PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of CJ Real Estate LLC, ClayMoore Engineering is requesting a zoning change from C-1 Commercial to NR-PD Non-Residential Planned Development on 0.68 acres located at 6425 Precinct Line Road. GENERAL DESCRIPTION: The 29,428-square-foot site under consideration is located on the east side of Precinct Line Road, just south of the intersection of Martin Drive. The site is vacant and located between Shipleys Do-Nuts and Andy's Frozen Custard. The owner proposes to construct a Starbucks quick service restaurant with drive through on the property. A complete site plan package for the proposed restaurant is attached. Planned improvements to the site include a 2,202-square-foot restaurant with drive-through service. The zoning ordinance includes specific standards for the design and layout of drive-through lanes, and the proposed project satisfies all design standards. The parking lot contains 28 spaces, including stacking space for eight cars in the drive- through lane. Driveway access is available from Precinct Line Road through a shared driveway with Shipley Do-Nuts. Additional driveway access is available from the rear of the site through an existing common access easement that connects Martin Drive to the Home Depot parking lot. Landscaped areas cover 22% of the lot. These areas include a landscape setback adjacent to Precinct Line Road, parking lot islands, and landscaped areas adjacent to the drive-through lane. A multi-tenant monument sign is proposed that would provide signage for the Starbucks restaurant and a future development on the lot to the west, which does not have street frontage. IqRH The application for rezoning to the NR-PD district provides an opportunity to address modifications to specific site development and building design standards for the site. These items are described in more detail below. All other development standards have been satisfied. Land use In 2015, the zoning ordinance was amended to create new land use types for restaurants. One of the land use types is "quick service restaurant," commonly referred to as a fast food restaurant. This land use requires approval of a special use permit in the C-1 zoning district or approval as part of a planned development district. The applicant is requesting approval of the land use as part of the planned development district. Building design The proposed building design is consistent with the architecture and design direction for newer Starbucks stores being constructed. However, the overall design does not technically conform to all the architectural standards j contained in the zoning ordinance, specifically those related to articulation and ornamentation. The exterior wall materials include brick and cementitious fiberboard panels. The proposed fiberboard panels are a product manufactured by Nichiha®, and similar panels are used on the Andy's Frozen Custard building. The design standards limit the allowable area covered by the fiberboard panels to 15% of a building elevation. One the north and east elevations of the Starbucks building, the fiberboard panels would cover 42% and 25% of the elevations, respectively. The applicant is requesting approval of the proposed design as part of the planned development request. Signs A multi-tenant monument sign is proposed on Precinct Line Road. A conceptual drawing and photos of the monument sign are included in the site plan exhibits. The proposed sign is intended to v provide signage for both the Starbucks restaurant and a future development on the lot to the west, which does not have street frontage. Since the sign r, rei � is larger and taller than allowed by the standards i" NANT and would include signage for off-site tenants, special approval of the sign is required as part of the planned development district. IqRH The sign code standards for multi-tenant monument signs allow a structure size of 100 square feet and height of 8.5 feet. The proposed sign is approximately 104 square feet in area and 13 feet in overall height. The sign design includes a masonry base with two signage panels for off-site tenants and the Starbucks graphic medallion on top. The applicant is requesting that the conceptual sign design and sign size parameters be approved as part of the planned development district. Planned development conditions The following are the proposed conditions of approval for this planned development application. Any other conditions recommended by the Planning and Zoning Commission will be included in the proposed ordinance considered by City Council. 1. Permitted land uses. Uses permitted in this NR-PD district are limited to those permitted in the C-1 Commercial zoning district with the addition of the following: a. Quick service restaurant 2. Site development standards. Development of the property must comply with the site development standards of the C-1 Commercial zoning district and the standards described below. a. Building location and setbacks must be as shown on the attached site plan. b. Landscaping must be installed as shown on the attached landscape plan. All landscaping and irrigation must be installed prior to the issuance of a certificate of occupancy. c. A multi-tenant monument sign may be constructed on the site. i. The sign must not exceed one hundred four (104) square feet in area and thirteen (13) feet in height. ii. The sign may contain sign panels for tenants located on Lot 17R, Block 1, Thompson Park Estates. The total sign area of the panels must not exceed twenty two (22) square feet. 3. Building design development standards. Development of the property must comply with the building design standards of the C-1 Commercial zoning district and the standards described below. a. Building design and appearance must be as shown on the attached building elevations. Building materials must complywith Section 118- 693 of the zoning ordinance. b. Cementitious fiberboard materials may be used on the facades of the building in proportions and locations indicated on the attached elevations. IqRH M COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Retail." This designation is intended to permit a variety of retail trade, personal and business service establishments, and offices. CURRENT ZONING: The property is currently zoned C-1 Commercial. PROPOSED ZONING: The proposed zoning is NR-PD Non-Residential Planned Development following the C-1 Commercial district land uses and development standards. The proposed change is intended to authorize the quick service restaurant use and allow for the modifications to the building design and site development standards for the property. PRESENTER: Clayton Husband, Principal Planner SUMMARY: On behalf of TX Motors of North Richland Hills, Inc., Dynamic Engineering Consultants, PC, is requesting a special use permit (SUP) to authorize a waiver of the masonry requirement for new auto shade structures to be constructed at the AutoNation Hyundai North Fort Worth and AutoNation Chrysler Dodge Jeep Ram (CDJR) North Richland Hills dealerships. The 23.97-acre site is located on the south side of NE Loop 820 and west of Booth Calloway Road. GENERAL DESCRIPTION: The property under consideration includes two automobile dealerships located on the NE Loop 820 frontage road. The properties are bounded on the east by Booth Calloway Road, on the south by Rodger Line Drive, and on the west by Calloway Branch creek. Dealerships have been operating on the properties since at least 1979. Section 118-713 of the zoning ordinance establishes standards for permanent and temporary auto shade covers. Permanent shade covers are permanently attached to the ground with a rigid framework and flexible membrane canopy that covers an area of 500 square feet or more. The shade covers are allowed to be constructed in the front, side, or rear yards of the property, provided they do not obstruct emergency vehicle access. The covers must be a solid subdued color and may not contain any advertising sign or logos. The owner proposes to construct 19 permanent auto shade covers on the properties. Ten of the shade covers would be constructed on the Hyundai site, and nine shade covers constructed on the CDJR site. Shade covers would be located in the front, side, and rear of the properties. The total covered area on both lots would be 85,699 square feet (8.2% of total lot area). The canopies would be constructed with a black steel structure and IqRHN0KTFI KICHLAND HILLS silver/gray membrane fabric. A summary plan showing the proposed locations is shown below. A detailed set of plans showing the site layout, landscaping, and outdoor lighting plans is attached. NE LOW 820 X 7 LEGEND - 77 77 -' 7 , AUTO SHADE COVER M/7771 75 RODGER LNE OR Since the shade covers are considered structures, the standards for exterior materials are applicable. This requires that the columns for the shade covers be constructed or wrapped with a masonry material such as brick or stone. The applicant has applied for an SUP to authorize a waiver of this requirement, as permitted by the zoning ordinance. Landscaping The construction of the new shade structures also makes the landscaping and buffering standards applicable to the properties. The standards are based on the Freeway Corridor Overlay district. The improvements required by the code include landscape setbacks on all street frontages and installation of hardscape elements that include limestone material. The proposed plans include the following features. Detailed landscaping plans are attached. Since some of the landscaping would be located within in the NE Loop 820 right-of-way, the applicant is coordinating with TXDOT for authorization to place the trees and shrubs within the right-of-way. * New crape myrtles on the NE Loop 820 frontage road (9 trees) and Booth Calloway Road (15 trees) * Nine (9) new cedar elm trees on Rodger Line Drive adjacent to Hyundai dealership property IqRH • Parking lot screening shrubs (636 shrubs) on the NE Loop 820 frontage road, Booth Calloway Road, and Rodger Line Drive adjacent to Hyundai dealership property • Limestone monuments on NE Loop 820 frontage road at the driveway and street intersections on both properties Special Use Permit The zoning ordinance provides that special use permits may establish reasonable conditions of approval on the operation and location of the use to reduce its effect on adjacent or surrounding properties. The following are the proposed conditions of approval for this SUP application. These conditions are based on the applicant's proposed construction. These conditions may be modified by the Planning and Zoning Commission. Any other conditions recommended by the Commission will be included in the proposed ordinance considered by City Council. 1. Site development standards. Development of the property must comply with the development standards of the C-2 Commercial zoning district and the standards described below. a. The auto shade covers must be constructed and located as shown on the site plan attached as Exhibit "C." b. Construction of the auto shade covers must comply with Section 118- 713 of the Zoning Ordinance. c. A waiver of the exterior materials standard contained in Section 118-693 of the Zoning Ordinance is authorized for the columns of the auto shade structures. 2. Landscaping. The landscaping for the site, as approved by the Development Review Committee, must be installed within 90 days of approval of the final inspection of the auto shade structures. COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Commercial."This designation is intended to permit a variety of commercial uses including automobile-related services, retail trade, and business service establishments with outside storage, display, and sales. CURRENT ZONING: The property is currently zoned C-2 Commercial. This district is intended to provide for the development of retail and general business uses primarily to serve the community and region. Uses include a wide variety of business activities and may involve limited outside storage, service, or display. The C-2 district should be located away from low and medium density residential development and should be used as a buffer between retail and industrial uses. The district is also appropriate along business corridors as indicated on the comprehensive plan. PROPOSED ZONING: The applicant is requesting a special use permit to authorize a waiver of the masonry requirements for automobile shade cover structures. PRESENTER: Clayton Comstock, Planning Manager SUMMARY: On behalf of Long Real Estate Investments, RCC/CT LLC, and DFW Oil, Beaten Path Development is requesting approval of a Special Development Plan (SDP) in the Smithfield Transit Oriented Development (TOD) District. The applicant proposes to develop a project that includes 100 single-family residential units comprised of 76 townhome and 24 duplexes. The property is located on the north side of Mid-Cities Boulevard on the east and west sides of Holiday Lane. GENERAL DESCRIPTION: The project is located within the "Arterial Mixed Use" and "TOD Residential' subzones of the Smithfield TOD district. • The "Arterial Mixed Use" subzone is intended to provide appropriate transitions to major regional roadways while taking advantage of the frontage for limited auto- oriented uses and sites. The subzone does not permit townhomes by right. Any residential proposed within the "Arterial Mixed Use" subzone is limited to second floors above non-residential uses. • The "TOD Residential' subzone provides the transitions from higher intensity development of the TOD Core and existing residential neighborhoods and allows townhomes by right. The map excerpt below, taken from the Smithfield TOD Regulating Plan, shows the subject property (thick black outline), the subzone districts, and recommended thoroughfares. Below is a summary of the proposed development, which is planned for construction in two sections on the east and west sides of Holiday Lane. A complete concept plan of the project is attached. T-1.1i M.- I 2ELiDilsissism Project Area 10.92 acres Attached SF units 100 units Residential density 9.16 units/acre Open space 0.79 acres(7.23%) Programmable open space 2.40 acres(21.98%) Common areas 17 lots Parking spaces/residential unit 4.26 spaces TOD WAIVERS REQUESTED: The following waivers to the TOD Code are being requested by this Special Development Plan proposal: 1. TOD Subzone Deviation. The "Arterial Mixed Use" subzone of the TOD code is a subzone found only in the Smithfield TOD and only along Mid-Cities Boulevard. The subzone does not permit single family or first-floor residential. It is intended to encourage continued commercial development along Mid-Cities Boulevard to support the increasing residential densities in other subzones of the district. Because of its proximity along Mid-Cities and at the edge of the TOD district, elements of Conventional Suburban Design (CSD) are permitted by the code. This includes deeper building setbacks from the street, 100% commercial uses, and standard site landscaping. As an example, the shopping center at the northeast corner of Smithfield Road and Mid-Cities Boulevard (Fitness 2000, Subway, The IqRH Corner Cafe, etc.) was designed to meet the TOD code's Arterial Mixed Use subzone. 2. Townhome lot width. The minimum width of a townhome lot or other attached single-family lot permitted by the TOD code is 25 feet. The applicant proposes 83 attached single-family lots with a lot width of 22 feet dispersed throughout the development. These lots support a 22-foot wide townhome product (59 lots) and a 19-foot wide duplex unit product (24 lots). Seventeen (17) of the 100 lots would meet the minimum 25-foot width requirement. 3. Customized street designs. The design of the streets proposed within the development are customized to fit the context and function of the neighborhood while still using the TOD street design criteria as a guide. The dimensions of travel lanes, landscape strips, and parking spaces are all consistent with the TOD design criteria, however on-street parking is limited to one side of the street in the case of Street "A" and Street "C." Street "D" is also designed with the east side sidewalk constructed at the back of the street curb where there would usually be a landscape strip for street trees. Street "B" is also proposed as a one-way street around the central open space. Five-foot sidewalks are also proposed in some areas rather than the minimum six-foot sidewalks required by the TOD Code. See Page 4 of the attached "Design Guidelines" for additional information on the street designs. 4. Parking driveway width. Because of the narrower width of the lots and need for parallel parking off the rear alleys, the maximum permitted residential driveway width of 20 feet may not be achievable. Instead, a continuous concrete parking lane along the alleys will likely be necessary. 5. Build-to-Zone. Both the TOD Residential and Arterial Mixed Use subzones require front build-to-zones with a minimum setback of 10 feet. The applicant is proposing to adopt a front setback of seven (7) feet. STAFF DRC REVIEW: The Development Review Committee (DRC) evaluated the proposal based on the design intent and standards for the Smithfield TOD. The DRC believes that this plan is an improvement over the previous plan proposed by this applicant for this property, which was recommended for denial by the Planning and Zoning Commission on March 15, 2018, under case SDP 2017-06, and was subsequently withdrawn by the applicant. The DRC believes this most recent plan to be an improvement for the following reasons: Larger centralized open space. Open spaces provided on the 2017 plan were small and dispersed areas leftover from where streets and home sites would not fit. The new plan has an open space that is intentionally designed to serve as a centralized park for the neighborhood and can be programmed with neighborhood events and other larger gatherings. Improved pedestrian connections. A mid-block sidewalk is provided that connects Mid-Cities to the centralized open space and further on to the Cotton Belt IqRH Trail through a series of open space paseos. This provides convenient access to the park and trail for all units within the neighborhood. Street connection to east. The 2017 plan did not propose a fully integrated street network that allowed for a mix of uses to develop to the east of the subject property. The new plan provides a street connection to the undeveloped property to the east, which allowe that property vehicular access to the median opening in Mid-Cities Boulevard and the signalized intersection at Holiday Lane. Product diversity. The previous plan had two types of product: a 22-foot wide townhome (74 lots) and a 25-foot wide townhome (19 lots). While smaller, the new plan does include a new product type of a 19-foot wide duplex unit (24 lots) that all face out toward Mid-Cities Boulevard. See Page 3 of the attached "Design Guidelines" for additional information. While the above points demonstrate the improvements to the previous plan, the DRC continues to be interested in the Planning and Zoning Commission and City Council discussions regarding the two remaining topics of concern: Local market uncertainty of 22-foot townhome and 19-foot duplex product. The DRC recognizes that over 90 units of 22-foot wide townhomes were approved in the Iron Horse TOD; however, those townhomes have not yet hit the sales market. The DRC is concerned about additional deviations to the 25-foot minimum lot requirement for townhome lots until the community has a better understanding of the local market for 22-foot townhomes or direction is provided by City Council that this is a favorable and targeted product for North Richland Hills. Units facing Mid-Cities Boulevard. Twenty-four (24) units are proposed to face out toward Mid-Cities Boulevard, a 6-lane major arterial roadway. While a TOD project in Iron Horse TOD does have townhome units facing Iron Horse Boulevard, that roadway is a four-lane street and on-street parking is being provided with that new development. The closest comparison to this situation is The Enclave, which has first-floor multi-family units that face and have access to Mid-Cities Boulevard without on-street parking. COMPREHENSIVE PLAN & CURRENT ZONING: This area is designated on the Comprehensive Land Use Plan and is currently zoned Transit Oriented Development. The purpose of the transit oriented development code is to support the development of the community's station areas into pedestrian-oriented, mixed-use urban neighborhoods, with convenient access to rail transit, shopping, employment, housing, and neighborhood retail services. The goal of each station area is to encourage an efficient, compact land use pattern; encourage pedestrian activity; reduce the reliance on private automobiles; promote a more functional and attractive community through the use of recognized principles of urban design; and allow property owners flexibility in land use, while prescribing a high level of detail in building design and form. IqRH SPECIAL DEVELOPMENT PLAN: The applicant is requesting a special development plan for consideration of modifications to the standards of the transit oriented development district. The special development plan process is intended to allow applicants development flexibility to address specific market opportunities and/or contexts within the transit oriented development district. In evaluating a special development plan, the Planning and Zoning Commission and City Council must consider the extent to which the application meets the following: • the goals and intent of transit oriented development in the city; • provides an alternative"master plan" approach by consolidating multiple properties to create a predictable, market responsive development for the area; • fits the adjoining context by providing appropriate transitions; • provides public benefits such as usable civic and open spaces, livable streets, structured and shared parking, and linkages to transit; and, • does not hinder future opportunities for higher intensity transit oriented development. We contributed the right-ol'way free Of COSt, When WalUga Road was changed, and then the new road divided our land in two. It was our intention that the ownership of this property would furnish security in our old age; Lanni now 83 and my wile is 84. Frankly,the tax has been a burden in more recent years. None the less, it is very, rewarding now,, when we anticipate that our investment will provide a very important improvement to the entire North Texas area, There will be delightful places for families to live,very up to date, prestigious; and SO Convenient to every, needed urban establishment. Recreation will be at hand, and the beautiful landscaping will contribute to everyone's calm composure. Only such a setting encourages the ones living there to enjoy their neighbors, and it will be so nice to go out for dinner and entertainment,oriust visit at home. What triore could anyone expect in their new horne? -Hardly anything! Open park areas within a neighborhood provide play space and outdoor activity space for the community. This 2nd plan with the park like area is an improvement for urban living. I support the Beaten Path Development plan at the corner of Mid Cities Blvd and Holiday Lane with the following exceptions: 1. Inadequate street parking.The first plan submitted by Beaten Path Development contained 93 single family townhomes and 2.83 acres of open space. The second plan compresses 100 single family lots with only 1.85 acres of open space. People and cars will be packed in a small area like sardines. The narrow alley shown parallel to Mid Cities Blvd will not support two way traffic for the fire trucks! 2. Where are the side walks within the community? Many people will be walking to and from the new train station. 3. Because of the high density, the question remains: Will street parking be allowed upon one or both sides of Mid Cities Blvd?If not, where will people park their 2nd and 3`d cars? (or will people be forced to park outside the community? And perhaps park in the commercial areas, or in other neighborhoods, or across Mid Cities Blvd in the church parking lot?)
