MINUTES OF THE MEETING OF THE CITY COUNCIL
OF THE CITY OF NORTH RICHLAND HILLS, TEXAS,
HELD AT THE CITY HALL, 4101 MORGAN CIRCLE,
MARCH 25, 1974 - 7:30 P.M.

Mayor Marion L. Massey called the meeting
to order at 7:30 p.m., March 25, 1974.

INVOCATION
The invocation at this regular City Council
meeting was given by Mayor Massey.
APPROVAL OF THE
MINUTES OF THE
PREVIOUS MEETING
Regular Council Meeting - March 11, 1974
Councilman Faram moved, seconded by Councilman
Ellis, to approve the minutes of the
March 11, 1974, meeting as presented. The
motion carried by a vote of 5-0.

PRESENTATION
Mr. Kenneth Wilson
5005 Susan Lee
Re: Variance for Portable Building
Mr. Kenneth Wilson has just purchased a
new home in North Richland Hills and he
has a 12X20 portable building at his old
home which he would like to move to his
new home. Mr. Wilson requested a variance
to the City Ordinance which only allows
portable buildings up to 200 square feet.

Councilman Ellis moved, seconded by
Councilman McKinney, to grant Mr. Wilson
a variance and allow him to put a 12X20
portable building at 5005 Susan Lee.
The motion carried by a vote of 5-0.
SEWER EFFLUENT INTO
BEAR CREEK
Consideration of request of Bursey Estates
to discharge Sewer Effluent into Bear Creek
City Manager Riddle explained the request
of Bursey Estates for a permit from Texas
Water Quality Board to allow the building
of a residential sewer treatment plant that
by 1976 would discharge up to 1,000,000
gallons of sewer effluent per day into
Bear Creek. Mr. Riddle stated there were
no alternatives available until the outfall
was brought down from Colleyville. North
Richland Hills is unable to develop the
northern most section of our city because
there is no way to furnish sewage facilities.
Mr. Riddle requested authority to appear
at the Public Hearing on April 11, 1974
to oppose the issuing of this permit.
Councilman Ellis moved, seconded by
Councilman Cato, to authorize the City
Manager and other necessary city staff
to appear at the Public Hearing on April 11,
armed with information to oppose the issuance
of the permit to discharge sewer effluent
into Beer Creek. The motion carried by
a vote of 5-0.
AMENDING
ORDINANCE NO. 520
Consideration on Accepting letter of
Agreement from Texas Electric Service
Company in lieu of Section 4 of Ordinance
No. 520
Councilman Faram gave details of two meetings
which he had had with Texas Electric Service
Company in the past two weeks. He feels
the deletion of Section 4 which calls for
an automatic reversion to old rates, does
not weaken the Councils position. The
Charter gives the Council the right to set
utility rates and if, after hiring a rate
analyst, the Council feels justified in
lowering the rate, the Council has the legal
right to do this.

Councilman Faram moved, seconded by
Councilman Ellis, to reconsider and
pass Ordinance No. 520 without Section 4.

RATE ANALYST
After much discussion, the motion carried
by a vote of 4 to 2. Councilmen Ellis,
Faram, Smith and Cato for; Councilmen
McKinney and Newman against.
Consideration of Hiring a Rate Analyst
for Study of Texas Electric Service
Company's Rate Increase
A proposal from Mr. Jack Hopper of Austin
to take an initial look at the facts
prepared by Texas Electric was discussed in
great detail. City Attorney stated that the
formula for rate of return was prescribed
by law and the only service an "expert"
could give would be to verify the facts.
After discussion, Mayor Massey instructed
the City Manager and City Staff to "shop"
for an expert and to obtain a full blown
picture including what the total price
will be. He also instructed the City Manager
to use Mr. Newman's expertise in talking
with prospective experts.
PARK AND
RIDE BUS SERVICE
Consideration of Park and Ride Bus Service
Mayor Massey explained the proposed 90 day
trial period of a Park and Ride Bus Service
from North Richland Hills to downtown Fort
Worth. The total possible cost to the City
would be $2,200. Councilman Ellis moved,
seconded by Councilman Cato, to approve
the 90 day trial period. The motion carried
by a vote of 6-0.
PAYMENT
Consideration of Partial Payment to Elm
Fork Construction for Job 3-511, Estimate #1,
Water System Improvements, in the amount of
$65,120.53
Councilman Faram moved, seconded by Councilman
Newman, to approve payment for Estimate #1,
Job 3-511, Water System Improvements, in the
amount of $65,120.53. The motion carried
by a vote of 6-0.

Consideration of Partial Payment to
Universal Tank and Iron Works, Inc.,
on Estimate #4, Job 3-509, 500,000
Gallon Elevated Water Storage Tank
in the amount of $6,840.00
Councilman Faram moved, seconded by
Councilman Ellis, to approve payment
to Universal Tank and Iron Works for
Estimate #4, Job 3-509, 500,000 Gallon
Elevated Water Storage Tank in the amount
of $6,840.00. The motion carried by a
vote of 6-0.

PRESENTATION
Mr. Wallace Richardson, 7605 Sybil
Re: Water leak under driveway
Mr. Richardson stated that there had
been a water leak behind his curb line
and under his driveway for approximately
two years. He has replaced the line
between the house and the main line so
he feels confident the leak is in the main
line. The City Manager was instructed to
look into the problem and report back to
the Council.
CITIZEN I S
PRESENTATION
Mrs. James K. Williams, 7900 Maplewood
Re: Improper Use of 7832 Maplewood
Mrs. Williams appeared before the Council
objecting to the building of a large
garage behind the offices of O. D. S.
Construction Company at 7832 Maplewood.
Mrs. Williams stated that in April, 1973
when the zoning of this property changed
from IF-9 Single Family Dwelling to
Specific Use Neighborhood Retail, Mr. Stewart
assured the neighbors there would be ample
off street parking and no other buildings
put on the property. The neighbors did
not object to the rezoning. Mrs. Williams
objects to the on street parking and the
building of the garage.
City Manager Riddle stated he authorized
the issuing of the permit.
After discussion the Council directed the
City Manager to Red Tag the construction
of this garage.

agenda for consideration, Councilman
Newman moved, seconded by Councilman
Ellis, that the City Council meeting
of March 25, 1974, be adjourned. The
motion carried by a vote of 6-0.
