Adam Buczek and Collier Bailey, on behalf of The Skorburg Company, 8214 West Chester Drive, Suite 710 Dallas, Texas 75225, presented their request. Chairman Shiflet asked the applicant to clarify the programmable area shown on the plan. The applicant stated the area is open space and does not have a landscape plan, but anticipates the area to be used by the neighborhood. November 16, 2017 Planning and Zoning Commission Meeting Minutes Page 3 of 12 Chairman Shiflet asked if a conversation has taken place with the post office concerning cluster mail boxes. Mr. Bailey stated he has sent an email to the post office and is waiting for a response. Commissioner Don Bowen asked the applicants if they would accept a percentage of homes allowed to be between 1,800 and 2,000 square feet. The applicants stated yes, twenty percent, or seven lots, was proposed. Commissioner Justin Welborn asked if the applicants would accept removing all cedar board fencing along the property line and replacing with a combination of ornamental metal and masonry fencing. The applicants stated the cedar board fencing along Holiday Lane could be changed to ornamental metal, but stated the cedar board fencing along the southern property line is to provide privacy for property owners. Commissioner Jerry Tyner asked if the Homeowners Association will be in charge of maintaining the cedar board fencing. The applicants stated yes. Chairman Shiflet asked for Mr. Comstock to present the staff report. Mr. Comstock presented the staff report. Chairman Shiflet asked for the height of the cedar board fencing as proposed. Mr. Comstock stated six feet. Chairman Shiflet asked if the setbacks could allow for a six foot setback between homes, being three feet between the common property line and each house. Mr. Comstock stated the minimum total setback between homes is ten feet, being seven feet on one side and three on another. Chairman Shiflet asked if a left turn could be included in the center median on Mid November 16, 2017 Planning and Zoning Commission Meeting Minutes Page 4 of 12 Cities Boulevard. Mr. Comstock stated a median cut does exist in the center median on Mid Cities Boulevard and it was unlikely that the median opening could be expanded or another one added. James Jennings, 6129 Abbott Avenue, North Richland Hills, Texas 76180, spoke neither in opposition or support of the request. Chairman Shiflet asked the applicant to address issues brought up by Mr. Jennings. Mr. Bailey stated existing fences on common property lines will be replaced with new eight foot cedar fencing. Mr. Bailey also stated that the proposed alley radii has been deemed acceptable by Republic Services, but would be accepting of constructing ballards. Chairman Shiflet asked if the garbage pick-up is in the alley or the street. Mr. Bailey stated trash will be picked up in the alley. Vice Chairman Steven Cooper asked about trees on the property. Mr. Collier stated they are open to saving trees in the open spaces. Chairman Shiflet called for anyone wishing to speak for or against the request to come forward. There being no one wishing to speak, Chairman Shiflet closed the public hearing. The Commission discussed fencing requirements along the perimeter of the proposed neighborhood, specifically, the proposed cedar board fencing and height. CONTINUED Chairman Randall Shiflet introduced the item, opened the public hearing, and asked for Principal Planner Clayton Husband to present the text revision. Mr. Husband presented the text revision. Commissioner Jerry Tyner asked if the display of multiple colors is allowed. Mr. Husband stated no, however the colors may change at a two minute interval under the proposed ordinance. Chairman Shiflet voiced concerns over possibilities of indoor lighting because the ordinance only mentions outdoor lighting. Commissioner Tyner asked for staff to research acceptable time limits for color changes. Commissioner Justin Welborn asked how this ordinance would affect current outdoor lighting. Mr. Husband stated that existing outdoor lighting would be non-conforming and grandfathered until changed. Chairman Shiflet stated the code should reference indoor lighting as well as outdoor lighting. Vice Chairman Steven Cooper stated timing limits for color changes should reflect industry standards. Chairman Shiflet called for anyone wishing to speak for or against the request to come forward. There being no one wishing to speak, Chairman Shiflet closed the public hearing. PRESENTER: Clayton Comstock, Planning Manager SUMMARY: Hamilton Duffy, P.C. is requesting a special use permit for two detention ponds associated with the final plat of Carrington Center Addition. The property is located on the north side of Mid-Cities Boulevard mid-block between Holiday Lane (west) and Smithfield Road (east). GENERAL DESCRIPTION: The applicant is requesting approval of a special use permit to authorize the use of two detention ponds on the site. Section 118-729 of the Zoning chapter and Section 102- 124 of the Floods and Stormwater Management chapter of the Code of Ordinances establish the requirements and standards for the special use permit. The use of all detention or retention ponds requires approval of a special use permit. Detention Ponds City codes allow for detention ponds if the proposed development is discharging stormwater into an undeveloped property if downstream drainage infrastructure cannot be constructed at the time of development due to lack of easements or rights-of-way. During the evaluation of the site and the existing conditions of the area, the applicant concluded that detention ponds would be necessary to accommodate development of the site. The proposed building on the site would be located at the north end of the property, with a detention pond constructed on each side of the building. Stormwater would enter the detention areas through curb cuts in the parking lot and exit the site through a channel near the northwest corner of the property. Each pond is designed with a vertical concrete retaining wall around the perimeter and includes concrete pilot channels to direct stormwater through the pond system. The depth of the detention areas ranges from three to four feet below the grade of the adjacent sidewalk. fg1tH NORTH RICHLAND HILLS The system is designed to detain stormwater and allow it to drain from the site at the same rate as the undeveloped conditions. It is not designed to retain water and create decorative ponds. A landscape plan was submitted as part of the site plan application for the property and is currently under review. The landscape plan must be reviewed and approved by the Development Review Committee (DRC) before final acceptance of the public infrastructure. The design of the ponds includes vertical walls adjacent to the sidewalk in front of the building. Since this does not leave room for landscaping in front of the ponds, the Development Review Committee recommends adding two Bald Cypress trees in each pond. These trees would be in addition to the proposed trees along the north property line and other required landscaping for the site. A formal maintenance agreement will be executed as part of the approval of the special use permit. Generally, the agreement will require the owner to mow and maintain all grass and landscaping, remove trash and debris once a week, remove silt from the basin or outlet structures as necessary, and repair any decorative fencing. The agreement runs with the property and applies to any future owner or user. Special Use Permit The zoning ordinance provides that special use permits may establish reasonable conditions of approval on the operation and location of the use to reduce its effect on adjacent or surrounding properties. The ordinance also includes specific criteria for detention and retention ponds, for which slight deviations are recommended due to the functional nature and location of the pond on the site. The following are the proposed conditions of approval for this SUP application. 1 . Permitted use. A special use permit is authorized for two detention ponds. fg1tH NORTH RICHLAND HILLS 2. Engineering approval. Construction of the detention ponds is subject to final approval of the engineering plans and including safety measures by the Development Review Committee and City Engineer. 3. Landscaping. The detention ponds must be landscaped in accordance with Chapter 114 — Vegetation of the Code of Ordinances. The landscape plan is subject to final approval by the Development Review Committee. In addition to the required landscaping, two (2) Bald cypress trees shall be planted in or around each detention pond. 4. Detention pond criteria. The following design criteria apply to the detention ponds: a) Pond outlet structures may be located within 50 feet of a property line. b) Detention basin side slopes may be steeper than 4H:1V. c) Embankment may be taller than 12 inches above adjacent grade. d) A four-foot tall ornamental metal fence shall be installed between the sidewalk and the concrete retaining wall of the ponds. 5. Maintenance agreement. The owner must execute a detention/retention storage facility maintenance agreement in conjunction with the approval of the subdivision plat for the property. PRESENTER: Clayton Husband, Principal Planner SUMMARY: A revision is proposed to the Zoning Ordinance related to Section 118-1 Definitions, Section 118-693 Exterior materials and colors, and Section 118-728 Outdoor lighting. The revision would add a definition and standards related to luminous tube lighting. This public hearing was continued from the November 16, 2017, meeting to allow staff time to provide additional information requested by the Commission. GENERAL DESCRIPTION: During the discussion of this item at the November 16, 2017, meeting, the Commission requested more information about time limits for color changes, and also expressed concern about the visibility of luminous tube lighting if it were attached inside windows and doors instead of on the exterior. These topics are discussed in more detail below. A complete copy of the proposed ordinance is attached. Color changes The proposed text amendment previously included a standard that would allow for the color of the light to change every two minutes. The Commission noted that this time interval might be too long and requested information about typical industry standards on the timing of color changes. According to industry and retailer information, most LED tube and strip lighting are operated by light controllers that range from knob style devices to programmable and wireless remote controls. These controllers allow for the lighting colors to be mixed or changed on a variable basis, and are capable of creating flashing, strobing, pulsating, and fade-change lighting effects. Research indicates there is not a typical timing standard as the color changes can be set on a continuously variable basis. IgRH NORTH RICHLAND HILLS During the discussion at the meeting, staff referenced that digital billboards are permitted to change messages every eight seconds. This timing is the same as the Texas Department of Transportation standards provided by state law. The Commission felt that eight seconds was too short and could lead to the appearance of a flashing or strobing light. In the absence of an industry standard and in order to strike a balance between these two times, a time interval of one minute is recommended. uii luu�u uu uu luu moilu Ili umitu If the luminous tube lighting fixture uses LED or similar technologies that allow for the color of the light to change, only one color change every sixty (60) seconds is permitted. Interior lighting The Commission expressed concern that luminous tube lighting could be installed on the interior of a window or door and still be visible from the outside. In order to address this concern, the following language is recommended. It is based on an existing provision in the NRH sign regulations related to window signs. Luminous tube lighting shall not be placed, attached, or affixed to the interior of a window or door or within three feet behind a window or door. CITY COUNCIL: The City Council will consider this request at the December 11 , 2017, meeting following a recommendation by the Planning and Zoning Commission. RECOMMENDATION: Approve TR 2017-04. (2) Bright, pure tone primary or secondary colors, and luminous tube lighting are permissible only in limited application as accent colors on door and window frames, moldings, cornices, canopies, awnings, etc. in proportions consistent with trim or accentuation only. Such building trim and accent areas shall not exceed 15 percent of any single exterior wall area excluding all windows, doors, and glass construction materials. Luminous tube lighting must comply with the provisions of Sec. 118-728 (Outdoor Lighting). Section 3: THAT the Comprehensive Zoning Ordinance and Code of Ordinances of the City of North Richland Hills be amended by modifying Section 118-728(f) (Outdoor lighting) of Chapter 118 of the North Richland Hills Code of Ordinances to add a new subsection and re-number this section in part to read as follows: (f) General requirements for nonresidential and multifamily property. (7) Luminous tube lighting. The following standards shall apply to luminous tube lighting. a. Location. Luminous tube lighting may be attached to the exterior of a building as an architectural detail to reinforce specific elements of the structure, subject to the following conditions. 1 . The lighting may be attached to the roofline, parapet, cornice, eave, canopy, or other building element or architectural detail. The lighting must be mounted at least eight feet above grade and no higher than top edge of the roofline, eave, or building element. Ordinance No. 3491 Page 2 of 5 2. The lighting shall not be attached to or used to outline windows, doors, building columns, poles, or ground signs. The lighting shall not be attached to vertical corners of the building or along roof hips and/or ridge lines. 3. Luminous tube lighting shall not be placed, attached, or affixed to the interior of a window or door or within three feet behind a window or door. b. Residential adjacency. When luminous tube lighting is located within 100 feet of a property zoned or used for a residential use, the maximum permitted installation height shall be 20 feet, regardless of the height of the roofline or eaves. c. Shielding. Luminous tube lighting must be shielded or shrouded with an opaque, semi-opaque or translucent housing or building element. Unshielded or exposed lighting or the combination of lighting with any reflective materials is prohibited. d. Color and motion. Light output must be of constant intensity and uniform color. If the luminous tube lighting fixture uses LED or similar technologies that allow for the color of the light to change, only one color change every sixty seconds is permitted. Pulsing, flickering, moving, or flashing lights, or displays of multiple colors is prohibited. (8) Exterior lighting plan required. The following exterior lighting information must be included with all site plan submissions. Such information shall be prepared by a certified engineer, architect, landscape architect or lighting engineer: a. Plans indicating the location of the exterior lighting on the premises, and the type of illuminating devices, fixtures, lamps, supports, reflectors, and other devices. b. Description of the illuminating devices, fixtures, lamps, supports, reflectors, and other devices. The description may include, but is not limited to, catalog cuts by manufacturers and drawings (including sections where required) and height of the luminaires. c. A statement from the property owner, developer, or agent and the preparer of the lighting plan that exterior lighting depicted Ordinance No. 3491 Page 3 of 5 on the lighting plan will comply with the requirements of this section after installation. d. Photometric plan and data sheets showing the angle of cut off or light emissions in footcandles across the entire property and at the property lines. 1 . A waiver to the photometric plan requirement may be granted by the development review committee upon request for certain small-scale, low-impact developments so long as the other submittal requirements of this subsection are met. Section 4: This Ordinance shall be cumulative of all provisions of ordinances and of the Code of Ordinances of the City of North Richland Hills, Texas, as amended, except when the provisions of this Ordinance are in direct conflict with the provisions of such ordinances and such code, in which event the conflicting provisions of such ordinances and such code are hereby repealed. Section 5: It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this Ordinance are severable, and if any section, paragraph, sentence, clause, or phrase of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining sections, paragraphs, sentences, clauses, and phrases of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional section, paragraph, sentence, clause or phrase.
