The meeting of the City Council was called to order by Mayor Marion L. Massey at 7:30 P.M. PRESENT: Mayor: Councilmen: Marion L. Massey M. E. Riddle J. R. Hubbard Dick Faram Tom E. Newman W. F. Hatliff J. R. Price ABSENT: None The invocation at this regular City Council meeting was given by Mayor Marion L. Massey. Regular Ci~y Council Meeting - May 10, 1971 Councilman Newman moved, seconded by Council- man Owen, that the City Council approve the minutes of the regular City Council meeting May 10, 1971 as presented. The motion carried by a vote of 7-0. Highway traffic signal maintenance agreement with Texas Highway Department City Manager, Jack D. Russell presented this CONTRACT CONTINUANCE TEN MINUTE RECESS MAYOR'S ANNOUNCEMENTS NElli 5-24-71 Two item to the City Council, advising that according to policy of the Texas Highway Department, cities of 15,000 population and over assume full responsibility for the installation, operation and maintenance of traffic signals at intersections and non- intersection locations along State highway routes within their corporate limits, with one exception. The exception to this policy is for traffic signals installed along full control of access highways, in which case the state is responsible for the installation only, and the city is responsible for the operation and maintenance of the signal. Since many cities in this population range are not yet equipped to maintain these signals, the State is in a position to assist the City in both the operation and maintenance of same within the highway system. Councilman Hubbard moved, seconded by Council- man Polster, that the City Council approve the maintenance agreement, to become effective September 1, 1971, as presented. The motion carried by a vote of 7-0. (A COPY OF THE AGREEMENT IS ATTACHED TO THESE ORIGINAL MINUTES FOR PERMANENT RECORD) Authorization to continue contract with the firm of Christian, Miller and Honts, Inc., to develope State and Federal grants City Manager, Jack D. Russell, asked the City Council for approval to continue the contract with Christian, Miller and Honts, Inc., to develope State and Federal grants since there are programs pending and other items developing. Councilman Polster moved, seconded by Council- man Owen, that the City Council authorize approval for continuance of this contract with Christian, Miller and Honts, Inc., until September 30, 1971. The motion carried by a vote of 7-0. Mayor Marion L. Massey advised the City Council that proper recognition should be given Mr. Shorty Matziner, Scout Leader of Troop 167 - sponsored by the Richland Hills MAYOR'S PRESENTATIONS MAYOR'S PRESENTATION NIlli 5-24-71 Three Christian Church - for a project the Scouts will perform on June 5, 1971. Scouts will be cleaning the right-of-way on Highway 121 from city limit to city limit. Estes Service Company has agreed to furnish a truck for the debris the boys will be removing and security proctection for traffic control of the scouts will be furnished by the City. Mayor Massey introduced Chief of Police J. R. Price, who in turn introduced the following members of his family to the Ci ty Council: IVlrs. J. R. Price Miss. Donna Price, daughter Mr. Robert Price, son Mrs. Mary Ann Nanney, daughter Mrs. Jane Elizabeth Willis, daughter Mayor Massey, on behalf of the members of the City Council presented the following award to Chief Price: COMMENDATION AWARD from AMERICAN F1':lDERATION OF POLICE "This will certify that Chief Johnny R. Price is hereby citied and commended for his performance of duties as a Police Officer by an act so outstanding that the General Commendation Award is presented on behalf of the law enforcement profession, this 15th day of May, 1971 at Washington D. C. /s/ ~:~ Col. N. Lee Tucker, National President D. B. Van Brad, Executive Secretary L. S. Severson, Executive Director" Mayor Massey noted to the members of the City Council that this award was caused by Chief Price saving the life of Tad Robinson who had fallen into the swimming pool at Glenview Square Apartments. Mayor Massey announced the presentation of a proclamation to Les Thomas of the Mid Cities Daily News, which is as follows: NRH 5-24-71 Four PROCLAMATION WHEREAS, it is the desire of the City Council of the City of North Richland Hills to recognize LES THOMAS, News Reporter of the Mid-Cities Daily News, the offical newspaper for the City of North Richland Hills, for his outstanding performance in news coverage of all functions of the City of North Richland Hills, and, WHEREAS, LES THOIvIAS gives far more of his time and effort than the duties of the job require to insure that his articles are accurate in every detail. This conscientuous and thorough research and reporting of public issues has enabled him to accomplish an outstanding records of news coverage for the citizens of North Richland Hills. NOW, THEREFORE, I, MARION L. MASSEY, 1,1ayor of the City of North Richland Hills, Texas, do hereby proclaim this the 24th day of May, 1971, a day of recognition and appreciation for a "job well done" by Les Thomas and call upon the citizens of the City of North Richland Hills, Texas, to give appropriate recognition of this day. ATTEST: 5f- .& TRl\.FFIC SIGl'JAL MAlNTEK~NCE AGREEMENT NO. 2-6 ~ STATE OF TEXAS ( ) COUNTY OF TARRANT () TIllS AGREEMENT made this 24th day of May , 1971, by and between the State of Texas, Texas Highway Department, District 2, hereinafter referred to /: .. as the "St.ate") party of the first part, and the City of North Richland Hills, Tarrant County, Texas, (population 16,375 , 1970 Federal Census) acting by and through its duly authorized officers, hereinafter called the "City", party of the second part. This agreeœnt will take effect September 1, 1971. ìHTNESSETH WHEREAS, the City has declared that it does not have trained personnel and that it is not feasible to hire trained personnel to maintain properly its traffic signal system; and I . I WHEREAS, it is a policy of the Texas Highway Department that all cities having i..} a population of 15,000 or over (last Federal Census) install and maintain, at the City's sole expense, traffic signals on highway routes as authorized by the Texas Highway Department; and WHEREAS, the District Engineer, has made it known to the City that the State will assist the City in the maintenance and operation of authorized traffic signals on State Highway Routes within such City, conditioned that the City will enter into an agreement with the State for the purpose of determining the responsibilities of the parties thereto; and NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, it is agreed that services for maintenance and operation of specified traffic signals will be performed by the State as set out in the following provisions. -1- COVERAGE I. 1. Traffic signals covered under this agreement are the existing signals , '--- installed on the State Highway Routes as shown on Sheet No.4. 2. It is mutually agreed that the installation of additional authorized traffic signals, and reconstruction of existing authorized traffic signals I: will be covered by separate agreements between the City and State. v 3. It is mutually agreed that upon completion of the construction of a new traffic signal or reconstruction of an existing traffic signal, authorized by the Texas Highway Department, maintenance and operation will be covered under this agreement. 4. In the event the present system of State Highway routes within the City is, changed by cancellation, modified routing, new routes, or change in the City's corporate limits, the State shall terminate maintenance and operation of those traffic signals affected. '..,...-> GENERAL CONDITIONS 1. The City hereby agrees and does hereby authorize the State to maintain and operate traffic signals covered by this agreement. 2. The State agrees to establish and maintain the operating schedule of all traffic signals covered under this agreement in accordance with established o traffic engineering practices and procedures. 3. The State agrees to furnish labor, materials, and equipment required to maintain traffic signals covered by this agreement and to maintain the operating schedule established within tolerable limits as equipment and personnel are available. -2- '.-":-', .,.::.:...:......--'-----.-'--------'----...--... .".- --~._..__.-.~.~...._-_.__..,._-_._- ì- 4. The City agrees to reimburse the State at the end of each month the actual , cost of labor (including allowance for vacation, sick leave, F.I.C.A., and other contingent benefits accrued by St2te employees), equipment rental and materials required to maintain traffic signals covered by this agreement. TERMINATION 1.
