HomeMy WebLinkAboutResolution 2020-015 RESOLUTION NO. 2020-015 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, TO POSTPONE THE MAY 2, 2020 SPECIAL ELECTION TO THE NEXT UNIFORM ELECTION DATE OCCURRING ON NOVEMBER 3, 2020, PURSUANT TO GUBERNATORIAL PROCLAMATION DATED MARCH 18, 2020, AS AMENDED. WHEREAS, the City Council, at its February 10, 2020 meeting, approved Resolution No. 2020-006, calling a special election for the purpose of authorizing the issuance of General Obligation Bonds, in the aggregate principal amount of not more than $49,875,000 to be held on May 2, 2020; and WHEREAS, on March 11, 2020, the Coronavirus Disease (COVID-19) was declared a worldwide pandemic by the World Health Organization; and WHEREAS, on March 13, 2020, Texas Governor Greg Abbott, Tarrant County Judge Glen Whitley, and President Donald Trump declared state, county and national emergencies due to COVID-19; and WHEREAS, on March 13, 2020, the Mayor of North Richland Hills declared a local disaster to prevent and alleviate the suffering of the citizens of North Richland Hills and to protect the public health and safety; and WHEREAS, on March 18, 2020, Governor Abbott issued a proclamation (Attachment A) suspending Sections 41.0052(a) and (b) of the Texas Election Code to the extent necessary to allow political subdivisions to move their general or special elections to be held on May 2, 2020 to the next uniform election date—November 3, 2020. NOW THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: SECTION 1. The City Council of the City of North Richland Hills hereby finds that the recitals set forth above are true and correct and are incorporated into this Resolution as if written herein. SECTION 2. The City Council of the City of North Richland Hills hereby expresses its desire to postpone the May 2, 2020 Special Election to the next uniform election date—November 3, 2020, or as amended by Gubernatorial proclamation. SECTION 3. The City Council confirms that all applications for ballot by mail (ABBM) for voters that are voting by mail due to being over the age of 65 or due to disability, will still be valid for the postponed election, and that ABBMs for Resolution No 2020-015 Page 1 of 2 voters who submitted ABBMs based on expected absence from the county would not be valid for the postponed election. SECTION 4. The relevant dates for the November 3, 2020 election are as follows: • October 5, 2020 —voter registration deadline • October 23, 2020 — deadline to submit an application for ballot by mail • October 19, 2020 — October 30, 2020 — early voting by personal appearance SECTION 5. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, as amended, Texas Government Code. SECTION 6. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and this City Council hereby declares that this Resolution would have been enacted without such invalid provision. SECTION 7. That this Resolution shall take effect and be in full force and effect from and after the date of its adoption, and it is so resolved; and all Resolutions of the City Council of the City in conflict herewith are hereby amended or repealed to the extent of such conflict.
