Mr. July 19, 2018 Planning and Zoning Commission Meeting Minutes Page 1 of 9 Comstock then introduced the Planning and Zoning Commission orientation and annual training, summarized actions taken on planning related items at the June 25, 2018, and July 9, 2018, City Council meetings, and provided city announcements. He further discussed development activity in North Richland Hills. Mr. Comstock began presenting to the Commission concerning Planning and Zoning Commission regulations set by the City Charter, duties and responsibilities, and other legal and ethical responsibilities of the Commission. City Attorney Maleshia McGinnis presented governing rules and regulations, composition of the Commission, duties and responsibilities of Commission members, authority of the Planning and Zoning Commission, open meetings, ethics and conflicts of interest, and public information and electronic communications. Mr. Comstock provided a brief overview of planning and zoning ordinances, conventional and form-based zoning, subdivision ordinances, landscape ordinances, the Development Review Process, approval process, public hearing notices, decision of the Commission, and City Council goals. Mr. Comstock updated the Commission on the Strategic Plan Committee and Vision 2030. Griggs for a special use permit for a metal accessory structure at 7229 Londonderry Drive, being 3.676 acres described as Lot 2R1, Block 1, Double K Ranch Addition. PRESENTER: Clayton Husband, Principal Planner SUMMARY: Bob E. Griggs is requesting a special use permit to authorize the construction of a metal accessory building on a 3.676-acre lot located at 7229 Bursey Road. GENERAL DESCRIPTION: The property under consideration is a 3.676-acre (160,126 square feet) lot located at the west end of Londonderry Drive. In addition to the house, the property includes two accessory buildings located in the northwest corner of the lot. These buildings include an enclosed wooden barn and an unenclosed metal loafing shed, with a combined size of approximately 1,800 square feet. The applicant has indicated his intent to sell this portion of the property to the adjacent property owner and replat the properties. Since the buildings then would be located on another lot, the applicant proposes to construct a new 1,540-square foot enclosed metal building on the property to replace the buildings that would be sold. The attached letter provided by the applicant explains their request in more detail and describes the overall plan for the property and proposed uses for the building. Exhibits are attached that show the existing and proposed building locations and conceptual design of the proposed building. The proposed metal barn building is 22 feet wide and 70 feet long. It would be located near the northwest corner of the lot and provide a side setback of 50 feet and rear setback of 10 feet from the proposed new lot line (see Exhibit A-1). The building would include overhead garage doors and personnel doors are located on two elevations of the building. All exterior walls of the building are proposed to be metal. Section 118-718(c) of the zoning ordinance establishes the requirements and standards for permanent accessory buildings and structures. The proposed accessory building is compliant with all development standards except for the masonry requirements and roof IqRH pitch. For lots greater than 40,000 square feet in area, the zoning ordinance allows for consideration of a special use permit for varying from specific development standards, which are described in the table below. s e ° ed ° e ° e °e em e Masonry requirement 85%of exterior walls must be faced with 100% metal exterior walls masonry material Roof pitch 2:12 on each side of the ridge 4:12 on each side of the ridge Special Use Permit The zoning ordinance provides that special use permits may establish reasonable conditions of approval on the operation and location of the use to reduce its effect on adjacent or surrounding properties. The following are the proposed conditions of approval for this SUP application. 1. Permitted use. A special use permit is authorized for one (1) accessory building on the property. 2. Building size. The accessory building must not exceed one thousand five hundred forty (1,540) square feet in floor area. 3. Roof pitch. The roof pitch of the accessory building must be a minimum 2:12 pitch on each side of the ridge. 4. Building permit. A building permit may not be issued for the accessory building until one of the following standards are satisfied: a. The two existing buildings shown on the attached exhibit are removed from the property. b. A replat of the property has been recorded that results in the two existing buildings being incorporated into an adjacent property. DRC recommendation The Development Review Committee's recommendation for denial of the special use permit application is based on the building being proposed with metal exterior walls. The zoning ordinance requires at least 85% of the exterior wall surface of each elevation of the building have a masonry exterior. COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Low Density Residential." This designation is intended to provide areas for the development of traditional, low-density single-family detached dwelling units. CURRENT ZONING: The property is currently zoned R-1-S Special Single Family. We have no issues with this being located on the northwest corner of his property which borders ours. I understand what they are wanting does not meet the local ordinance but given the size of his property and location of the new barn I would hope you will consider an exception in this case.
