Mayor Faram called the meeting to order November 13, 1978, at 7:30 p.m. CALL TO ORDER 2. The invocati on was given by Mayor Faram. INVOCATION 3a. Mayor Faram presented Mr. Bobby Combs of the Church of Jesus Christ of Latter Day Sai~ts with a proclamation proclaiming November 9, thru November' 25, 1978, as Family Week. PROCLA~1ATION PROCLAIMING FAMILY WEEK Mr. Combs presented the Council with a Family Manual. 4. Councilman Michener moved, seconded by Councilwoman Reeder, to approve the minutes of October 23, 1978. APPROVAL OF MINUTES OF THE OCTOBER 23, 1978, COUNCIL MEETING Councilman Wood stated that on page 10, last sentence, the name should be Hale instead of Harp. Motion to approve as corrected carried 7-0. Councilman Cato stated the Council had been requested to hear item 12 at thi s time. Councilman Cato moved, seconded by Councilman Mills, to hear item 12. Motion carried 7-0. 12. Marion Massey, Attorney, appeared before the Council representing Mr. Elmer Allison. Mr. Massey stated he was appearing before the Council to ask that an appeal hearing on PZ 78-37 be granted. REQUEST OF ELMER P. ALLISON FOR AN APPEAL HEARING ON PZ 78-37 GRANTED-TO BE HEARD Õ tCËHßTICT1~--i97Ef- November 12, 1978 Page 2 Counci lman Cato moved, seconded by Councilman Wood, to grant an appeal hearing for Mr. Elmer Allison, PZ 78-37, to be heard on December 11, 1978. Motion carried 7-0. 5. Mayor Faram presented Mr. Charles Linehan of the Police Department with a certificate and service pin for ten years service with the Police Department. Mayor Farant presented Mr. Gardner Smith of the Fire Department and Mr. John Lynn of the Police Department with a five year certificate and service pin. WHEREAS, during the Texas Municipal League Convention the City of North Richland Hills was afforded means to promote the industrial opportunities available in the city, it is the desire of the City Council to recognize those who made this promotion a success, and PRESENTATION OF SERVICE AWARDS AND PINS TO CHARLES LINEHAN, 10 YEARS; GARDNER SM ITH 5 YEARS: JOHN LYNN, 5 YEARS RESOLUTION OF RECOG- NITION FOR PROMOTIONAL EFFORT AT n~L RESOLUTI ON 78-17 6. Mayor Faram presented the following Resolution: WHEREAS, Mr. Bob Brady did donate his time and effort to convey a positive and progressive image of the city to any and all persons that may be interested in locating business within the City Corporate limits, and WHEREAS, Mrs. Jeanette ~10ore and Mrs. Harriet Brady whö are employees of the city did also give of their time and talents above and beyond the call of duty to make this promotional effort a resounding success, and THEREFORE be it resolved that the City Council of North Richland Hills does hereby recogni ze the efforts of Mr. Brady, rks. t100re and Mrs. Brady, and does hereby express its sincere appreciation to them. Councilman Wood moved, seconded by Councilman Cato, to approve Resolution No. 78-17. Motion carried 7-0. 7. Councilman Cato moved, seconded by Councilwoman Reeder, to postpone this item until December 11, 1978. Motion carried 7-0. CITIZENS PRESENTATION MR. JOE GRAY REQUESTING TO DRILL A DEEP \~ATER i-IELL FOR HQt'1E US E POSTPONED Councilman Freeman asked if the well would be used for the lake at the entrance of Meadow Lake. CITIZENS PRESENTATION MR. G. O. STEVENS,VP TARRANT REAL ESTATE DEV., CO. REQUESTING TO DRILL A SHALLOW WELL IN MEADOW LAKES ADDITION APPROVED 8. Mr. Gerry Stevens, 5822 Chimney Circle, appeared before the Council. Mr. Stevens stated he wanted to drill a well in Meadow Lake Estates to maintðin the level of the lake located in this addition. Mr. Stevens stated the well would be for the lake on the northeast. November 13, 1978 Page 3 Councilwoman Reeder moved, seconded by Council man Wood, to grant Mr. Stevens a permit to dri 11 a \'Jater well up to 200 feet. Motion carried 7-0. 9. Mr. Henry I. Benner, 800 0 Brown Trail, appeared before the Council. Mr. Benner stated he had property located in the extreme north part of the city. Mr. Benner stated he would like to move a home on the property, but the city could not furnish water. Mr. Benner stated he would like for ~1cKee to furni sh him \rJater until such time the city could furnish water. CITIZENS PRESENTATON DR. HENRY I. BENNER D.O. REQUESTING PERMISSION TO ALLOW DAN MCKEE TO SERVE WATER ON SHADY GROVE APPROVED -- Mayor Faram asked how far the property was from city \'later. Mr. Benner stated the nearest water line would be on Davis and Shady Grove Road. Coùncilman Wood asked Mr. Benner how many houses he planned to move on the property. ,Mr. Brenner stated he would not move more than one house in two years. Councilman Freeman moved, seconded by Councilman Cato, to allow Dan McKee to furnish Mr. Brenner water until such time the city could furnish water to the property. Motion carried 7-0. 10. Mayor Faram opened the Public Hearing and read the following statement: PUBLIC HEARING COA PROGRAM FOR 19ì8 At the last Public Hearing, we established the needs of our city and its neighborhoods. Those needs are: water, street and drainage improvements. At this Public Hearing, we will establish the projects that the city will recommend to meet those needs. If you wish to present your views in writing, please fill out the questionnaire. At this time we are accepting all comments, questions, statements or complaints regarding those proposals. ~1ayor Fa ram called for anyone present \'JÌ shi ng to comment to please come forward. There was no one present wishing to comment. City Engineer Perkins outlined the proposals the Counc·il had previously considered. The project most desirable as far as the Council was concerned was the construction of the concrete channel lining for Mackey Creek. Mayor Faram closed the Public Hearing. November 13, 1978 Page 4 11. Councilman Michener moved, seconded by Councilman Frel'::man, to approve Resolution No. 78-18. Motion carried 7-0. 12. Heard after item 4. 13. Mayor Param asked if the land dispute had been settled between the property owners. ¡'1r. Ted Harp stated an Attorney was dravdng-up an agreement for the property owners. Mayor Faram asked if the Staff had looked at the revi sed property descri pti on. . Mr. Harp stated the city staff had not seen the new description. Mayor Faram stated this case would be passed over until the staff could review the property description. 14. Mr. J. B. Sandlin, 5137 Davis Blvd., appeared before the Council to represent this case. Mr. Sandlin stated the property in question was Holiday West, Section 2, west of Richland High Schbol. Mr. Sandlin stated the City ha'd y'equested that Trinidad be a 41 foot street with 6 inches of hot mix. Mr. Sandlin stated Trinidad was a continuation of North Richland Blvd., and North Richland Blvd., was 37 feet wide with 5 inches of hot mix. Mr. Sandlin stated that he felt that if Trinidad was a 41 foot street it would encourage large trucks to use the street and would be putting more traffic in a residential area. t,lr. Sandl in stated he was requesting the Council to approve a 37 foot street with 5 inches of hot mix. After discussion, City Engineer Perkins stated there had been a mistake made and the street should be only 37 feet vJÌ de. Councilman Cato moved, seconded by Councilman Freeman, to schale down from a 41 foot street to a 37 foot wide street with 5 inches of hot mix. Motion carried '7-0. 15. Mayor Faram opened the Public Hearing. City Engineer Perkins stated the project would be funded out of Urban Funds but the city would incur some of the cost. Mr. Perkins stated the .street would be widened from Rufe Snow Dri ve to Loop 820. New curb and gutter would be installed on North Richland Hills side. The Richland Hills side of Grapevine Highway would not have curb and gutter, at their request. POSTPONED 10-23-78 POSTPONED PRESENTATION BY HAMM/ SANDLIN, RICHLAND ENT., INC., REQUESTING PARTICIPATION BY CITY IN OVERSIZING OF TRINIDAD DRIVE AT A COST OF $6,031.20 PUBLIC HEARING ON STREET IMPROVEMENTS FOR GRAPEVINE HIGHWAY BETWEEN RUFE SNOW AND INTERSTATE LOOP 820 November 13, 1978 Page 5 Mayor Faram called for anyone wishing to speak to please come forward. Mrs. JoAn Williams appeared before the Council. Mrs. Williams asked if it would make any difference if one side of Grapevine Highway had êurb and the other did not. Mayor Faram advised Mrs. Williams the south side of Grapevine Highway was not in North Richland Hills. Mrs. Williams asked if the City of North Richland Hills \':ould be liable. City Attorney McEntire stated North Richland Hills would not be liable. Mrs. Williams stated that the Shopping Center at Glenview and Grapevine Highway was almost impossible to get in and out of. Mrs. Williams asked if North Richland Hills had any jurisdiction over the Center. Mr. Britton stated the city was working with the State Highway Department to get the situation resolved. Mr. Britton stated the reason it had not been resolved is because of an ownership change. The owners could not get a permit for a driveway without the approval of North Richland Hills. Mr. Joe Krieg, 6429 Diamond Loch, appeared before the Council. Mr. Krieg stated he was in business in the Shopping Center in question and would liKe to know why a permit could not be issued. Mr. Britton stated that some time ago the Council passed a Policy and in the Policy Statement there is a requirement that curb, gutter, and storm drainage be placed along both sides of Grapevine Highway from Rufe Snow to Loop 820. Mr. Krieg stated they presently had a set of plans approved by Richland Hills calling for a 37 foot wide concrete entrance on to Grapevine Highway. Mr. Britton stated that Richland Hills did not have the authority to approve a curb cut in North Richland Hills and the Highway Department will not approve a permit for a curb cut. Mr. Krieg asked if they wanted to start pouring concrete could they not do so. Mr. Britton stated they would be doing it without a permit from the State Highway Department. Mr. Krieg asked how the City of Richland Hills could issue a permit and North Richland Hills says you can not pour the entrance. November 13, 1978 Page 6 Mr. Britton advised Mr. Krieg that Richland Hills was not in North Richland Hills. Mr. Krieg stated the driveway that was going to be poured was in Richland Hills. Mr. Britton stated that when the drive came past the telephone poles it was in North Richland Hills. Mr. Krieg stated the set of plans they were furnished with was an approved set of plans showing a concrete drive tied into Grapevine Highway. Mr. Krieg stated this was the assumption they were working under. Mr. Britton stated the builder and former owner of the property brought plans to Noith Richland Hills City Hall and he was advised of the Council Policy and the procedure he would need to follow was explained to him and he chose to ignore it. Mr. Krieg stated he had been in contact with the new owner and explained to him that the question was going to come up and he asked Mr. Krieg to pursue the matter and find out what information he needed to get the job accomplished. Mr. Britton stated he had talked with an attorney representing the new owner and he had all the information on what is required. Mr. Tommy Thompson representing Steel Properties appeared before the Council. Mr. Thompson stated they had just bought a piece of property in North Richland Hills which is the Shopping Center where Wolfe Nursey is located. Mr. Thompson stated they were for the assessment program. Mr. Thompson asked Mr. Britton if the Engineering plans for Grapevine Highway were complete. Mrs. Sue Fugate, Co-owner of 7109 Grapevine Highway appeared before the Council. Mrs. Fugate stated she had never received notice that Grapevine Highway was going to be improved. Mrs. Fugate stated she a 1 ready had curb and gutter and as ked if she V.JOU 1 d have to put in new curb. City Attorney McEntire stated Mrs. Fugate had all credits for the assessment and would not be assessed. Mr. Vi rgil Hume, 7125 Grapevi ne Hi ghway, appeared befot'e the Counci 1. Mr. Hume asked if he had any credits. City Attorney McEntire stated Mr. Hume would owe $55. November 13, 1978 Page 7 Mr. Joe Drummond representing the Clarence Jones Family owners and operator's of Greater Richland Shopping Center appeared ' before the Council. Mr. Drummond stated that fifteen years ago they had put in curb and gutter and paved the Shopping Center. Mr. Drummond stated he had waited all these years for someth~ng to be done to Grapevine Highway. Mr. Drummond stated he felt that improving Grapevine Highway was the most wonderful thing that had happened in North Richland Hills. Mayor Faram closed the Public Hearing. 16. Councilman Michener moved, seconded by Councilman Cavanaugh, to approve Ordinance No. 727 as written. Motion carried 7-0. Mayor Faram called a fifteen minute recess at this time. Mayor Faram called the meeting back to order. The same Council Members and Staff were present as recorded at the beginning of the meeting. 17. Councilman Cavanaugh moved, seconded by Councilman Michener, to approve Ordinance No. 728. Motion carried 7-0. 18. Mr. Austin was not present and this item was passed over. 19. Councilman Cato moved, seconded by Councilman Hood, to approve Estimate #1 for Emerald Hills Street and Drainage -Improvements in the amount of $31,217.94 to Texas Bitulithic Company. Motion carried 7-0. Councilman Wood moved, seconped by Councilwoman Reeder, to approve Estimate #4 for Watauga Drive Booster Pump Station,$79,969.94, payable to Red River Construction Company. Mr. Dick Perkins, City Engineer, advised the Council that Red River had asked for a time extension of about 30 days due to one of the sub-contractors being unable to deliver some eqùipment by a certain date. Mr. Perkins statèd Red River was granted the extension. They have now asked for an additional extension because one of the other suppliers was on strike and unable to meet the time requirement. Mr. Perkins stated the extension was granted. Mr. Perkins stated the completion date had been set for March 1, 1979 Mr. Perkins stated he had sent a letter to the contractor stating that he would not look very kindly toward any further extensions due to the fact that we must have the booster pump station completed by April 1, 1979. Mr. Perkins stated he also advised the contractor that if he foresees any other delays or finds out specifically any other delays in equipment deliverly that he seek other means of securing equipment that could be approved to get this completion taken care of. Mayor Faram asked if granting the extensions had caused the completion date to be delayed three months beyond the date that was set for completion. Mr. Perkins stated the completion date would be delayed about sixty days. Motion to approve payment carried 7-0. 21. Councilman Wood moved, seconded by Councilman Mills, to tdke Ì'Íl~. Mr. Britton stated he would like to make the Council aware that the bids received were both over what was budgeted. The one ton truck was over $49.28 and the 3~ ton truck was $535.63 over budget. Motion carried 7-0. 22. ,Councilman Mills moved, seconded by Councilman ltJood, to accept the bid of Hudiburg for five 1/2 ton pickups. Motion carried 6-1; Councilmen Wood, Cavanaugh, Mills, Freeman, Michener and Councilwoman Reeder voting for; Councilman Cato aganist. Councilman Michener moved; seconded by Councilman Freeman, to award the bid to J. L. Bertram Contracting Company. Motion carried 7-0. 24. Councilman Michener moved, seconded by Councilman Cavanaugh, to approve payment to the City of Richland Hills for ROW map for Glenview Drive. After discussion, Councilman Michener made a substitute motion, seconded by Councilwoman Reeder, to postpone action on this item. Motion carried 7-0. 25. Councilman Hood moved, seconded by Councilwoman Reeder to approve the agreement with the Police Association for maintenance service on the Recreation Center. Motion carried 7-0. 26. Councilman Wood moved, seconded by Councilwoman Reeder, to cancel the Council meeting of November 27, 1978. Motion carried 7-0. 27. Mayor Faram adjourned the meeting of November 13, 1978.
