The Planning and Zoning Commission may enter into closed Executive
Session as authorized by Chapter 551, Texas Government Code. Executive
Session may be held at the end of the Regular Session or at any time during
the meeting that a need arises for the Planning and Zoning Commission to
seek advice from the city attorney (551.071) as to the posted subject matter of
this Planning and Zoning Commission meeting.

SUMMARY:
Over the next few months, a series of presentations about the zoning ordinance will be
included on the work session agenda. These presentations are intended to provide an
overview and training on the concepts and contents of the zoning ordinance.
The preliminary schedule is below, but it may vary depending on the size and complexity
of cases on these agendas. The complete zoning ordinance is online at I RH.._Z.oning

September 20 Residential zoning districts and use regulations. Comparison of residential zoning districts as the
foundation for the zoning ordinance, Including residential planned developments. Look at how land
uses are distributed throughoutthe districts and special conditions for uses.Review of building design
requirements and related site design standards such as parking,fencing,and landscaping.
October 4 Nonresidential zoning districts and use regulations. Comparison of nonresidential zoning districts as
the foundation for the zoning ordinance, including the Town Center zoning district. Look at how land
uses are distributed throughoutthe districts and special conditions for uses.Review of building design
requirements and related site design standards such as parking,fencing,and landscaping.
October 18 Special zoning districts and use regulations. Comparison of special districts including the Freeway
Corridor Overlay and Transit Oriented Development districts. Look at how land uses are distributed
throughout the districts and special conditions for uses
November 1 Miscellaneous regulations.Review of general standards such as outdoor storage,accessory buildings
and structures,outdoor lighting,detention ponds,and other standards.
November 15 Administration. Overview and discussion of procedures for administration of the zoning ordinance,
including zoning change applications and code amendments. Look at the Zoning Board of Adjustment
and nonconforming uses and structures.

The minutes are approved by majority vote of the Commission at the Planning and

GENERAL DESCRIPTION:
The Planning and Zoning Office prepares action minutes for each Planning and Zoning
Commission meeting. The minutes from each meeting are placed on a later agenda for
review and approval by the Commission. Upon approval of the minutes, an electronic
copy will be uploaded to the City's website.
RECOMMENDATION:

Planning Manager Clayton Comstock introduced Planning and Zoning Commissioner
Wendy Werner. Mr. Comstock summarized actions taken on planning related items

further discussed development activity in North Richland Hills.

Planning Manager Clayton Comstock presented item CA and provided a history of
zoning change requests dating back to 2014 regarding zoning changes to R-1-S
Special Single-Family and R-1 or R-2 Single-Family Residential.
Mr. Comstock presented item C.2. Mr. Comstock and the Commission discussed the
proposed setbacks of the antenna and similar antennas within North Richland Hills.

Chairman Welborn and Mr. Comstock discussed how the boundary for the residential
estate area was created. Mr. Comstock stated that it was created by staff based on
existing contiguous areas of R-1-S and AG zoned properties as well as lot sizes and
residential densities.
Chairman Welborn announced Planning Technician John Chapman will begin calling
individuals who filled out and submitted a public meeting appearance card to speak.

Commissioner Kathy Luppy commented that the upcoming 2018 comprehensive plan
is proposed to be adopted by the end of the year and will likely include a residential
estate lot recommendation.
Commissioner Mason Orr stated the R-2 zoning request is reasonable.
Vice Chairman Jerry Tyner stated he was part of the 2014 joint meeting with City
Council when the estate lot subject was first discussed and that he is opposed to the
request.
Chairman Welborn summarized the applicant's statements concerning the value of
the subdivision and that particular property is appropriate to be zoned R-2.

changing that fencing to metal.

SUMMARY:
On behalf of Ralph Swearingin, Jr., Alpha Land Surveying is requesting a zoning change
from R-1-S Special Single-Family to R-1 Single-Family Residential on 0.526 acres located
on the west side of Meadow Road between Chapman Road and North Forty Road.
GENERAL DESCRIPTION:
The 0.526-acre area proposed for rezoning is the front portion of a 1.67-acre property.
The site has 122 feet of frontage on Meadow Road and is approximately 186 feet deep.
The owner is requesting a zoning change to R-1 Single-Family Residential with the intent
to develop the entire property into two residential lots.
The remainder of the property (1.14 acres) has frontage on and access from Brittany Park
Court. It is currently zoned R-1-S Special Single-Family and is not included in the rezoning
request. It is included in the replat of the property, which is an associated item on the
September 20, 2018, agenda (see RP 2018-06).
The character of the development on Meadow Road is low density single-family
residences on estate style lots. Most of these properties are zoned R-1-S Special Single
Family, while some properties are zoned R-1 Single Family Residential. The Brittany Park
Estates neighborhood is located south and west of the site and is zoned R-2 Single Family
Residential.
Estate Lots
Under the current 2012 Comprehensive Land Use Plan, the request is consistent with the
"Low Density Residential" land use designation. In 2014, a zoning case in the area led
to discussions about estate lots and the applicability of the R-1-S zoning district in certain
areas of the city.

As a follow up, staff held a joint work session with the City Council and Planning and
Zoning Commission to discuss the estate lots in the Little Ranch Road/Meadow Road
and Continental TrailNalley Drive areas. Estate lots were viewed as a desired market
niche for North Richland Hills as land and house values are typically higher than average.
Based on these discussions, staff generated a general map of the areas and a
development policy to guide the review of zoning and plat applications:
• Encourage R-1-S zoning in the Little Ranch Road/Meadow Creek Road and
Continental Trail/Valley Drive areas
• Discourage R-2 zoning within the residential estate areas
• Discourage R-1-S zoning outside the residential

Staff was directed to engage these neighborhood areas in
the update to the comprehensive plan. In July 2017, staff

conducted a neighborhood meeting with residents of the
two areas. While a majority of the residents present
favored the reservation of the large lot character of the 4

area, there was not a clear consensus.
The map to the right shows the Little Ranch Road and l
Meadow Creek Road estate lot area. The property under
consideration is located in the southeast portion of the
Core Hightower Area. While it is on the perimeter of the
core area, the property is located within the boundary -
where the R-1-S zoning district and estate lot development ` �
would be considered appropriate.
DRC recommendation
The Development Review Committee's recommendation for denial of the zoning change
is based on the general development policy that encourages the R-1-S Special Single
Family district in this area. The property is currently zoned R-1-S. The properties on the
west side of Meadow Road between Chapman Road and Hightower Drive and directly
across the street from the site are currently zoned R-1-S and developed as residential
estate lots.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation provides areas for traditional low-
density single-family detached dwelling units.
The Strategic Plan Committee reviewed the residential estate lot areas during its
discussions on the future land use plan. The Committee is expected to formulate its
recommendations on this topic in September for consideration by Planning and Zoning
Commission and City Council later this year.
CURRENT ZONING: The property is currently zoned R-1-S Special Single-Family. The
R-1-S zoning district is intended to provide areas for very low-density development of

single-family detached dwelling units that are constructed at an approximate density of
one unit per acre in a quasi-rural setting. The R-1-S district is specifically planned to allow
for the keeping of livestock in a residential setting.
PROPOSED ZONING: The proposed zoning is R-1 Single-Family Residential. The R-1
zoning district is intended to provide areas for very low-density development of single-
family detached dwelling units that are constructed at an approximate density of 2.9 units
per acre.

SUMMARY:
On behalf of Ralph Swearingin, Jr., Alpha Land Surveying is requesting approval of a
replat of Lots 4R1 and 4R2, Block 4, Morgan Meadows Addition. This 1.67-acre property
is addressed at 6779 Brittany Park Court, but the property also has frontage on Meadow
Road. The proposed replat meets the requirements of the subdivision regulations and the
proposed zoning district standards.
GENERAL DESCRIPTION:
This property was originally platted in 2005 as Lot 4, Block 4, Morgan Meadows Addition.
The property is currently vacant. The proposed replat would create two lots for the
construction of new single-family residences on the property.
The property is zoned R-1-S Special Single-Family, but the applicant has requested a
zoning change to R-1 Single-Family Residential on the front portion of the lot (see ZC
2018-03). Each lot would have a separate zoning designation. A description of each lot
is below.
• Lot 4R1. This lot is zoned R-1-S and is 49,642 square feet (1.14 acres) in size.
The lot has 50 feet of frontage on Brittany Park Court, and driveway access is
available from this street. The lot is generally 392 feet wide and 126 feet deep. The
plat establishes a 25-foot front building line.
• Lot 4R2. This lot is proposed for rezoning to R-1 and is 22,913 square feet (0.526
acres) in size. The lot has frontage and access on Meadow Road. The lot is
generally 122 feet wide and 186 feet deep. The plat establishes a 25-foot front
building line.

As required by Section 212.015 of the Texas Local Government Code and Section 110-
219 of the subdivision regulations, this replat will require a public hearing when the plat
is considered the City Council. Since the property is zoned for single-family residential
uses, the public hearing will include notification of all property owners within 200 feet of
the lot boundary that are within the original plat boundary.
