SUMMARY:
The 86th Texas Legislature concluded on May 27, 2019, with 338 bills approved that
directly impact city operations and local jurisdictional control. These bills are generally
related to property taxes, development regulations, and municipal fees.
At the work session, staff will update the Commission on some of the bills approved by
the legislature that will impact NRH development, including but not limited to the following
bills:
• HB 3167 regarding time limits on city review of site plans and platting.
• HB 852 regarding how a city may not assess building permit fees based on
construction value.
• HB 2439 regarding a city's ability to regulate building materials. Please visit

Pertaining to item CA Planning Director Clayton Comstock discussed the special use permit
request for 5417 Davis Boulevard. Ex-Officio Dupree and Mr. Comstock discussed fence
material, location, and sprinkler system installation. Commissioner Bowen and Mr. Husband
discussed standards for soundproofing the building. Commissioner Werner and Mr. Husband
discussed an email received from a citizen with a number of question and Mr. Husband stated
that he responded to the citizen's questions.
Pertaining to item DA Economic Development Director Craig Husle discussed the Vision203O
Economic Development Plan. Vice Chair Tyner and Mr. Hulse discussed the overall support for
the outlined goals. Ex-Officio Dupree and Mr. Hulse discussed the city's incentive programs.

Jason Haynie for a zoning change from AG Agricultural to R-1-S
Special Single-Family at 7409 Bursey Road, being 1.773 acres
described as Tract 1131, John Condra Survey, Abstract 310, and
Tract 1134, Stephen Richardson Survey, Abstract 1266.

SUMMARY:
Jason Haynie is requesting a zoning change from AG Agricultural to R-1-S Special Single-
Family on 1.773 acres located at 7409 Bursey Road.
GENERAL DESCRIPTION:
The property is located on the north side of Bursey Road between Valley Drive and Hunter
Lane. The property is unplatted and currently developed with a single-family residence.
The 1.773-acre property has 255 feet of frontage on Bursey Road and ranges from 293
to 335 feet deep.
The applicant is requesting a zoning change to R-1-S Special Single-Family with the
intent to construct a new residence on the property. Approval of a subdivision plat for the
property would be required prior to the issuance of a building permit.
The character of the development in the Valley Drive and Continental Trail area is low
density single-family residences on estate style lots. Most properties are zoned AG
Agricultural, with the exception of three properties being zoned R-1-S Special Single-
Family.
Estate Lots
In 2014, the City Council and Planning and Zoning Commission held work sessions to
discuss the applicability of estate lots and the R-1-S zoning district in certain areas of the
city. A general policy was established at that time that R-1-S zoning would be encouraged
in two specific areas of the city to promote neighborhoods defined by larger single-family
lots. This property falls within the Continental/Valley area that was discussed for larger
single family lots.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation provides areas for traditional low-
density single-family detached dwelling units.

NORTH KICHLAND HILLS
The Strategic Plan Committee reviewed the residential estate lot areas during its
discussions on the future land use plan. The Committee recommended a Residential
Estate land use designation for the area. This designation would promote neighborhoods
defined by larger single-family lots and houses at a density less than two units per acre.
Livestock, barns, rural cross-section roadways, and rural-or estate-style perimeter fences
would be characteristics of the area. While the future land use plan recommendations
have not yet been adopted by City Council, this area is recommended for residential
estate development. The land use plan is scheduled for consideration by City Council on
June 24 and July 8, 2019.
CURRENT ZONING: The property is currently zoned AG Agricultural. The AG district is
intended to preserve lands best suited for agricultural use from encroachment of
incompatible uses, and to preserve in agricultural use, land suited to eventual
development into other uses pending proper timing for practical economical provisions of
utilities, major streets, schools, and other facilities so that reasonable development will
occur.
PROPOSED ZONING: The proposed zoning is R-1-S Special Single-Family. The R-1-S
zoning district is intended to provide areas for very low-density development of single-
family detached dwelling units that are constructed at an approximate density of one unit
per acre in a quasi-rural setting. The R-1-S district is specifically planned to allow for the
keeping of livestock in a residential setting.

SUBJECT: PP 2019-02 Consideration of a request from Convergence Capital
LLC for a preliminary plat of Berry Creek Village, being 8.443 acres
located in the 8900-9100 blocks of Mid-Cities Boulevard.

SUMMARY:
On behalf of Convergence Capital LLC, Rhonda Berry is requesting approval of a
preliminary plat of Berry Creek Village. This 8.443-acre development is generally located
in the 8900-9100 blocks of Mid-Cities Boulevard. The proposed preliminary plat meets
the requirements of the zoning ordinance and subdivision regulations.
GENERAL DESCRIPTION:
The property is located on the north side of Mid-Cities Boulevard across from Birdville
High School, just east of Hawk Avenue. The site is immediately west of The Home Depot
and east of the Brynwyck subdivision. The property is currently vacant.
The preliminary plat includes twelve lots intended for office and retail development. The
lots generally range in size from 21,000 square feet to 45,000 square feet. The plat
includes a common access easement that connects all lots to proposed driveways on
Mid-Cities Boulevard as well as the existing traffic signal at Hawk Avenue.
The owner has indicated the initial plans are to final plat and develop the four western lots
in the subdivision. The remaining lots would be developed in the future, with the final lot
arrangement dependent on proposed development at that time.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Neighborhood Service." This designation is intended to permit limited service
establishments and retail stores for the benefit of adjacent and nearby residential areas.
CURRENT ZONING: The property is currently zoned C-1 Commercial. This district is
intended to permit a variety of retail trade, personal and business services
establishments, and offices. The zoning was approved by City Council on September 24,
2018 (Ordinance 3542).
THOROUGHFARE PLAN: The development has frontage on Mid-Cities Boulevard,
which is classified as a P6D Principal Arterial roadway. A P6D roadway is a six-lane
divided street with a variable ultimate right-of-way. Right-of-way dedication is not required
for the plat as sufficient right-of-way exists at this location.

Services for a replat of Lots 7R1 and 7R2, Block 2, W.E. Odell
Addition, being 0.33 acres located at 7917 Mickey Street.

SUMMARY:
On behalf of O.C. Constructions, Windrose Land Services is requesting approval of a
replat of Lots 7R1 and 7R2, Block 2, W.E. Odell Addition. The proposed replat does not
meet the requirements of the zoning ordinance and subdivision regulations, so the
applicant is requesting approval of two variances.
GENERAL DESCRIPTION:
The property under consideration is a 14,400-square-foot lot located on the north side of
Mickey Street and east of Smithfield Road. The purpose of the replat is to divide the
existing lot into two single-family residential lots, with one lot fronting Mickey Street and
the other lot fronting Odell Street. The proposed lots do not meet the minimum lot
standards for lot area and lot width, and the owner is requesting a variance to these
standards to approve the lots as presented.
The property is currently platted as Lot 7, Block 2, W.E. Odell Addition, which was
originally platted in 1948. This plat created lots fronting Odell Street, Smithfield Road, and
Mickey Street, with 16 of the lots extending from Mickey Street to Odell Street. The
original plat includes lots on Odell Street east of Davis Boulevard, as at that time Davis
Boulevard was not constructed. All lots are 60 feet in width.
In 2006, two replats were approved that divided existing lots into lots that fronted both
Odell Street and Mickey Street. There are three lots remaining in the original
configuration, including the property under consideration.
The property is zoned R-3 Single-Family Residential. The lot standards in this district vary
depending on the date the property was platted, as shown in the table below. At the time
of the original plat of W.E. Odell Addition, there were no standards in place as the property
was not annexed into North Richland Hills.

The applicant is requesting a variance to the lot area and lot width standards for the
proposed lots. Section 110-42 of the subdivision regulations allows for the Planning and
Zoning Commission and City Council to consider and approve variances to the
regulations where hardships or practical difficulties may result from strict compliance with
the regulations. A comparison of the existing standards and the proposed lots is below.

As required by Section 212.015 of the Texas Local Government Code and Section 110-
219 of the subdivision regulations, this replat will require a public hearing when the plat
is considered the City Council.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as "Low Density Residential." This designation is intended to provide for traditional,
low-density single-family detached dwelling units.
CURRENT ZONING: The property is currently zoned R-3 Single-Family Residential. The
R-3 district is intended to be a transitional zone between developments of lower and
higher densities or between lower density residential and nonresidential areas. The
district provides areas for moderate density development of single-family detached
dwelling units that are constructed at an approximate density of 4.8 units per acre.
THOROUGHFARE PLAN: The development has frontage on Odell Street and Mickey
Street. Both streets are classified as an R2U Residential street, which is a two-lane
undivided roadway with an ultimate right-of-way width of 50 feet. The plat includes a right-
of-way dedication of ten feet for Mickey Street.

Ladies and Gentlemen of the Planning commission, Planning and zoning committee, and City

I Jim O'Connor, owner of OC Construction LLC, the owner of 7917 Mickey St. Lot 7 block 2 of Odell W
E Addition am requesting consideration of two variances as permitted by Section 110-42 of the
Subdivision Ordinance to the Minimum Lot Area and Minimum Lot Width requirements of Section
118-313 (Lot and Area Requirements). The minimum lot area for a property zoned R-3 and platted
after August 12, 2002 is 7,700 square feet. The request is for two lots of 6,600 square feet (Lot 7R2)
and 7,200 square feet (Lot 7R1). The minimum lot width required of properties zoned R-3 and
platted after August 12, 2002 is 70 feet. The requested lot width is 60 feet under existing lot
conditions.
