. 2. ROLL CALL PRESENT ZBA Members Chairman Duer Bill Schopper Paul Young Jimmy Bellomy ABSENT Billy Cypert CITY STAFF Director, Planning Barry LeBaron Planner Bill Longnecker Recording Secretary Valerie Byers 3. CONSIDERATION OF MINUTES OF DECEMBER 17, 1997 APPROVED Mr. Young made the motion to approve the minutes of December 17, 1996, as presented. The motion was seconded by Mr. Schopper. The motion carried 3- 0. Mr. Bellomy abstained because he was not present at this meeting. Chairman Duer stated that State law requires four affirmative votes for a variance to pass, regardless of the number of members in attendance. He stated the board consists of five voting members and only four members were present, meaning all four members would have to vote unanimously in order for a motion to carry. 4. BA 97-01 REQUEST OF CUSTOM DESIGN HOMES TO ALLOW A STRUCTURE TO ENCROACH INTO A REQUIRED SIDE YARD ON LOT 9, BLOCK 10, CRESTWOOD ESTATES ADDITION (LOCATED AT 7509 SHANE CT) APPROVED Chairman Duer opened the public hearing and asked any proponents of this request to come forward. Mr. Ed White, Construction Manager for Custom Design Homes presented this request. He explained that after receiving a building permit for a new residence at 7509 Shane Ct., the future owner requested some modifications, which pushed the house closer to the side property line. He explained that the foundation was poured and the house is only 7 1/2 feet from the side property line. Mr. White explained they are requesting this variance to prevent a possible delay in closing on this property when it is sold. Chairman Duer called for any additional proponents, there being none, Chairman Y p p � 9 Duer called for any opponents. There being none, he closed the public hearing. Mr. Bellomy made a motion to approve BA-97-01 as presented. Mr. Young seconded the motion and it carried 4 - 0. 5. BA 97-02 REQUEST OF CHARLES SIMPSON TO ALLOW A CARPORT TO ENCROACH ON THE SIDE BUILDING LINE OF LOT 2, BLOCK 4, FOSTER VILLAGE ADDITION (LOCATED AT 7304 MEADOWVIEW TR.) DENIED Chairman Duer opened the public hearing and asked for any proponents to come forward. Mr. Charles Simpson, 7304 Meadowview Terrace, presented his request. He explained that he had hired a contractor to construct two carports for him. Mr. Simpson says he was unaware of a permit process and his contractor never mentioned it. Mr. Simpson submitted a petition signed by neighbors stating they had no problem with the carports. Additionally, he submitted pictures for the Commissioners and stated he would answer any questions they may have. Chairman Duer asked for any additional proponents. There being none, Chairman Duer asked for any opponents. There being none, the public hearing was closed. Mr. LeBaron stated that an unsigned letter had been hand delivered earlier in the afternoon opposing to Mr. Simpson's request. All the Commissioners stated their concerns with the height of the carport over the R.V., and the fact that he was driving over his grass for access to this carport. Chairman Duer asked the Commissioners for a motion. There was no response and Chairman Duer informed Mr. Simpson that his request was denied because of a lack of a motion. Chairman Duer informed Mr. Simpson of the appeal process thru the State District Court System. 6. BA 97-04 REQUEST OF NEAL NELSON TO VARY FROM THE MASONRY SCREENING WALL REQUIREMENTS BETWEEN COMMERCIAL AND RESIDENTIAL PROPERTY ON LOT 3, BLOCK 2, CULP ADDITION. (LOCATED IN THE 8300 BLOCK OF NORTHEAST PARKWAY) WITHDRAWN Chairman Duer announced that the applicant had withdrawn his request for a variance and that in order to be heard in the future, the applicant would have to reapply and the citizens would be re-notified. 7. BA 97-03 REQUEST OF THOMAS WARD TO ALLOW A CARPORT TO EXTEND BEYOND THE FRONT BUILDING LINE BY 21 FEET ON LOT 89, BLOCK 4, NORTH HILLS ADDITION (LOCATED AT 5916 NORTH HILLS DRIVE) APPROVED Chairman Duer opened the public hearing and called for any proponents. Mr. Robert Selito, grandson to the applicant, presented this request. He explained that he and his wife live with his grandfather, who is 89 years old and take care of him. The applicant is requesting a variance on the front building line in order to erect a carport to protect the grandson's new vehicle before the hail season hits. Mr. Selito additionally stated that this carport would give a little protection to his grandfather going to and from the mailbox. Mr. Ward, applicant, requested the board consider granting his request. Chairman Duer asked for any additional proponents. There being none, Chairman Duer asked for any opponents. There being none, the public hearing was closed. Mr. Schopper made a motion to approve BA 97-03. Mr. Bellomy seconded the motion and it carried 4 - 0. 8. STAFF REPORT There was nothing to report. 9. CITIZEN COMMENTS There were none. 10. ADJOURNMENT There being no further business to conduct, the meeting adjourned at 8:12 p.m. Chairman, Zoning Board of Adjustment
