Mayor Massey advised that the City Council meetings would begin at 6:15 p.m. beginning September 25, 1972. ANNOUNCEMENT APPROVAL OF THE MINUTES OF THE PREVIOUS MEETING Regular City Council Meeting - August 14, 1972 Councilman Faram moved, seconded by Councilman Cato, that the Minutes of the City Council Meeting of August 14, 1972, be approved as presented. The motion carried by a vote of 6-0. ASPHALT ON DALEY STREET Consideration of increasing asphalt on Daley, between Highway 121 and Glenview Drive, to 5~ inch hot mix. City Manager Riddle advised the City Council that the asphalt on Daley Street needed to be increased to 5~ inches because of heavy traffic traveling on this street. City Manager Riddle also advised the cost would be approximately $3,500. 2 Councilman Faram moved, seconded by Councilman Smith, that the City Council approve increasing asphalt on Daley Street to 5~ inches. The motion carried by a vote of 6-0. CITIZEN'S PRESENTATION Mr. Melvin Morrow 7833 Arnold Terrace Re: Request for Damages Mr. Melvin Morrow appeared before the City Council requesting damages caused from sewer backup. Mayor Massey explained to Mr. Morrow that the City's insurance firm had refused to pay the claim and the Council did not feel the City was at fault. (- After discussion, Councilman McKinney moved, seconded by Councilman*Ellis, that the City pay Mr. Morrow $500.00 for damages. Mr. Morrow informed the City Council that he felt $500.00 was not a fair amount. Councilman Ellis asked the City Attorney to give a legal opinion. The City Attorney advised that his opinion was that the City was not at fault. After discussion, the Mayor called for a vote on the motion. The motion failed by a vote of 4-3; Councilmen Cato, Faram and McKinney voting for; Councilmen Ellis, Smith and Newman voting against; Mayor Massey voting against to break the tie. CITIZEN1S PRESENTATION Mr. Bob Jones Precinct Line Road, Hurst, Texas Re: Electrical Code Mr. Bob Jones, President of Arch Electric Company, appeared before the City Council requesting permission to use plastic conduit instead of metal in buildings within the City of North Richland Hills. After discussion, Councilman Newman moved that the City Council table the request of Mr. Jones until further study. The motion died for lack of a second. Mr. Jones was advised by the City Council that Ordinance No. 310, Electrical Code, prohibits the use of plastic conduit and that this ordinance would be upheld. I I \1 ¡- *Councilman Faram seconded motion as corrected in the Minutes of the City Council Meeting of September 11, 1972. 3 BLACKMAN DRIVE Consideration of Blackman Drive construction. City Manager Riddle advised the City Council that assessments had been collected on Blackman Drive and that the city's records indicate that at some time after the assessment ordinance was passed this street was deleted from the CIP program. After discussion, the City Council instructed the City Manager to contact the property owners on Blackman Drive and see which they would prefer; (1) refund of the money, (2) a small additional assessment to rebuild the street, or (3) possible abandonment by the city of this street. SUBMISSION OF 1972-73 BUDGET Submission of 1972-73 Budget by City Manager and setting of pUblic hearing thereon. City Manager Riddle submitted the 1972-73 Budget to the City Council and told the Council the budget proposal he is preparing retains the tax rate and includes two main areas of increase which is personnel and equipment. Councilman Ellis moved, seconded by Councilman McKinney, that the Public Hearing on the 1972-73 Budget be set for September 11, 1972, at 7:30 p.m. The motion carried by a vote of 6-0. Consideration of bids on Richland High School Sewer Line. BIDS Councilman Faram moved, seconded by Councilman Ellis, that the City Council accept the low bid of Elm Fork Construction Company, in the amount of $8,913.50, for the construction of Richland High School sewer line. The motion carried by a vote of 6-0. CONTRACTOR'S ESTIMATE Leonard Hazel, Inc. Estimate #1 & Final, Job #3-206 North Hills 3611 Storm Drain $11 ,817.20 Councilman Ellis moved, seconded by Councilman Smith, that the City Council approve payment to Leonard Hazel, Inc., in the amount of $11,817.20, Estimate #1 and Final, Job #3-206, as recommended by Consulting Engineers. The motion carried by a vote of 6-0. OVERSIZING - SUSAN LEE LANE ORDINANCE NO. 430 PLANNING & ZONING 4 Consideration of payment to Holiday North Joint Venture, in the amount of $1,400.00, for the oversizin9 of Susan Lee Lane. Councilman Ellis moved, seconded by Councilman Newman, that the City Council approve payment to Holiday North Joint Venture, in the amount of $1,400.00 for the oversizing of Susan Lee Lane. The motion carried by a vote of 6-0. Ordinance No. 430, amending Ordinance No. 169, Zoning Ordinance, adopting revised Official Zoning Map. After discussion, Councilman Smith moved, seconded by Councilman Faram, that the City Council accept Ordinance No. 430, adopting revised Official Zoning Map as presented. The motion carried by a vote of 6-0. PZ 72-36, request of Cameo, Inc. to rezone 32.123 acres out of the S. Richardson Survey from Agriculture to IF-12 One Family Dwelling. SECOND READING Mayor Massey declared the meeting in public hearing to consider PZ 72-36 and called for all interested persons present to come forward to speak for this rezoning. Mr. Don Davis, representing Cameo, Inc., appeared before the City Council requesting approval of PZ 72-36 to be rezoned IF-12 One Family Dwelling and stating that Cameo, Inc. agrees to 30% of the houses being a minimum of 1,600 square feet. Mr. Charles Palachek, 8909 Kirk Lane, appeared before the City Council stating that 1,600 square feet in 30% of the houses would be agreeable to him. There being no further persons present wishing to speak for PZ 72-36, Mayor Massey called for interested persons present to come forward to speak against the rezoning. There being no persons present wishing to speak against PZ 72-36, Mayor Massey declared the public hearing on PZ 72-36 closed. Councilman Cato moved, seconded by Councilman Newman, that the City Council approve Ordinance No. 429, PZ 72-36, to rezone 32.123 acres out of the S. PS 72-20, request of P & S Construction Company to replat (Final Re-Plat) Block 18, Lots 9-26; Block 19, Lots 1-23; Block 20, Lots 3-23; Block 21, Lots 1-17; Block 22, Lots 1-19; Richland Hills West Addition, Section 3. Mr. John Parish, representing P & S Construction Company, appeared before the City Council requesting approval of Final Re-Plat of Richland Hills West Addition. Councilman Ellis moved, seconded by Councilman McKinney, that the City Council approve PS 72-20, Final Re-Plat of Hlock 18, Lots 9-26; Block 19, Lots 1-23; Block 20, Lots 3-23; Block 21, Lots 1-17; Block 22, Lots 1-19; Richland Hills West Addition, Section 3, subject to Engineer's letter of August 15, 1972. The motion carried by a vote of 6-0. (Copy of Engineer's letter dated August 15, 1972, attached to these minutes as permanent record.) PS 72-21, MEADOWVIEW ESTATES - PRELIMINARY PLAT Mr. Doug Long appeared before the City Council requesting approval of PS 72-21, Meadowview Estates Preliminary Plat, in concurrence with Consulting Engineer's letter of August 18, 1972. Councilman Smith moved, seconded by Councilman McKinney, that the City Council approve PS 72-21, Meadowview Estates, Preliminary Plat, subject to stipulations outlined in Consulting Engineer's letter of August 18, 1972. August 18, 1972 Planning and Zoning Commission City of North Richland Hills 4101 Morgan Circle Fort Worth, Texas 76118 Subject: 3-850, CITY OF NORTH RICHLAND HILLS, MEADOWVIEW ESTATES ADDITION, PRELIMINARY PLANS Dear Sirs: We have received and reviewed the preliminary planning for Meadowview Estates Addition to the City of North Richland Hills and furnish you our comments as follows: Fì 1. At the South end of Meadowview Drive one-half of the right- of-way is indicated to be dedicated from an adjoining property owner. We would suggest it be made clear that this plat would not be approved unless that dedication is arranged' for by this Developer. 2. At the North end of Meadowview Drive where it curves from a Northerly direction to an Easterly direction, the tangent of this curve is actually a reverse curve. It is our opinion that this reverse curve could be a hazard, unless the radius is flattened considerably, and we would recommend either that this be made tangent or a very flat reverse curve. f'f . ~ I '.... 3. These plans call for an earthen channel across the Northwest corner of the addition. In order to construct this channel, permi ss i on wi 11 be neces.sary to enter the property on the West and North of this tract in order to re-route the original channel as shown and the Developer should provide that written permission. Also, the channel shown is an earthen channel and the North Richland Hills' Policies do not provide for earthen channels except in the cases of Walker, Calloway and Mackey Creeks. According to those policies, the Developer shall either improve the channel by concrete lining or place with the City an amount of $18.00 per linear foot of that channel so that the City might make the improvement. ... 600 ""IRST STATE BANK BUILDIi'!G' BEDFORD, TEXAS 76021. The sanitary sewer shown in Meadowbrook Drive should extend to the edge of this development and should be carried at a depth ~\Ih i ch wi 11 all 0\'1 extens i on in Ki rk Road. I , 5. The sanitary sewer line in the easement from Meadowview Drive to the lift station, we would suggest should be an 8-inch line, and we would also suggest that the lift station have a force main of 6-inch, rather than 4-inch. 6. It should be understood at this point that the lift station proposed could very conceivably be in existence for many years, and we, therefore, should mention that it should be constructed of a permanent type similar to the one constructed by the City of North Richland Hills on Daley Drive. 7. The water main shown as proposed in Rumfield Road is shown as a 6-inch. The City Master Plan calls for a 16-inch in this road and, because of the amount of development taking place in this area, we would recommend that the 16-inch be installed with these developments. It is our opinion that the plat under consideration would require an 8-inch main for fire protection purposes, and therefore, that there will be City oversizing between an 8-inch and a 16-inch. '"-, 8. On the water and sewer layouts there are substantial amounts of water and sewer piping shown to be installed IIby others II. We feel that it should be understood by all parties that the City does not have responsibility for the installation of these mains by others at any certain time, and that this development will not allowed to proceed ahead of the installa- tion of these lines; and that therefore, this development may be responsible for those approach mains which are indicated by others. '-I 9. This plan indicates 5 feet of additional dedication for street on Rumfield Road. If the existing right-of-way is 50 feet, this will provide 60 feet which is consistent with the Master Thoroughfare Plan; however, we would request verification of the existing right-of-way for this purpose. 10. According to the City's Policies this developer would be responsible for the improvement of Rumfield Road and Kirk Road ""' Page 3 - 8/18/72 - Planning and Zoning Commission along the area where it is fronted on by this development. Since these are such short lengths, we would recommend that this developer place funds for that improvement in escrow with the City for use at a future date. August 15, 1972 Planning & Zoning Commission City of North Richland Hills 4101 Morgan Circle Fort Worth, Texas 76118 Subject: 3-819, CITY OF NORTH RICHlAND HILLS, RICHLANDHILLS WEST ADDITION Gentlemen: We have received the plat of subject addition for review and offer the following comments. 1. The drainage area into Onyx Drive North is of significant magnitude, and due to the fact that there is no way in \'hich to carry this water underground and subsequently into ß-ìg Fossil Creek, \'e'would recommend that 811 curbs be con- structed on this one street only. 2. The developer should be required to put up his pro-rata share of the cost of the existing 611 \'later and sewer lines located in Onyx Drive South, and which abut the property which is under consideration for replatting. 3. Due to the location of this property in relation to the flood plain of Big Fossil Creek, we would recommend that a rear building line b~ established on the lots in ßlock19. 4. Your City Developer policies provide that the developer should put up his pro-rata share of the 2411 sewer 1 ine \'1hi ch crosses the property near the rear of Block 19. A 611 line would be the equivalent line size necessary to serve the area to be replatted. Should you have any further questions regarding this review, please do not hesitate to call.
