The invocation at this regular City Council
meeting was given by Councilman Faram.
APPROVAL OF THE
MINUTES OF THE
PREVIOUS MEETING

Councilman Newman moved~ seconded by Councilman
Ellis~ to approve the minutes of the February
25~ 1974~ meeting as presented. The motion
carried by a vote of 7-0.
CITIZEN'S
PRESENTATION
Mr. Wendell Davis
3311 Ruth Road~ Richland Hills
Re: RYA Girl's Softball
Mr. Wendell Davis~ representing RYA~ requested
permission from the City to build a third
girls softball field at Fossil Creek Park.
The new diamond will be located between the
two existing diamonds. This would necessitate
the removal of approximately 35 trees. The
possibility of transplanting the trees was
discussed.
Also RYA requested permission to close the
road that runs between the restrooms and
concession stand.

There are 494 girls registered and without
another field one hundred of these girls
will have to be cut from the program.
Councilman McKinney moved~ seconded by Councilman
Newman~ to give RYA authority to close the
existing road between the concession stand and
the restrooms and permission to build a third
ball diamond between the two existing diamonds.
The motion carried by a vote of 7-0.
The City Manager was instructed to obtain a
report from the City's Traffic Safety Coordinator
to ascertain an orderly flow of traffic for
the park.
CITIZEN'S
PRESENTATION
Mr. Shelton Aninson
Re: Request of 121 Inc.~ for Appeal Hearing
on PZ 74-6
Mr. Shelton Aninson requested the Council
grant 121 Incorporated an appeal hearing on
PZ 74-6. The property is located at the corner
of Highway 121 and Loop 820 Access Road. It
is presently zoned local retail and the request
that was denied by the Planning and Zoning
Commission was for the sale of beer for off
premise comsumption. Mr. Aninson indicated
he felt the Planning and Zoning Commission
had been arbitrary in its decision that the
sale of beer at this location would increase
the traffic hazards.
ORDINANCE NO. 519
Councilman Cato moved~ seconded by Councilman
Newman~ to grant appeal hearing on PZ 74-6
without attesting to the arbitrariness of the
Planning and Zoning Commission. The hearing
will be April 8~ 1974. The motion carried
by a vote of 7-0.
The City Manager was asked to have the Traffic
Safety Coordinator present at this meeting.
Consideration of Ordinance Amending Ordinance
No. 337~ Plumbing Code~ to allow PVC pipe
After discussion~ Councilman Faram moved~
seconded by Councilman Ellis~ to approve
Ordinance No. 519 which allows for PVC pipe
between a building and the main sewer line.
The motion carried by a vote of 7-0.

ORDINANCE NO. 520
Consideration of an Ordinance Granting
Texas Electric Service Company's Requested
Rate Increase
Councilman Newman stated TESC had been very
cooperative in answering his questions but
he was not a rate expert and felt that he
could not determine whether the rate structure
was fair or not.
The City Attorney explained that the Council
could~ if they wished, approve the Ordinance
with an additional section which contained
a reversionary clause that could be enforced
if they did hire a rate expert who determined
the increase was inequitable. This would
allow the TESC to go ahead with the rate
increase while the Council studied.
Councilman McKinney moved to request the
City Attorney to contact a recommended rate
analysist in Austin to determine the cost
of a study. This motion died for a lack of
a second.
Councilman Faram moved~ seconded by Councilman
Ellis~ to pass Ordinance No. 520 with the
added paragraph in the City Attorney's own
wording which in effect gives the City two
months to hire a rate expert if that be
necessary. The motion carried by a vote of
7-0.
SEWER CONTRACT
Consideration of Sewer Contract with Fort Worth
After discussion, Councilman Cato moved~
seconded by Councilman Ellis, to table the
consideration of the contract with Fort Worth
regarding sewer rates until the additional
information requested is received. The
motion carried by a vote of 7-0.
HEWITT DRAINAGE
PROBLEM
Consideration of Engineer's Report concerning
the Hewitt Street Drainage Problems
City Engineer stated there were several
alternatives available that would temporarily
or permanently solve the drainage problems.
After discussion~ Councilman Faram moved~
seconded by Councilman Newman~ to approve
Alternate 2 and to investigate further what
can be done on the property to the South of
Chapman Road. The motion carried by a vote
of 7-0.

PAYMENT
Consideration of Payment to Texas
Bitulithic~ Inc.~ for Estimate #2~
Contract 13~ Job 3-313~ in the amount
of $66~498.49
Councilwoman Goodnight moved, seconded by
Councilman Ellis, to approve payment to
Texas Bitulithic in the amount of $66~498.49.
The motion carried by a vote of 7-0.
APPROVAL OF
PAYMENT
Consideration of Payment to Crookham and
Vessels for Estimate #3, Job 3-512, Walker
Branch Outfall Sewer Line in the amount of
$62~157.37
Councilman Ellis moved~ seconded by
Councilwoman Goodnight~ to approve payment
to Crookham and Vessels~ Inc.~ in the
amount of $62~ 157.37. The motion carried
by a vote of 7-0.
PLANNING & ZONING
PZ 74-2
ORDINANCE NO. 521
Request of Donald Kerr Associates~ Inc. ~ to
rezone 286.54 acres from Agriculture to
Industrial
The Mayor stated that the Public Hearing was
held at the previous meeting and asked if
Mr. Stembridge had consulted his clients
regarding a compromise. Mr. Stembridge
stated that his clients felt that a request
to have 15% developed in three years was
reasonable.
Councilman Ellis moved~ seconded by Councilwoman
Goodnight~ to approve PZ 74-2~ Ordinance No. 521~
to rezone 286.54 acres from Agriculture to
Industrial with a buffer zone where bounded
by single family residential and that 15% of
acreage must be developed within three years or
the Council can rezone the undeveloped part
to any more restricted classification. The
motion carried by a vote of 7-0.
PLANNING & ZONING
PS 74-4
Request of D & D Investment for Final Plat
Approval on Briarwood Estates
O. D. Long represented D & D Investment in
their request for Preliminary and Final Plat
approval.
After discussion~ Councilman Newman moved,
seconded by Councilman Ellis~ to approve
PS 74-4~ the Prelininary and Final Plat
for Briarwood Estates. The motion carried
by a vote of 7-0.

PS 74- 5
Request of J. Barfield for approval of
Preliminary and Final Plat on Brentwood
Es tates
O. D. Long representated John Barfield in
requesting the Preliminary and Final Plat
approval on Brentwood. Mr. Long stated
the only reason for platting at this time
was so Southwestern Bell could lay a cable.
Mr. Barfield is not ready to develop this
land at this time and the only thing they
know is where the street will be.
After much discussion~ Councilman Faram moved~
seconded by Councilman Ellis~ to approve
PS 74-5~ preliminary and final plat of
Brentwood Estates. The motion carried by a
vote of 6-1. Councilmen McKi~ney~ Ellis~
Faram~ Smith~ Cato and Councilwoman Goodnight
for; Councilman Newman against.
CITIZEN'S
PRESENTATION
Bob Harvey
North Richland Hills Fire Fighters
Re: Wage Increase
Mr. Bob Harvey~ president of the North Richland
Hills Fire Fighters Association appeared before
the Council to ask for a wage increase and
for collective barganing. Mr. Harvey explained
the reasons for the needed increase and agreed
that it was very difficult in mid year to grant
increases. Mr. Harvey requested a work session
with the Council. It was suggested that the
Civil Service Committee meet with the fire
fi ghters.
After discussion it was agreed that the entire
Council would have a meeting with representatives
of the Association~ Monday~ March 18~ ]974.
CITIZEN'S
PRESENTATION
Billy R. Griffin
4891 Susan Lee Lane
Mr. Billy R. Griffin told the Council that for
more than one year he and his family had been
constantly harassed by his neighbor~ Mr. Myers.
He explained in great detail some of the
incidents that had happened~ such as banging
garbage cans at midnight~ cursing his wife~
motorcycles starting under their windows and
beer bottles thrown over the fence. All he
asked was some help in controlling the problem.

ADJOURNMENT
Mr. Griffin was advised of his legal
rights under the law by the City Attorney.
Mayor Massey advised Mr. Griffin to file
a complaint in Municipal Court every time
anything happened. The Council agreed that
Mr. Griffin had one of the most frustrating
problems there is and that there is very
little if anything the City Council can do.
There being no further items on the agenda
for consideration, Councilman Ellis moved~
seconded by Councilman Newman~ that the
City Council meeting of March 11~ 1974~ be
adjourned. The motion carried by a vote of
7-0.

HEWITT DRAINAGE PROBLEM
Dear Gene:
We have studied the subject drainage problem and offer a variety of
alternative solutions for the Council IS review.
Alternate No.1 -- The improvements covered under this alternate include
all necessary work to install drainage facilities~ street replacement
(including curb and gutter) and utility adjustments as called for in the
Master Drainage Plan and in accordance with standard City specifications
and policies regarding street and utility construction. This alternate
would provide permanent relief and would be considered an ultimate
solution to drainage~ street and utility needs for this subdivision.
Alternate No.2 -- This alternate would be considered as a minimum
solution to Mr. Alexander's problem. This work includes channel
improvement from the bend in Hewitt Street South to Chapman Road.
There are existing easements available to perform this construction.
This alternate is shown in orange on the enclosed aerial photo print.
Alternate No.3 -- This alternate provides the same minimum solution to
the drainage problem as Alternate No. 2~ but is somewhat cheaper due to
the shorter routing of the proposed channel improvements. Construction
of this alternate would require the acquisition of one drainage easement
(approx. 20 feet wide). This may be difficult to obtain due to its
physical location on thè property in question. This alternate is shown
in green on the enclosed aerial photo print.
Alternate No.4 -- This construction could be done in addition to
either Alternate No.2 or No. 3~ as the need demands. This construction

includes replacement of all obstructed driveway culverts~ or those
culverts which are too small~ along both sides of Hewitt Street from
Mr. Alexander's house North to the end of the street and the regrading
of the bar ditch on the East side of the street.
If you elect to make any improvements in the subject drainage problem~
we would recommend the following course of action:
Construct Alternate No. 2 now~ and if the problem still persists, continue
with Alternate No.4 later. Alternate No.4 should not be constructed
without prior construction of Alternate No.2 or No. 3~ anyway.
We trust that the information provided will assist you in your decision
regarding Mr. Alexander's problem. Should you need further information
pertaining to this matter~ please do not hesitate to call.
