Ratliff Dick Perkins ABSENT: Councilmen: Dick Faram Charles L. Owen The invocation at this regular City Council meeting was given by Mayor Marion L. Massey. Regular City Council Meeting - June 14, 1971 Councilman Cato moved, seconded by Councilman Newman, that the City Council approve the minutes of the regular city council meeting of June 14, 1971 as presented. The motion carried by a vote of 4-0. AN ORDINÞN CE ADOPTING RULES, REGULA- TIONS, POLICIES AND PROCEDURES FOR THE CITY OF NORTH RICH LAND HILLS, TEXAS, WATER AND SEWER SYSTEM, AND DECLARING AN EMERGENCY. DEPARTMENTAL REPORT INVOICE Councilman Hubbard moved, seconded by Councilman Cato, that the City Council follow the recommenda- tion of the City Manager and the City Engineer and approve Ordinance No. 351 as presented. The motion carried by a vote of 4-0. POLICE DEPARTMENT Chief J. R. Price reported to the City Council, as instructed, in regard to the use of radar within the corporate city limits. A copy of the report as furnished to the City Counci I is attached to these minutes for permanent record. Chief Price informed the City Counci I that the Police Department had sponsored a baseball team this season and was coached by Sgt. Brazzi I and Officer Burchell. They feel they had a good year and would like to participate in this program again next year. Also, the Pol ice Department has arranged to make awards to the boy scout troops for the clean up work recently done in the City. This item is consideration of payment, Invo ice No.1, in the amount of $11,231.30 and Invoice No.2, in the amount of $11,525.51 to Cambridge Development Corporation for clearing, grubbing and channel excavation in North Park Estates (North Richland Hills proposed park portion) under the Capital Improvements Program in accordance with contract approved by the City Council April 26, 1971. The City Manager has received the following recom- mendation from the Consulting Engineers: "We have completed the earthwork calculations on the drainage channel in subject subdivision (North Park Estates), and have determined that 39,366 cubic yards of dirt were excavated from the channel. Also, based on our rough calculations, 12.0 acres of land in this same area was cleared and grubbed. We, therefore, authorize payment of $16,946.40, in accordance with the contract between the City and Cambridge Development Company, dated April 15, 1 97 1 . LAND PURCHASE 1 . 12.0 acres clearing and grubbing ® $100.00 per acre = $ 1,200.00 2. 39,366 cubic yards channel di rt excavated ® $0.40 per cubic yard = $15,746.40 TOTAL AUTHORIZED PAYMENT $16,946.40 Should you have questions regarding this authoriza- tion, please do not hesitate to call me. Isl J. Richard Perkins" Councilman Hubbard moved, seconded by Councilman Cato, that the City Council authorize payment under this contract as outlined above. The motion carried by a vote of 4-0. APPROVAL OF APPORTIONMENT OF EXTRA- TERRITORIAL JURISDICTION BETWEEN KELLER AND NORTH RICHLAND HILLS The City Manager asked that the City Council approve this item, and a map indicating the agreement was furnished the City Council indicating the present boundary of the City of North Richland Hills, the present Keller boundary and new agreed upon boundary, a Iso indicating the area to be annexed by the City of North Richland Hills. A copy of this map is attached to the original minutes for permanent reco rd. Councilman Cato moved, seconded by Councilman Polster, that the City Council approve the recom- mendation of the City Manager and approve the extra-territorial jurisdiction as presented on the map fu rn ished . The motion carried by a vote of 3-1; Councilmen Cato, Newman and Polster voting yes; Councilman Hubbard voting no. The City Manager asked for City Council approval of Lots 11-14, Block 2 and Lots 8-10 of Block 3, J. L. Autrey Addition for the consideration of $10,000.00 to provide storage and warehouse facil ities for water and sewer operations. MAYOR'S PRESENTATION RESOLUTION NO. 71-13 Councilman Polster moved, seconded by Councilman Hubbard, that the City Council approve the recom- mendation of the City Manager as outlined above. The motion carried by a vote of 4-0. Mayor Massey recognized and presented length of service awards to the following city employees: B. C. Redding Frank C. Cook William C. Hamilton Edward P. Fuchs Wa Iter Dansby Larry Scott Johnny Dendy Malcolm L. Akins, Jr. Richard H. Cain E. Dean Holland Arthur P. Rydell Freddy T. Taylor Betty L. Terrell Evalyn R. Huston These service awards is a City Council adopted policy and will be awarded to all city employees in the future when they have completed five years length of service with the City. A RESOLUTION REQUESTING THE CORPS OF ENGINEERS STUDY OF FOSSIL CREEK, CALLOWAY BRANCH AND WALKER BRANCH This resolution as presented to the City Council by the City Manager and is as follows: "RESOLUTION NO. 71-13 A RESOLUTION REQUESTING CORPS OF ENGINEERS STUDY OF FOSSIL CREEK, CALLOWAY BRANCH, AND WALKER BRANCH WHEREAS, the City of North Richland Hills, Texas, has been advised of the provision of Section 206, Pub I ic Law 86-645, Flood Control Act of 1 960, as amended, and the benefits thereunder; and WHEREAS, it is the desire of the City of North Richlard Hills to encourage optimum use of lands in said City; and WHEREAS, the City of North Richland Hills desires to avail itself of the factual information that would be available for reducing future flood damages and hazards, if any, through carefully considered and well planned local regulations and use of the flood plain, including both the guidance as to prospective land use and the preserving of adequate floodway and channel right-of-way and channel clearances; to provide publicly available information for the guidance of private citizens and interests on the use of flood plains; and to minimuze future public expendi- tures and for alleviation of flood problems which would follow improper flood plain development, therefore, increasing the amount of land available for use; and WHEREAS, portions of Fossil Creek, Calloway Branch and Walker Branch are within the City of North Richland Hills and the continued pressures of land needs for residential, commercial, industrial and recreation uses necessitates flood damage pre- vention measures and plans and regulations for the use thereof; NOW, THEREFORE BE IT RESOLVED BY THE CITY COJN CIL OF THE CITY OF NORTH RICH LAND HILLS, TEXAS: That the City of North Richland Hills respectfully requests the U. S. Army Corps of Engineers to undertake a study of the prescribed areas, and to investigate the intensity of flood and establish flood elevations along said water courses. Councilman Hubbard moved, seconded by Councilman Polster, that the City Council approve Resolution No. 71-13 as presented. The motion carried by a vote of 4-0 . ORDINANCE NO. 358 AN ORDINANCE PROHIBITING THE POSTING OF POLITICAL, COMMERCIAL AND OTHER TYPES OF HANDBILLS, SIGNS, POSTERS OR ADVER- TISEMENTS WITHOUT PERMISSION; MAKING THE PERSON, FIRM OR CORPORATION ADVERTISED PRIMA FACIE RESPONSIBLE FOR SUCH POSTING AFTER NOTICE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND NAMING AN EFFECTIVE DATE. Councilman Hubbard moved, seconded by Councilman Newman, that the City Council table this item for further information and study. The motion carried by a vote of 4-0. ORDINANCE NO. 359 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, SETTING UP A WATER USE SCHEDULE, THE POWER TO INVOKE SUCH SCHEDULE, PROVIDING FOR A PENALTY AND DECLARING AN EMERGENCY. WHEREAS, as there has been and are times of the year when the water supply in the City of North Richland Hills is inadequate to serve the citizens of North Richland Hills to the extent that certain portions of the City are without adequate water supply, and; WHEREAS, the City Council feels that the health and welfare of the citizens of North Richland Hills will be impaired without an adequate water supply, and; WHEREAS, the City Council feels that a water ration- ing program will help prevent an inadequate water supp ly . IT IS HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, THAT: A use schedule be adhered to by the citizens of North Richland Hills, Texas, as follows: All odd numbered houses water on odd numbered days; All even numbered houses water on even numbered days; Provided, however, that there be no outside watering between the hours of 5:00 p. m. to 9:00 p. m. daily. BE IT FURTHER ORDAINED that the above schedule is to be invoked at the discretion of the City fV'anager upon recommendation of City Engineer and Director of Utilities of the City when the necessity arises and proper notice is given to the citizens of North Richland Hills, Texas. BE IT ALSO ORDAINED that any person violating this Ordinance shall be guilty of a misdemeanor, and assessed a fine not to exceed TWO HUNDRED AND NO/lOO ($200.00) DOLLARS for each violation. Due to the fact that during certain times of the year water rationing may become necessary and it would be to the benefit of the citizens of the City of North Richland Hills, Texas, an emergency has been created requiring the suspension of any rule that requires an ordinance to be read for more than one time, and this ordinance shall be effective from and after its passage and publication as required by law. The motion carried by a vote of 4-0 . Authorize appropriation of $12,000.00 from prior years earned surplus for construction of facilities to house Utility Department. After discussion by the members of the City Council, Councilman Hubbard moved that this item be tabled fOl~ specifications and detailed planning report from the City Manager before receiving further consider- ation. The motion died for lack of a second. Councilman Polster moved, seconded by Councilman Hubbard, that this item be tabled for further study. The motion carried by a vote of 4-0. PS 71-3 Request of Harry James for approval of preliminary and final plat of North Park Estates Councilman Newman moved, seconded by Councilman Hubbard, that the City Council approve PS 71-3 as presented. The motion carried by a vote of 4-0. Mr. Harry James verbally agreed to contract between the City of North Richland Hills and Cambridge Development Corporation wherein the Cambridge Development Corporation agrees to donate approxi- mately 42.489 acres to the City of North Richland Hills for the development of public outdoor recreational facil ity. PS 71-11 Request of Z. L. Simpson for dedication of uti I ity easement and street right-of-way on land located outside City Limits of North Richland Hills within extra-territorial jurisdiction. Councilman Hubbard moved, seconded by Councilman Polster, that the City Council approve PS 71-11 as requested and presented. The motion carried by a vote of 4-0. CITIZEN'S PRESENTATIONS Mr. Harry James spoke before the City Council expressing thanks to the City Council, the City Manager, the City Staff and Consulting Engineers for all their help and favorable consideration ralating to his project and his hope for a good and long rela- tionship with our City. ADJOURNMENT There being no further items on the City Council agenda for consideration, Councilman Polster moved, seconded by Councilman Hubbard, that the City Council meeting be adjourned. HiddlG City Coùncilman DATE: June 28, 1971 MEMORANDUM Police Chief SUBJECT: Recommendation "~~ order to make the speed limit on Rufe Snow more real to reconmlend that the limit be raised from m.p.h. to 35 m.p.h. This would include the blocks b Loop 820 and the Grapevine Highvvay. It should be noted that when Rufe Snow crosses"the Grapevine Highway and becomes part of the Richland Hills city limits« it is only a two-lane thoroughfare and yett,he speed limit pO$ted there is 35 m.p.h. In our city, Rufe Snow is a four-lane thoroup;hfare. I further reco~nend that the speed limit sien posting 20 m.p.h. speed limit in the school zone, south of the school, on Rufe Snow be moved. It is now located near Victoria Drivø which is actually too far away from the school. It should be relocated nearer the school, about 50 yards south of Shauna Drive.
