APPROVAL OF THE tENUTES OF THE PREVIOUS HEETI NG Regul ar City Counei 1 ¡·1eeting - t),ay 14, I9/}_ Councilman Smith moved, seconded by Ccuncilman Faram, that the City Council approve the Minutes of the Regular City Council Meeting of ~1ay 14, 1973, as presented. City Þ.Homey Tim Truman advised that on page 7, paragraph 6, should read Condemnation Ordinance instead of Assessment Ordinance. After correction, the motion carried by a vote of 6-0; Councilman McKinney abstaining due to absence from this meeting. 2 PROCLAr-tATION Proclamation - Nita Thurman Mayor Massey presented Nita Thurman, former News Reporter with the Mid-Cities Daily News, a Proclamation citing her for her outstanding performance in news coverage of all functions of the City of North Richland Hills. CITIZEN I S PRESENTATION Mr. R. W. McClure 5916 Derek 485-1377 Re: Water Bi 11 Mr. R. W. McClure, 5916 Derek) appeared before the City Council advising them he wanted to be reimbursed for a water bill he did not feel he owed. Mr. McClure advised he had received notice on May 31, 1973, that his water would be cut off June 5, 1973. Mr. McClure advised that he had talked to Mr. Riddle and Mr. Bronstad and gotten no where. He also said he told Mr. Riddle not to cut off his water. City f·1anager Riddle advised that fflar. flcCll1'"e's water was cut off June 5, 1973, because he did not pay his bill. On June 5, 1973., Mr. Mclure cut the lock off the meter. On June 6, 1973, the Water Department removed thè meter. 'On June 7, 1973, Mr. McClure placed a jumbe~ on the line. ~1r. ~1cCl ure advi sed the Ci ty Counei 1 he v,Ias charged for water he did not use and wanted to be refunded $24.10 for his January water 'bill $32.55 it cost him to get his water turned on. \'!f\Tf\LJGA UTI L ITY E/~SEMENT Request of the Town of Watauga to vacate Utility Easement. -,----_..~--- This was a request of the Town of Watauga to vacate the utility easement from Linda Lane and to the North of the of the Watauga fire station. Councilman Smith moved, seconded by Councilman Ellis, that the City vacate this easement, as stipulated in the Enöineer's letter of May 30, 1973. The motion carried by a vote of 7-0. GARBAGE FRANCHISE Consideration of Texas Comnerical Service Company, Inc., R_equest"inq Garbag0ra.!}chigL Mr. Charles M. Supple, 15th floor, Fort Worth National Bank Building, Fort Worth. Texas, appeared before the City Council representing Texas Commerical Service Company, Inc., Mr. Supple submitted a request to the City CouncïJ to collect commerical garbage only in the City of North Richland Hills. City Attorney Tim Truman advised the City Council that before they take any action on this proposal, they needed to study the basic Ordinance No. 24, Garbage Ordinance. This Ordinance maybe revised. After discussion, Councilman Cato moved, seconded by Councilman Faram, to table the request of Texas Commerical Service Company, Inc., the motion carried by a vote of 7-0. ~1ayor ~1asscy instructed the City Sec¡^etary that if the Council had not had a work session on this item in the next two weeks, to put this item on the agenda for the f'irst meeting in July. Councilman Cato moved to amend the motion to include deleting the following, seconded by Councilwoman Goodnight. "And as ~'ie 11 , all amendments, rev'j s ions, and additions thereto, hc=reafter adopted by the Southern Building Code Congress. This ih effect changes Ordinance No. 207 vlhich first added Section 1.01v." The motion carried by a vote of 7-0. TEXJ\S ELECTRIC SERVICE COfllPANY AGREH:1ENT Consideration of appl~oval of agreement \'lith Texas Electric Service Company to construct water line in their easement. -------,-,,_.~.._~-- Councilman Ellis moved, second(~d by Council,· woman Goodnight, that the City Council authorize the Mayor to sign agreement with Texas Electric service Company to construct an 8-inch water 1 i ne across 1 ands m'med by Texas El ectri c Service Company. The motiO¡'1 carried by a vote of 7-0. RAIL ROAD CROSSING KEL.l.ER-Sf>1ITHFIELD RD. Consideration of City participation in constructing Rail Road Crossing on Keller- Smithfield Road. City Engineer Dick Perkins advised the Council that he had received a letter from the St. Louis-Southwestern Railway Lines and the cost to the City would be $23,000.00, sometime 1 ater he talked to ~1ì". The motion carried by a vote of 7-0. PZ 73-24, request of Glen Buckner, Cameo Enterprises, Inc., to rezone 26.94 acres out of the S. Mr. Buckner stated that homes on the Eastern and Southern boundry of thi s pr'operty wou' d be rrri nimum of 1,800 square feet of living space and the balance of these homes would be 50% 1,300 square feet of living space and 50% 1,500 square feet of living space. Mr. Buckner advised he only increased the size of the homes and decreased the size of the lots. Mayor Massey called for all interested persons present to come fon/ard to speak agai nst thi s rezoning case. Mr. Fred Morrow, Rt. 1, Box 525, Smithfield, appeared before the City Council to speak against this rezoning case. Mr. Morrow stated that most of the homes in this area were larger lots and larger houses and he thought it should be kept that way. Mr. Buckner stated that Mr. Morrow did not know of the changes made in the plan. This zoning case was temporary delayed until after item 22. PZ 73-25, request of to rezone 2.99 acres Survey from IF-9 One Two Family Dwelling. Richland Enterprises, Inc., out of the W. W. Wallace Family Dwelling to 2F-9 >._~------- Mayor Massey declared the public hearing on PZ 73-25 open and called for all interested persons present to come forward to speak for this rezoning case. Mr. Cal Luper, 5009 Eldorado, Richland Enterprises, Inc., appeared before the City Council requesting approval of PZ 73-25, as presented. Councilman Faram moved, seconded by Councilman Ellis, that the City Council approve PZ 73-25, Ordinance No. 479, "request of Richa1nd Enter- prises to rezone 2.99 acres out of the W. W. Mayor Massey declared the publie hearing on PZ 73-28 open and called for all interested persons present to come forward to speak for this rezoning case. Mr. Bart Bradford, Carter & Burgess, 11 Macon, appeared before the City Council speaking for this rezoninq case. Mr. Bradford advised the Council the land was zoned commerical to constrûct warehouses and they wanted to build an apartment for the manager so he could take care of the warehouses. Mayor Massey called for all interested persons present to come forward to speak ag~nst this rezoning case. There being none, Mayor Massey declared the public hearing closed. Councilman Faram moved, seconded by Councilman Smith, that the City Council approve PZ 73-28, Ordinance No, 480, request of Pilgrim Realty Company to rezone 4.32 acres out of the \,1. H. 1'Ja 11 ace Sm'vey from Commeri ca 1 to Local Retail, with the stipulation that the Plans and Specifications be attached to the Ordinance as permanent record. The motion carried by a vote of 7-0. PZ 73-30, Request of Ed Ellis Harding to rezone 36.89 acres out of the T. K. Mr. Don Reams, 1217 Sinclair Building, representing Mr. Ed Ellis Harding, appeared before the City Council requesting approval bf PZ 73-30. Mr. Reams advised the City Council that the legal description was wrong. It should be rJct 8, Block 11, Clearview Addition and not 36.89 acres of land. ¡I¡r. Reams informed the City Counci 1 thùt ¡'ir. Harding wanted to put a small retail store and used car lot on this property. Mayor Massey called for all interested persons present wishing to speak against this rezoning case to come fOfviard. Mr. Clayton, 5108 Colorado, appeared before the City Council speaking against this rezoning case. Mr. Clayton informed the Council that drainage problems already exist in this area and if Mr. Harding builds on this lot it will effect the drainage. t'1r. Fred Ross, Llr., 5104 Color-dCio Blve!., appeared before the City Council speeking against this rezoning case. Mr. Ross informed the Council that noise from a service station hear this location disturb~ the neighborhood and if Mr. Harding builds a used car lot it will increase the noise. Mr. Ross advised the Council that he also had drainage problems. After discussion, Councilman Faram moved. seconded by Councilman Cato, to deny PZ 73-30, request of Mr. Ed Ellis Harding to rezone Tract B, Block 11, Clearview Addition, from Local Retail to Commerical. The motion carried by a vote of 7-0. PZ 73-31, Request of Lawerence M. Briggs to rezone 2.0 acres out of the T. K. MJrtin Survey from Agriculture to Residentia1 Mayor Massey declared the public hearing on PZ 73-31 open and called for all interested persons present to come forward to speak for this rezoning case. Mr. Newborn advised the Council that Mr. Lawerence had a little less than two acres of land and could not be issused a building permit. He also inform2d the Council that this propery \'ié\S land locked, tk. Lawerence could not buy any more land because it is not ava'ilable. ~1r. ~¡ð'lborn advised the Counciì that ì1r. f3rig~1 had a buyeì' for the land if he could get a permit to build a house. After discussion, Councilwoman Goodnight moved, seconded by Councilman Smith, to approve PZ 73-31, Ordinance No. 481, request of Mr. Lawerenee M. Briggs to rezone 1.1477 acres of land out of the T. K. Martin Survey from Agriculture to IF-12 One Family Dwelling. The motion carried by a vote of 5-0; Councilmen McKinney, Cato, Ellis and Smith and Councilwoman Goodnight vot'ing fot'; Councilmen Faram and Newmar agai~st. Mayor Massey called for all interested persons present wishing to speak against this rezoning case to come forward. There being none, Mayor Massey declared the public hearing closed. Councilman Cato moved, seconded by CouncilmGn Ellis, that the City Council approve PZ 73-32~ Ordinance No. 482, request of Richland Terrace Venture to rezone Lots 18 thru 33, 4281, Lots 34 thru 45 & 54 thru 66, 4281, Lots 67 thru 100, 4782, Richland Terrace Addition, from Specific Use to Specific Use, with the stipulation that the plans and specificatiDns attached to the Ordinance as permanent record. The motion carried by a vote of 7-0. PZ 73-29, request of Jerry D, Griffith to rezone 0.5742 acres of land out of the T. K. Martin Survey from Argiculture to IF·-9 One Fan1ilLP\<le 11 i n9. _,____ Mayor Massey declared the public hearing opsn on PZ 73-29 and called for all interested persons present to corne fon-lard to speak for this rezoning case. Mr. Doug Long, 1615 Precinct Road, representing ~1r. Jerry D. Griffith. appeared before the City Council requesting approval of PZ 73-29. Mr. Long advised the Council that Mr. Griffith had sold all but .05742 acres of land and he was not aware that he didnot have the required two acres left. Mr. Griffith will tie on to the utilities in Glenann Addition and the street next to this property will be paved. Mayor Massey called for interested persons present to come forward to speak against this rezoning case. There being none, Mayor Massey delcared the public hearing on PZ 73-29 closed. Councilman Ellis moved, seconded by Council- woman Goodnight, that the City Council approve PZ 73-29, Ordinance No. 484, request of Jerry D. Griffith to rezone .05742 acres out of the T. K. Mr. Newborn advised the Council that Mr. Briggs was requesting a variance in the Subdivision Ordinance requiring him to pave the street and put in curbs and gutter. After discussion, Councilwoman Goodnight moved, seconded by Councilman Smith, that the City Council approve PS 73-13, request of Lawerence for variance in Subdivision Ordinance. The motion carried by a vote of 4-3; Council men Smith, tvicKi nney and Ellis and Councilwoman Goodnight voting for; Councilmen Faram, Cato and Newman against. As the abandonment of this easement will sever our connection and access to this site (100' x 100'), we would recoilunend that ti,t.: City of North Richland Hills agree to the abandonment of the easement i.lr.d the site providing that the City of Watauga, ;n t!lrn, will flrovid(~ North R1chland Hills with an equivalent size site for its proposed 2.0 million gallon elevated water tank at the location as shown on the enclosed water system map excerpt. We \</111 need approximately 1 acre for this site, and \'lith this arranqe- ment the City of Watauga would secure the site either now or in the future from the Developer, and, if not dedicated in the platting, could be bought with Watauga paying for 100' x 100' (or 10,000 square feet) of the site with North Rich1and Hills paying for the remainder.
