MINUTES OF THE REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF NORTH RICHLAND HILLS,
TEXAS, HELD AT THE CITY HALL, 4101 MORGAN
CIRCLE, ON MONDAY, JULY 23, 1973, AT 7:30 P.M.
CALL TO
ORDER
The regular meeting of the City Council was
called to order at 7:30 p.m. by Mayor Marion
L. Massey.

INVOCATION
The invocation at this regular City Council
meeting was given by Councilman Lloyd McKinney.
COUNCILMAN CATO WAS PRESENT AT THIS TIME.

City Attorney Tim Truman advised that on page
2 under "Item Added to The Agenda" Paragraph
2 should read as follows:
"Councilman Faram moved, seconded by Councilman
Cato, that the City Council approve Resolution
73-12, authorizing the City Attorney to file
suit for a declaratory judment to interpret the
rights of the rights of the res ective party as
to the existence of the franchlse or lnance with
the telephone company. The motion carried by
a vote of 4-0."
Counilman Smith moved, seconded by Councilman
Faram, that the City Council approve the Minutes
of the Regular City Council Meetinq of July 9, 1973,
with the above correction.

The motion carried by a vote of 4-0;
Councilmen McKinney, Ellis and Newman
abstaining due to absence from the July
9, 1973 meeting.
DRUG ABUSE
CENTER
Mayor Massey advised that Councilman Cato and
Councilwoman Goodnight was the liason committee
concerning the Drug Abuse Center.
Councilman Cato reported that he and Councilwoman
Goodnight attended several meetings with
representatives with other cities and got quite
involved resumes on this proposed Drug Abuse
Center which is more a phyciatric clinic
staffed with professionals who are not necessarily
phyciaratrists. He also stated that the primary
function as he understood it is to take two
majors who have drug problems, not the medical
aspects but the physicolgial aspects, take thp.m
into the organization either voluntarily or being
sent there by thetr local police department as
an alternative to having charges filed against
them and council them over a period of time.
Those that are referred by their police department
for time they must serve out or get charges
filed aganist them. Those that come in voluntarily
are free to come and go as they please. The
situation for our area is that they wish to set
up a center somewhere in the Mid-Cities or
Northest Tarrant County area with one permanent
full time secretary and two circulating operators.
He also advised that Dr. Garrett in Fort Worth
has had the center there for approximately
three years and Arlington recently opened one
this past year in conjunction with the Fort Worth
operation. Councilman Cato advised that the
money involved if we were to go into this
operation for one year would intail $641.75
per month or $7,701.00 for the year, which would
be strictly fot the contract with Fort Worth to
furnish the secretary and the two counselors~
If the representives in this area are successful
in obtaining free lodging for this operation,
then there will be just miscellaneous expenses
for utilities over and above $7,701. Otherwise,
we will be expected to go a maximum outlay of
$10,000.00 for the year. Councilman Cato stated
that as a committee he and Councilwoman Goodnight
highly recommend that the City undertake the
contract with the City of Fort Worth for a one
year period for our portion of the Drug Abuse
Center. Councilman Cato also advised that Fort
Worth feels they have done well but no records
are kept.

Mrs. Poindexter associated with the Drug
Abuse Center, advised that from 400 to 700
per month go to Fort Worth and Arlington but
there is no clinical record.
After discussion, Councilman Faram moved, seconded
by Councilman Ellis, that the City Council table
consideration of the Drug Abuse Center until the
City Council meeting of August 13, 1973.
The motion carried by a vote of 7-0.
PLANNING &
ZONING
PZ 73-33, request of L. D. Kemp and Mike Brackney
to rezone 6.581 acres of land out of the S.
Richardson Survey from Agriculture to Commerical.
PZ 73-34, request of L. D. Kemp and Mike Brackney
to rezone 2.0 acres of land out of the S.
Richardson Survey from Agriculture to Local Retail.
Mr. Calvin Luper of 5009 Eldorado, repesenting
L. D. Kemp and Mike Brackney, appeared before
the City Council requesting that the public hearing
on PZ 73-33 and PZ 73-34 be considered at the
same time.
All council members agreeing to Mr. Luper's
request, Mayor r~assey declared the public hearing
open to consider PZ 73-33 and PZ 73-34 at the
same time and called for all interested persons
present to come forward to speak on these two
rezoning requests.
Mr. Calvin Luper appeared before the City Council
requesting approval of PZ 73-33 and PZ 73-34
and advised that they would conform with the
zoning ordinance regulations. Also, he stated
that the people opposing these zoning requests
at the Planning and Zoning Commission has signed
a letter stating that they now do not oppose
either rezoning request.
It was pointed out that the request of zoning
on PZ 73-33 should read "from Local Retail to
Commericalll and was agreed that it was not
necessary to go back through the Planning and
Zoning Commission but to change the request on
Ordinance No. 486, PZ 73-33, to read Local Retail
to Commerical instead of Agriculture to Commerical
as presented to the City Council. This change
was approved by the City Attorney.
There being no further persons wishing to speak
for these rezoning cases, Mayor Massey called
for all interested persons present to come
forward to speak aqainst PZ 73-33 and PZ 73-34.

There being none, Mayor Massey declared the
public hearing on PZ 73-33 and PZ 73-34 closed.
Councilman Ellis moved, seconded by Councilman
Cato, that the City Council approve PZ 73-33,
Ordinance No. 486, rezoning 6.581 acres of land
out of the S. Richardson Survey from Local Retail
to Commerical. The motion carried by a vote of
7-0.
Councilman Cato moved, seconded by Councilman
Smith, that the City Council approve PZ 73-34,
Ordinance No. 487, rezoning this property from
either Local Retail or Agriculture, to be checked
out by the City Attorney, to Local Retail before
finalization of the ordinance. The motion carried
by a vote of 7-0.

PRESENTATION
Mr. J. W. Childress

Re: Sewer back up
Mr. J. W. Childress advised the Council that his
sewer backed up and did $250.00 damage to his
floors. He also advised that the city crew came
out twice on one day and cleaned the sewer out
and then it backed up again the following day
at which time the crew cleaned the sewer up from
his and found the problem. Mr. Childress asked
if the city was responsible for his damage.
City Attorney advised that this was not a case
to be presented to our insurance company.
There being no further items on the agenda for
consideration, Councilman Faram moved, seconded
by Councilman Ellis, that the City Council Meeting
of July 23, 1973, be adjourned. The motion
carried by a vote of 7-0.
