ORDINANCE NO. 626
WHEREAS, the Council finds that there is an ambiguity in the City
Charter in connection with Article VI, Sections 5, 6, and 7, and Article XVII,
Section 3, wherein the Mayor is given the power to appoint and remove certain
officials of the City with approval of two-thirds (2/3) majority of the Council;
and
WHEREAS, the Council finds that the Charter is silent on whether or not
the approval of the Council must be procured prior to the appointment or removal
by the Mayor or whether such approval may be procured subsequent to such
appointment or removal;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF NORTH RICHLAND HILLS, TEXAS, THAT:
1.
The above findings are hereby specifically made and adopted by the
Council.
2.
Hereafter, no removal or appointment by the Mayor of the officials
referred to in the above Sections of the Charter shall be in any way effective
unless the Council's approval, by a two-thirds (2/3) majority, is given in
advance or simultaneous with such appointment or removal. The work of such
appointed officials shall not be interrupted or suspended by any attempt to
remove or replace such officials unless the Council has approved such action
by a two-thirds (2/3) majority vote.
3.
The Council finds that any attempt to remove a City Official until such
removal is approved by the Council is disruptive and interferes with the
operation of the City in protecting the health, safety and general welfare of the
inhabitants of North Richland Hills, Texas, so therefore, this Ordinance shall
be in full force and effect immediately upon passage.
Passed by the City Council and spread upon the minutes of the City
Council meeting this 17th day of r1ay , 1976.
