MINUTES OF THE SPECIAL CITY COUNCIL
MEETING OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, HELD AT THE CITY HALL,
4101 MORGAN CIRCLE, MAY 6, 1974 - 7:00 P.M.
Mayor Faram called the meeting to order
at 7:00 p.m.

Consideration of Payment to Shaw Construction,
Inc., on Estimate #10 and Final on Job 3-312,
Contract 12, C.I.P. Street and Drainage
in the amount of $54,601.10
Councilman Ellis moved, seconded by
Councilman Conant, to approve payment to
Shaw Construction, Inc., on Estimate #10
and Final on Job 3-312, Contract 12, C.I.P.
Street and Drainage in the amount of $54,601.10.
Councilman Cato inquired if the problems had
been solved, such as the water valve and
Mr. Counts gas leak.
City Manager Riddle advised the Council
that the water valve was being fixed.
Mr. C. R. Shaw, President of Shaw Construction
Company, advised the Council that he did
not know about the water valve problem
until payment was refused at the Council
meeting of April 22, 1974. Mr. Shaw said
he did not feel that he was responsible for
the gas line leaking. He also stated that a
year ago was when the line was broken. He
said he called Mr. Bronstad of the Utility
Department and Mr. Bronstad advised that

he would get in touch with him on
the water valve later. The City Inspector
called today and told him they had found
the water valve, Shaw started work on it
today.
Councilman Newman asked if a Inspector
was on the job at all times.
Mr. Shaw replied that most of the time
there was.
Councilman Newman advised his concern
was Mr. Counts gas leak and wanted to know
who was responsible, Shaw, the Gas Comapny
or the City.
City Manager Riddle advised the leak was
at the base of the meter and not in the
line.
Mayor Faram said he understood that the meter
was broken over a year ago and that the
Gas Company made repairs at that time.
Mr. Raymond E. Counts, 4200 Lynn Terrace,
appeared before the Council and advised
that the gas meter was broken last summer
when Shaw was working on the street. The
Gas Company fixed it at that time. He also
told the Council that he had just put in
a new line a few years before the meter
was broken and he felt that it was not his
place to fix the leak due to the fact that
it did not leak before being knocked over
by Shaw construction in the area.
Councilman Conant asked Mr. Counts if the
Gas Company reset the meter at the time
of the break.
Mr. Counts advised the Gas Company did and
had worked on it several times since. He
did not know he had a leak until the Gas
Company was making a routine check a week
or so ago. They left a tag on his door
informing him.
Mr. Shaw informed the Council that when they
break any type of utility line, such as a
gas company line they call the gas company
and they fix it and bill Shaw.

Mr. Shaw also stated that when he
received a letter from Mr. Counts
concerning the gas leak, he contacted
his Insurance Company. The Insurance
Company said they did not feel responsible.
Councilman Cato asked Mr. Shaw if they
had done any work at this location since
the original break.
Mr. Shaw replied they had not.
Councilman Ellis asked Mr. Shaw if he
felt responsible for Mr. Counts problem.
Mr. Shaw replied that it was hard for
him to say that, after a year he was.
Councilman Lamond said he felt that
Mr. Counts needed help but thought it
was unfair to withhold Shaw Construction
Company's payment.
BIDS
The motion carried by a vote of 5-0.
The City Manager was instructed to set
a meeting with the Gas Company, the City
Engineer, City Inspector and City Attorney
on Mr. Counts problem and report back
to the Council at the May 13 City Council
meeting.
Opening and Consideration of Bids for
sale of Race Street Property
Mayor Faram informed the Council that
only one bid was received. The bid
was from Lewis Tape & Label Products.
Councilman Lamond moved, seconded by
Councilman Cato, to accept the bid of
Lewis Tape & Label.
Councilman Ellis inquired as to what the
principal balance was if the City wanted
to buy the property outright.
City Manager Riddle advised it would
be $123,300. He also told the Council
that the City paid $625.00 per month
and had seventeen years left on the
lease agreement.

Mr. George Noah, Vice Present of Lewis
Tape & Label, advised the Council that
Councilman Lamond knew he was looking
for a building to move his business into
and told him about the City having one
on Race Street. He also stated that he
wanted to assume the City's Lease Agreement,
but felt the proposal was unfair. According
to the proposal, the land would belong to
the City and building to Lewis.
Mr. Noah also stated he needs to have
the property rezoned to industrial. His
chances are very good for getting the
rezoning.
Councilman Cato reminded the Council that
the City had been trying for two and one
half years to get out of the agreement and
had failed to do so.
Councilman Lamond expressed doubt of a
better offer.
RECESS
Mr. Noah advised that Mrs. McCann didn't
want the property paid off but was in
agreement with Mr. Lewis assuming the
City's Lease Agreement.
Mayor Faram called a five minute recess
at this time.
All Council members and City Staff were
present when the meeting was called back
to order.
Mayor Faram recognized Mr. Tom Mitchell
of the Press as being present in the
audience.
Mr. Noah advised the Council that he
needed a building now and could not wait.
He also stated he would like to have the
building on Race Street because it was
in the general location of his present
business. He also stated he wanted to
buy the land adjacent to the building
and wanted to build on to the present
building.
After further discussion, the motion
carried by a vote of 5-0, for Lewis
Tape & Label Products to assume the
ADJOURNMENT

City's Lease Agreement.
There being no further items on the
agenda, Mayor Faram adjourned the
meeting.
