MINUTES OF THE CITY COUNCIL MEETING OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS, HELD IN THE CITY

Mayor Newman called the meeting to order June 13,
1977, at 7:30 P.M.

INVOCATION
MINUTES
The Invocation was given by Councilman Lamond.
Approval of Minutes of May 23, 1977, Meeting
Mayor Pro Tern Cato moved, seconded by Councilman
Conant, to approve the minutes of the May 23, 1977,
meeting. Motion carried 6-0.
PROCLAMATION
Mayors Proclamation
Mayor Newman read a Proclamation declaring June 19,
1977, as "French Gymnasti c Team Day".
Mr. Henry Besson accepted the proclamation on behalf
of the gymnastics team.
Citizens Presentation by the Senior Citizens Alliance
of Tarrant County to Discuss Raising Senior Citizen's
Tax Exemption

Mr. A. J. Shippey, President Senior Citizens Alliance
of Tarrant County, Incorporated, appeared before
the Council. Mr. Shippey stated he was requesting
the Council to raise the tax exemption from $3,000.00
to $7,000.00, for over age 65, Senior Citizens, Inc.,
National Retired Teachers Association, American
Association of Retired Persons, National Association
of Retired Federal Employees, Bell Helicopter
Retirees, General Dynamics Retired Employees, General
Motors Retirees, Telephone Pioneers, Golden Bears
and others.
Mr. Shippey stated the elderly were on fixed incomes,
the increase in utility bills, gas and taxes has
caused a hardship for them. Mr. Shippey stated the
Senior Citizens did a lot of volunteer work, they
were the first to be called on and the last to be
helped.
Mr. Shippey cited several cities that allowed the
$7,000.00 exemption. He also read the Resolution
that Fort Worth had approved. He ask the Council
to approve the exemption and include it in the
1977-1978 Budget.
Mayor Newman stated we did not know where the money
would come from and would like to table this item
until after the Budget Worksession.
Councilman Mills ask Mr. Shippey how he arrived at
the $7,000.00 exemption.
Mr. Shippey stated that a State wide survey had
been conducted in major cities, and based on
inflation it worked out to be $7,000.00.
Councilman Mills ask if he had the statistics on
retired persons on fixed income in the City of
North Richland Hills.
Mr. Shippey replied he did not, only in Tarrant
County.
Councilman Mills ask Mr. Shippey if the County and
School Boards had been approached.
Mr. Shippey stated they had gone before the School
Board last Wednesday. The County had not made a
decision.
Councilwoman McClure ask if the School Board had
responded.
Mr. Shippey said the School Board was having

financial difficulty. They had not responded.
Councilman Lamond stated he felt their was a real
need for the exemption in North Richland Hills,
but felt it should be handled in the Budget Work-
session.
PLANNING AND ZONING
PS 77 - 16
Councilman Conant moved, seconded by Councilwoman
McClure, to table this item until the first Council
Meeting after Budget Worksession. Motion carried 6-0.
Councilman Lamond instructed the City Secretary to
survey the cities in Tarrant County and find out how
much of an exemption they were allowing.
Planning and Zoning, PS 77-16~ Request of Mr. Mack
L. Garvin, Replat Lot 14, Block 2, Morgan Meadows
Mr. Mack L. Garvin appeared before the Council to
speak for this case. Mr. Garvin stated he wanted
to replat the two acres in order to build a house
on it.
Mr. Britton stated he wanted the Council to be aware
of the letter from the Utility Director concerning
the cost of Utilities.
Councilman Conant ask who was going to pay the cost
of the utilities.
Mr. Garvin stated he had an agreement with Mr.
Bronstad on the utilities. A building permit would
not be issued until the fee had been paid.
Mr. Britton stated that Mr. Garvin would sign a
covenant for his pro rata share of the streets.
Councilman Lamond moved, seconded by Mayor Pro Tern
Cato, to approve PS 77-16, subject to Mr. Garvin
signing the covenant and the Engineers letter. Motion
carried 6-0.
PLANS AND SPECIFICATIONS
ONYX BRIDGE
Approval of Plans and Specifications for Onyx Street
Bridge
Councilman Lamond moved, seconded by Councilman Conant,
to approve bids and specifications for Onyx Street
Bridge, to be taken as soon as possible. Motion
carried 6-0.
FINAL PLAT EMERALD HILLS
Approval to have Engineer Submit Final Plat and
Construction Plans for our Portion of Emerald Hills
June 13, 1977

Mr. Britton advised the Council the City acquired
the property at the same time as the Park in Emerald
Hills. There are plans for a Fire Station to be
built on the North side of the property. There are
twelve lots that are zoned single family, the City
has no need for these lots.
PAYMENT
After discussion, Councilman Mills moved, seconded
by Councilwoman McClure to table this item for further
study. Motion carried 6-0.
Approval of Partial Payment to A. E. Shull Construction
Company
Councilman Conant moved, seconded by Mayor Pro Tern
Cato, to approve partial payment to A. E. Shull
Construction Company in the amount of $27,710.09,
Water and Sewer System Extension to serve Foster
Village, North Hills, Industrial Park and Bursey
Road. Motion carried 6-0.
CONTRACT
Approval of Contract with City Engineers
Councilman Conant moved, seconded by Councilman Mills,
to approve Resolution 77-8, City Engineers Contract.
Motion carried 6-0.
CITIZENS PRESENTATION
Citizens Presentation, Mr. Richard Southerland
Concerning Violations of Ordinance 461
Mr. Fred Kempf, Attorney, Oklahoma City, appeared
before the Council representing Mrs. Parker.
Mr. Kempf stated he had ask Mr. Sutherland to present
the letter of request to be placed on the agenda on
his behalf.
Mr. Kempf advised the Council he was representing
Mrs. Bridie Parker, 4701 Rufe Snow. Mr. Kempf
stated Mrs. Parker was his Grandmother. Mrs. Parker
had received two letters from the City concerning
high weeds and horses grazing on her property. Mrs
Parker owns 25 acres and has boarded horses on the
property since 1938. Mr. Kempf stated he felt the
Ordinance did not apply to Mrs. Parker because she
owned the property before the City adopted the Master
Plan or the Ordinance.
City Attorney McEntire ask what Ordinance Mr. Kempf
was referring to.

Mr. Britton replied the Nuisance Ordinance which
stated livestock are not allowed within 100 feet
of a residence.
City Attorney McEntire ask if Mrs. Parker was there
before the residences.
Mr. Kempf replied she was. The land used to be a
dairy.
Councilman Mills ask how many complaints had been
received.
Mr. Britton replied, two.
Councilman Freeman ask if the horses belonged to
Mrs. Parker.
Mr. Kempf stated Mrs. Parker rented the pasture
for $10.00 a month per horse.
COUNCILMAN SMITH PRESENT.
Mr. Kempf brought Mrs. Parker before the Council.
Mr. Kempf ask Mrs. Parker her age and how long she
had lived on this property. Mrs. Parker replied
she was 87 years old and lived on the property
since 1938. Mr. Kempf ask Mrs. Parker how much she
paid in taxes. Mrs. Parker stated she paid $524.00
City Taxes and $1,306.00 School Taxes. Mr. Kempf
ask Mrs. Parker how the government handled her
Social Security Check. Mrs. Parker stated it was
sent to the Bank and when the taxes were due the
Bank sent the check. Mr. Kempf ask Mrs. Parker why
she did not build a fence inside the present fence.
Mrs. Parker stated she could not afford to build one.
Mr. Jim Parker, 3617 Wendell Drive, Mrs. Parker's son
appeared before the Council. Mr. Parker stated he
had priced the cost of building a fence on three sides,
about five years ago, it would have cost approximately
$1,760.00.
Councilman Mills ask Mr. Parker if the Council agreed
to let Mrs. Parker keep the horses, upon her demise
would he cease keeping the horses.
Mr. Parker replied he would.
Councilman Freeman ask if they had talked to the
people in the area about Mrs. Parker.
Mr. Kempf stated he had not.

Mr. Britton stated he felt it would cause more trouble
if they contacted the residents.
Councilman Lamond moved, seconded by Councilwoman
McClure to approve Mrs. Parker's request, under
non-conforming use. Motion carried 7-0.
Mayor Pro Tern Cato ask the City Attorney if the
Council would be setting a precedent.
City Attorney McEntire replied he did not feel they
would.
ADJOURNMENT
Mayor Newman adjourned the meeting of June 13, 1977.
