The Planning and Zoning Commission may enter into closed Executive

recently withdrawn, and the process of resubmitting an application.

Texas Bluebonnet Realty LLC for a special use permit for a
detention/retention storage facility at 8161 and 8165 Precinct Line

W.C. Newton Survey, Abstract 1182; Tracts 8131, 8C1, 8E1, and 8F,
Thomas Peck Survey, Abstract 1209; and Tract 8J, Stephen
Richardson Survey, Abstract 1266.

SUMMARY:
Texas Bluebonnet Realty LLC is requesting a special use permit for a detention/retention
storage facility associated with the final plat of Northstar Addition. The property under
consideration is located on the west side of Precinct Line Road south of North Tarrant
Parkway.
GENERAL DESCRIPTION:
The applicant is requesting approval of a Special Use Permit to authorize the use of a
detention/retention facility on the site. Section 118-729 of the Zoning chapter and Section
102-124 of the Floods and Stormwater Management chapter of the Code of Ordinances
establish the requirements and standards for the Special Use Permit. The use of all
detention or retention ponds requires approval of a Special Use Permit.
Detention Pond
City codes allow for detention ponds if the proposed development is discharging
stormwater into a developed downstream system that does not have the capacity to
handle the runoff. During the evaluation of the site and the existing conditions of the area,
the applicant concluded that a detention pond would be necessary to accommodate
development of the site.
Three medical office buildings are proposed to be developed on the site. One detention
pond is proposed and would be located at the front of the property adjacent to Precinct
Line Road. This pond is intended to be a dry pond with an overall depth of five feet. The
pond design includes a three-foot wide concrete pilot channel to direct water to an outfall
structure on the south side of the pond, where water would discharge into the storm
drainage system in Precinct Line Road.

Landscaping
Zoning standards require that all retention ponds be landscaped. A conceptual landscape
plan is attached. A formal landscape plan for the open space areas must be reviewed
and approved by the Development Review Committee (DRC) before final acceptance of
the public infrastructure for the project.
Maintenance
The property owner is responsible for the maintenance of the pond and all associated
landscaping. A formal maintenance agreement will be executed as part of the approval
of the special use permit. Generally, the agreement will require the owner to mow and
maintain all grass and landscaping, remove trash and debris once a week, remove silt
from the basin or outlet structures as necessary, and repair any decorative fencing. The
agreement runs with the property and applies to any future owner or user.
Special Use Permit
The zoning ordinance provides that special use permits may establish reasonable
conditions of approval on the operation and location of the use to reduce its effect on
adjacent or surrounding properties. The ordinance also includes specific criteria for
detention and retention ponds, for which slight deviations are recommended due to the
functional nature and location of the ponds on the site. The proposed conditions of
approval for this SUP application are attached.

Plan as Office Commercial. This designation encourages professional, medical, and
administrative office as well as limited commercial establishments that benefit adjacent
and nearby residential areas, and in which all business and commerce is conducted

office buildings, executive suites, and co-working spaces.
CURRENT ZONING: The property is currently zoned 0-1 Commercial. This district is
intended to permit the professional and organizational office needs of the community. The
properties were rezoned to 0-1 Office on September 24, 2018 (Ordinance 3540) and

Letter of Intent
Dear Mr.Comstock,
Please let this letter serve as the Letter of Intent for the SUP request associated
with the Northstar Dermatology Medical Offices located on Precinct Line Road.
As part of this project we have analyzed the downstream drainage facilities and
determined that detention will be required for this development. The site
currently drains to Precinct Line Road which is controlled by TxDOT. The
detention pond shall be designed to meet all TxDOT drainage criteria and
requirements. We are requesting the SUP for the following conditions.
• To allow the use and construction of a detention pond.
• To allow the use and construction of vertical retaining walls as part of
the detention pond design.
• To allow the use and construction of 4:1 earthen slopes as part of the
detention pond design.
• To allow the pond outfall to be located closer than 50' of the public
right-of-way, This outfall will connect to underground storm facilities
and shall not discharge above grade.

Special Use Permit Case SUP 2019-11
8161 and 8165 Precinct Line Road, North Richland Hills,Texas
This Special Use Permit (SUP) shall adhere to all the conditions of the North Richland Hills Code
of Ordinances, as amended, and the base zoning district of 0-1 Office.The following regulations
shall be specific to this Special Use Permit. Where these regulations conflict with or overlap
another ordinance, easement, covenant or deed restriction, the more stringent restriction shall
prevail.
A. Permitted land uses. A special use permit is authorized for one detention/retention storage
facility on the property.
B. Site development standards. The construction of the detention/retention storage facility is
subject to the following.
1. Construction of the detention pond is subject to final approval of the engineering plans,
including safety measures, by the Development Review Committee and City Engineer.
2. The detention pond must be landscaped in accordance with Chapter 114—Vegetation of
the Code of Ordinances and this Exhibit"B."The landscape plan is subject to final approval
by the Development Review Committee.
3. The detention pond outlet structure may be located less than fifty (50) feet from a
property line.
4. The side slopes of the detention pond may exceed a 5H:1V slope. If vertical walls are
included, the walls must be constructed and/or faced with natural stone.
5. The owner must execute a detention/retention storage facility maintenance agreement
in conjunction with the approval of the final plat for the property.
C. Amendments to Approved Special Use Permits. An amendment or revision to the special use
permit (SUP) shall be processed in the same manner as the original approval. The application
for an amendment or revision shall include all land described in the original ordinance that
approved the SUP.
The city manager or designee may approve minor amendments or revisions to the SUP
standards provided the amendment or revisions does not significantly:
1. Alter the basic relationship of the proposed uses to adjacent uses;
2. Change the uses approved;
3. Increase approved densities, height, site coverage, or floor areas;
4. Decrease on-site parking requirements;
5. Reduce minimum yards or setbacks; or
6. Change traffic patterns.

Realty for a final plat of Lot 1, Block A, Northstar Addition, being
3.191 acres located in the 8100 block of Precinct Line Road.

SUMMARY:
Texas Bluebonnet Realty is requesting approval of a final plat of Lot 1, Block A, Northstar
Addition. This 3.191-acre development is located in the 8100 block of Precinct Line Road.
GENERAL DESCRIPTION:
The property is located on the west side of Precinct Line Road, south of North Tarrant
Parkway. The site is situated between the North Tarrant Marketplace retail center and the
Thornbridge North subdivision.
The final plat includes one lot intended for the development of medical offices. The lot
has 331 feet of frontage on Precinct Line Road and is approximately 396 feet deep. The
plat consolidates two tracts of land that were purchased on the front of two residential
parcels on Precinct Line Road. The plat includes access easements that provide
connections to the commercial property to the north and the two residential sites to the
west.
An existing house is located in a portion of the northwest corner of the site. The house
must be demolished or moved prior to construction on the lot.
At the September 19, 2019, meeting, the Planning and Zoning Commission disapproved
this plat due to noncompliance with requirements related to public sanitary sewer access.
On the previous plat, the developer had not obtained a sanitary sewer easement from the
property owner to the west, which is required for the extension of a utility line to provide
sanitary sewer service to the development. The required easement has been obtained
and would be recorded prior to this plat being recorded.

KOC Gran Via Richland LLC is requesting approval of a replat of Lots 2R1 and 2R2, Block
4, University Plaza Addition. This 7.294-acre development is located 8925 and 9001
Airport Freeway.
GENERAL DESCRIPTION:
The property is located generally at the northeast corner of Airport Freeway and Weyland
Drive. The lot at 9001 Airport Freeway is the site of the Frost Bank office tower. The lot
at 8925 Airport Freeway is currently vacant and primarily has frontage on Weyland Drive.
The replat would make the following revisions to the previous plat.
1. Existing Lot 2R would be subdivided to create two new lots. Lot 2R1 would be a
vacant lot available for development. Lot 2R2 would remain developed with the
existing office tower.
At the September 19, 2019, meeting, the Planning and Zoning Commission disapproved
this plat due to noncompliance with requirements related to public sanitary sewer and
drainage facilities. On the previous plat, these facilities were located on a private lot
without benefit of a public easement. The applicant has revised the plat so that the private
sanitary sewer and drainage infrastructure is located on the lot it serves.
The plat does not alter or remove any recorded covenants or restrictions, if any, on the
property.
As required by Section 212.015(f) of the Texas Local Government Code (effective
September 1, 2019), written notice of this replat will be mailed to each owner of a lot in
the University Plaza Addition that is within 200 feet of the lots being replatted. The notice
is required to be sent no later than 15 days after approval of the plat by City Council.
COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use
Plan as Office Commercial. This designation encourages professional, medical, and

administrative office as well as limited commercial establishments that benefit adjacent
and nearby residential areas, and in which all business and commerce is conducted
indoors. It encourages the development of a variety of office types including traditional
office buildings, executive suites, and co-working spaces.
CURRENT ZONING: The property is currently zoned C-1 Commercial.
TRANSPORTATION PLAN: The development has frontage on the following streets. The
property also fronts Airport Freeway. Right-of-way dedication is not required for this plat.

Jason Haynie is requesting approval of a final plat of Lot 8, Block 2, Green Valley Country
Estates. This 1.773-acre property is located at 7409 Bursey Road.
GENERAL DESCRIPTION:
The property is located on the north side of Bursey Road between Valley Drive and Hunter
Lane. The property is unplatted and currently developed with a single-family residence.
The 1.773-acre property has 255 feet of frontage on Bursey Road and ranges from 293
to 335 feet deep. The proposed final plat is intended to create one residential lot for the
purpose of demolishing the existing residence and constructing a new home. Water and
sanitary sewer service are available to the property.
LAND USE PLAN: This area is designated on the Comprehensive Land Use Plan as
Residential Estate. This designation promotes neighborhoods defined by larger single-
family lots and homes at a density less than two (2) units per acre. These neighborhoods
are characterized by large lots, rural street design, estate-style fencing, barns, and
livestock. These properties address a specific market niche and add to the diverse mix of
housing and lot options for the community.
Transitional densities and lot sizes of 13,000 square feet or more may be appropriate
when adjacent to Major Collector roadways and existing conventional suburban
residential neighborhoods. New development should be sensitive to the surrounding
context in scale and form and be designed to reflect a contiguous and seamless growth
pattern that avoids fragmented and disconnected development. The Vision203O

WRITTEN STATEMENT OF CONDITIONS
The City of North Richland Hills received this plat application on September 18, 2019. The Development
Review Committee reviewed this plat on September 24, 2019. The following represents the written
statement of the conditions for conditional approval of the plat.
1. This plat is scheduled for City Council consideration on October 14, 2019. Prior to filing with the
County Clerk, new tax certificates must be obtained.
2. Regarding the title block:
a. Revise the title block to read FINAL PLAT rather than PRELIMINARY PLAT NRHSubdivision
Regulations§110-331(18)(Requirements for all plat drawings—title block).
b. Revise the text to refer to the proposed plat as LOT 8, BLOCK 2, GREEN VALLEY COUNTRY
ESTATES. The"R"designation is not required,as the original plat for Green Valley Country
Estates was not recorded. Additionally, "Green Valley Addition" is the name of another
platted subdivision not in close proximity to this property. NRH Subdivision Regulations§110-
331(16)(Requirements for all plat drawings—subdivision name).
3. Regarding the plat graphic:
a. Remove all trees, structures, pavement, fencing, utilities and contours from the plat and
legend.
b. Remove all zoning designations from the plat.
c. Dimension the right-of-way width for Bursey Road at the property corners from the
centerline of the street as well as the property lines across Bursey Road. NRHSubdivision
Regulations§110-331(14)(Requirements for all plat drawings—Street right-of-way).
4. Provide the Certificate of Approval (i.e. "approval block")for City Council.
5. Informational: A front yard sidewalk must be constructed for this lot prior to completion of any
new primary structure. Construction of any sidewalk must conform to the standards and
specifications contained in the Public Works Design Manual. NRH Subdivision Regulations §110-372
(Sidewalk requirements)
DESIGN PRINCIPLES
The following comments represent suggested modifications to the plat drawing based on general NRH
