MINUTES OF THE SPECIAL JOINT MEETING OF
THE CITY COUNCIL AND PLANNING AND ZONING
COMMISSION OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, HELD AT THE CITY HALL, 4101
MORGAN CIRCLE, DECEMBER 20, 1973 - 7:30 P.M.
The special joint meeting of the City Council
and the Planning and Zoning Commission was
called to order by Mayor Marion L. Massey at
7:30 p.m.

Mayor Massey explained the Public Hearing of
the City Council and the Planning and Zoning
Commission would be held simultaneously.
PLANNING &
ZONING
PZ 73-55 Request of F. E. Harrington for
Specific Use - Sale of Beer for Off-Premise
Consumption for 1.403 acres at 7700 Davis Blvd.
Mayor Massey declared the Public Hearing on
PZ 73-55 open and requested all persons wishing
to speak for PZ 73-55 to come forward.

Mr. Lowry Davidson, an attorney representing
F. E. Harrington, requested the approval of
the Specific Use Zoning for Mr. Harrington's
grocery store on Davis Blvd. He noted that in
the previous hearings the possibility of a
traffic hazard developing had been mentioned.
Mr. Davidson quoted Mr. Henry Powers, North
Richland Hills Traffic Safety Coordinator,
as stating there had never been an accident
at the location of the store and very few at
the nearest intersections. Mr. Davidson asked
the members of the audience to stand that were
here in support of the rezoning request.
Mayor Massey called for all persons wishing
to speak against PZ 73-55 to please come
forward.
There being no opposition, the Public Hearing
was closed.

ZONING
PZ 73-56 Request of Hope, Garcia & Lancarte
to rezone Tracts 14B & 14C of Abstract 1606
from Agriculture to Local Retail with 156'
Wide Buffer Strip on West End of property to
be zoned 2 F-9
Mayor Massey declared the Public Hearing on
PZ 73-56 open and called for all persons
present wishing to speak for PZ 73-56 to
come forward.
Mr. Henry Kerry, an attorney representing the
property owners, requested the approval of the
rezoning of Tracts 14B and 14C of Abstract 1606.
Mr. Kerry complimented the City Staff on the
cooperation shown him during these lengthy
proceedings. He also thanked the City Council
and the Planning and Zoning Commission for the
joint meeting.
Mr. Kerry stated that he felt the proposed
zoning was satisfactory to all concerned.
Mayor Massey requested all persons wishing to
speak against PZ 73-56 to please come forward.
There being no opposition, Mayor Massey declared
the Public Hearing on PZ 73-56 closed.

RECESS
Mayor Massey declared the City Council
meeting in recess until such time as
the Planning and Zoning Commission made
their decision on these two cases.
The City Council meeting was reconvened
at 8:15 p.m.
Mayor Massey asked the City Secretary to
report the recommendations of the Planning
and Zoning Commission.
PZ 73-55
Both PZ 73-55 and PZ 73-56 were approved as
presented by the Planning and Zoning Commission.
Councilman Newman moved, seconded by Councilman
Smith, to approve the request of F. E. Harrington
for Specific Use - Sale of Beer for Off-Premise
Consumption, at 7700 Davis Blvd. The motion
carried by a vote of 5-0.
PZ 73-56
Councilman Newman moved, seconded by Councilman
Cato, to approve the request of Hope, Lancarte
and Garcia, to rezone Tracts 14B and 14C of
Abstract 1606 to Local Retail, with a 1561
Buffer Strip on the West End of Property to
be zoned 2F-9. The motion carried by a vote
of 5-0.
ADJOURNMENT
There being no further items on the agenda for
consideration, Councilman Newman moved, seconded
by Councilman Faram, that the City Council meeting
of December 20, 1973, be adjourned. The motion
carried by a vote of 5-0.
