The Planning and Zoning Office prepares action minutes for each Zoning Board of
Adjustment meeting. The minutes from each meeting are placed on a later agenda for
review and approval by the Board. Upon approval of the minutes, an electronic copy will
be uploaded to the City's website.

A. CALL TO ORDER
The Zoning Board of Adjustment of the City of North Richland Hills, Texas met in
work session on the 23rd day of May 2019 at 6.30 p.m. in the City Council Work
Room prior to the 7.00 p.m. regular Zoning Board of Adjustment meeting.

Vice Chair Elston called the work session to order at 6.44 p.m.
1. PLANNING DIRECTOR REPORT
Principal Planner Clayton Husband provided an update on City Council actions,
development activity, and announcements.
2. DISCUSS ITEMS FROM THE REGULAR ZONING BOARD OF
ADJUSTMENT MEETING.
Principal Planner Clayton Husband summarized the item on the agenda. Pertaining to
item C.1., Mr. Husband discussed the request for a variance from Matt Latham.
Board Member Kemp asked if the there was a house next to the property. Mr.

Husband stated there is a house on both sides of the property.
Board Member Koons asked about setback rules for the fence line from the sidewalk,
and if any of the fences near the house have masonry pillars. Mr. Husband stated the
fence can be on the property line at the front of the property, and that the fence at
7228 Bursey Road has masonry columns.
Board Members Kunkel and Kemp asked if the other houses were considered by the
Board about installing a front yard fence. Mr. Husband stated there was a house but
it was a little further down Bursey Road.
Vice Chair Elston adjourned the work session at 6.55 p.m.

Vice Chair Elston read the rules and regulations of the Zoning Board of Adjustment.
She stated alternate Board Member Koons is acting in place of absent members and
would be voting on the item.
Vice Chair Elston opened the public hearing, and called for Principal Planner Clayton
Husband to introduce the request. Mr. Husband introduced the request.
Vice Chair Elston called for the applicant to present the request and be sworn in prior
to speaking.
The applicant, Matt Latham, 7236 Bursey Road, North Richland Hills, was sworn in by
Vice Chair Elston and presented the request.
Board Member Koons asked if there are any masonry pillars in the fence. Mr.
Latham answered no.
Vice Chair Elston called for anyone wishing to speak for or against the request to
come forward. There being no one else wishing to speak, Vice Chair Elston closed
the public hearing.
Board Member Kemp stated the lot was unusual compared to the rest on the street
due to the way all the lots were platted. Mr. Husband stated it was unusual since the
area developed over time and not as a uniform subdivision.

Jesus Aguayo for a variance to Section 118-314 (off-street parking
standards) of the North Richland Hills zoning ordinance at 6642
Jannie Street, being 0.16 acres described at Lot 7, Block 2, Richland
Hills West.

SUMMARY
Jesus Aguayo is requesting approval of variance to the off-street parking standards to
allow a garage conversion to remain without providing two covered parking spaces on the
property. The property is located at 6642 Jannie Street.
BACKGROUND INFORMATION
The property is located on the south side of Jannie Street between Rufe Snow Drive and
Charles Street. The lot is 59.75 feet wide, 120 feet deep, and 7,170 square feet in area.
The lot is zoned R-3 Single-Family Residential. The house was constructed about 1954
and has approximately 1,059 square feet of living area.
Jesus Aguayo purchased the house in August 2019. At some time prior to the sale, the
house was completely remodeled by the previous owner without issuance of building
permits. The single-car garage conversion appears to have been done as part of the
remodel. The garage door was not removed as part of the conversion, and the
construction has not been inspected for compliance with building and life safety codes.
Photos of the interior and exterior of the house are available online as part of the previous
real estate listing of the property (Irca ll„pir: p rn 6642 �V ir�„nie Street).
Due to the garage conversion, the house does not meet the current zoning standard that
requires two covered parking spaces located behind the front building line. This standard
is required by �,ca, .....

permitted if an alternative location for the required covered parking is provided. At the
time the house was constructed (1954), there was not a requirement to provide a garage
or covered parking, but setback standards were in place in the event a garage was
constructed (Ordinance 23: NRH zoning ordinance of 1957).
The owner has applied for a variance from the parking standard to allow the garage
conversion to remain without converting the space back to a garage or providing covered
parking elsewhere on the property.

FINDINGS FOR VARIANCE APPROVAL

"...to authorize upon appeal, in specific cases, such variance from the terms of [the
Zoning Ordinance] as will not be contrary to the public interest and where, because of
special conditions, the enforcement of the [Zoning Ordinance] would result in an
unnecessary hardship."
In exercising its powers to grant a variance, the board of adjustment must make specific
findings and show in its minutes that:
a. Literal enforcement of the controls will create an unnecessary hardship or practical
difficulty in the development of the affected property.
b. The situation causing the hardship or difficulty is neither self-imposed nor generally
affecting all or most properties in the same zoning district.
c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting of the variance will be in harmony with the spirit and purposes of
these regulations.
OPTIONS FOR BOARD CONSIDERATION
The Zoning Board of Adjustment has the following options regarding this application.
1. Approve the variance as presented. This action would allow the garage conversion
to remain and may require certain modifications to the area in order to comply with
life safety and building code standards.
2. Approve the variance with conditions. This action would allow the garage
conversion to remain subject to the owner making modifications to the size,
location, or design as directed by the Board.
3. Deny the variance. This action would require the space be converted back to a
garage or that two covered parking spaces be added to the property.

Approval of garage conversion to a bedroom with a full bathroom, constructed without a building
permit.
2. State the grounds for the request and describe any special conditions that cause hardships that,in your opinion,justify the
variance(s)being requested. Examples of special conditions are:topography, creeks, utility lines, irregular lot or tract shapes,
etc. The Zoning Board of Adjustment must determine that special conditions exist before making a motion to approve a
request. If It is determined that special conditions do not exist,the motion must be to deny the request. If necessary, use a
separate sheet.
The home was purchased with the understanding that the building department issue with the
conversion of the garage to a bedroom with a full bathroom had been resolved prior to sale. It was
communicated by the previous owner that the City requested that the information be part of the
seller disclosure and that that was sufficient in order for the property to be sold. The purchase price
lof the home is for a 3 bedroom home and the home was priced accordingly. As the conversion was
done prior to my purchase and the property was soled under the understanding that the issue had
been resolved with the building department, I hope that the board will approve my application for
non-conformity.

plat was approved prior to the current zoning ordinance requirements; or(2)the zoning ordinance was amended or a policy

SUMMARY OF THE ZONING BOARD OF ADJUSTMENT
The Board of Adjustment shall have the powers and exercise the duties cf a Board |n accordance with of the «
Texas Local Government Code. Board members are representatives of the City and shall have the right to inspect pvam|eam
where required in the discharge of their responsibilities under the laws of the State of Texas and the ordinances of the City of
North Richland Hills. The Board's jurisdiction shall extend to and include the hearing and deciding of the following topics of
appeals and applications,and to that end shall have the necessary authority to ensure continuing compliance with its decision.

SUMMARY
Bob Wilburn is requesting approval of a variance to the minimum dwelling unit size for a
new house. The property is located at 6766 Mike Drive.
BACKGROUND INFORMATION
The property is located on the south side Mike Drive, between Rufe Snow Drive and
Steven Street. The lot is 80 feet wide, 153.7 feet deep, and 12,296 square feet in area.
The lot is zoned R-2 Single-Family Residential.
Earlier this year, the existing house on the property was damaged by fire. The owner
received a demolition permit in June 2019 to remove the debris and foundation on the
site. The property is currently vacant.
On August 29, 2019, the owner applied for a building permit to construct a new house on
the lot. The permit application indicates the proposed house design includes 1,350 square
feet of living area. The R-2 Single-Family Residential zoning district requires a minimum
dwelling unit size of 1,800 square feet if platted prior to 1998. The applicant was notified
that the permit could not be approved, as the house design did not meet the required
minimum dwelling unit size. Rather than revise the size of the structure, the applicant has
submitted an application for variance.
The variance application and supporting materials are attached. The materials include a
plot plan showing the proposed improvements to the property, a copy of the house plans,
and the building permit application. An analysis of the request and relevant codes is
below.
ANALYSIS
The variance request is related to the minimum dwelling unit size requirement contained
in S,ect"i, „itn,,,,.....11,11, ,3,'1'3' of the zoning ordinance. The applicant proposes to construct a new
house on the property. The proposed house design provides a living area of 1,350 square
feet. However, the zoning of the property (R-2 Single-Family Residential) requires a

minimum living area of 1,800 square feet. This is the minimum square footage required
for properties platted prior to January 1, 1998. The lot was platted as part of the Hillview
Addition in 1955.
Size of previous house
The variance application indicates the owner is proposing to construct a house of similar
size as the previous house. The original house was built in 1956. The Tarrant County
deed history cards for this lot indicate the original size of the house was 1,473 square feet
and included a 420-square-foot garage. Photos of the interior and exterior of the previous
house are available online as part of previous real estate listings of the property.
Size of other houses
The owner states in the variance application that they want the new structure to match
the size and style of the existing houses in the neighborhood. While house style is subject
to interpretation, the sizes of existing houses is measurable. At the time of platting for the
original Hillview Addition in 1955, the minimum square footage requirement was 1,200
square feet. Data from Tarrant Appraisal District for houses on the same section of Mike
Drive are shown in the table below.

The proposed house size of 1,350 square feet is less than the average house size and
median house size for the lots on the same block on Mike Drive. It is also less than the
size of the original house constructed in 1956.
Financial hardship
The owner states in the variance application that they cannot afford a house any larger
than 1,350 square feet. According to State statute and City ordinances, financial or
economic considerations may not be the sole justification in defining a hardship for the
purposes of a variance to the zoning ordinance. The determination of hardship must relate

to the special or unusual physical characteristics of the property as outlined in the
"Findings for Variance Approval" section below.

appeals and applications, and to that end shall have the necessary authority to ensure continuing compliance with its decision.
The Board of Adjustment, in specific cases, may authorize or order the following:
• Interpretation. Hear and decide appeals where it is alleged there is error on any order, requirement, decision, or
interpretation of the zoning regulations by the Building Official in the enforcement of this ordinance or a zoning district
boundary. In reaching its decision, the Board shall establish firm guidelines for future administrative actions on like
matters.
• Permits for nonconformity. Authorize a building permit for the reconstruction, extension, or enlargement of a building
occupied by non-conforming uses, on the lot or tract occupied by such building, provided such reconstruction does not
prevent the potential return of such property to a conforming use.
• Discontinuance of nonconformity. Require the discontinuance of non-conforming uses of land or structures under any
plan whereby the full value of the structure and facilities can be amortized within a definite period of time, taking into
consideration the general character of the neighborhood and the necessity of all property to conform to the regulations
of the zoning ordinance. All actions to discontinue a non-conforming use of land or structure shall be taken with due
regard to the property rights of the persons affected when considered in light of the public welfare and the character of
the area surrounding the designated non-conforming use and the conservation and preservation of the property. The
Board may, from time to time on its own motion or upon cause presented by interested property owners, inquire into
the existence, continuation, or maintenance of any non-conforming use within the city.
• Variances. Authorize upon appeal, in specific cases, such variance from the terms of the zoning ordinance that are not
contrary to the public interest, and where, because of special conditions,the enforcement of the ordinance would result
in an unnecessary hardship. However, the Board shall not have the power to grant variances from the terms of the
zoning ordinance for a change in use not allowed in a district. In exercising it powers to grant a variance, the Board of
Adjustment shall make findings and show in its minutes that:
a. Literal enforcement of the controls will create an unnecessary hardship or practical difficulty in the development
of the affected property.
b. The situation causing the hardship or difficulty is neither self-imposed nor generally affecting all or most
properties in the same zoning district.
c. The relief sought will not injure the permitted use of adjacent conforming property.
d. The granting of the variance will be in harmony with the spirit and purposes of the zoning regulations.
