MINUTES OF THE REGULAR CITY COUNCIL MEETING OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, HELD AT THE CITY HALL, 7301 NORTHEAST LOOP 820, MAY 10, 1976 - 7:30 P.M. CALL TO ORDER Mayor Tom Newman called the regular meeting to order May 10, 1976, at 7:30 p.m. ROLL CALL PRESENT: Mayor Counci 1 men Councilwoman T. E. Riddle Winnie Barclay Rex McEntire Dick Perkins ABSENT: Councilwoman Councilman Dorothy McCl ure James Cato INVOCATION The invocation was given by Councilman Conant. COUNCILMAN CATO PRESENT. APPROVAL OF MINUTES Approval of Minutes of Regular Meeting April 26, 1976 Councilman Conant moved, seconded by Councilwoman Goodnight, to approve the minutes as presented. Motion carried 5-0. RESOLUTION NO. 76-7 Consideration of Resolution Canvassing the Run-Off Election May 8, 1976 Mayor Newman summarized Resolution No. 76-7, which contained the results of the May 8, 1976, Run-Off Election for Place One and Place Four. Candidates Office Total Denver Mills Councilman 741 Mikel Brown Place One 502 John Lamond Councilman 713 Everett Hays Place Four 531 The following candidates were declared duly elected to the offices indicated. Councilman Place One, Denver Mills, Councilman Place Four, John Lamond. Councilman Cato moved, seconded by Councilman Conant, to approve Resolution No. 76-7 as presented. Motion carried 5-0. City Attorney Rex McEntire administered the following oath to the new Council members. I, do solemnly swear (or affirm) that I will faithfully execute the duties of the offi ce of Ci ty Council man of the Ci ty of North Richland Hills, State of Texas, and will to the best of my ability, preserve, protect, and defend the Constitution and laws of the United States and of this State; and I furthermore solemnly swear (or affirm) that I have not directly or indirectly paid, offered, or promised any public office or employment as a reward for the giving or withholding a vote at the election which I was elected. So help me God. MAYOR PRO TEM Election of a Mayor Pro Tern Mayor Newman opened the floor for recommendations for a Mayor Pro Tern. Councilman Lamond nominated Councilman Cato for Mayor Pro Tern. Mayor Newman asked if there were any other nominations. APPEAL HEARING REQUEST Councilman Lamond moved, seconded by Councilwoman Goodnight, that Councilman Cato be elected Mayor Pro Tern. Motion carried 6-0. Mr. Charlie Evans' Request for Appeal Hearing on Zoning Case Mr. Charlie Evans, Attorney, representing the First National Bank of Hurst, appeared before the Council requesting an appeal hearing regarding Lot 5, Block 23, Clearview Addition. Mr. Evans advised the Council that the Planning and Zoning Commission had disapproved this zoning request. Councilman Cato moved, seconded by Councilwoman Goodnight, to grant Mr. Evans an appeal hearing at the June 14, 1976, Council meeting. Motion carried 5-1; Councilman Smith voting aganist. PLANNING & ZONING PS 76-2 PS 76-2, Final Plat - Patsy Gester Mr. Doug Long, Engineer, Hurst, Texas, represented Patsy Gester. Mr. Long advised the Council that Patsy Gester only wanted to label this tract so she could get a permit to build a house. Mr. Long advised that there was no sewer, but she had a percolation test to give to the Engineer. The plat had been corrected as requested by the City Engineer. Councilman Mills state that the information he had said that Conet Drive had been taken care of by providing an easement. He asked if we knew where Conet Drive was going to be located. Councilman Lamond stated that at the present time, metes and bounds could not be set. Councilman Cato asked the City Engineer if he had seen the corrections made on the plat and other items referred to in his letter of April 23. Mr. Perkins replied that he had not seen them. Mrs. Barclay advised Mr. Perkins that the corrections had been brought in. Mr. Perkins speaking on behalf of the firm of Knowlton-English- Flowers, stated that he wanted to go on record as advising the Council that if plats such as this one or subsequent plats along this proposed throughfare, they feel that there may be some point in the furture that the Council will have to buy more right-of-way and/or houses. Due to the uncertainty of where the road is to be located. We have recognized the potenal problem and want the Council to be aware. It will be very difficult to review plats along this proposed throughfare until we have some kind of guide lines to go by~ Councilman Lamond moved, seconded by Councilman Cato, to approve PS 76-2; Councilman Cato amended the motion to read as contingent on the Engineer of the requester complying with the recommendations of the City Engineers letter of April 23, 1976. Motion carried 6-0. PLANNING & ZONING PS 76-5 Replat of Fossil Creek Trails Mr. Doug Long, Engineer, Hurst, Texas, presented this case. He informed the Council that he had complied with the City Engineers request. The replat was necessary because some easements had been left off the orginial plat. PLANNING & ZONING PS 76-6 PAYMENT EMERGENCY ITEM ADDED CANCELING MAY 24, 1976 COUNC I L ME ETI NG *seconded by Councilman Conant. Motion carried 6-0. Replat of Holiday Hills Addition Mr. Jim Davies, Fort Worth, represented Richland Enterprises on the replat of Holiday Hills. He advised the Council he had complied with the City Engineers requirements. The building lines did not conform with the Zoning Ordinance. Councilman Cato moved, seconded by Councilman Smith, to approve PS 76-6. Motion carried 6-0. Consideration of Payment to Thomas Electronics in the Amount of $850.00 After discussion, Councilman Mills moved, seconded by Councilman Conant, to approve payment to Thomas Electronics. Motion carried 6-0. * Councilman Cato moved to add an emergency item to the agenda. Councilman Cato explained that the next regular City Council meeting was scheduled at the same time the Bicennintal Celebration at the Birdville School was being held and the Council was to participate . Councilman Smith moved, seconded by Councilman Conant, to cancel the May 24, 1976, regular City Council meeting. Motion carried 6-0.
