RESOLUTION NO. 2004-046
BE IT RESOLVED by the City Council of the City of North Richland Hills, Texas,
that:
1.
The City Manager be, and is hereby authorized to execute the attached
Mechanic's Lien Contract for Public Improvements with James M. Davis and Deana
Davis for sidewalk improvements to Lot 1 R, Block 14, Glenann Addition as an act and
deed of the City.
PASSED AND APPROVED this the 26th day of July, 2004.

MECHANIC'S LIEN CONTRACT FOI{
PUBLIC IMPROVEMENTS

This contract is made b\ and between .lames M. Davis and Deana Davis, herein styled
"Owners:' and the City of North Richland Hills. Texas, herein styled "City."' for the purpose of
documenting thc terms and conditions under which City wil] construct a sidewalk along Mé!rtin
Drive adjacent to Owners' property. at Owners' (~Xren3e, and Owne":¡ .:,:rant a m,?clJi:UÚ,-'::-, ii"i1 tc'
the City securing payment of such expenses. Such contract is made in order to relieve Owners of
the immediate obligation under the City's subdivision ordinance requirements to construct such
side\valk as a condition of developing Owners' property.
FOR AND IN CONSIDERATION of the mutual covenants herein set Iè)rth, Owners and
City agree as Iè)llows:
1 . Owners agree to pay City the cost of labor and materials required to construct a sidewalk
along Martin Drivc in the right-of-way adjacent to Owners' property known and described as Lot
I R, Block 14. Glerl::., Addition. an addition of the City of North Richland Hills, Tarrant
County, Tcxas. If not paid within 60 days after a statement is mailed or delivered 10 Owncrs.

City agrces to construct the sidewalk described in I. above to the standards or the Cit) 111
eflect at the time or such construction. and to mail or deliver to Owners an itemized statement
upon compJetion of such improvements. which shall be due and payable sixty (6()) davs after

5. It is agrecd and understood that the sidewalk described herein may not be constructed by
City for years. and that Owners or their successors in title shall be entit]ed to a release of these
obJigatlons by securing required permits and constructing sueh sidewalk to City specifications.
