CALL TO ORDER Mayor Newman called the meeting to order January 24, 1977, at 7:30 p.m. PRESENT: Mayor Councilmen ROLL CALL Councilwoman Tom E. INVOCATION The Invocation was given by Councilman John Lamond. APPROVAL OF MINUTES SERVICE AWARD Approval of Minutes of the January 13, 1977, Meeting. Councilman Mills moved, seconded by Councilman Conant, to approve the minutes of the January 13, 1977, meeting. Motion carried 5-0. Presentation of Five Year Service Award. Mayor Newman presented Laura Prewitt, Librarian, for North Richland Hills, with a five year pin and certificate for five years of service with the city. Mayor Newman thanked Mrs. Prewitt for her service to the city and gave his appreciation for her dedication to the Library. Dick Perkins Present. CITIZENS REQUEST Citizens Request - Mr. R. D. Jones, Requesting the City to Join N.T.C. Minutes January 24, 1977 Page 2 Mr. Oscar Reeder, of the Haltom/Richland Chamber appeared before the Council. Mr. Reeder stated he had been a representative of the Haltom/Richland Chamber for the past five years. He stated that N.T.C. advertised allover the world. They promoted public relations between cities and businesses. Mr. Burke of N.T.C. appeared before the Council and stated he would encourage the cities participation in N.T.C. He stated ten cities were participating in the program. Mr. Burke advised that N.T.C. contacted businesses out- side the area and showed literature on different cities. Their main objective was to attract new business to an area. Mayor Newman ask Mr. Burke if any cities in the Haltom/Richland area belonged to N.T.C. Mr. Burke stated they had only appeared before Haltom City. Mayor Newman ask what the fee was based on. Mr. Burke stated it was based on population, $0.11 per capita. Councilman Lamond ask what percentage went to administration. Mr. Burke stated about 20% went to administration. Councilman Smith ask what cities were in N.T.C. Mr. Burke replied McKinney, Farmers Branch, Grand Prairie, Cedar Hill, Irving and Grapevine. He advised that no city had refused, but some cities are still considering whether or not to join. Councilman Mills ask Mr. Burke if N.T.C. could take credit for any business located in the area. Mr. Burke replied, Association Corporation of America had moved from Indiana to Irving. Councilman Mills ask how the area was selected. Mr. Burke replied N.T.C had ten people on the Board and they show prospects literature on the Metroplex and the companies decide on the location. Minutes January 24, 1977 Page 3 Councilman Lamond moved, seconded by Councilman Smith, to table this item until the February 14, 1977, meeting. Motion carried 5-0. Fire Chief Gertz Present. CITIZENS REQUEST Citizens Request-Diane Stevens, Mid Cities Da i ly News Ms. Stevens was not present, Councilman Lamond moved, seconded by Councilman Smith to table this item until February 14, 1977. ORDINANCE CHANGE Consideration of Ordinance Change Mr. George Staples, Attorney, 1516 Precinct Line Road, Hurst, appeared before the Council repre- senting Mr. Otis Gotha.rd, Gothard Wrecker Service and Mr. Dan Praytor, Northeast Paint and Body. Mr. Staples advised the Council that Mr. Praytor and Mr. Gothard wanted the Council to restrict the wrecker service to North Richland Hills resident operators. They are not allowed to pull cars in Haltom City and Hurst. They feel they can give better and faster service. They would also pay the City a 2% franchise fee. Councilman Conant ask how many wreckers pulled in North Richland Hills. Mayor Newman replied four (4). Councilman Mills ask if Richland Hills had a system. City Attorney Rex McEntire advised no, Richland Hills used Gothard and Northeast. City Attorney McEntire advised the Council they could instruct the city staff to limit the wrecker service to Gothard and Praytor and work out the details on the ordinance later. Councilman Lamond moved, seconded by Councilman Mills, to instruct the city staff to limit the wrecker service to Gothard and Praytor on police ca 11 s, with the sti pul ation that the city coul d change this policy if it became necessary. After discussion, Councilman Smith moved, seconded by Councilman Conant, to table this item until the February 14, 1977, meeting. Motion carried 3-2; Councilmen Lamond and Mills against. CIVIL SERVICE SECRETAKY REQüEST RESOLUTION 77-1 RESOLUTION 77-2, PROCLAMATION Minutes January 24, 1977 Page 4 COilsideration of Request of Civil Service Secretary Mayor Newman read a letter from the Civil Service Secretary requesting pay be reimbursed for three days she was off work to attend a funeral. Mayor Newman stated he felt this was a personnel matter and would like to go into closed session. Councilman Mills moved, seconded by Councilman Smith, to go into closed session. Motion carried 5-0. Mayor Newman called the meeting back to order. The same Council members and staff were present as recorded at the beginning of the meeting. Councilman Mills moved, seconded by Council- woman McClure, to table this item permanently. Motion carried 5-0. Consideration of Resolution Mayor Newman stated that the Legislative Budget Board had voted to merge the Commission on Law Enforcement Officer Standards and Education with the Board of Private Investigators and Private Security Agencies. The Private Investigators and Security Agencies would have no funding unless they merged. Chief Scruggs had written a memo stating reasons why police Departments were against the merge. The Resolution stated we were against the merge and a copy of the resolution was to be sent to the Legislative Budget Board and each State Representative and State Senator. Councilman Mills moved, seconded Smith, to approve Resolution No. recommendation of Chief Scruggs. carried 5-0. by Councilman 77-1, on the Motion Consideration of Resolution Canvassing the Election for Councilman Place Seven Proclamation Calling a Run-Off Election City Attorney McEntire advised the Council the Resolution and Proclamation could be heard together. City Attorney McEntire read the resolution canvassing the election. The results were as follows: Minutes January 24, 1977 Page 5 Candidate Charles Erwin Earnest "Woody" Jones Dave Freeman Jack Roseberry Votes 76 23 146 95 No candidate having received a majority of the votes, there will be a run-off election between Dave Freeman and Jack Roseberry. City Attorney McEntire read the proclamation calling a run-off election. The election will be held February 19, 1977, at the Municipal Complex, 7301 Northeast Loop 820, between the hours of 7:00 a.m. and 7:00 p.m. Absentee voting will begin January 27, 1977, and end February 15, 1977, at 5:00 p.m. Mrs. Ann Smith will serve as Judge and Mrs. Laura Wilhite as Alternate Judge. Councilman Smith moved, seconded by Councilman Conant, to approve Resolution 77-2, and the proclamation calling the run-off election for February 19, 1977. Motion carried 5-0. RESOLUTION 77-3 Consideration of Resolution - TRA Mayor Newman advised this resolution with Trinity River Authority would be for future water supply for the city. Councilwoman McClure moved, seconded by Councilman Conant, to approve resolution 77-3. Motion carried 5-0. ORDINANCE 652 Consideration of Ordinance Pertaining to Library Materials Councilman Smith moved, seconded by Councilman Conant, to approve Ordinance No. 652. Councilman Smith stated the Library had trouble getting people to return books. They send letters and call to no avail. With this Ordinance maybe the Library could recover more books. Councilwoman McClure stated there should be a minimum fine as well as a maximum. City Attorney McEntire advised the Ordinance covered both, up to $200.00 could be the fine. Minutes January 24, 1977 Page 6 Councilman Mills ask if a book was lost how it would be handled. City Attorney McEntire advised the party would be fined the cost of the book. Councilman Mills advised the Ordinance set the minimum fine as $1.00. City Attorney McEntire advised the Ordinance could be passed with an amendment taking out the $1. 00. Councilman Smith amended his motion to eliminate the minimum fine of $1.00. Motion carried 5-0. BIDS Consideration of Insurance Bids Mrs. Ruth Pinner, Director of Finance, appeared before the Council. Mrs. Pinner stated that five companies had been sent offers to bid on the insurance. Alexander and Alexander was the only bid received. Mr. Roy Miller, Alexander and Alexander Insurance, appeared before the Council. Mr. Miller adv~sed the Council there had been two rate increases in the last year. Councilman Mills ask what factor was used to determine the rate. Mr. Miller replied, by the number of people on the payroll. He also stated his company had had a good experience with the city as far as accidents were concerned. The loss has been very low. Councilman Lamond stated he wanted the names of the other companies who were sent bids written into the record. They are as follows: Leffingwell Insurance Agency, Eastern Tarrant Insurance Company and Glen Schnider. Mrs. Pinner advised the Council only $22,000.00 was budgeted for insurance. Councilman Conant moved, seconded by Councilwoman McClure, to approve the bid of Alexander and Alexander in the amount of $27,083.00, $5,083.00 to be paid out of the General Fund Surplus. Motion carried 5-0. ORDINANCE NO. 653 Consideration of Fire Department Ordinance ADJOURNMENT ATTEST: 4¿d45 );;. ~/ ette Moore, Ci ty Secretary Minutes January 24, 1977 Page 7 Fire Chief Gertz advised the Council the Fire Department was operating under the 1965 NFPA. It had not been updated since 1972. Councilman Smith moved, seconded by Councilman Conant, to approve Ordinance No. 653. Councilman Mills ask if this ordinance would have any effect on the Insurance Rates. Fire Chief Gertz replied it would not. This Ordinance would give the Fire Department better guide lines to follow in making inspections. Councilman Mills stated the Ordinance called for a Board of Appeals to be appointed by the City Manager. He would like to change it to the Mayor appoints, with the approval of the Council. Councilman Mills ask if Section 6, pertaining to Electrical Code would interfere with the one being used by the Inspection Department. Mr. Britton advised he would check and see, but thought they were both the same. Councilman Smith amended the motion to read the Appeals Board would be appointed by the Mayor and approved by the Council. Motion carried 5-0. Mayor Newman adjourned the meeting of January 24.
