CALL TO ORDER The regul ar meeting of the City Council of the City of North Richland Hills was called to order by Mayor Marion L. APPROVAL OF THE MINUTES OF THE PREVIOUS MEETINGS CITY COUNCIL MEETING NOVEMBER 13, 1972 Regular City Council Meeting - October 23, 1972. Councilman Smith moved, seconded by Councilman Newman, that the City Couneil approve the Minutes of the Regular City Council Meeting of October 9, 1972, as presented. The motion carried by a vote of 7-0. Special City Council Meeting - October 16, 1972. Councilman Newman moved, seconded by Councilman Smith, that the City Council approve the Minutes of the Special City Council Meeting of October 16, 1972, as presented. The motion carried by a vote of 5-0; Councilmen McKinney ahd Faram abstaining due to absence from this meeting. Consideration of cancellation of regularly scheduled City Council Meeting of November 13, 1972. Councilman Ellis moved, seconded by Councilman Newman, that the City Council cancel the regularly scheduled City Council meeting of November 13, 1972, as the Texas Munici'pal 2 League Conference will be held November 12 through 14. The motion carried by a vote of 7-0. APPOINTMENT Member to Planning & Zoning Commission Councilman Smith moved, seconded by Councilwoman Goodnight, that the City Council appoint Mr. Charles Palachek to the Planning and Zoning Commission, his term to expire May 1, 1973. The motion carried by a vote of 7-0. Mayor Massey instructed the City Secretary to notify Mr. Charles Palachek by letter of his appointment and extend the Council's appreciation for his service on the Zoning Board of Adjustment. ITEM ADDED TO AGENDA ORDINANCE NO. 438 APPOINTMENT - Zoning Board of Adjustment. Councilman Smith moved, seconded by Councilman Newman, that the City Council add the appointment of a new menber to the Zoning Board of Adjustment to the agenda. The motion carried by a vote of 7-0. Member to Zoning Board of Adjustment Counci 1 man Ell is moved, seconded by Counci hlOman Goodnigh, that the City Council appoint Mr. Denver Mills to the Zoning Board of Adjustment, his term to expire May 1, 1974. The motion carried by a vote of 7-0. Mayor Massey instructed the City Secretary to notify Mr. Denver Mills by letter of his appointment and extend the Council's appreciation of his willingness to serve on this board. Acceptance of bids on City Park. Councilman Cato moved, seconded by Councilman McKinney, that the City Council table bids on City Park and schedule for consideration at a Special City Council Meeting on Wednesday, November 1, 1972, at 6:30 p.m. The motion carried by a vote 7-0. Ordinance amending Ordinance No. 310, Electrical Code, adding thereto a Section 65 permitting the use of PVC-schedule 40 for underground wireways. The following Ordinance No. 438 was presented to the City Council for consideration. APPOINTMENT BIDS "ORDIflANCE NO. 438 AN ORDINANCE AMENDING ORDINANCE NO. 310, ELECTRICAL CODE, ADDING THERETO A SECTION 65 PERMITTING THE USE OF PVC-SCHEDULE 40 FOR UNDERGROUND WIREWAYS WHEREAS, after study, the Electrical Board of the City of North Richland Hills, Texas, has recommended to the City Council that Ordinance No. 310, The Electrical Code, be amended to permit the use of PVC-Schedule 40 for underground wireways, and whereas it is the consensus of the City Council of the City of North Richland Hills, Texas that such amend~ ment should be made, and that it is in the best interest of the City and its citizenry, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: That Ordinance No. 310 of the City of North Richland Hills, Texas, heretofore passed and adopted on the 11th day of May, 1970, is hereby amended by adding thereto, the following Section 65: "SECTION 65. PVC-SCHEDULE 40 PERMITTED any other provision of this Ordinance to the contrary notwithstanding, the use of PVC-Sshedule 40 for underground wireways is hereby expressly permitted." THIS ORDINANCE SHALL APPLY ONLY TO PROJECTS COMMENCED AFTER THE EFFECTIVE DATE HEREOF, WHICH SHALL BE THE DATE OF FINAL PASSAGE. , PASSED and ADOPTED by the City Council of North Richland Hills, Texas, this day of , 1972. Massey, Mayor ATTEST: Donna Parish, City Secretary Councilman Cato moved, seconded by Councilman Ellis, that the City Council approve Ordinance No. 438, amending Ordinance No. 310, Electrical Code, adding thereto a Section 65 permitting the use of PVC-Schedule 40 for underground wire- ways. The motion carried by a vote of 7-0. 4 DRAINAGE WORK Approval to proceed with drainage work in area of Susan lee and Janetta. Councilwoman Goodnight moved~ seconded by Councilman McKinney, that the City Council authorize Consulting Engineers to advertise for bids and bids be sumitted with the contengency that contract doc~ents woul~ be revised so that if the money lS not avallable for entire project it could be cut back to the amount now remaining in the Capital Improvements Fund. The motion carried by a vote of 7-0. HIGHWAY 121 GLENVIEW DRIVE CHANNELIZATION AND SIGNALIZATION Consideration of channelization and signalizaton of Highway 121 and Glenview Drive; City Engineer Dick Perkins presented a plan for channelization and signalization of Highway 121 and Glenview Drive which would restrict left turns onto Blaney. Mr. Allan Hamm, 7201 Riviera, operator of Richland Drug, appeared before the City Council advising that the proposed plan submitted by the Engineer would seriously hurt the businesses and stating he believes the proposal would make the accident rate go up as coming throu~h the Shopping Center and out on Highway 121 would be hazardous. Mr. Hamm also requested further study and possibly obtaining right-of-way from Mobil and making a stright shot into Blaney could be worked out. Mr. Jim Childress~ 6732 Corona, appeared before the City Council; opposing the proposed plan as outlined by the City Engineer. Mr. Bill Martin, 4109 Blaney, appeared before the City Council advising that he belived the proposed plan would not be solving the problem, but just creating a new one and also stated that Blaney was not properly marked. Councilman Newman moved, seconded by Councilman McKinney, that the City Council reject project of channelizing and signalizing Highway 121 and Glenview Drive as proposed by the City Engineer for further study. The motion carried by a vote of 6-1; Councilmen McKinney, Ellis, Faram, Newman and Cato and Councilwoman Goodnight voting for; Councilman Smith voting against. 5 CHANGE IN WA TER POll C I ES Consideration of change in water policies in the Rules, Regulations, Policies and Procedures for North Richland Hills Water and Sewer System. The following change in water policies was presented to the City Council: RECOMMEND CHANGE IN POLICY 4.3 Asbestos Cement Pipe shall conform to AWWA C400-74T as herein excepted or further clarified. An affidavit of compliance shall be furnished in accordance with Section 5 of the AWWA standard. Pipe class shall be for a working pressure not less than 200p.s.i for 6" pipe and be in standard 10ft. or 13ft. lengths. 8" and larger pipe shall be for working pressure not less than 150p.s.i. and be in standard 13ft. lengths with 10% permissible shorter random lengths allowed as per,AWWA standards. Asbestos-cement pipe couplings shall include an asbestos-cement sleeve, of the same composition as the pipe, and two rubber rings. The couplings shall be machined so as to insure a tight joint with the pipe. The rubber rings used to seal the joints shall conform to the requirements of the latest revision of ASTM 0 1869. Councilwoman Goodnight moved, seconded by Councilman McKinney, that the City Council adept the recommended change in water policies as submitted. The motion carried by a vote of 7-0. CONTRACTOR'S ESTIMATE H. M. Huffman Construction Company Partial Payment #1 Glenann Addition, First Filing $13,944.15 Councilman Ellis moved, seconded by Councilwoman Goodnight, that the City Council approve for payment to H. M. Huffman Construction Company, partial payment #1, in the amount of $13,944.15, as recommended by the Consulting Engineers. The motion carried by a vote of 7-0. CONTRACTOR'S ESTIMATE Elm Fork Construction Company Estimate #2 and Final, Job 3-415 Richland High School Sewer Line $1,815.81 ~-___._,I 6 Councilman Ellis moved, seconded by Councilman McKinney, that the City Council approve for payment to Elm Fork Construction Company, Estimate #2 and Final, Job 3-415, in the amount of $1,815.81, as recommended by the Consulting Engineers. The motion carried by a vote of 7-0. CONTRACTOR'S ESTIfv1ATE Elm Fork Construction Company Estimate #6, Job 3-501 & WPC-Tex-628 Construction of the Calloway Branch Outfall Sewer. . $20,331.90 Councilman Ellis moved, seconded by Councilman Faram, that the City Council approve for payment to Elm Fork Construction Company, Estimate #6, Job 3-501 & WPC-Tex-628, in the amount of $20,331.90, as recommended by the Consulting Engineers. The motion carried by a vote of 7-0. PLANNING & ZONING Second Reading (Appeal) PZ 72-32, request of Continental Housing Consultants to rezone 41.753 acres out of the W. D. Barnes Survey from IF-9 One Family Dwelling to IF-7 One Family Dwelling. Mayor Massey declared the meeting to be in public hearing to consider PZ-72-32 on appeal second reading and called for all interested persons to speak for this zoning request. Mr. Red Rutledge, repesenting Continental Housing Consultants, appeared before the City Council requesting approval of PZ 72-32 to IF-7 One Family Dwelling with stipulations of 1200 square foot minimum housing and 7500 square foot minimum lots. There being no further persons wishing to speak for PZ 72-32, Mayor Massey called for all interested persons present to speak aganist this zoning request. There being none, Mayor Massey declared the public hearing on appeal second reading of PZ 72-32 closed. Councilman Ne\~an moved, seconded by Councilman Cato, that the City Council uphold the recommendation of the Planning and Zoning Commission and deny PZ 72-32, request to rezone 41.753 acres out of the W. D. Barnes Survey to IF-7 One Family Dwelling. Mr. Jim Childress 6732 Corona Re: Request for repair of damage in street at Corona and Katherine Mr. Jim Childress appeared before the City Council, requesting that the street at Corona and Katherine be repaired as this section of street is deteriorating. The City Council instructed the City Manager to repair the damage and install a concrete pan north across Corona. There being no further items on the agenda for consideration, Councilman Ellis moved, seconded by Councilwoman Goodnight, that the regular meeting of the City Council be adjourned.
