CALL TO ORDER The special City Council meeting of the City Council of the City of North Richland Hills, Texas, was called to order by Mayor Marion L. Massey at 6:30 P.M. ROLL CALL PRESENT: Mayor: Councilmen: Marion L. Massey W. N. Ratcliff Dick Faram W. F. Polster Tom E. Newman J. F. Cato Charles L. Owen STAFF PRESENT: City Manager: City Secretary: City Attorney: Financial Advisor: Jack D. Russell Evalyn R. Huston Dennis M. Morrow Frank Medanich ABSENT: Councilman: J. R. Hubbard ITEM ON THE AGENDA FOR CONSIDERATION: Consider passage of order authorizing the issuance of $5,275,000.00 Waterworks and Sewer System Revenue Bonds, Series 1971 City Attorney Dennis M. Morrow and Financial Advisor Frank Medanich discussed with the City Council the need for consideration of this item, being due to the Texas Water Rights Commission being given authority to set water rates in a district court rul ing and as a result of this rul ing the Attorney General stated that he will not approve any more revenue bonds after Monday, September 6, 1971, until the matter is clarified. It is necessary that we get our order to him on Wednesday of this week or face a se rious de lay in issuance of bonds for the purchase of Tarrant County Water Supply Corporation. Mayor Massey presented Ordinance No. 370 to the City Council, being an ordinance prescribing rates and charges of the waterworks and sanitary sewer system of the City of North Richland Hills, Texas, (a copy of which is attached to these original minutes for permanent record). Councilman Faram moved, seconded by Councilman Owen, that the City Cruncil approve and adopt Ordinance No. 370 as presented. The motion carried by a vote of 6-0. Mayor Massey presented Ordinance No. 371 to the City Council, being an ordinance authorizing issuance of $5,275,000.00 "City of North Richland Hills, Texas, Waterworks and Sewer System Revenue Bonds, Series 1971", dated September 1, 1971, (a copy of which is attached to these original minutes for permanent record). Councilman Owen moved, seconded by Councilman Polster, that the City Cruncil approve and adopt Ordinance No. 371 as presented. The motion carried by a vote of 6-0. ADJOURNMENT There be ing no further items on the agenda for consideration at this special City Council meeting, Councilman Owen moved, seconded by Councilman Polster, that the City Council meeting be adjourned. Relative to Nonencumbrance of City's Combined Water- works and Sanitary Sewer System. That the City is in the process of acqu~r~ng its Water- works and Sanitary Sewer System and save and except for the pledge of the income and revenues of the City's combined Water- works and Sanitary Sewer System to the payment of the principal and interest to become due with respect to the $5,275,000 "CITY OF NORTH RICHLAND HILLS, TEXAS, WATERWORKS AND SEWER SYSTEM REVENlÆ BONDS, SERIES 1971," dated September 1, 1971, said income and revenues of said System have 'not been pledged or hypothecated in any other manner or for any other purpose; that there are no liens, encumbrances or any other indebtedness whatsoever outstand- ing against the City's combined Waterworks and Sanitary Sewer System or the income and revenues of such System; and that the above bonds, when issued, will evidence the only lien, encumbrance or indebtedness of said System or the income and revenues of such System. 2. Relative to Incumbency and Incorporation. That on March 3, 1969, the date of passage of resolution and order calling election for the issuance of bonds, through and including March 31, 1969, the date of passage of resolution canvassing returns and declaring result of the election held on March 25, 1969, the following were the duly qualified and acting officers of the City of NOrth Rich1and Hills, Texas: CALVIN F.
