CALL TO ORDER The meeting was called to order by Dr. Tommy Duer at 7:00 p.m. 2. CONSIDERATION OF MINUTES OF NOVEMBER 18, 1999 Kyle Bacon, seconded by Leslie Jauregui moved to approve the Minutes of the November 18, 1999 meeting after corrections on page 3, 5 and 7 (Kevin Bacon changed to Kyle Bacon). The motion carried unanimously. Dr. Tommy Duer explained that this board consists of five voting members and it requires four affirmative votes in order for a variance to pass. BA 99-23 PUBLIC HEARING TO CONSIDER THE REQUIEST OF THE CITY OF NORTH RICHLAND HILLS FOR ANTHONY & BRENDA VEAL FOR A VARIANCE FROM SECTION 410 R-1, SINGLE FAMILY DISTRICT FOR THE MINIMUM FRONT YARD SETBACK ON LOT 2, BLOCK 5, HEWITT ESTATES. THE PROPERTY IS LOCATED AT 6819 MEADOW ROAD. Anthony and Brenda Veal were granted a building permit by City Manager, C.A. Sanford, in 1996 prior to the plat being approved. When the building plans were submitted, the house was shown to be located 25 feet from the front property line as required. Mr. Sanford approved the building permit based on the fact that the developer, Jean Cloke, would complete the platting process. The platting process was not completed. The City Manager's Office in an effort to clear up some issues for future building permits and sales, authorized staff to submit a plat for approval on Lot 2, Block 5, Hewitt Estates. City Council approved the plat on November 22, 1999. When the platting process was begun the second time, it was discovered that a 4 foot of right-of-way dedication was necessary for Meadow Road. The right-of-way dedication means the existing house encroaches 4 feet into the new 25 foot front yard setback. Staff recommended the Zoning Board of Adjustment approve the request as submitted by the City of North Richland Hills to the City of North Richland Hills Zoning Ordinance No. 1874, Section 410.C.5, Minimum Front Yard Setback as shown on the survey for property addressed as 6810 Meadow Road and known as Lot 2, Block 5, Hewitt Estates. 1 . Section 410.C.5. — Minimum Front Yard Setback — The minimum front yard setback is 25 feet from the property line. The requested variance is to allow only the existing house to encroach 4 feet into the 25-foot front yard setback as shown on the survey. Staff found special conditions exist on this request. The house is existing and at the time of construction the house met the 25 foot front yard setback. Approval of this variance is for the house only and will stay with the property. Dr. Duer ask if there were any questions from the Board, and if they had received a permit for the pool. Greg Dickens stated the pool was complete. They did receive a permit for construction of the pool. ZBA Minutes 2 December 16, 1999 Seeing no further questions, Dr. Duer closed the public hearing and opened the discussion from the board members or motion. Leslie Jauregui made a motion that the Board approve due to the circumstances that occurred in the past and to clear for future sales and permits for existing structure only and any future remodeling would have to comply with current city building regulations and codes. Kyle Bacon seconded the motion and the motion carried unanimously by a vote of 4-0. 5. BA 99-24 PUBLIC HEARING TO CONSIDER THE REQUEST OF TEXAS STAR BUILDERS FOR A VARIANCE FROM SECTION 630.E.3, FRONT BUILDING LINE SETBACK — A CARPORT SHALL NOT EXTEND BEYOND THE FRONT BUILDING LINE; AND SECTION 140.A FRONT YARD REGULATION ON LOT 12, BLOCK 16, NORTH RICHLAND HILLS ADDITION. THE PROPERTY IS LOCATED AT 4720 VANCE ROAD. (RESCHEDULED TO JANUARY 20, 2000). 6. CITIZEN COMMENTS There were none. 7. MISCELLANEOUS REPORTS & DISCUSSION There were none. 8.
