Mayor Dick Faram called the specially scheduled meeting to order July 21, 1975, at 7:30 P.M. INVOCATION APPROVAL OF MINUTES Approva 1 of the Mi nutes of the Regul ar Meeti ng, June 23, 1975 Vote: 6-0 9' Motion was made by Councilman Newman, seconded by Councilman Lamond, to approve the minutes of the June 23, 1975 meeting as presented. Motion carried 6-0. Consideration of Resolution Canvassing the Special Election of July 12, 1975 RESOLUTION 75-13 Vote: 6-0 13' Mayor Dick Faram summarized Resolution No. 75-13 which contained the results of the Special Election of July 12, 1975. The following results were can- vassed: Candidates, Councilman Place I Total Mrs. Bill (Dorothy) McClure E. J. (Eddie) Mikeska Jim Jameson 205 39 30 Write-In Candidates, Councilman Place I W. F. (Bill) Polster 10 The following candidate was declared duly elected to Councilman, Place I: Mrs. Bill (Dorothy) McClure City Attorney Tim Truman administered the following to the new Councilwoman: OATH OF OFFICE I, Dorothy McClure, do solemnly swear that I will faithfully execute the duties of the office of City Councilwoman of the City of North Richland Hills, State of Texas, and will to the best of my ability, preserve, protect, and defend the Consti- tution and laws of the Unites States and of this State; and I furthermore solemnly swear that I have not directly or indirectly paid, offered, or promised to pay, contributed, nor promised to contribute any money, or valuable thing, or promised any public office or employment as a reward for the giving or withholding a vote at the election at which I was elected. So help me God. OATH OF OFFICE Mayor Faram presented Councilwoman McClure with a Certificate of Election, and she was seated at the Council Table. Public Hearing and Consideration of Ordinance Closing Public Hearing and Levying Assessments for a Portion of the Cost of Improving a Portion of the Following Streets: Honey Lane, Randle Drive, Lynn Terrace, Linma Lane, Mayor Faram declared the Public Hearing open and called for those wishing to speak in favor of this ordinance to please come forward. Mr. Albert Cote, 6505 Harmonson, came forward and asked why he must pay for curb and gutter in front of his property in the area he used for a drive. The City Manager explained to Mr. Cote that a lay- down curb would be installed in the drive area. Mr. Cote then asked if he could have the laydown curbing in another area. He was told that this would be possible and that he would be contacted before the curbing was installed. Mayor Faram requested those opposed to this ordinance to please come forward. There being no one wishing to speak in opposition to this ordinance, Mayor Faram declared the public hearing closed. Motion was made by Councilman Lamond, seconded by Councilman Cato, to approve the ordinance as set forth hereinafter. Motion carried 7-0. ORDINANCE CLOSING HEARING AND LEVYING ASSESSMENTS FOR A PORTION OF THE COST OF IMPROVING A PORTION ORDINANCE NO. 606 Vote: 7-0 30' OF THE COST OF IMPROVING A PORTION OF THE FOLLOWING STREETS: HONEY LANE FROM GLENVIEW DRIVE TO HARMON SON ROAD: RANDLE DRIVE FROM ASHMORE TO BOOTH CALLOWAY; LYNN TERRACE FROM ROGAN TO LOOP 820; LINMA LANE FROM SCRUGGS DRIVE TO FLORY; DEVILLE DRIVE FROM CUMMINGS DRIVE TO END OF STREET; COLORADO BLVD. FROM STATE HIGHWAY 121 TO STANDLEY STREET; KEN MICHAEL COURT FROM STATE HIGHWAY 121 TO RIVIERA; HOLIDAY LANE EAST FROM RIVIERA DRIVE TO LOOP 820 IN THE CITY OF NORTH RICHLAND HILLS, TEXAS; FIXING CHARGES AND LIENS AGAINST PROPERTY ABUTTING THEREON, AND AGAINST THE OWNERS THEREOF; PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS AND THE ISSUANCE OF ASSIGNABLE CERTIFICATES IN EVIDENCE THEREOF: RESERVING UNTO THE CITY COUNCIL THE RIGHT TO ALLOW CREDITS REDUCING THE AMOUNT OF THE RESPECTIVE ASSESSMENT TO THE EXTENT OF ANY CREDIT GRANTED; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THE ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTES OF THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS, AND BY FILING THE ORDINANCE IN THE ORDINANCE RECORDS OF SAID CITY: AND PROVIDING AN EFFECTIVE DATE. Consideration of payment to Texas Bitulithic Company in the amount of $67,635.08, Job 3-314, Contract No. 14 Motion was made by Councilwoman Goodnight, seconded by Councilman Cato, to approve payment as presented. Motion carried 7-0. Consideration of payment to Albert S. Komatsu & Associates, in the amount of $1,848.00 Motion was made by Councilman Newman, seconded by Councilwoman Goodnight, to approve payment as presented. Motion carried 7-0. Consideration of payment to Public Administration Service, in the amount of $1,870.00 Motion was made by Councilman Newman, seconded by Councilman Cato, to approvement of this final payment as presented. Motion carried 7-0. Consideration of payment to Stafford R. Hardin, in the amount of $58,132.00 Motion was made by Councilman Newman, seconded by Councilman Conant, to approve payment as presented. Motion carried 7-0. APPROVAL OF PAYMENT Vote: 7-0 70' APPROVAL OF PAYMENT Vote: 7-0 75' APPROVAL OF PAYMENT Vote: 7-0 APPROVAL OF PAYMENT Vote: 7-0 Mr. J. Frank Yarbrough, 6813 Davidson, appeared representing Mr. L. Hilger, requesting permission to dig lias deep as necessary" in order to obtain water in Cherokee Estates. He stated that the Council had approved a covenant previously, limit- ing the drilling to a maximum of 200 feet. He said that the well drilling people had informed him that it would be necessary to go deeper; how- ever, no one could tell him how much deeper. It was agreed by the Council that it could not grant him permission to drill to any depth necessary without qualifications to protect the City water supply. Mr. Yarbrough and Mr. Hilger were directed to contact City Manager Gene Riddle and he would work with them to attempt to arrive at a solution to the water problem. City Manager Gene Riddle was directed to determine the City water levels (with assistance from City Engineer Dick Perkins) and let Mr. Yarbrough and Mr. Hilger know what depth would be acceptable.
