The Special City Council meeting was called to
order at 6:30 P.M. by Kayor Pro Tem Dick Farana.

PZ 71-19, Request of Mr. C. J. Kinman and Mr.
Louis M. Howard to rezone 6.43 acres out of the
E. S. Carder and L. C. Walker Surveys from its
present classification of 1F-12 One Family
Dwelling to a proposed classification of Planned
Development.
2. PLANNING AND ZOnNG:
PZ 71-20, Request of Mr. C. J. Kinman and Mr.
Loùis M. Howard to rezone 12.11 acres out of
the E. S. Carder and L. C. Walker Surveys from
its present olassification of 1F-12 One Family
Dwelling to a proposed classification of Multiple
Fanaily Dwelling.
Mayor Pro Tem, Dick Faram, declared the Special City
Council meeting to be in Public Hearing for second
reading on the above zoning cases.
Upon a call from the Mayor Pro Tea for those interested
in appearing before the City Council to speak in favor
of these zoning cases. Mr. Don White of Hank Dickerson
and Company, representing Mr. C. J. Kinman and
Louis M. Howard, presented proposed zoning to
the City Council on both tracts to rezone from
1F-12 One Fanaily Dwelling to Planned Development and
from 1F-12 One Fanaily Dwelling to Multiple Fanaily
zoning, asking for favorable consideration and
approval of these zoning cases by the City Council.
No on else present appeared before the City Council
to speak in favor of this proposed zoning.
Upon a call from the Mayor Pro Tem, Mr. Robert C.
Chadwell, 4912 Oakridge Terrace, appeared before
the City Council to inform them on being against
the zoning as presented, however, if satisfactory
alignment of Oakridge Terrace could be acoomplished
he would not be opposed to the plan.
~or Pro Tem Dick Farana declared the Publio Hearing
closed on these two zoning cases.
City Manager, Jack D. RUBsell, informed the City
Council that he and the Engineers, Counoilman
Ratcliff and Mr. Don White had worked out a
proposed anaendment to Ordinance No. 366, Zoning
Case PZ 71-19 he would like to present to the
City Council which should satisfy all persons
concerned as well as meet requirements of the City.
The anaendment as read to the City Counoil by the
City Manager is as follows:
SUBJECT TO 'l'HE FOLLOWING CONDITIONS:
The private street provided for in the Planned
Development shall be made a publio street and a
50 foot right-of-~ provided therefore and the
street be rerouted from the South end of the single
family unit portion of the Planned Development to
oonnect with the North end of Oakridge Terrace
where the existing 50 foot right-of-~ ends.
Construction plans and routing of the street shall
be subject to the approval of the City Manager and
City Engineer. Permission is hereby granted to
reposition the Multiple Family two-story units
in the Planned Development provided the number of
Mul tiple Family two-story units is not increased.
A new plan indioating these changes shall be
submitted tc the City Manager for approval within
20 d83S and shall upon approval become part of
this ordinance.
Construotion plans for all facilities including
street, drainage, utilities and buildings shall
be approved by the City Manager and City Engineer
prior to oommenoement of any construction within
the development. Any easement. and right-of-way
deemed necessary for the construotion of public
facilities shall also be obtained prior to
oommencement of such construction.

PUBLIC HEARING. The motion oarried by a
vote of 5-0.
Mr. Chadwell appeared before the City Council
again stating that his first preference is to
retain the single fanaily dwelling zoning
presently in jffeot at this location, however,
if this is not the preference of the City
Counoil he would like to ask for rearrangement
of Oakridge Terrace as previously mentioned.
Mrs. H. L. Rutherford, 4908 Oakridge Terrace,
appeared before the City Council asking for
clarification 0* the proposed realigment of
Oakridge Terrace.
Xa¥or Pro Tem, Dick Faram, declared the Public
Hearing closed.
Councilman Polster moved,seconded by Counoilman
Ratoliff, that the City Counoil approve zoning
oase PZ 71-19, Ordinance No. 366, as amended
by the reoommendation of the City Manager (as
shown above). The motion oarried by a vote
of 4-1; Counoilmen Ratoliff, Cato, Polster
and Owen voting yes; Councilman lIewman voting
no.
Counoilman Polster moved, seoonded by Counoilman
Owen, that the City Counoil approve zoning
case PZ 71-20, Ordinance No. 367, as presented.
The motion carried by a vote of 3-2; Counoilmen
Ratoliff, Polster and Owen voting yes;
Counoilmen Newman and Cato voting no.
ADJOtJRNMEN'l'
There being no further items on the agenda for
oonsideration, being a Special City Counoil,
meeting, Mayor Pro Tem Diok Faram, deolared
the City Council meeting-adjourned.
