PRESENT: Dick Faram Jim Wood Denver Mills Sid Cavanaugh Lena Mae Reeder Mayor Counci lmen Councilwoman STAFF: Tom Paul Jeanette Moore City Manager City Secretary ABSENT: John r~i chener Dave Freeman Jim Cato Councilmen 3. f1ayor Faram opened the Public Hearing and called for anyone present wishing to speak in favor of this request to please come forWard. Mr. E. K. Arledge, Richardson, Texas, appeared before the Council. Mr. Arledge stated he wanted to put in a auto sales and rental lot. The property is located on Bedford- Euless Road. Mr. Arledge stated he had a ten year lease from Hertz Rent-A-Car. Mr. Arledge stated he would handle late ¡model cars, two to three years old. Mr. Arledge stated he would put 3% to 5% of the lot into landscaping. Mayor Faram asked if there would be any maintenance work done at the lot. Mr. Alredge replied no, there would only be a car wash. Mayor Faram asked Mr. Arledge if the lease was a ten year lease with two five year options. Mr. Arledge stated yes. He also had no objection to the zoning bei ng ti ed to purchaser occupancy. Mayor Faram asked if the word used cars could be taken off and Hertz Rental and Sales used. Mr. Arledge stated it would be called Hertz-Buy-Car. -'>~ J CALL TO ORDER ROLL CALL RECONSIDERATION OF PZ 79-31 AND PS 79-58, REQUEST OF E. K. ARLEDGE TO REZONE FROM COMMERCIAL TO COMMERCIAL-SPECIFIC USE-SALE OF USED CARS AND CAR RENTAL APPROVED ORDINANCE NO. 787 October 23, 1979 Page 2 Councilman Cavanaugh asked Mr. Arledge if he was the owner of the property at this time. Mr. Arledge stated no, he had an option until the 25th of October. Mayor Faram asked Mr. Arledge if he was asking for Specific use for Hertz Sales and Rental; 3% of lot in landscaping and no car on the lot over two years old. Mr. Arledge replied yes, but the normal age for the used cars was three years old. Mayor Faram called for anyone in opposition of this request. No one appeared in opposition. Mayor Faram closed the Public Hearing. Councilman Wood moved, seconded by Councilwoman Reeder, to approve PZ 79-31, Ordinance No. 787, subject to the zoning being issued to Hertz Corporation, minimum of 3% landscaping and a three year maximum age of cars. Councilman Mills asked Mr. Arledge if he had a rendering to attach to the ordinance. Mr. Arledge supplied the Council with a rendering of the proposed car lot. After discussion, Councilman Cavanaugh made a substitute motion seconded by Councilwoman Reeder, to approve the Specific Use Zoning Permit to Hertz Corporation, not use the word "used cars", 3% landscaping, no car over three years of age, zoning to revert back to original zoning after Hertz lease is ended and no repair work to be' done on the property; rendering to be a-part of the ordinance. Councilman Wood asked for a definition of maintenance since there would be a car wash on the lot. Councilman Mills stated repair should be used instead of maintenance. Councilman Cavanaugh asked if the surrounding property owners had been notified. City Secretary Moore replied yes. Motion to approve carried 4-0. Mayor Faram stated the original motion was moot. October 23, 1979 Page 3 Counci1man Cavanaugh moved, seconded by Counci,lman, to approve PS 79-58, subject to Engineer's letter of August 14, 1979. Motion carried 4-0.
