MINUTES OF THE REGULAR CITY COUNCIL MEETING
OF THE CITY OF NORTH RICHLAND HILLS, TEXAS,
HELD AT THE CITY HALL, 7301 NORTHEAST LOOP 820,
JULY 19, 1976 - 7:30 P.M.
CALL TO ORDER
Mayor Newman called the regular meeting to
order July 19, 1976, at 7:30 p.m.

APPROVAL OF MINUTES
Approval of the Minutes of the June 28, 1976,
meeting
Councilwoman Goodnight moved, seconded by
Councilman Lamond, to approve the minutes
of the June 28, 1976, meeting. Motion
carried 6-0.
APPOINTMENT
Consideration of Appointment of three members
to the Zoning Board
Counilman Mills moved, seconded by Councilman
Cato, to approve the re-appointment
of Mrs. Mary Jo Shaunty and appointment of
Mr. Forrest Grubb and Mr. Darrell Wood to
the Planning and Zoning Commission. Motion
carried 6-0.

APPOINTMENT
Consideration of Appointment of Three
Members to the Zoning Board of Adjustment
Councilman Lamond moved, seconded by
Councilman Mills to appoint Dr. E. K. Hahn,
Mr. Jack Rosenberry and Mr. Jay Jones, to
the Zoning Board of Adjustment. Motion
carried 6-0.
Councilman Cato asked that a letter be
written to the Board of Adjustment Members
asking them to be more specific as to which
of the three basic requirements of the
Zoning Ordinance they are granting a
vari ance on.
APPROVAL OF CIVIL
SERVICE APPENDIX A
Consideration of Approval of Civil Service
Rules, Appendix A
Councilman Cato advised the Council that
the only change in Civil Service Appendix
A, was pertaining to tuition for City
employee's attending Universities and
Co 11 ege.
Councilman Cato moved, seconded by Councilwoman
Goodnight, to approve the Civil Service
Rules, Appendix A. Motion carried 6-0.
PAYMENT
Consideration of Final Payment to Texas
Bitul ithi c
Councilwoman Goodnight moved, seconded by
Councilman Cato, to approve payment to
Texas Bitulithic.
Councilman Lamond asked the City Engineer
why the City Manager requested that Texas
Bitulithic be penalized 50 days and the
Engineer and Director of Public Works
requested 28 days.
Mr. Perkins advised that Mr. Britton, Texas
Bitulithic and himself had a meeting and
agreed on the 28 days. He stated that
he thought the City Manager was aware of
the agreement.
Mr. Perkins explained that Texas Bitulithic
was being penalized for liquidated damages.
The contract called for the contractor to
notify the Engineer in writing within? days.

The contractor was having trouble with
the gas company. The Engineer
does not grant time beyond the 7 day
requirement.
Councilman Lamond asked the City Engineer
if this company had a history of being
late.
Mr. Perkins advised that this contractor
had a history of going beyond the completion
date of the contract. This was the first
time they have ever been penalized.
Councilman Lamond made a substitute motion,
seconded by Councilwoman McClure, to
penalize Texas Bitulithic 50 days.
Councilman Mills asked if the Contractor
had been fully informed.
Mr. Britton replied that the Contractor
had been informed in writing.
Mr. Perkins advised that Mr. Britton,
Mr. Riddle and himself had a meeting
before the job was completed and basically
agreed on 50 days. The contractor asked
to go to the Council to be heard.
While the City Manager was out of town,
another meeting was held and 28 days was
agreed on. Mr. Perkins stated he did
not think the City Manager was fully
aware of the agreement.
PURCHASE OF BUILDING
Motion carried 5-1; Councilman Smith
voting against.
Consideration of Purchasing Metal Building
from the Developers of Meadow Lake Estates
Mr. Ray Britton, Director of Public Works,
presented the Council a sketch of a building
he proposed to buy from the developers of
Meadow Lake Estates and move to the City
Garage. Mr. Britton explained that more
room was needed and this building could
be purchased for $1,500.
Councilman Lamond asked what it would cost
to move the building and how it would be
moved.

Mr. Britton replied that it would
cost approximately $2,000.00 and he
would use the labor we already have
and move it in their spare time.
Councilwoman McClure asked what it
would cost to have it moved.

Mr. Britton replied about $6,000.
Councilman Lamond asked for a direct
labor cost.
Mr. Britton replied about $4,000.00
when completely finished.
BID
Councilman Mills moved, seconded by
Councilman Smith, to purchase the
building from Meadowlake Estates.
Motion carried 5-1; Councilman Lamond
voting against.
Consideration of Bid for Mini-Computer
Mayor Newman advised the Council that
three bids were sent out and Burroughs
was the only bid submitted.
Councilwoman McClure moved, seconded
by Councilman Smith, to accept the
bid from Burroughs.
Councilman Cato asked Mrs. Ruth Pinner,
Director of Finance, if the machine met
with her approval.
Mrs. Pinner replied that the machine
would do the work quite sufficiently.
Councilman Cato asked why the Cassette
Station was needed.
Mrs. Pinner replied that they wanted to
put it on the old machine. They could
change the program quickly. With the
cards and tapes, it would take about
30 minutes.
Councilman Mills asked why the one on
the new machine could not be used.

Mrs. Pinner replied that the new one
was wired into the machine. As many
changes that would need to be made,
the tapes and cards would wear out.
Councilman Cato asked Mr. Britton if
a cost had been made on what it would
cost to re-construct the billing room
for proper air conditioning.
Mr. Britton replied that he had talked
with the contractors and was advised
that the air distrubition was all that
needed to be changed.
Councilman Cato asked if more ducting
was needed.
Mr. Britton replied no.
Councilman Cato advised Mr. Britton
to get Burroughs to get something
in writing from the contractor on the
air conditioning.
Motion carried 6-0.
APPOINTMENT
Appointment of Voting Representative
to C.O.G.
Mayor Newman appointed Councilman Walter
Smith as the Voting Representative to
C.O.G.
Councilman Mills moved, seconded by
Councilwoman McClure, to approve the
Mayors appointment. Motion carried
5-0.
ORDINANCE #631
Consideration of Ordinance Allowing
Handicapped Persons to Operate Certain
Vehicles on City Streets
Councilman Lamond advised the Council
that the purpose of this Ordinance was
to help the handicapped in our City.
He stated that a gentleman in Diamond
Loch needed the use of a golf cart to
get around in. ~ The police had stopped
him and told him it was illegal to drive
the cart on city streets.
Mayor Newman stated that he felt the police
should be helping the handicapped and not
give them tickets.
Councilwoman Goodnight asked if this
Ordinance had been coordinated with the
Police Department.

Councilman Lamond stated that he had
talked with the Police Chief and was
advised that the Police Department did
not make the laws, only inforced them.
Councilwoman McClure stated that she
did not like the $5.00 permit fee.
Councilman Lamond advised the fee could
be reduced.
Councilman Mills stated that he would
like to have the City Attorneys opinion
on the liability of the City if the
Council asked the Police Department not
to interfere. Would the City be liable
if someone caused an accident. He stated
that maybe some minor changes needed to
made to the Ordinance.
Councilwoman Goodnight asked Councilman
Lamond if the had talked with the City
Manager regarding this problem.
Councilman Lamond replied that he had,
and received the same answer that he
got from the Police Chief.
Councilman Smith stated that he felt that
our Police Department had a tough job and
would have to defend them.
Councilman Lamond moved, seconded by
Councilwoman McClure, to approve Ordinance
No. 631. Motion carried 6-0.
CITIZENS PRESENTATION
Mrs. James Williams, 7900 Maplewood,
appeared before the Council and stated
that she and a neighbor had called the
Police Department for the animal control
officer at 10:00 a.m., to pick up a dog.
At 12:00 p.m., they called again and was
advised by the dispatcher that they were
having trouble finding the address.
Mrs. Williams stated that she called again
and talked with Officer Brown and he assured
her that they would be there shortly.
At 7:00 p.m., the animal control officer
had not shown up.
Mayor Newman advi sed Mrs. Wi 11 i ams that
he would talk with the City Manager concerning
this problem.
